Ten tanker cars on the BNSF
Railway train caught fire

A
n oil train derailed and caught fire
early Wednesday in a rural area of
central North Dakota, prompting the
evacuation of a nearby town where about three
dozen people live.
No injuries were reported in the accident,
which happened about 7:30 a.m. near Heimdal, about 115 miles northeast of Bismarck.
The residents who left were staying with family
and friends, Wells County Emergency Manager
Tammy Roehrich said.

said.
“The engine and cars that aren’t burning
have been decoupled and moved to safety,”
she said.
Firefighters from four area communities
responded to the fire, and regional hazardous
materials teams from Grand Forks and Devils
Lake were sent to the scene, Fong said. A team
of 10 investigators from the Federal Railroad
Administration was expected to arrive on the
scene by mid-day Wednesday, said spokesman
Kevin Thompson.
The Environmental Protection Agency was
sending someone to the site to gauge any
contamination to waterways in the vicinity of
the derailment, spokesman Rich Mylott said.
The rail line through Heimdal runs next to
an intermittent waterway known as the Big
Slough, which drains into the James River
about 15 miles downstream near Bremen,
North Dakota.
It was unclear how many cars were part of
the train or how many derailed. There was

State Department assistant secretary
said Wednesday it’s “not acceptable”
for any agency employee to conduct
government business on a private email server
as former Secretary of State Hillary Rodham
Clinton did.
Joyce Barr, the agency’s chief freedom
of information officer, made the comment
under questioning from Republican senators
who used a Senate Judiciary hearing on open
records laws to attack Clinton over her email
practices.
Sen. John Cornyn of Texas said that Clinton’s approach amounted to a “premeditated
and deliberate” attempt to avoid open records
requirements.
Sen. Thom Tillis of North Carolina said that
anyone who took such an approach should
be fired, and asked Barr whether it would be
considered acceptable.
Barr said that she had not been aware of
Clinton’s decision to conduct all her State
Department email on a private server but that
the agency has now made it clear to employees
that such an approach would not be acceptable.
“I think that the actions that we’ve taken
in the course of recovering these emails have
made it very clear what people’s responsibilities
are with regard to record-keeping,” she said.
“We continue to do training, we’ve sent department notices, telegrams, we’ve talked to directors and I think the message is loud and clear
that that is not acceptable.”
Clinton, who is running for president, has
defended using a personal email account while
serving as secretary of state as a matter of
personal convenience. She says she has turned
over to the State Department all work-related
emails, though House Republicans investigating the 2002 attacks on the U.S. mission in
Benghazi, Libya, are demanding more. They

awaii lawmakers passed dozens of bills
Tuesday heading into the final days
of the Legislative session, approving
plans that could raise taxes, save energy and
ban sex trafficking. A bill to set up a system of
medical marijuana dispensaries is scheduled for
a full legislative vote on Thursday.
Here’s a rundown of some of the major bills
that passed both chambers and are now heading to Gov. David Ige.
RENEWABLE ENERGY — Hawaii could
become the first state in the nation to adopt
a 100 percent renewable energy portfolio. A

the source, and officials did not immediately
return calls from The Associated Press.
Since 2006, the U.S. and Canada have
seen at least 24 oil train accidents involving a
fire, derailment or significant amount of fuel
spilled, according to federal accident records
reviewed by the AP. The derailment Wednesday was the fifth this year and comes less than
a week after the Department of Transportation
announced a rule to toughen construction
standards for tens of thousands of tank cars
that haul oil and other flammable liquids.
FRA Administrator Sarah Feinberg said in
a statement that the accident was “yet another
reminder” of the need for changes that have
been resisted by the oil industry, which says
it will take years to get the unsafe tank cars
replaced or off the tracks.

Speaker Jim Wright
dies at age 92

bill that passed the House and Senate Tuesday
calls on Hawaii to use 100 percent renewable
energy by the year 2045. “This is going to be a
game changer for the energy sector across the
country,” said Rep. Chris Lee, who introduced
the proposal. The University of Hawaii would
be using 100 percent renewable energy by 2035
under another of Lee’s bills that’s now heading
to the governor.
SEX TRAFFICKING — The House and
Senate unanimously passed a bill banning sex
trafficking, moving Hawaii one step closer to
being the last state in the nation to put a sex
trafficking ban in statute. The bill calls for
a victim-centered approach that treats those
forced into prostitution as victims instead of
criminals.
RAIL TAX — A tax to fund Oahu’s planned
rail transit project could be extended under a
plan approved by the Hawaii Legislature. The
Former U.S. House Speaker Jim Wright, the
longtime Texas Democrat who became the first
House speaker in history to be driven out of
office in midterm, has died. He was 92.
The World War II veteran and author,
often praised for his eloquence and oratorical
skills, was living in a nursing home when he
died early Wednesday morning, according to
the Harveson and Cole funeral home in Fort
Worth. Funeral arrangements are pending.
Wright represented a Fort Worth-area congressional district for 34 years, beginning with
his election in 1954. He was the Democratic
majority leader in the House for a decade,
rising to the speakership in January 1987, to
replace Tip O’Neill.
Although three House speakers had resigned
before Wright stepped down in 1989, they all
served during the 19th century — and none
before him had been under fire and facing
judgment in the House for breaking its ethics
rules.
For nearly a year, the House Ethics Committee investigated Wright’s financial affairs at the
prodding of a little-known Georgia congressman, Republican Newt Gingrich, who publicly branded Wright a “crook.” The bipartisan
committee charged Wright with 69 violations
of House rules on reporting of gifts, accepting
gifts from people with an interest in legislation,
and limits on outside income.
The committee accused Wright of scheming
to evade limits on outside earnings by self-publishing a book, “Reflections of a Public Man,”
he then sold in bulk. He was also accused of
improperly accepting $145,000 in gifts over 10
years from a Fort Worth developer.
In response, Wright said he had not violated
any House rules and vowed to fight the charges. But his support among fellow Democrats
quickly eroded.
In a floor speech that ended with the
announcement of his resignation on April 30,
1989, Wright called for an end to “mindless

A copy of summary of a judgment that, when filed with the
appropriate public office, creates a lien on the judgment
debtor's non-exempt property.

A statutory lien that secures payment for labor or maerials
supplied in improving, repairing or maintaining real or personal property. The lien remains in effect until these people
have been paid in full and may, in the event of a liquidation
before they have been paid, give them priority over other
creditors.

create a lien against any property the taxpayer might or does

income tax.

constructed under a 2011 voluntary rail industry standard
intended to make them tougher than older cars that were long
known to pose a safety risk. But the new cars have proved equally
dangerous. The five major oil train accidents so far this year in
the U.S. and Canada all involved the newer cars, each of which
can hold about 30,000 gallons of fuel.
Roughly 22,000 of the cars are in service hauling crude oil
and must be retrofitted or replaced by 2020 under the new
federal rule. Cars hauling ethanol, another fuel involved in multiple accidents, have a longer timeline for replacement.
It was not immediately known if the oil had been processed
under the state’s new rules that were meant to reduce the
volatility of North Dakota crude by stripping out gases that can
easily ignite, Thompson said. North Dakota officials have said
the rules would make the volatility of treated oil comparable to
gasoline. Critics have said the state’s requirements were too lax
and insufficient to prevent major fires.

Tuesday that would extend the half-percent surcharge on the
state general excise tax for an additional five years. Neighbor
islands could get in on the taxing action by increasing their general excise tax by a half-percent to fund transportation projects
from 2018 to 2022.
HEALTH EXCHANGE — The Legislature decided to send
$2 million to the financially troubled health exchange, which
expects it could break even starting in 2022. All state-run
exchanges operating as part of President Obama’s Affordable
Care Act must be financially sustainable this year, so lawmakers felt compelled to support the institution instead of potentially leaving it vulnerable to a partial federal takeover. Some
lawmakers griped about giving the exchange more money, but
Sen. Rosalyn Baker said the exchange has improved under new
leadership.
STATE SPENDING — The Legislature approved the state’s
two-year $26 billion budget. House Finance Committee Chairman Sylvia Luke said her committee worked to limit growth
in spending, but Republicans in the Legislature said they’re
worried about looming deficits in upcoming years. The state
is spending more than it’s taking in and is chipping away at a
surplus that stood at about $665 million at the end of fiscal year
2014, but is expected to fall below $200 million at the end of fiscal year 2017, according to Wes Machida, director of the state’s
department of budget and finance.

His detractors contended that Wright resisted acknowledging
his ethically dubious actions.
The Wright episode proved to be a harbinger of the rising
partisanship within the House and the personal attacks between
House members that would mark the chamber for much of
the last quarter-century. Critics would say Wright himself had
helped fuel the ill will between the parties by generally ignoring Republicans as he and other Democrats tended to House
business.
House Republicans chose Gingrich as their whip just months
before Wright’s resignation, and the Georgia congressman later
became speaker for four years, beginning in 1995, until his own
ethical lapses led to his departure.
James Claude Wright Jr. was born in Fort Worth on Dec.
22, 1922, the son of a professional boxer-turned-tailor. After
the attack on Pearl Harbor in December 1941, he left college to
enlist in the U.S. Army and flew combat missions in the South
Pacific, earning the Distinguished Flying Cross and the Legion
of Merit.
He served in the Texas House for one term, and at age 26
became mayor of Weatherford, his boyhood hometown. He
served in that post for four years, from 1950 to 1954, before his
first congressional victory.
