purchase all meat products to be used in an Outback Jacks Bar & Grill
restaurant from Top Cut Foods.

Outback Jacks Bar & Grill Franchisees will be the only class of
persons/corporations who will be affected by the conduct.
There are numerous suppliers of meat products in Australia with varying prices
and quality of product which are sourced both locally and from overseas. As
such, numerous factors can affect the quality of products supplied such as
farmed standards, storage facilities and methods of transporting goods.
Accordingly, whilst Franchisees may be able to source meat products from
alternative suppliers at a lower wholesale price - or even the same price as
Top Cut Foods - it is impossible to ensure that the products will be of the same
quality as those supplied by Top Cut Foods and even if they are high quality
they will be different to those supplied by Top Cut Foods which will affect the
consistency of dishes served by Outback Jacks Bar & Grill restaurants.
Additionally, Top Cut Foods is the only supplier in Australia capable of
supplying Franchisees in every state in Australia.

Arguments in support of notification:

Outback Jacks Bar & Grill restaurants are all Franchised Businesses or
Corporate restaurants operated by the Frenchisor or Master Franchisees.
Outback Jacks Bar & Grill restaurants offer competitive Iy priced yet high quality
grilled meals, with its 'Diamond Cut' steaks representing its 'signature' product
and offering.
The Applicant has spent a number of years searching for the best quality meat
products - in particular the 'Diamond Cut Steaks' - and seeks to ensure that
all Outback Jacks Bar & Grill restaurants offer the same high-quality products.
Franchised restaurants by their nature base their success on the recognition of
the brand, recognised customer service and in particular consistent high
quality food products. If a Franchise System can ensure a consistent high
quality product it will benefit the reputation of all Outback Jacks restaurants in
the Franchise System, and by extension add value to the Franchised Business
owned by each individual Franchisee. Conversely, if just one (1) Franchisee is
permitted to serve poor quality food products it can affect the reputation of all
Outback Jacks Bar & Grill restaurants and by extension damage the business
of all Franchisees in the Franchise System.
Furthermore, as all Franchisees use the same menu and marketing material,
which focuses on the quality of 'Diamond Cut Steaks', if a Franchisee were
permitted to serve steaks that are not 'Diamond Cut Steaks' to customers
expecting a 'Diamond Cut Steak', this would amount to misleading and
deceptive conduct.

determined by the Frenchisor - not based on the cost of individual products although the Franchisees are permitted to lower prices in the interests of
competition.
