This Rule provides the framework for the management of all online Learning Resources via the University Learning Management System, and must be read in conjunction with the Online Learning Resources Procedures that support this policy. Scope 2. This Rule applies to all University Representatives involved in the development, administration and delivery of all online Learning Resources via the University Learning Management System (LMS). Policy Principles 3. The University is committed to enhancing the quality of our course offerings and embracing new technologies to support our aspiration to be the leading provider of flexible and online learning. 4. Appropriate tools and technologies for teaching and learning will be used in all units (where applicable) to enhance the student learning experience. 5. All units will have a dedicated University Learning Management System (LMS) site. 6. The Learning Management System supports the online delivery and administration of resources, communication, collaboration and assessment. 7. Online Learning Resources must adhere to accessibility standards in accordance with government legislation. 8. The University is mindful of safeguarding its intellectual property, managing the rights and responsibilities of UNE authors, and administering copyright and license compliance obligations in relation to the use of Learning Resources. Responsibilities 9. 96 of 154 Unit Coordinators are responsible for administering and overseeing the unit LMS site including: (a) developing and reviewing all unit content and creating engaging Learning Resources for students based on sound pedagogical principles; (b) unit Core Learning Resources are available to students in accordance with release deadlines specified in clause 11 of the Online Learning Resources procedures; (c) ensuring published Third Party Copyright materials copied under Part VB of the Copyright Act 1968 (Cth) required for inclusion in electronic reserve meet the University Library submission deadlines specified in clause 10 of the Online Learning Resources procedures; (d) providing links to Library Resources and not reproducing the content in the LMS; (e) ensuring online Learning Resources meet compliance obligations detailed in the University Copyright Policy; (f) where applicable adding teaching team members and contact details prior to the first week of teaching; and (g) in accordance with government legislation, providing reasonable adjustments to online Learning Resources for students with a declared special need. 10. The Special Needs Office is responsible for: (a) providing advice to Unit Coordinators and the relevant Head of School on making reasonable adjustments to online Learning Resources for students with a declared special need; and (b) providing the agreed reasonable adjustments for online Learning Resources to students with a declared special need. 11. Teaching and Learning Support is responsible for: (a) the ongoing management of the Learning Management System, which includes the identification and actioning of any future system developments and improvements; (b) providing professional development opportunities and support to academic staff to facilitate curriculum development and to extend and develop existing teaching approaches with the aim of optimising student understanding and engagement. 12. The University Library is responsible for providing and managing Library Resources and providing services to academic staff to support their teaching activities. 13. The Copyright Officer is responsible for providing and maintaining information resources and services to assist staff preparing online Learning Resources to manage their copyright obligations. 14. The Information Technology Directorate is responsible for providing technical support, development of existing systems and implementation of new systems within the virtual learning environment. 15. Heads of School are responsible for: (a) authorising the final version of the Core Learning Resources; (b) ensuring that, for each unit offered in their School, all the Core Learning Resources are available and released to students as specified in clause 11 of the Online Learning Resources Procedures; and (c) ensuring the quality delivery of the Learning Resources on a continuous and ongoing basis, including the communications between staff and students and other university staff as appropriate through the Learning Management System. Records Management 16. Electronic records must be kept in accordance with the University Records Management Rule. Rule Administration 17. In the event of a conflict between this Rule and any School Rule, Policy or practice, this Rule shall take precedence. Authority and Compliance 18. The Vice-Chancellor pursuant to Section 29 of the University of New England Act makes this University Rule. 19. University Representatives must observe this Rule in relation to University matters. 20. The Rule Administrator is authorised to make procedures and guidelines for the operation of this Rule. The procedures and guidelines must be compatible with the provisions of this Rule. 21. This Rule operates as and from the Effective Date. 22. Previous policy on Learning Resources is replaced and has no further operation from the Effective Date of this new Rule. 23. Core Learning Resources comprise the minimum Learning Resources the student must engage with in order to complete the assessment requirements for a unit. 26. Effective Date is the date on which this Rule will take effect. 27. Learning Management System is a software application for the administration, documentation, tracking, reporting and delivery of electronic educational technology teaching and learning programs. 28. Learning Resources comprise the sum of ‘UNE-Authored Learning Resources’ and ‘Third Party Copyright and Licensed Materials’ that are made available to students to achieve learning outcomes and complete assessment requirements for a unit. 29. Library Resources include resources and licensed materials that are managed and made accessible by the University Library (including the electronic reserve collection) to support teaching and learning activities. 30. Third Party Copyright and Licensed Materials comprise materials for which the copyright is held by the author or publisher (not the University) or obtained through a services aggregator and for which the requirements of Australian copyright law or licensing agreements with the aggregator services must be adhered to. 31. UNE-Authored Learning Resources comprise assignment topics, worksheets, journals and other materials created by University staff which can be distributed to enrolled students without infringing the copyright of others. 32. University Representative means a University employee (casual, fixed term and permanent), contractor, agent, appointee, UNE Council member, adjunct, visiting academic and any other person engaged by the University to undertake some activity for or on behalf of the University. It is the overall framework within which best possible quality research training outcomes for HDR students are pursued and maintained. (2) The Rule is based upon a culture of continuous improvement based on the four-stage quality cycle of Plan, Act, Evaluate, and Improve, and is consistent with the University’s Academic Quality Management Policy. Section 2 - Scope (3) This Rule applies to all University Representatives and organisational units that deliver, or contribute to the delivery of high-quality research training at higher degree level. Section 3 - Rule Principles (4) The University will offer HDR training that: a. contributes to the strategic research goals and objectives of the University b. meets the principles and criteria specified in the Australian Qualifications Framework and other regulatory requirements c. provides high-quality research training to candidates d. promotes a collaborative and professional research culture committed to excellence Framework for Assuring Quality of Research Training (5) Evaluation of the University’s research training activities occurs through a number of monitoring and review processes: a. Confirmation of Candidature: every HDR student must undergo confirmation of candidature after six months of full-time equivalent candidature to allow the supervisors and confirmation chair to identify any support or guidance necessary for the candidate to proceed to full candidature; assess progress to date and the academic preparedness of the candidate; provide an opportunity for the candidate to demonstrate their writing and other necessary research skills; and allow the candidate and their supervisory team to plan for a successful and timely completion. b. HDR Progress Reporting: occurs every six months and is undertaken by all HDR candidates to provide the opportunity for the candidate and their supervisors to critically reflect on the progress in the candidate’s research during the past six months; consider intended research directions for the next six months and identify any issues regarding progress or resourcing. Each progress report is considered by the candidate, their supervisors and their Head of School, and is tracked by Research Services. The aggregated results of HDR Progress Reporting are reported to the Graduate Research Subcommittee, which has oversight of the progress reporting process. c. Supervisor Accreditation Training: in order to ensure quality supervision is available to HDR candidates, the University provides Supervisor Accreditation Training. 99 of 154 d. HDR Program Review: is conducted to ensure that all HDR programs are systematically evaluated through internal monitoring and, where necessary, revision, internal and external reviews at least every seven (7) years based on available benchmarks in terms of admission criteria, students’ progress and completion, structure, alignment of learning objectives to learning outcomes and assessment in the context of the University’s graduate attributes, currency of the curriculum, changes to the discipline, quality of the supervision, student support, student perceptions, physical and electronic resources and infrastructure and feedback from relevant professional, accreditation and employer groups. This process is overseen by the Graduate Research Subcommittee, in its capacity as the course advisory committee for HDR programs. e. Where areas for improvement are identified from the monitoring, these should be reported to the Graduate Research Subcommittee with an implementation plan which includes a final report when issues are resolved. f. Academic Governance: a summary of the yearly monitoring of all HDR programs, and of the internal and external reviews of HDR programs, is provided to Academic Board annually. g. The Pro Vice Chancellor (Research) is responsible for ensuring that this policy is implemented effectively and consistently for all HDR programs across all relevant academic and professional areas. Policy Review (6) The Graduate Research Subcommittee maintains a review cycle for all HDR Rules, policies and procedures. This provides the opportunity for periodic review to ensure policy material is appropriate and sustainable, and to ensure that UNE maintains a quality research environment for research training: a. Policy review is continual and entails extensive consultation with relevant stakeholders across the University and affiliated organisations. b. Where necessary specialist working parties can be established to undertake targeted analysis or benchmarking. Authority and Compliance (7) The Vice-Chancellor, pursuant to Section 29 of the University of New England Act, makes this Rule. (8) University Representatives and Students must observe it in relation to University matters. (9) The Pro Vice Chancellor Research, as Rule Administrator, is authorised to make procedures and guidelines for the operation of this Rule. This Rule is designed to ensure quality academic programs that are aligned with the objectives of the University’s Research Plan to deliver excellent research training. This policy applies to the development of new HDR courses, amendments to existing HDR courses and withdrawal of HDR courses. Section 2 - Scope (2) The HDR Program Approval Rule applies to all higher degree by research programs at the University of New England. Section 3 - Rule Principles (3) UNE is committed to providing HDR programs that: a. are academically rigorous b. reflect the important role of HDR training in a knowledge-based society c. actively encourage candidates to develop the skills required to undertake their research and future careers d. promote collaboration and connections with other University groups and offerings, where possible e. are an efficient and sustainable use of University resources and are aligned with the University Research Plan. (4) Development, amendment and withdrawal of HDR academic programs must be informed by consultation with internal and external stakeholders. HDR Course Development and Renewal (5) When developing or renewing an HDR course, UNE: a. reflects on internal and external stakeholder feedback, benchmarks, standards and requirements b. draws on appropriate content and established bodies of knowledge to ensure currency of curriculum c. ensures the course enables candidates to be part of a scholarly intellectual community d. provides for the development of relevant graduate attributes e. ensures that the course design and requirements safeguard the integrity of student research and assessment f. aligns the learning objectives and assessment to the desired learning outcomes g. considers entry and exit pathways h. considers resource implications 102 of 154 i. undertake on an annual basis regular monitoring and review to support continuous improvement, and formal internal and external course review at least every seven (7) years. Administration (6) The Pro Vice Chancellor (Research) administers the HDR program approval process and makes recommendations for course approvals. The University Research Committee, through the Graduate Research Subcommittee, provides advice on these programs. Academic Governance (7) The Pro Vice Chancellor (Research) will report new HDR courses and HDR course recissions to Academic Board, as well as reporting to Academic Board on HDR course reviews and monitoring, as required. Quality Assurance (8) All HDR programs will undergo periodic review to ensure a framework for evaluating HDR programs as part of the University’s quality assurance cycle, assessing the objectives, structure and program management to ensure that HDR programs are meeting the objectives of UNE’s Strategic Plan. (2) e-publications@UNE provides a stable, secure and long term archive for the research outputs of UNE Authors. Compliance with this Rule enables UNE Authors and the University to meet the requirements of government agencies and research funding bodies for responsible reporting of research outputs of the University. (3) This Rule governs the deposit and management of research outputs in epublications@UNE. This Rule defines the deposit principles and content of epublications@UNE, and provides a framework against which deposit, collection and access decisions may be made. (4) This Rule must be read in conjunction with the e-publications@UNE Deposit, Collection and Access Procedures, which support this Rule, and the Open Access to UNE Research Publications and Data Policy. Section 2 - Scope (5) This Rule applies to all individuals associated with the University, and working and/or publishing under the auspices of the University of New England. This includes employees, emeriti, adjunct and honorary appointments, research students and postdoctoral fellows. In this Rule, these individuals are referred to as the UNE Author. (6) This Rule applies to all material which represents the research and scholarly output of the University. Section 3 - Rule Principles (7) UNE Authors are required to submit their research outputs to e-publications@UNE under the terms of this Rule, including the Deposit Licence. (8) e-publications@UNE will include research and scholarly material that satisfies at least one of the following criteria: a. material required by a government agency or research funding body for deposit and/or reporting in an institutional repository; b. research outputs produced by UNE Authors, including non-traditional research outputs; c. material forming the whole or part of work examined and accepted for the award of a University of New England Higher Degree by Research. Terms of Deposit (9) UNE Authors submitting a research output to e-publications@UNE will agree to the terms stated in the Deposit Licence. The Deposit Licence (10) By submitting a research output to e-publications@UNE, I: 104 of 154 a. assert that I am a UNE Author or am authorized to submit the material on behalf of a UNE Author under the terms of this Licence; b. confirm that I have exercised reasonable care to ensure that the material is original, and does not, to the best of my knowledge, breach any laws including defamation, libel and copyright; c. grant UNE the right to include the material in e-publications@UNE and to electronically store, copy or translate the material to any medium or format for the purpose of future preservation and accessibility; and d. acknowledge that deposit of research outputs into e-publications@UNE does not transfer copyright to the University. (11) The University, through e-publications@UNE: a. will ensure that all authors are identified with their research output; b. will not alter submitted material except as allowed under this Rule; c. is not responsible for any mistakes, omissions or legal infringements within the submitted material; d. will make research outputs accessible under the terms of the Open Access to UNE Research Publications and Data Policy; e. has no obligation to take legal action on behalf of a UNE Author or other rights holder in the event of any alleged breach of any rights in the submitted material; and f. may remove material from e-publications@UNE should there be a dispute about its ownership or intellectual property rights or for any other reason which may affect the integrity of e-publications@UNE. Quality Assurance (12) Success of this Rule will be demonstrated by: a. an increase in the number of research outputs of the University recorded in epublications@UNE. b. an increase in accesses to UNE research outputs in e-publications@UNE. c. satisfactory reporting of UNE research outputs in response to University and government or research funding body requirements. Responsibilities (13) The University Librarian or delegate is responsible for overseeing the operation and technical standards of e-publications@UNE. (14) UNE Authors are responsible for ensuring the quality and accuracy of all data they submit to e-publications@UNE. Breaches (15) e-publications@UNE is subject to the University of New England's website “Disclaimer” notices including the “Copyright Takedown Notice” form. (16) Non-compliance with this Rule may result in action being taken in accordance with the University Code of Conduct for Research. (28) Non-traditional research outputs are research outputs which do not take the form of published books, book chapters, journal articles or conference publications, including but not limited to, original creative works, live performance of creative works, recorded/rendered creative works, curated or produced substantial public exhibitions and events. (29) Research funding bodies are public or private organizations in Australia and internationally, which fund research. (30) Research outputs means scholarly and research literature, including articles, conference papers, and selected creative works created by a UNE author. (31) Student - means an Admitted Student or an Enrolled Student, at the relevant time. a. Admitted Student means a student who has been admitted to a UNE course of study and who is either entitled to enrol in a unit of study or who has completed all of the units in the UNE course of study. b. Enrolled Student means a student who is enrolled in a unit of study at UNE. 106 of 154 (32) The Copyright Act 1968 identifies categories of material that receive copyright protection, including literary, artistic, dramatic and musical works, sound recordings, cinematograph films, television and sound broadcasts and published editions of works. This protection governs those who wish to make, use, sell, import, export, reproduce, adapt and disseminate such material. The Act also provides for other rights and exceptions. Executive Summary The Authorities Retained By Council Rule lists the matters which have not been delegated to the Vice Chancellor, including matters handled by a Council Committee on behalf of Council. Revisions were proposed and approved at the 18 September 2015 Council meeting, but members also requested that further revision be brought back to the November Council meeting. The suggestion was for the overview section of this rule to make reference to the Governance Framework, the functions of the Vice-Chancellor rule and to the terms of reference documents of Council Committees and Academic Board etc, which have delegated authorities from Council. The Council may exercise authority over any matter at the University and this Rule does not fetter this power. What it does is specify matters that are restricted to Council, and that the Vice Chancellor or any other person or body does not have authority over. The proposed changes to the Rule are provided as Attachment 1 below. Origin of report: Addresses action items from the 29 May 2015 Council meeting including, • ACTION: The Chief Legal and Governance Officer was requested to update Council with a list of those policies which might be considered a priority for change to rules. • ACTION: The Vice-Chancellor was requested to provide Council with a suggested approach to further progress the rationalisation of policies at UNE. Related to Terms of Reference: Establish policies and procedural principles for the University consistent with legal requirements and community expectations Recommendation Mr Brendan Peet, Chief Legal and Governance Officer Council is asked to NOTE the update re Policy rationalization priorities, report #15396. Executive Summary The University Council has asked University management to take steps to rationalize the University’s rules, policies and procedures (collectively referred to in this report as “policies”), in order to promote greater understanding and ease of use by the University Community. This policy rationalization is being carried out in conjuction with the work being done around organisational planning, delegations and compliance. The UNE Governance Framework has established a process under which policy development is supported and case-managed by the Policy and Governance Unit. This is a key control that will promote policy rationalization and central oversight of policies created at UNE. A scan of policies at UNE has been carried out to compile a list of all policies, who is responsible for administering them and when they were last reviewed. This list is attached (see Attachment 1). Policy instruments are now published through the University’s policy database (TWEEK). A framework has also been prepared that allocates responsibility for policy under broad policy groupings (e.g. “research” and “finance”). This is an administrative document. Priorities for policy rationalization are being developed. Teaching and research will always be priority areas, along with human resources and information technology. STRATEGIC MATTERS 3.1. * Presentation of Annual TEFMA Benchmarks #15279 Professor Peter Creamer spoke to the report, advising that the benchmarks are developed across the whole of the university sector for comparison purposes. Professor Creamer invited Mr Ben Harris, Deputy Director of FMS, to discuss details. Mr Ben Harris informed the committee that there are a series of metrics comparing UNE against the Australian average and, generally, UNE is within or near the averages. In terms of actual maintenance expenditure, we have been at or below the average which has contributed to a backlog of maintenance issues, now being addressed. The meeting discussed: • comparisons with other regional and older universities; • different methods of reporting; • information collection and fine-tuning of results leading to improved data; • options for alternative funding and best use of long term financial liability; • building maintenance considered in planning of new assets; • that recent proposals regarding new buildings included disposal of old, unused buildings which reduced maintenance backlog liability; and • data being useful for making choices and decisions into the future. The Infrastructure Committee NOTED the Annual Presentation of TEFMA Benchmarks #15279. 3.2. * Energy Management Biannual Report #15280 Mr Ben Harris spoke to the report and the Chair asked how this report will change once the solar farm is up and running. Mr Ben Harris advised that whilst the usage of electricity will not reduce, the cost of electricity will reduce. The solar farm is targeted to produce 50% of UNE’s academic campus power so that cost should reduce significantly. A member queried whether this percentage of the academic campus power supply was as a result of the completion of stage one or all three stages. Mr Ben Harris advised that the solar farm, as approved, will supply 50% of the electricity with any subsequent extension allowing for further reduction and power storage being a viable option for the future. The Infrastructure Committee NOTED the biannual Energy Management Report #15280. 3.3. * Works Project Report #15283 Professor Creamer and Mr Ben Harris addressed the report and there were no questions from the Committee. Next Meeting The Chair advised that the next meeting of the Infrastructure Committee will be held on Friday, 11 December 2015 and will be held in the Council Room, Booloominbah. [Anne Myers joined the meeting from the Parramatta Campus] The Chair welcomed Ms Myers and asked if she had any questions on the earlier reports. Ms Myers referred to Item 3.4, Information Technology Biannual Report #15281, and commented that there seemed to be a lack of information around cyber security and privacy in the biannual report. As these are becoming key governance topics in the IT realm, it was suggested that these issues should be covered in future reports. Professor Creamer confirmed that the information could be included in this report and there should be some dimensions around the numbers and types of attacks that we have had and what we can and are doing to prevent these. There is a major project, Identity & Access Management, which will take approximately 2.5 years to come to fruition so, in the interim, relevant information will be included in the next report. ACTION: CSO to include IT security and privacy information in the next IT Biannual Report scheduled for 2016. 6.3. Origin of report: Scheduled Work Plan item. Related to Terms of Reference: #3.1 b, Oversee and monitor the University's performance. Recommendation Dr Jack Hobbs, Chair Standing Committee Convocation Council is asked to NOTE the Chair of Standing Committee Convocation’s Report #15302. Executive Summary The third meeting for 2015 was held on 18th November. The Chair reported on his meeting earlier that afternoon with Trevor Goldstone, PVCER, at which he explained the function of the Standing Committee. Trevor has agreed to attend the first meeting next year to advise what he is doing and to explore how he can work with us. The committee was encouraged by the positive response from Trevor and looks forward to working with him and the new Director of the Office of Advancement, when that appointment has been made. The Chair also reported on his recent trip to Canberra during which he had been hoping to catch up with some of the more than 100 former Earle Page College residents now living in the Canberra area, who were contacted by email inviting them to contact Jack. Unfortunately, only one person did get in touch, but she expressed interest in trying to organise a get-together in the future for those in her area. Jack has agreed to help wherever he can. Liz Ryan reported to the committee on her trip to PNG earlier this year, when she met with a number of UNE graduates. The committee discussed the possibility of setting up an Alumni chapter in the area. Jennifer Miller reported on the Distinguished Alumni awards made this year and indicated that she is about to investigate what other universities might be doing about specific awards for indigenous Alumni, with a view to considering the introduction of a new award next year. Gabrielle Price presented the results of the recent Self-Review Survey of the committee. These provided a useful stimulus for discussion of the ways in which the committee operates and suggestions how improvements might be made. The committee also had a discussion about its Terms of Reference and membership, with particular consideration to broadening membership to possibly include some younger and indigenous Alumni representatives.
