Notice to Bidders
Sand Lake Town Library – Main Room Renovation
The Sand Lake Town Library is soliciting sealed bids for the Main Room renovation, to their existing
Sand Lake Town Library facility, located at 8428 Miller Hill Road (NY Route 66), Averill Park, NY.
Prevailing wage applies to this project. The Sand Lake Town Library reserves the right to reject any
and all bids.
Interested bidders must submit sealed bids, with all bid requirements as listed in the bid packet, to the
Sand Lake Town Library Director, 8428 Miller Hill Road, Averill Park, NY 12018 on or before 2:00
PM on Monday, November 30, 2015, at which time all bids shall be publicly opened by the Library
Director.
Information and specifications for said renovation can be obtained from the Library Director’s office
or by visiting www.sandlaketownlibrary.org. The Sand Lake Town Library hours are listed as
follows: Monday-Thursday 11AM - 8PM, Friday 11AM - 6PM, Saturday 11AM - 4PM, and Sunday
1PM – 4PM. You may contact the Sand Lake Town Library Director by phone at 674-5050 or by

Instructions to Bidders
COPIES OF BID DOCUMENTS:
 A complete set of the Bid Documents as stated in the Bid Notice may be obtained from the Sand
Lake Town Library Director, as provided in the Bid Notice.
 Complete sets of Bid Documents must be used in preparing Bids; the Sand Lake Town Library
assumes no responsibility for errors or misinterpretations resulting from the use of incomplete
sets of Bid Documents.
 The Sand Lake Town Library makes copies of Bid Documents available on the above terms only
for the purpose of obtaining Bids for the Work and does not confer a license or grant for any
other use.
EXAMINATION OF BID DOCUMENTS AND SITE:
 It is the responsibility of each Bidder before submitting a Bid:
(a) To examine thoroughly the Bid Documents and other related data identified in the Bid
Documents;
(b) To visit the site to become familiar with and satisfy Bidder as to the general, local and site
conditions that may affect cost, progress, performance or furnishing of the Work;
(c) To consider federal, state and local Laws and Regulations that may affect cost, progress,
performance or furnishing of the Work;
(d) To study and carefully correlate Bidder's knowledge and observations with the Bid
Documents and such other related data; and
(e) To promptly notify the Sand Lake Town Library of all conflicts, errors, ambiguities or
discrepancies which Bidder has discovered in or between the Bid Documents and such other
related documents.
 On request, the Sand Lake Town Library will provide each Bidder access to the site to conduct
such examinations, investigations, explorations, tests and studies as each Bidder deems necessary
for submission of a Bid. Bidder must fill all holes and clean up and restore the site to its former
conditions upon completion of such explorations, investigations, tests and studies.

AVAILABILITY OF LANDS FOR WORK, ETC.
 Any land upon which the Work is to be performed and any rights-of-entry for access thereto and
other lands designated for use by Contractor in performing the Work and the limits of Work are
identified in the Contract Documents which will be provided by the Sand Lake Town Library.
All additional lands and access thereto required for temporary construction facilities, construction
equipment or storage of materials and equipment to be incorporated in the Work are to be
obtained and paid for by Contractor.
INTERPRETATIONS AND ADDENDA
 All questions about the meaning or intent of the Bid Documents are to be directed to Terrence

 Written questions should be emailed to Terrence Dingman at [email protected]
 Interpretations or clarifications considered necessary in response to such questions will be issued
by email to all parties having received the Bid Documents. Questions received less than two days
prior to the date for opening of Bids may not be answered. Only questions answered by formal
written Addenda will be binding. Oral and other interpretations or clarifications will be without
legal effect.
 Addenda may also be issued to modify the Bid Documents as deemed advisable by the Sand
Lake Town Library.
CONTRACT TERM
 The contract shall commence following approval by the Sand Lake Town Library and receipt of
satisfactory certificate of insurance. Work shall be completed within 30 days of the bid award or
as mutually agreed upon. If a prolonged period of inclement weather is experienced, a
reasonable extension of time shall be granted.
PREVAILING WAGE
 Prevailing Wage must be applied to this project. Certified Payrolls must be supplied before
payment will be released. Prevailing Wage schedule for Rensselaer County can be found at the
NYSDOL website by following the link below:

INSURANCE
 Before commencement of work, the Sand Lake Town Library shall be provided liability and
property damage insurance certificates insuring the winning bidder for a minimum amount of
$1,000,000, naming the Sand Lake Town Library as an additional insured. Certificates for
worker’s compensation shall also be provided to the Sand Lake Town Library for all workers
utilized for the project.
REFERENCES
 A minimum of three reliable business references shall be furnished with all bids, showing
adequate experience and reputation on other contracts performed of similar size and scope to this
bid project.

BID FORM
 Bids shall be accepted only on the attached Bid Forms, with proper signatures. The blank places
in the Bid Forms must be filled in as noted and no change shall be made in the phraseology of the
proposal or in the items mentioned herein. The specifications attached hereto are to be considered
as and shall form a part of the agreement.
 Each proposal shall specify the correct gross or lump sum and shall also specify the unit prices
for each of the separate items if called for in the proposal. In case the amounts shown in words
and the equivalents in figures do not agree, the written words shall be considered binding.
 Bids by corporations must be executed in the corporate name by the president or a vice-president
(or other corporate officer accompanied by evidence of authority to sign).
 Bids by partnerships must be executed in the partnership name and signed by a partner.
 Bids by limited liability companies must be executed in the LLC name and signed by a member,
duly authorized to do so.
 The Bid shall contain an acknowledgment of receipt of all Addenda (the numbers of which must
be filled in on the Bid Form).
 Evidence of authority to conduct business as an out-of-state corporation in the state where the
Work is to be performed shall be provided. State contractor license number, if any, must also be
shown.
SUBMISSION OF BIDS
 Bids shall be submitted at the time and place indicated in the Notice to Bidders and shall be
enclosed in an opaque sealed envelope, marked with the Project title and name and address of
Bidder and accompanied by other required documents. If the Bid is sent through the mail or other
delivery system, the sealed envelope shall be enclosed in a separate envelope with the notation
"BID ENCLOSED" on the face of it.
MODIFICATION AND WITHDRAWAL OF BIDS
 Bids may be withdrawn based upon unilateral error or mistake only in accordance with
subdivision 11 of Section 103 of the General Municipal Law.
 The sole remedy for a bid mistake shall be withdrawal as set forth above and in no case shall a
bid be amended or reformed.
OPENING OF BIDS
 Bids will be opened and (unless obviously non-responsive) read aloud publicly at the place where
Bids are to be submitted. An abstract of the amounts of the base Bids and major alternates (if
any) will be made available to Bidders after the opening of Bids.
BIDS TO REMAIN SUBJECT TO ACCEPTANCE
 All Bids whom the Sand Lake Town Library believes to have a reasonable chance of receiving
the award will remain subject to acceptance for thirty-five days after the day of the Bid opening.

AWARD OF CONTRACT
 The Sand Lake Town Library reserves the right to reject any or all Bids, and may reject a low bid
for good reason and choose another bidder based on experience and/or reputation. Including
without limitation the rights to reject any or all nonconforming, non-responsive, unbalanced or
conditional Bids and to reject the Bid of any Bidder if the Sand Lake Town Library believes that
it would not be in the best interest of the Project to make an award to that Bidder, whether
because the Bid is not responsive or the Bidder is unqualified or of doubtful financial ability or
fails to meet any other pertinent standard or criteria established by the Sand Lake Town Library.
The Sand Lake Town Library also reserves the right to waive all informalities not involving
price, time or changes in the Work. Discrepancies between the multiplication of units of Work
and unit prices will be resolved in favor of the unit prices. Discrepancies between the indicated
sum of any column of figures and the correct sum thereof will be resolved in favor of the correct
sum. Discrepancies between words and figures will be resolved in favor of the words.
 In evaluating Bids, the Sand Lake Town Library will consider the qualifications of Bidders, and
such alternates, unit prices, lump sum and other data, as may be requested in the Bid Form or
prior to the Bid Award.
 The Sand Lake Town Library may consider the qualifications and experience of Subcontractors,
Suppliers, and other persons and organizations proposed for those portions of the Work as to
which the identity of Subcontractors, Suppliers, and other persons and organizations must be
submitted. The Sand Lake Town Library also may consider the guarantees of major items of
materials and equipment proposed for incorporation in the Work when such data is required to be
submitted.
CONTRACT
 Upon award of Bid, the Bid Documents shall constitute the Contract.
 The specifications attached hereto are to be considered as and shall form a part of the agreement.
PRE-CONSTRUCTION CONFERENCE
 The successful bidder shall meet on site with the Sand Lake Town Library’s representative and
review methods and procedures related to all work to be performed under the project scope, prior
to start of project. This meeting will take place no later than two weeks prior to the start of
construction or no later than two weeks after bid award, whichever is earliest.
SALES AND USE TAXES
 The Sand Lake Town Library is exempt from State Sales and Compensating Use Taxes on
materials and equipment to be incorporated in the Work. Said taxes shall not be included in the
Contract Price.
PAYMENT
 Upon successful completion of project, the contractor will furnish invoicing and Certified
Payrolls to the Sand Lake Town Library. Invoices are to be sent to: Sand Lake Town Library,
Melinda Fowler, Library Director, 8428 Miller Hill Road, Averill Park, NY 12018. Certified
Payrolls must be submitted before payment will be released.

SCOPE OF WORK
Bidders shall provide all labor and materials for said renovations of the 46’ by 31’ Main Room per the
following specifications:











Contractor is responsible for the legal disposal of all debris associated with the scope of the work to be
completed outlined as follows;
o Surface mounted light fixtures
o Approximately 148 SY of carpeting
o Miscellaneous debris as required
o All debris shall be picked up at the end of each work day with special care taken to retrieve any
sharp objects that may puncture tires outside the Library.
Special Notes:
1. Town Hall Building Complex, which includes the Sand Lake Town Hall, Sand Lake Town
Library and NY State Police Sub-Station, will remain open during this project and execution of
this construction project shall be planned accordingly.
2. Removal of shelving, books, equipment, and furniture from the Main room will be by others.
Subfloor Repairs – Subfloor to be screwed down to eliminate squeaks, and minor repairs to be made as
required to support the application of carpeting.
Wall and door painting.
o Walls to be patched as required prior to painting
o Paint finishes to be used are as follows;
 Walls – Eggshell
 Doors – Semi-Gloss
o Coats to be applied;
 (1) – Primer
 (2) – Finished Coats
o Paint Color – To be specified by Library Director from samples provided by Contractor
Suspended Ceiling – Suspended ceiling system to be installed with fissured ceiling tiles to match
adjacent rooms (Children’s Room, Kennedy Room).
o Existing smoke detectors to be incorporated into new ceiling and mounted in an appropriate
manner to insure proper functioning.
Lighting – Purchase and install 18 low profile LED surface mounted lighting fixtures (1’ by 4’) using
prismatic lenses. Existing switching to be reused.
Computer Hook-Ups – Two power pools with 110 volt outlet and CATV wiring form monitor to be
provided in locations designated by the Library Director.
Circulation Desk – Floor Power and CATV outlets, along with phone jacks, to be provided for
Circulation Desk to support two computers, fax machine, and phone. Locations to be established at
time of construction. Circulation Desk to be purchased and supplied the Sand Lake Town Library.
Soffit – A soffit to match above Circulation Desk outline to be constructed along with wall section 4’
by 20” with oak cap in location adjacent to Circulation Desk with location to be established at time of
construction.
Work Station – Construct work station consisting of 1 18” base cabinet, and 60” laminate and support
brackets against outside wall positioned behind Circulation Desk.
Furnish and install 4 vertical blinds in windows designated by Library Director.
Furnish and install 148 SY of carpet tile along with all associated cove base. Carpet and coving to be
commercial grade product chosen from samples provided by Contractor.

IRANIAN ENERGY SECTOR DIVESTMENT
Certification Pursuant to Section 103-g of the New York State General Municipal Law
1.
Contractor/proposer hereby represents that said contractor/ proposer is in compliance with New York
State General Municipal Law Section 103-g entitled “Iranian Energy Sector Divestment”, in that said
contractor/proposer has not:
a)
Provided goods or services of $20 million or more in the energy sector of Iran including but not
limited to the provision of oil or liquefied natural gas tankers or products used to construct or
maintain pipelines used to transport oil or liquefied natural gas for the energy sector of Iran; or
b)
Acted as a financial institution and extended $20 million or more in credit to another person for
forty-five (45) days or more, if that person’s intent was to use the credit to provide goods or
services in the energy sector in Iran.

complied with subdivision (a) above, shall not be considered for award. In any case where the
bidder/proposer cannot make the certification as set forth in subdivision (a) above, the bidder/proposer
shall so state and shall furnish with the bid a signed statement setting forth in detail the reasons
therefore. The Sand Lake Town Library reserves its rights, in accordance with General Municipal Law
Section 103-g to award the bid/proposal to any bidder/proposer who cannot make the certification, on a

can be terminated upon a finding by any governmental agency that the undersigned is in violation of
applicable discrimination laws and that such finding will also disqualify the undersigned for future
contracts with the Library. The undersigned certifies to the Sand Lake Town Library that there is no
pending or outstanding decision, ruling or order against it finding the undersigned in violation of the
laws against discrimination.

HOLD HARMLESS
CLAUSE
The Agent shall at all times defend, indemnify and hold harmless the Sand Lake Town Library and
its employees from any and all claims, damages or judgments or for the defense or payment thereof,
based on any claim, action or cause of action whatsoever, including any action for libel, slander, or
personal injury, or any affiliated claims, by reason of any act or failure to properly act on the part of
Agent and in particular as may arise from the performance under this contract. Such obligation to
the Library shall not be construed to negate, abridge or reduce other rights of indemnity which
would otherwise exist. This provision shall supersede any other provision in this Agreement
deemed to be in conflict, unless specifically stated otherwise. In the event of an injury by the
subcontractor or its employees, they shall cause notice to be served up on the Library within
twenty-four (24) hours of any such injury.”
