An Act to amend the Crown Lands Acts so as to provide for granting increased areas to present holders ; permitting a present holder to sell to another; for the reduction of interest on unpaid balances and the issue of certificates in certain cases; to alter the present conditions of residence on, and selling, exchanging, and leasing lands ; to alter the present system of balloting; to defer payments and provide for family holdings and the right of parents to assist their children ; to provide for the conversion and extension of settlement leases and annual leases; and for other purposes. This A c t m a y be cited as t h e " Crown L a n d s A c t A m e n d m e n t A c t , 1 9 0 3 , " a n d shall be read a n d c o n s t r u e d w i t h t h e P r i n c i p a l A c t s , a n d shall a p p l y only to t h e E a s t e r n a n d C e n t r a l Divisions. 2. 2. P r i n c i p a l A c t s " m e a n s t h e C r o w n L a n d s A c t of 1 8 8 1 , t h e Crown L a n d s A c t , 1881), a n d t h e C r o w n L a n d s A c t , 1895, t o g e t h e r with the Acts amending the same. Additional conditional purchases, homestead selections, or conditional leases. or settlement 3. T h e holder of— a n y h o m e s t e a d selection ; or a n y s e t t l e m e n t l e a s e ; or a n y original conditional p u r c h a s e , o t h e r t h a n t h e holder of a non residential conditional p u r c h a s e ; m a y m a k e application as prescribed, a n d a c c o m p a n i e d b y such provisional deposit as m a y be prescribed, for a d d i t i o n a l land, to be h e l d by h i m as a n additional holding u n d e r t h e same class of t e n u r e (except t h a t t h e holder of a n original or additional conditional p u r c h a s e m a y a p p l y for a conditional lease, subject to t h e l i m i t a t i o n of section t w e n t y - s i x of t h e Crown L a n d s A c t of 18S9), as t h a t u n d e r which he holds t h e l a n d by v i r t u e of w h i c h he applies—• (a) Subject to t h e provisions of section four of this A c t , land shall be available for t h e p u r p o s e of a n y such a p p l i c a t i o n w h i c h is available for h o m e s t e a d selection or s e t t l e m e n t lease, or conditional p u r c h a s e or conditional lease, w h e t h e r specifically set a p a r t for t h e class of h o l d i n g applied for or n o t . (h) N o t more t h a n one application shall be m a d e b y v i r t u e of t h e same conditional p u r c h a s e selection or lease, unless a n d u n t i l a n y previous a p p l i c a t i o n or all previous applications u n d e r this sect ion have been disposed of, unless t h e t o t a l area applied for ( w h e n t a k e n w i t h t h e a r e a of all conditional p u r c h a s e s or conditional leases of t h e series) does n o t exceed t h e m a x i m u m area prescribed b y t h e P r i n c i p a l A c t s , (c) T h e m e r e fact t h a t t h e land applied for does n o t adjoin t h e original conditional p u r c h a s e or a n y p u r c h a s e or lease of t h e series, or t h e original homestead selection or s e t t l e m e n t lease, shall not be a bar to t h e additional p u r c h a s e , h o m e s t e a d selection or lease applied for. A l l available l a n d adjoining t h e original or prior additional p u r c h a s e s or leases of t h e series, or t h e original h o m e s t e a d selection or s e t t l e m e n t lease, shall first be e x h a u s t e d , a n d t h e lands applied for or allotted shall be, in t h e opinion of t h e board, w i t h i n a reasonable w o r k i n g distance of t h e l a n d b y v i r t u e of w h i c h t h e application is m a d e : P r o v i d e d t h a t t h e board m a y confirm a n y a p p l i c a t i o n m a d e u n d e r t h e provisions of t h i s section, a l t h o u g h all t h e available l a n d adjoining t h e original or prior additional purchases p u r c h a s e s or leases of t h e series, or t h e original homestead selection or s e t t l e m e n t lease, lias not been e x h a u s t e d , if, in t h e opinion of such hoard the facts of t h e cast; w a r r a n t it. T h e board may disallow a n y application if of opinion t h a t t h e a p p l i c a n t is seeking to t a k e a n u n f a i r a d v a n t a g e of t h e provisions of this section, (d) The board shad i n q u i r e into t h e m e r i t s of every application u n d e r this section, a n d m a y disallow such application or confirm it for such a n area a n d in such a position ( w h e t h e r different from that applied for or not) as such board m a y , with the consent el' t h e a p p l i c a n t , d e t e r m i n e , n o t w i t h s t a n d i n g t h a t t h e area confirmed m a y , b y itself or with t h e area of t h e original conditional p u r c h a s e , homestead selection, or s e t t l e m e n t lease, or conditional p u r c h a s e s or leases of t h e series, exceed t h e m a x i m u m area prescribed by t h e P r i n c i p a l Acts. T h e board shall not confirm any a p p l i c a t i o n u n d e r t h e provisions of t h i s section for a n y area w h i c h , shall t o g e t h e r with all o t h e r lands held b y t h e a p p l i c a n t u n d e r w h a t e v e r t e n u r e (other t h a n a n n u a l t e n u r e ) , exceed such a n area as, in t h e opinion of t h e board, is sufficient for t h e m a i n t e n a n c e of his Lome thereon in a v e r a g e seasons a n d c i r c u m s t a n c e s . W h e r e two or more persons s i m u l t a n e o u s l y a p p l y for t h e s a m e land t h e board m a y confirm t h e application of each or either a p p l i c a n t as to p a r t of t h e l a n d applied for, a n d shall, as far as practicable, give preference to t h e a p p l i c a n t whose land adjoins, or is n e a r e s t to, t h e land applied for, b u t shall n o t be compelled to give such preference if of opinion t h a t s u c h a p p l i c a n t is less in need of additional l a n d t h a n a n a p p l i c a n t whose land does not adjoin, or is not n e a r e s t to, t h e l a n d applied for. (c) E x c e p t as hereinafter provided, an application u n d e r t h i s section shall not, u n l e s s a n d u n t i l confirmed, give t h e a p p l i c a n t any r i g h t to use or o c c u p y t h e land applied for, nor affect a n y lease or license u n d e r which t h e land m a y be held, b u t every such application shall give t h e applicant, p e n d i n g tin; disposal of his application, a preferent claim to t h e land over a n y a p p l i c a n t for any original holding who may s i m u l t a n e o u s l y or s u b s e q u e n t l y a p p l y for tin; same l a n d u n d e r a n y provisions of t h e P r i n c i p a l A c t s or section e i g h t e e n of this A c t . T h e title to t h e land included in t h e s i m u l t a n e o u s or s u b s e q u e n t application for the original holding, a n d t h e effect of s u c h application, shall in t h e m e a n t i m e he suspended. U p o n t h e confirmation of a n application (the effect of w h i c h has n o t been to i m m e d i a t e l y w i t h d r a w t h e l a n d applied for For from a n y a n n u a l lease or o c c u p a t i o n license), t h e land allotted by t h e board shall be d e e m e d to be w i t h d r a w n from any a n n u a l lease or occupation license u n d e r which it m a y be held, a n d t h e t i t l e to t h e additional p u r c h a s e selection or to t h e lease shall t h e r e u p o n c o m m e n c e . I n t h e case of a n additional conditional purchase; o r a conditional lease, t h e area of w h i c h ( w h e n t a k e n with t h e area of t h e p u r c h a s e s and leases of t h e series) does n o t exceed t h e m a x i m u m area prescribed by t h e P r i n c i p a l A c t s , t h e t i t l e to t h e land shall c o m m e n c e from t h e d a t e of application, if valid, a n d t h e application shall w i t h d r a w such of t h e lands therein described as may be available for t h e p u r p o s e from a n y a n n u a l lease or occupation license u n d e r w h i c h t h e y m a y be held. I n t h e case of an additional s e t t l e m e n t lease or a conditional lease t h e rent of t h e land, if it h a s n o t been d e t e r m i n e d a n d notified prior to t h e d a t e of application, shall, for t h e first period of t h e lease, be d e t e r m i n e d in a c c o r d a n c e w i t h t h e provisions of section six of t h e Crown L a n d s A c t of 1889. I n t h e case of a conditional p u r c h a s e t h e price or, in t h e case of a homestead selection, t h e capital v a l u e of t h e l a n d shall, if not notified prior to t h e date of a p p l i c a t i o n , be d e t e r m i n e d in accordance w i t h t h a t section. T h e deposit p a y a b l e on any s u c h c o n d i t i o n a l p u r c h a s e shall be t e n per c e n t u m , a n d t h e a n n u a l i n s t a l m e n t s shall b e five per c e n t u m , of t h e value of t h e land as so d e t e r m i n e d , a n d every instal m e n t except t h e first shall be deemed to i n c l u d e i n t e r e s t a t t h e r a t e of two a n d one half per c e n t u m per a n n u m on t h e b a l a n c e of flu; p u r c h a s e m o n e y . T h e provisional deposit shall be applied in p a y m e n t of t h e deposit of t e n per c e n t u m , a n d a n y excess shall be r e t u r n e d to t h e a p p l i c a n t ; a n d if t h e provisional deposit is less t h a n t h e deposit of ten per c e n t u m , t h e a p p l i c a n t shall pay tin; a m o u n t r e q u i r e d to c o m p l e t e t h e deposit w i t h i n one m o n t h after t h e value of t h e land applied for has been d e t e r m i n e d , (f) The general provisions a n d conditions of t h e P r i n c i p a l A c t s shall a p p l y to every p u r c h a s e selection or lease u n d e r t h i s s e c t i o n ; e x c e p t t h a t t h e condition of residence a t t a c h e d to t h e original a n d additional h o l d i n g s m a y be fulfilled on one of such h o l d i n g s . T h e board m a y a t t a c h a n y of t h e prescribed conditions to a n y additional homestead selection or s e t t l e m e n t l e a s e : Provided t h a t no a p p l i c a t i o n u n d e r t h i s section shall be e n t e r t a i n e d from t h e transferee of an original conditional p u r c h a s e u n l e s s s u c h a p p l i c a n t be in residence on his h o l d i n g for six m o n t h s i m m e d i a t e l y prior t o his application, unless the (g) (h) (i) (j) t h e local land hoard find t h a t t h e a p p l i c a n t was forced to d i s c o n t i n u e his residence u n d e r adverse conditions beyond his control. Original a n d additional homestead selections or s e t t l e m e n t leases shall be d e e m e d to be one h o l d i n g , a n d shall n o t b e transferred a p a r t or held separately. T h e board m a y impose a p e n a l t y for the w i t h d r a w a l or disallow a n c e of a n y application by r e t a i n i n g t h e w h o l e or s u c h portion of t h e provisional deposit money as m a y after d u e i n q u i r y seem justifiable. T h e provisions of t h i s section shall not a p p l y to a n a d d i t i o n a l conditional p u r c h a s e if m a d e o u t of a conditional lease held before t h e passing of this A c t , b u t save as aforesaid shall e x t e n d to a n d govern all additional conditional p u r c h a s e s or conditional leases applied for after t h e passing of this A c t . Sections twelve a n d s e v e n t e e n of t h e Crown L a n d s ( A m e n d m e n t ) A c t , 1899, are h e r e b y repealed. Lauds set apart for additional conditional purchase, SfC. 4. N o t w i t h s t a n d i n g a n y t h i n g to t h e c o n t r a r y in t h e P r i n c i p a l A c t s , t h e M i n i s t e r m a y , by notification in t h e Gazette, set a p a r t areas (to b e c o m e available on a n d after s u c h dates as m a y be specified) for additional conditional p u r c h a s e s or conditional leases, or a d d i t i o n a l h o m e s t e a d selections or additional s e t t l e m e n t leases ( w h e t h e r for one or m o r e of s u c h additional h o l d i n g s ) , a t s u c h r e n t s , c a p i t a l values, or prices w h e t h e r above, below, or a t one p o u n d p e r acre, as m a y be specified in t h e notification aforesaid, a n d m a y in a similar m a n n e r set a p a r t areas for a n y original h o l d i n g s to t h e exclusion of a n y or all of t h e additional holdings herein m e n t i o n e d . T h e M i n i s t e r m a y a m e n d or revoke, wholly or in p a r t , a n y notification u n d e r this section b y notification in t h e G a z e t t e . Settlement leases. 5. A n y s e t t l e m e n t lease applied for after t h e passing of t h i s A c t shall h a v e a t e r m of forty years. S u c h t e r m shall be divided into four periods each of t e n y e a r s . T h e a n n u a l r e n t of t h e first period s h a l l (subject to t h e provisions of section t h r e e of t h i s A c t as far as regards a d d i t i o n a l leases) be notified by t h e M i n i s t e r before t h e l a n d is m a d e available for lease, a n d t h e lessee m a y , if dissatisfied w i t h t h e a m o u n t so notified, w i t h i n t h r e e m o n t h s r e q u i r e t h e said r e n t to b e d e t e r m i n e d u n d e r section six of t h e Crown L a n d s A c t of 1889, a n d t h e a n n u a l r e n t for e a c h s u c c e e d i n g period m a y , on t h e a p p l i c a t i o n of t h e lessee, or on a reference b y t h e M i n i s t e r , be s e p a r a t e l y d e t e r m i n e d i n a c c o r d a n c e w i t h t h e provisions of section six of t h e C r o w n L a n d s A c t of 1889. The T h e h o l d e r of a n y s e t t l e m e n t lease applied for before t h e p a s s i n g of this A c t shall, on a p p l i c a t i o n as prescribed, h a v e t h e t e r m of his lease e x t e n d e d u n d e r t h e provisions of t h i s section ; a n d in a n y such case t h e t e r m of forty years shall be held to have c o m m e n c e d w h e n t h e lease c o m m e n c e d . T h e r e n t for each period c o m m e n c i n g after t h e date of a p p l i cation u n d e r t h i s section shall be separately d e t e r m i n e d as aforesaid, b u t t h e u n e x p i r e d portion of a n y period c u r r e n t a t t h e d a t e of such a p p l i c a t i o n shall, if it does n o t exceed five years, be joined w i t h t h e period n e x t succeeding, a n d t h e a n n u a l r e n t d e t e r m i n e d for t h e combined period. If t h e u n e x p i r e d p o r t i o n of t h e period exceeds five years, t h e a n n u a l r e n t for such u n e x p i r e d period shall be appraised as for a separate period. W h e r e a n y s e t t l e m e n t lease applied for before t h e c o m m e n c e m e n t of this A c t , a n d not b r o u g h t u n d e r t h e provisions of this section, is t r a n s f e r r e d or comes, o t h e r t h a n b y w a y of b o n a fide m o r t g a g e , i n t o t h e possession of a n y person o t h e r t h a n t h e o w n e r thereof at t h e c o m m e n c e m e n t of this Act, the r e n t p a y a b l e for t h e u n e x p i r e d t e r m of t h e lease shall be d e t e r m i n e d i n accordance w i t h t h e provisions of section six of t h e Crown L a n d s A c t of 1889, provided t h a t t h e provision of t h i s section shall n o t a p p l y to a lease w h i c h m a y come into t h e possession of a n y person t h r o u g h t h e d e a t h or l u n a c y of t h e h o l d e r thereof. So m u c h of t h e P r i n c i p a l A c t s as prescribe t h a t t h e a n n u a l r e n t of a s e t t l e m e n t lease shall be one a n d one q u a r t e r per c e n t u m of t h e c a p i t a l v a l u e of t h e land is hereby repealed so far as regards s e t t l e m e n t leases w h i c h come u n d e r t h e provisions of t h i s section. Conditional leases. 6. A n y conditional lease applied for after t h e passing of this A c t shall h a v e a t e r m of forty years. S u c h t e r m shall be divided i n t o four periods e a c h of t e n years. The a n n u a l r e n t for each period m a y , on t h e a p p l i c a t i o n of t h e lessee or on a reference by t h e M i n i s t e r , be separately d e t e r m i n e d in a c c o r d a n c e with t h e provisions of section six; of t h e C r o w n L a n d s A c t of 1889. ' t h e holder of a n y conditional lease applied for before t h e p a s s i n g of this A c t shall, on a p p l i c a t i o n as prescribed, h a v e t h e t e r m of his lease e x t e n d e d u n d e r t h e provisions of this s e c t i o n ; a n d in a n y s u c h case t h e t e r m of forty years shall be held to h a v e c o m m e n c e d w h e n t h e lease c o m m e n c e d . T h e r e n t for each period c o m m e n c i n g after t h e d a t e of a p p l i cation u n d e r this section shall be separately d e t e r m i n e d as aforesaid, b u t t h e u n e x p i r e d portion of a n y period c u r r e n t a t t h e d a t e of s u c h application application shall, if it does n o t exceed five years, be j o i n e d w i t h t h e period n e x t succeeding', a n d t h e a n n u a l r e n t d e t e r m i n e d for t h e combined period. If t h e u n e x p i r e d portion of t h e period exceeds five y e a r s , t h e a n n u a l r e n t for s u c h u n e x p i r e d period shall be appraised as for a s e p a r a t e period. Rent of homestead selections. 7. T h e holder of a n y h o m e s t e a d selection applied for before; or after t h e c o m m e n c e m e n t of this A c t , w h e r e t h e g r a n t of such homestead selection has n o t issued, shall from and after t h e e x p i r a t i o n of t h e first six years of s u c h selection p a y an a n n u a l r e n t of two a n d a half per c e n t u m of t h e capital v a l u e of t h e selection. Transfers of conditional purchases. 8. N o t w i t h s t a n d i n g ; a n y t h i n g contained in section t w e n t y - n i n e of t h e A c t of 1895, if a n y conditional p u r c h a s e r shall die or be declared a l u n a t i c or become a n insane p a t i e n t before t h e issue of t h e first certificate on his c o n d i t i o n a l p u r c h a s e , s u c h conditional purchase; m a y be t r a n s f e r r e d t o his r e p r e s e n t a t i v e s or t h e i r assigns, b u t m a y not be again transferred e x c e p t in similar c i r c u m s t a n c e s u n t i l after s u c h certificate has been issued. A n d u p o n a n y sale, transfer, or disposition of t h e estate; or i n t e r e s t of a n y conditional p u r c h a s e r , as provided in section one h u n d r e d a n d twenty-five of t h e C r o w n L a n d s A c t of 1884, s u c h conditional p u r c h a s e m a y be transferred to t h e p u r c h a s e r in like m a n n e r before t h e issue of t h e first certificate on t h e conditional p u r c h a s e , b u t m a y not be again transferred, except in similar c i r c u m stances, u n t i l after such certificate h a s b e e n issued. 9. N o t w i t h s t a n d i n g a n y t h i n g hereinbefore c o n t a i n e d , t h e M i n i s t e r m a y , upon a p p l i c a t i o n b e i n g m a d e to h i m in t h e prescribed form, g r a n t a r e a p p r a i s e m e n t of r e n t of a n y i m p r o v e m e n t lease to a n y C r o w n t e n a n t w h o shall lodge such application, t o g e t h e r w i t h a deposit of t e n pounds to cover t h e expenses of i n q u i r y a n d report by t h e local land board upon such application. But no such r e a p p r a i s e m e n t shall r e d u c e t h e r e n t below t h e price at which t h e l a n d was offered. And n o lease shall be reappraised more t h a n once. This section shall n o t a p p l y to leases hereafter g r a n t e d . Devolution of holder's interest. 10. If a n y holder of a h o m e s t e a d selection or a n y lease of land u n d e r t h e C r o w n L a n d s A c t s dies or is declared a l u n a t i c , his i n t e r e s t in s u c h land m a y be h e l d b y Ids representative's, subject to t h e fulfilment by t h e m of all unfulfilled conditions except t h e condition of residence (if any s u c h condition of residence a t t a c h e s to t h e h o l d i n g ) in t r u s t for t h e benefit of t h e persons e n t i t l e d : Provided t h a t s u c h representatives r e p r e s e n t a t i v e s shall, w h e r e a condition of residence a t t a c h e s to t h e holding', either sell a n d assign t h e lessee's or selector's interest in t h e l a n d to a bona fide purchaser w i t h i n twelve m o n t h s from the d a t e of t h e i r b e c o m i n g e n t i t l e d to possession h e r e u n d e r , or else w i t h t h e a p p r o v a l of t h e Minister, a n d for such t i m e as h e m a y p e r m i t , a p p o i n t a person as t h e i r n o m i n e e to reside upon t h e l a n d . Transfer and exchange of holdings. 1 1 . (1) T h e holder of a n y conditional p u r c h a s e or h o m e s t e a d selection or s e t t l e m e n t lease may, subject to t h e a p p r o v a l of t h e board a n d subject to such board being of opinion t h a t s u c h holder does n o t hold a n area which added to t h e area proposed to be a c q u i r e d is m o r e t h a n sufficient to m a i n t a i n his h o m e t h e r e o n , a c q u i r e b y transfer one or m o r e conditional p u r c h a s e s ( a l t h o u g h a condition of residence a t t a c h e s t h e r e t o ) or h o m e s t e a d selections or s e t t l e m e n t leases as additional selections or leases, a n d in a n y such case, t h e condition of residence a t t a c h e d to t h e original a n d additional holdings m a y be fulfilled on a n y one of such h o l d i n g s . (2) H o l d e r s of conditional p u r c h a s e s , c o n d i t i o n a l leases, s e t t l e m e n t leases, or h o m e s t e a d selections or g r a n t s m a y , s u b j e c t to t h e a p p r o v a l of t h e M i n i s t e r u p o n t h e r e c o m m e n d a t i o n of t h e board, a c q u i r e by e x c h a n g e p o r t i o n s of land held u n d e r conditional p u r c h a s e or conditional or s e t t l e m e n t lease or h o m e s t e a d selection or g r a n t b y adjoining holders, a n d t h e condition of residence a t t a c h i n g to a n y s u c h p o r t i o n m a y be fulfilled by residence; on t h e h o l d i n g to w h i c h s u c h portion h a s by t h e e x c h a n g e become a t t a c h e d . (3) Tin; lands to be a c q u i r e d by transfer u n d e r this s e c t i o n shall be of t h e same t e n u r e as t h e lands in v i r t u e of w h i c h t h e y a r e so a c q u i r e d ; and lands shall only be e x c h a n g e d u n d e r t h e p r e c e d i n g subsections for l a n d s of identical t e n u r e . (4) I n order to complete an e x c h a n g e of conditionally p u r c h a s e d or conditionally leased land for Crown lands, it shall n o t be necessary for t h e p u r c h a s e r or lessee of s u c h land to c o n v e r t t h e s a m e i n t o freehold or conditionally p u r c h a s e d land. Possession by mortgagee or execution creditor. 12. A n y m o r t g a g e e who has u n d e r t h e powers of t h e m o r t g a g e s u b m i t t e d a n y homestead selection, or s e t t l e m e n t lease, or area consisting of land of both t e n u r e s , for sale by p u b l i c auction, a n d a n y e x e c u t i o n creditor w h o has seized u n d e r process of a n y c o u r t a n y s u c h selection, lease, or area, if t h e m o r t g a g o r ' s or debtor's interest i n t h e l a n d is n o t t h e n sold to a b o n a fide p u r c h a s e r , m a y , in t h e prescribed m a n n e r , go into possession of t h e land, a n d t h e condition of residence shall, shall, for a period of twelve m o n t h s after t h e c o m m e n c e m e n t of s u c h possession, or for s u c h f u r t h e r period as m a y h e a p p r o v e d by t h e M i n i s t e r , he d e e m e d to be fulfilled, if a n o m i n e e of s u c h m o r t g a g e e or creditor, to be a p p r o v e d b y t h e local l a n d board, resides u p o n t h e land. T h e m o r t g a g e e or creditor shall, w i t h i n s u c h period or f u r t h e r period, sell t h e m o r t g a g o r ' s or d e b t o r ' s interest in t h e l a n d to a b o n a fide p u r c h a s e r , w h o t h e r e a f t e r shall be subject to all conditions affecting t h e original holder, a n d i n default of such sale t h e h o l d i n g or h o l d i n g s shall he forfeited : P r o v i d e d t h a t before a n y p e r s o n shall t a k e a d v a n t a g e of this section h e shall r e g i s t e r a t t h e local l a n d s office t h e total a m o u n t of his m o r t g a g e or j u d g m e n t d e b t a n d o t h e r p a r t i c u l a r s as prescribed, a n d a n y p e r s o n m a y t h e r e a f t e r prior to s u c h forfeiture as aforesaid a p p l y to t h e local land board to p u r c h a s e t h e said h o l d i n g for t h e a m o u n t of s u c h debt, a n d t h e board m a y g r a n t such a p p l i c a t i o n , a n d u p o n p a y m e n t t o t h e m o r t g a g e e or j u d g m e n t creditor of t h e a m o u n t t h e n d u e t h e a p p l i c a n t shall b e c o m e t h e h o l d e r of s u c h l a n d free of s u c h debt, b u t s u b j e c t to all unfulfilled conditions a t t a c h i n g to s u c h l a n d : Provided also, t h a t n o m o r t g a g e e or j u d g m e n t creditor shall t a k e proceedings h e r e u n d e r u n t i l t w o years after t h e passing of t h i s Act, a n d n o s u c h proceedings shall hereafter be t a k e n unless t h e m o r t g a g o r has been in default for one vear, or in t h e case of a n e x e c u t i o n creditor u n t i l one y e a r after j u d g m e n t has b e e n signed : P r o v i d e d f u r t h e r , t h a t t h i s section shall n o t in a n y w a y a b r o g a t e t h e provisions of section t w e n t y - t h r e e of t h e Crown L a n d s A c t of 1895. Reduction of purchase money of conditional repealed Act, purchases under the 13. W h e r e a n y conditional p u r c h a s e (other t h a n a m i n i n g conditional purchase) m a d e u n d e r t h e provisions of t h e C r o w n L a n d s A l i e n a t i o n A c t of 1 8 6 1 , a n d not b r o u g h t in respect of p a y m e n t u n d e r the provisions of t h e L a n d s A c t s A m e n d m e n t A c t , 1 8 7 5 , or t h e C r o w n L a n d s A c t F u r t h e r A m e n d m e n t A c t , 1880, or t h e C r o w n L a n d s A c t of 188f, is, after t h e p a s s i n g of this A c t , b r o u g h t u n d e r t h e i n s t a l m e n t system u n d e r t h e provisions of t h e l a s t - m e n t i o n e d A c t , t h e b a l a n c e of p u r c h a s e m o n e y on s u c h conditional p u r c h a s e shall be r e d u c e d by a n a m o u n t e q u a l to one-fifth of t h e total a m o u n t of i n t e r e s t (exclusive of fines) paid on such b a l a n c e of p u r c h a s e m o n e y b e t w e e n t h e date of c o m m e n c e m e n t of t h e p u r c h a s e a n d t h e date from which t h e conversion of s u c h p u r c h a s e u n d e r t h e i n s t a l m e n t s y s t e m t a k e s effect; a n d t h e b a l a n c e of p u r c h a s e m o n e y as so r e d u c e d shall be a c c e p t e d as t h e b a l a n c e of p u r c h a s e m o n e y t h e n d u e a n d p a y a b l e on s u c h conditional p u r c h a s e . Conversion shall t a k e effect from t h e first day of J a n u a r y of t h e y e a r d u r i n g w h i c h a p p l i c a t i o n to c o n v e r t is m a d e if s u c h a p p l i c a t i o n is m a d e d u r i n g t h e first six m o n t h s of t h e year, b u t otherwise shall shall t a k e effect from t h e first day of J a n u a r y of t h e succeeding year. T h e provisions of this section shall n o t a p p l y to a n y conditional p u r c h a s e unless b r o u g h t u n d e r t h e i n s t a l m e n t system w i t h i n two y e a r s after t h e passing of this A c t , a n d shall in a n y case a p p l y only to so m u c h of t h e area held b y a n y one holder as t h e board m a y find to be sufficient to m a i n t a i n t h e h o m e of s u c h holder, a n d t h e board in t h e i r d e t e r m i n a t i o n of this m a t t e r shall t a k e into consideration t h e n u m b e r of persons w h o are to be m a i n t a i n e d u p o n or by m e a n s of s u c h land a n d shall a p p l y only in cases w h e r e t h e holder has resided c o n t i n u o u s l y on some p a r t of s u c h l a n d for two years i m m e d i a t e l y p r e c e d i n g t h e passing of this A c t : Provided t h a t t h e Board m a y w a i v e such condition of residence in a n y case w h e r e it is satisfied t h a t t h e land is h e l d a n d used bona tide for t h e m a i n t e n a n c e of t h e h o l d e r a n d his family. Pale of interest on conditional purchases, 14, After t h e passing of this Act, t h e r a t e of interest p a y a b l e on t h e b a l a n c e of p u r c h a s e m o n e y on a n y c o n d i t i o n a l p u r c h a s e (other t h a n a m i n i n g conditional p u r c h a s e ) , w h e t h e r applied for before or after t h e passing of this Act, shall (if t h e b a l a n c e of p u r c h a s e m o n e y is p a y a b l e by a n n u a l i n s t a l m e n t s ) be t w o a n d one half per c e n t u m per a n n u m , instead of four per c e n t u m per a n n u m :. P r o v i d e d t h a t i n t e r e s t shall n o t be c o m p u t e d a t t h e lower r a t e e x c e p t w h e r e it c o m m e n c e s to a c c r u e for a full year of t h e p u r c h a s e after t h e thirty-first d a y of D e c e m b e r , one t h o u s a n d n i n e h u n d r e d a n d two, a n d shall be c h a r g e d a t t h e original r a t e w h e r e it h a s c o m m e n c e d to a c c r u e before t h e first d a y of J a n u a r y , one t h o u s a n d n i n e h u n d r e d a n d t h r e e , for such year of t h e p u r c h a s e as m a y be c u r r e n t at t h e passing of this A c t . This section shall in a n y case, as to c o n d i t i o n a l p u r c h a s e s held a t t h e p a s s i n g of this A c t , a p p l y only to so m u c h of t h e area held by a n y o n e holder as t h e board m a y find to be sufficient to m a i n t a i n t h e h o m e of such holder, a n d t h e board in t h e i r d e t e r m i n a t i o n of this m a t t e r shall t a k e i n t o consideration t h e n u m b e r of persons who are to be m a i n t a i n e d u p o n or by m e a n s of such land a n d shall apply only in cases w h e r e t h e holder h a s for t w o years i m m e d i a t e l y before s u c h date c o n t i n u o u s l y resided on some p a r t of such area or on a conditional p u r c h a s e or conditional lease of t h e same scries : P r o v i d e d t h a t t h e board m a y waive s u c h condition of residence in any case w h e r e it is satisfied t h a t t h e land is held a n d used b o n a fide for t h e m a i n t e n a n c e of t h e h o l d e r a n d his family. I n a n y case w h e r e t h e r a t e of i n t e r e s t is r e d u c e d to t w o a n d one half per c e n t u m as well as in respect of all conditional p u r c h a s e s hereafter to be m a d e t h e a n n u a l p a y m e n t m a y be m a d e at t h e r a t e of n i n e pence per acre per annum. E Payments Payments may he deferred. 15. T h e M i n i s t e r m a y , a t a n y t i m e , defer t h e p a y m e n t of a n y a m o u n t d u e , or to become due, w i t h i n twelve m o n t h s from t h e d a t e of t h e application, on a n y holding u n d e r t h e C r o w n L a n d s A c t s for a n y period n o t exceeding five y e a r s . A n y p a y m e n t so deferred shall bear i n t e r e s t a t t h e r a t e of five per c e n t u m per a n n u m from t h e date i t b e c a m e d u e u n t i l it is p a i d ; a n d s u c h interest shall, if t h e M i n i s t e r so directs, be p a y a b l e on s u c h dates as h e m a y d e t e r m i n e . T h e M i n i s t e r m a y allow t h e deferred a m o u n t s to b e repaid by a n n u a l i n s t a l m e n t s , w i t h i n t e r e s t a t t h e r a t e m e n t i o n e d i n this section. N o t h i n g in this section shall p r e v e n t t h e p a y m e n t of a n y a m o u n t before it becomes d u e . Parents may assist children to acquire land. 16. T h e board shall n o t disallow a n a p p l i c a t i o n for a n y h o l d i n g u n d e r t h e P r i n c i p a l A c t s or t h i s A c t as n o t h a v i n g been m a d e in good faith m e r e l y because t h e a p p l i c a n t h a s been or is to be financially assisted i n c o n n e c t i o n w i t h s u c h h o l d i n g b y a p a r e n t of s u c h a p p l i c a n t . Married women may acquire land. 17. A n y m a r r i e d w o m a n ( t h e provisions of t h e P r i n c i p a l A c t s to t h e c o n t r a r y n o t w i t h s t a n d i n g ) m a y , w i t h t h e c o n s e n t of t h e Minister, o u t of m o n e y s b e l o n g i n g to h e r for her separate u s e , a c q u i r e by p u r c h a s e or otherwise o t h e r t h a n by an original a p p l i c a t i o n a conditional p u r c h a s e , conditional lease, h o m e s t e a d selection, or s e t t l e m e n t lease, a n d she shall have t h e same p o w e r of d e a l i n g with a n d disposing of t h e same both a t l a w a n d in e q u i t y as if she were a f e m m e sole, a n d it shall be a sufficient c o m p l i a n c e with t h e P r i n c i p a l A c t s , so far as residence is concerned, if she shall reside u p o n a n y conditional p u r c h a s e , conditional lease, h o m e s t e a d selection, or s e t t l e m e n t lease h e l d b y h e r h u s b a n d ; or h e r h u s b a n d m a y fulfil t h e condition of residence on a n y conditional p u r c h a s e , c o n d i t i o n a l lease, h o m e s t e a d selection, or s e t t l e m e n t lease held b y himself or a n y h o l d i n g held by his wife u n d e r this section. I n e i t h e r case notice as prescribed shall be forwarded to t h e c h a i r m a n of t h e local land hoard of t h e i n t e n t i o n so to reside. Leases to outgoing pastoral lessees. 18. T h e registered holder or person e n t i t l e d to t h e e q u i t y of r e d e m p t i o n of a n y pastoral lease, p r e f e r e n t i a l occupation license, or occupation license m a y a p p l y for a lease of a n area n o t e x c e e d i n g onet h i r d of t h e total area of t h e l a n d comprised w i t h i n t h e lease or license license or lease and license a t t h e d a t e of e x p i r a t i o n of t h e pastoral lease, a n d t h e M i n i s t e r shall t h e r e u p o n refer such a p p l i c a t i o n To t h e local land board for r e p o r t as to t h e a r e a of a n d class of all leases held b y t h e a p p l i c a n t or on his behalf, a n d as to w h e t h e r t h e w h o l e or a n y p a r t of t h e l a n d comprised in such application is suitable; for closer s e t t l e m e n t or to enable present holders n o t h a v i n g a living area to a d d to t h e i r holdings. T h e Governor m a y , u p o n a r e p o r t from t h e board r e c o m m e n d i n g s u c h lease, g r a n t such application, e i t h e r w h o l l y or in p a r t , for a period n o t e x c e e d i n g t w e n t y - e i g h t years, subject to t h e r e n t conditions of i m p r o v e m e n t a n d w i t h d r a w a l for s e t t l e m e n t n a m e d in s u c h reference, or s u c h o t h e r r e n t a n d conditions as t h e Governor m a y determine. N o lease shall b e g r a n t e d u n d e r t h i s section of a n y land in respect of w h i c h a n earlier or s i m u l t a n e o u s a p p l i c a t i o n u n d e r section t h r e e of t h i s A c t is p e n d i n g . A r e t u r n of every s u c h lease g r a n t e d shall be laid before P a r l i a m e n t if in session w i t h i n one m o n t h from d a t e of t h e g r a n t i n g of t h e same or otherwise within one m o n t h after t h e c o m m e n c e m e n t of t h e n e x t e n s u i n g session. N o e x t e n s i o n of a n y such lease or license held by w a y of m o r t g a g e on or since t h e first day of J a n u a r y , one t h o u s a n d n i n e h u n d r e d a n d t h r e e , shall be g r a n t e d unless a n d u n t i l a c o m m o n a g r e e m e n t shall h a v e been arrived a t b e t w e e n t h e m o r t g a g o r , t h e m o r t g a g e e , a n d t h e M i n i s t e r as to a n y a d j u s t m e n t or otherwise of t h e m o r t g a g e d e b t a n d as to t h e t e r m s a n d conditions to be entered into b y s u c h m o r t g a g o r a n d m o r t g a g e e in respect of s u c h d e b t ; a n d for t h e p u r p o s e s of t h i s section tin; M i n i s t e r s h a l l be; e n t i t l e d to inspect or cause to be; inspected on his behalf all or a n y books of a c c o u n t , m o r t gages, deeds, securities, conveyances, a g r e e m e n t s or a n y elocumcnts or i n s t r u m e n t s r e l a t i n g to t h e said debt or t h e s e c u r i t y therefor. The acceptance* of a n y such e x t e n d e d leases by a n y n m r t g a g e e a n d m o r t g a g o r shall h a v e t h e effect of d i s c h a r g i n g t h e m o r t g a g e debt in connection w i t h s u c h lease or other s e c u r i t y worked i n c o n j u n c t i o n t h e r e w i t h t o t h e e x t e n t determined u p o n in t h e c o m m o n a g r e e m e n t referred to. The; mortgage's a n d o t h e r i n s t r u m e n t s b y which the' repayment of the; debt is secured shall h a v e endorsed t h e r e o n t h e p a r t i c u l a r s of such a g r e e m e n t a n d all parties t h e r e t o shall be b o u n d b y s u c h a g r e e m e n t : P r o v i d e d t h a t t h e area w h i c h m a y be g r a n t e d u n d e r t h e provisions of t h i s section shall be inclusive of all lands previously g r a n t e d on such h o l d i n g to the; a p p l i c a n t u n d e r i m p r o v e m e n t lease conditions. A n y lease u n d e r this section shall be d e e m e d to be a lease for p a s t o r a l p u r p o s e s w i t h i n t h e m e a n i n g of t h e A c t s r e l a t i n g to m i n i n g . 1 1 1 Family Family selections. 19. I n a n y case w h e r e t w o or m o r e h o l d i n g s s i t u a t e d w i t h i n w o r k i n g distance are held either u n d e r conditional p u r c h a s e ( w h e t h e r fully paid u p or o t h e r w i s e ) , conditional lease, h o m e s t e a d selection, or s e t t l e m e n t lease by m e m b e r s of one family, bona fide in t h e i r own s e p a r a t e interests, a n y condition of residence r e q u i r e d to be performed b y t h e m in respect of their holdings shall be d e e m e d to h a v e been duly p e r f o r m e d if s u c h residence is carried o u t on a n y p o r t i o n of t h e lands so held : P r o v i d e d t h a t t h e consent of t h e local l a n d board shall have been obtained in t h e prescribed m a n n e r . Ballots. 20. Section six of t h e Crown L a n d s ( A m e n d m e n t ) Act of 1899, is (except as to t h e repeals in t h e first clause thereof) h e r e b y repealed. W h e n a n y applications s i m u l t a n e o u s l y m a d e for original h o l d i n g s a r e conflicting, w h e t h e r severally or collectively, t h e l a n d a g e n t shall d e t e r m i n e by ballot in t h e prescribed m a n n e r t h e priority of s u c h applications, a n d t h e local l a n d board shall deal with t h e a p p l i c a t i o n w h i c h h a s gained priority in t h e ballot. W h e r e t h e l a n d a g e n t has o m i t t e d to hold a ballot, or has h e l d a ballot b u t n o t in t h e prescribed m a n n e r , t h e local l a n d board m a y direct t h e l a n d a g e n t to hold a ballot or a fresh ballot, as t h e case m a y be: P r o v i d e d t h a t if t h e application w h i c h b y t h e first or a n y s u b s e q u e n t ballot is d e t e r m i n e d to h a v e priority is w i t h d r a w n or disallowed a fresh ballot shall be h e l d in every s u c h case t o d e t e r m i n e t h e p r i o r i t y of those applications w h i c h r e m a i n a n d were included in t h e p r e v i o u s ballot. T h e board m a y impose a p e n a l t y for t h e w i t h d r a w a l or disallow a n c e of a n y application b y r e t a i n i n g t h e whole or s u c h portion of t h e deposit m o n e y as m a y after d u e i n q u i r y seem justifiable, a n d m a y a t its discretion disqualify s u c h a p p l i c a n t from m a k i n g a n y fresh applica tion for a period to be d e t e r m i n e d b y s u c h board. A p p l i c a t i o n s for conditional p u r c h a s e s a n d conditional leases of t h e same series shall, for t h e purposes of a n y ballot, be deemed to form t o g e t h e r a single application for t h e w h o l e of t h e l a n d described in t h e said applications t a k e n t o g e t h e r . Residential leases. 21. Subject to t h e provisions of section forty-eight of t h e Crown L a n d s Act of 1889, a n d section fifty of t h e Crown Lands A c t of 1895, any holder of a residential lease n o t e x c e e d i n g n i n e t e e n acres m a y m a k e additional residential leases adjoining the original or a n y prior additional residential lease or m a y a c q u i r e by p u r c h a s e or other wise a n y residential lease so adjoining : Provided t h a t t h e original a n d any a n y a d d i t i o n a l residential leases do n o t exceed in t h e whole t w e n t y acres. R e s i d e n c e m a y be carried o u t on a n y p a r t of t h e land u n d e r lease. T h e t e r m of a n y residential lease ( w h e t h e r applied for before or after t h e c o m m e n c e m e n t of t h i s A c t ) m a y be fixed for, or e x t e n d e d to, a n y t e r m n o t exceeding t w e n t y - e i g h t years : P r o v i d e d f u r t h e r t h a t a n y residential holder of an area w h e t h e r freehold or otherwise on a gold-field m a y o b t a i n a residential lease, subject to t h e approval of t h e board, of a n area "which w h e n t a k e n with t h e area he already holds on s u c h gold-field does n o t exceed t w e n t y acres. T h e condition of residence a t t a c h e d to t h e lease m a y be fulfilled on t h e lease or on t h e land on w h i c h he has a l r e a d y b e e n residing. Homestead selections or settlement leases survey. may be acquired before 22. N o t w i t h s t a n d i n g t h e provisions of t h e P r i n c i p a l A c t s , l a n d m a y be m a d e available for homestead selection or s e t t l e m e n t lease before t h e blocks or f a r m s are m e a s u r e d ; b u t a n y block or farm shall be t a k e n a c c o r d i n g to a n y published p l a n or d e s i g n thereof. After s u r v e y a n y necessary a d j u s t m e n t of area or r e n t shall be made, a n d a n y roads deemed to be necessary m a y be reserved or e x c l u d e d in t h e m e a s u r e m e n t of any block or farm. A n y r e n t d u e for a n y excess of area, or o t h e r moneys due, shall be paid w i t h i n s u c h period as t h e M i n i s t e r m a y allow, a n d if n o t so paid, t h e h o m e s t e a d selection or s e t t l e m e n t lease shall be liable to forfeiture : P r o v i d e d also t h a t in cases of e x i s t i n g h o l d i n g s t h e Minister may m a k e a n y m i n o r v a r i a t i o n of t h e existing design or survey of such holding to enable a b e t t e r b o u n d a r y to be secured for fencing or other purposes. Annual leases. 23. A n a n n u a l lease shall n o t e x e m p t t h e l a n d held t h e r e u n d e r from lease of a n y o t h e r kind, a n d u p o n t h e land b e i n g sold or leased t h e a n n u a l lease shall be held to have ceased a n d d e t e r m i n e d so far as r e g a r d s t h e land so sold or leased. T h e holder of a n y a n n u a l lease or leases (held by h i m on t h e first day of J a n u a r y , one t h o u s a n d n i n e h u n d r e d a n d t h r e e ) , m a y a p p l y to t h e M i n i s t e r for a n i m p r o v e m e n t lease of the, whole or a n y p a r t of t h e lease or leases so held, a n d t h e M i n i s t e r shall t h e r e u p o n refer t h e a p p l i c a t i o n to t h e local land board, a n d if s u c h board is of opinion t h a t t h e a p p l i c a n t has not a n area sufficient to s u p p o r t a family a n d t h a t n o valid objection in the p u b l i c i n t e r e s t exists to t h e g r a n t i n g of s u c h application the board may recommend and the Governor may grant a lease of a n area sufficient for t h a t purpose for a period n o t exceeding seven years, subject to such r e n t a n d conditions as may be set o u t b y the t h e M i n i s t e r in such reference, or such o t h e r r e n t a n d conditions as t h e M i n i s t e r m a y after s u c h report d e t e r m i n e . T h e b a l a n c e of t h e a r e a (if any) m a y be held by t h e a p p l i c a n t as an a n n u a l lease : P r o v i d e d t h a t n o s u c h lease shall be g r a n t e d on a n y p r o c l a i m e d gold or m i n e r a l field e x c e p t w i t h t h e a p p r o v a l of t h e M i n i s t e r for M i n e s . A n y holder of l a n d held u n d e r a n n u a l lease m a y a p p l y to h a v e t h e r e n t thereof d e t e r m i n e d in accordance w i t h t h e provisions of section six of t h e Crown L a n d s A c t , 1SS9. Auction sales. 24. Section sixty-one of t h e C r o w n L a n d s A c t of 1881- is h e r e b y a m e n d e d by t h e s u b s t i t u t i o n of t h e words " one m o n t h " for t h e words " two m o n t h s n o r more t h a n t h r e e m o n t h s , " a n d b y t h e s u b s t i t u t i o n of t h e words " o t h e r lands fifteen s h i l l i n g s " for t h e w o r d s " o t h e r l a n d s one p o u n d five s h i l l i n g s . " T h e provisions of t h e C r o w n L a n d s ( A u c t i o n Sales B a l a n c e s ) A c t , 1887, a n d of section fifty-six of t h e C r o w n L a n d s A c t , 1 8 9 5 , are h e r e b y e x t e n d e d to a n y p o r t i o n of c o u n t r y l a n d s of a less area t h a n forty acres. Conversion of settlement leases into homestead selections. 25. T h e holder of a n y s e t t l e m e n t lease w h i c h is n o t a t t h e t i m e of application h e r e u n d e r liable to forfeiture, m a y a t a n y t i m e after t h e e x p i r a t i o n of t h e first five years of t h e lease a p p l y i n t h e prescribed m a n n e r , subject to t h e provisions of section t w e n t y - s e v e n of t h e C r o w n L a n d s A c t , 1S95, for a n area n o t e x c e e d i n g one t h o u s a n d t w o h u n d r e d a n d e i g h t y acres of t h e land comprised u n d e r s u c h lease as a h o m e s t e a d g r a n t , a n d t h e board m a y allow s u c h application i n whole or i n p a r t if t h e y find t h a t t h e a p p l i c a n t is deserving of s u c h g r a n t , a n d t h e G o v e r n o r m a y issue t h e same. I n all s u c h cases t h e r e m a i n i n g area of s u c h s e t t l e m e n t lease m a y be held at a proportionate p a r t of t h e r e n t a l thereof. A refund of t h e r e n t a l shall n o t be g r a n t e d u n t i l after t h e e x e c u t i o n of t h e h o m e s t e a d g r a n t , a n d , w h e n g r a n t e d , shall be c a l c u l a t e d from t h e date of s u c h e x e c u t i o n . T h e condition of residence a t t a c h e d to t h e s e t t l e m e n t lease a n d to t h e h o m e s t e a d selection m a y be fulfilled for both holdings conjointly e i t h e r on t h e l a n d held u n d e r h o m e s t e a d selection or on t h e l a n d h e l d u n d e r s e t t l e m e n t lease, so l o n g as b o t h s u c h selection a n d lease are h e l d in t h e s a m e interest. 'fhe v a l u e of t h e land t a k e n u n d e r h o m e s t e a d selection shall b e d e t e r m i n e d by a p p r a i s e m e n t in a c c o r d a n c e w i t h t h e provisions of section six of t h e C r o w n L a n d s Act, 1889. Enclosure Enclosure of roads. 26. P e r m i s s i o n to enclose a road u n d e r t h e provisions of section e i g h t of t h e Crown L a n d s ( A m e n d m e n t ) A c t , 1899, m a y be g r a n t e d to a n a p p l i c a n t , a l t h o u g h s u c h road a t t h e t i m e of a p p l i c a t i o n forms p a r t of a n o c c u p a t i o n license or a n n u a l lease, a n d t h e g r a n t i n g of s u c h permission shall h a v e t h e effect of w i t h d r a w i n g t h e area of l a n d comprised in s u c h road from s u c h license or lease. W h e r e permission to enclose a road is g r a n t e d as aforesaid, t h e side of s u c h road shall be d e e m e d to be a c o m m o n b o u n d a r y line w i t h i n t h e m e a n i n g of section one h u n d r e d a n d forty-one of t h e Crown Lands Act, 1881. ' I n every case w h e r e t h e b o u n d a r i e s of a n y h o l d i n g m u s t be fenced, t h e board m a y , o n a p p l i c a t i o n in t h e prescribed m a n n e r , authorise a g i v e - a n d - t a k e fence, a n d such fence w h e n erected shall be deemed a compliance w i t h t h e law, a n d shall, for all p u r p o s e s of law a n d equity, or t h e b o u n d a r y b e t w e e n t h e parties. Amendment of Acts. 27. T h e holder of a n y conditional lease m a y a t a n y t i m e exercise his r i g h t to m a k e a n a d d i t i o n a l conditional p u r c h a s e of t h e w h o l e or any p a r t of such conditional lease n o t b e i n g less t h a n forty acres, n o t w i t h s t a n d i n g t h a t t h e area included i n such a p p l i c a t i o n shall exceed six h u n d r e d a n d forty acres. 28. Section t h i r t y of t h e A c t fifty-eighth Victoria n u m b e r e i g h t e e n is a m e n d e d by t h e i n s e r t i o n of t h e words " s o long as t h e person u p o n w h o m t h e p e r f o r m a n c e of t h e said condition wouid for t h e t i m e b e i n g devolve is the person w h o applied for tin; original conditional p u r c h a s e of t h e series a n d for t h e said additional c o n d i t i o n a l p u r c h a s e or conditional l e a s e , " in s u b s t i t u t i o n for t h e w o r d s i n s e r t e d t h e r e i n u n d e r section seventeen of t h e C r o w n L a n d s ( A m e n d m e n t ) Act, 1899. 29. Section t w e n t y - t w o of t h e Crown L a n d s A c t of 1 8 8 1 is h e r e b y a m e n d e d b y t h e addition of t h e words " o t h e r t h a n lands w i t h i n a proclaimed special a r e a " after t h e words " r e f e r to C r o w n l a n d s . " 30. T h e holder of a n y freehold t h e area of which is n o t less t h a n forty acres, a n d in t h e opinion of t h e local l a n d board is n o t sufficient to m a i n t a i n his family, m a y , if h e h a s for t w o y e a r s i m m e d i a t e l y prior to t h e passing of this A c t a n d a t t h e t i m e of m a k i n g application is residing on such freehold a n d u s i n g t h e s a m e for t h e m a i n t e n a n c e of his f a m i l y by f a r m i n g p u r s u i t s , a p p l y u n d e r a n d subject to t h e provisions of section t h r e e for a n a d d i t i o n a l conditional p u r c h a s e or conditional lease i n v i r t u e thereof, a n d shall be entitled to t h e benefit a n d subject to t h e conditions of t h e said section as if s u c h freehold area w e r e a conditional p u r c h a s e . 31. 3 1 . Section t w e n t y - s i x of t h e Crown L a n d s A c t of 1895 is h e r e b y a m e n d e d by i n s e r t i n g in t h e first line after t h e word " m a y " t h e w o r d s " u p o n t h e r e c o m m e n d a t i o n of t h e local l a n d b o a r d . " 32. I n addition to t h e m a t t e r s specified in section t h i r t y - s e v e n of t h e C r o w n L a n d s A c t of 1895, t h e c h a i r m a n shall h a v e power, s u b j e c t to t h e provisions of t h a t section, to deal w i t h — (i) inquiries as to fulfilment of conditions ; (ii) certificates of confirmation ; (iii) confirmation of a p p l i c a t i o n s ; a n d (iv) applications for a n n u a l leases. Condition of residence. 3 3 . "Where a person is t h e holder of two h o l d i n g s of a n y t e n u r e u n d e r t h e Crown L a n d s A c t s , a n d a condition of residence a t t a c h e s to e i t h e r or b o t h holdings, h e m a y , w i t h t h e consent of t h e board, a n d s u b j e c t to s u c h conditions as t h e b o a r d m a y impose, p e r f o r m t h e condition or conditions of residence b y residing on one of s u c h holdings. 34. This A c t shall come i n t o force on t h e first day of J a n u a r y , one t h o u s a n d nine h u n d r e d a n d four.
