Notification of Regulated Waste Activity
Information presented in this fact sheet is intended to provide a general understanding of the regulatory requirements governing conditionally exempt small quantity generators of hazardous waste. This
information is not intended to replace, limit, or expand upon the complete regulatory requirements found in Division 14 of the ADEM Administrative Code.
Companies in any of the seven categories listed below are required to submit a correct and complete ADEM
Form 8700-12, Notification of Regulated Waste Activity, (including all appropriate attachment pages and a
$180 fee) reflecting current waste activities to the Department annually
1) Hazardous waste generators that generate more than 220 pounds (100 kilograms) of hazardous waste
or more than 2.2 pounds (1 kilogram) of acute hazardous waste in any one calendar month during the
calendar year.
2) Active hazardous waste treatment, storage, or disposal facilities.
3) Hazardous waste treatment, storage, or disposal facilities that are undergoing corrective action,
closure, or post closure.
4) Hazardous waste transporters or transfer facilities.
5) Companies that generate or collect more than an average of 25 gallons per month of used oil (over 300
gallons per calendar year). Companies that do not generate used oil and only collect used oil from doit-yourself oil changers are exempt from having to file an annual notification.
6) Marketers, off-spec burners, transporters (off-site), or processor/re-refiners of used oil.
7) Hazardous waste generators (conditionally exempt small quantity generators) that generate less than
220 pounds (100 kilograms) of hazardous waste or less than 2.2 pounds (1 kilogram) of acute
hazardous waste in any one calendar month during the calendar year and wish to maintain an active
EPA ID number. Please note that if this is the only category your company is in (conditionally exempt
small quantity generator) you do not have to have an EPA ID number. However, if you wish to maintain
an active EPA ID number for your own reasons, you will be required to file an annual notification and
$180 fee.
The $180 total fee is per company site location, regardless of the number of categories your company falls
under.
If your company is no longer in one of the listed categories, but you still want to have an active EPA ID number,
please send in the completed, applicable 8700-12 notification form(s) with a short cover letter to the address
below. A $180 fee is required for this type of notification.
Also, If your company is no longer in one of the listed categories, and you no longer want to have an EPA ID
number, please send a letter stating this fact, to the address below, so that we can deactivate the ID number
assigned to your company. No fee is required for this deactivation.

Please be sure to include your completed applicable forms and check or money order in the same envelope
to the ADEM address given above.
Forms received without fees, fees received without forms, and incorrectly completed forms will be returned as
incomplete. Overdue and incomplete forms and fees may result in deactivation of your current EPA ID number.
The current ADEM Form 8700-12 notification forms and instructions are available at the following ADEM web

Please note that only the current version of the form set is acceptable for submittal.
If you do not have internet access, please call (334) 271-7700 to request mailing of the forms and instructions.
A new e-Permit online credit card payment and form submittal option is now available at URL
https://app.adem.alabama.gov/ePermit/Page/Entry/Login.aspx within the ADEM website or you may click on
“More Information” on the ADEM homepage, then “ePermit”. If the electronic submission of the forms and
credit card payment is not used, you must continue to mail the forms and payment.
Completion and submittal of a new set of forms and payment of a $180 fee is required each year in order to
maintain an active EPA ID number. Please refer to the table below to determine when the forms and fee must
