Act No. 2, 1912. A n Act to sanction t h e c o n s t r u c t i o n of a line of railway from G a l o n g to B u r r o w a ; to a u t h o rise t h e c o n s t r u c t i o n of t h e said line on public roads ; to a m e n d t h e P u b l i c W o r k s Act, 1900, so far as it relates to t h e m a k i n g and m a i n t a i n i n g of fences along t h e said line ; to provide for t h e use of t h e said line b y t h e C o n s t r u c t i n g A u t h o r i t y , or b y p e r s o n s a u t h o r i s e d b y h i m ; and for o t h e r p u r p o s e s c o n s e q u e n t t h e r e o n or i n c i d e n t a l t h e r e t o . [28th March, 1912.] W H E R E A S in accordance with the provisions of the Public Works Act, 1900, the Legislative Assembly did, by resolution, declare that it was expedient to carry out a certain work, namely, the construction of a line of railway from Galong to Burrowa : And whereas on the passing of the said resolution, a statutory duty was by the said Act imposed on the Minister for Public Works to introduce a Bill into the said Assembly to sanction the carrying out of the said work : Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :— 1. This Act may be cited as the " Galons? to Burrowa Bailway Act, 1912." 2 . The carrying out of the said work (more particularly described in the Schedule to this Act is hereby sanctioned), and the Minister for Public Works, or the member of the Executive Council for the time being performing the duties of the said Minister, is hereby authorised to undertake and carry out the said work, subject to the provisions of this Act, and for that purpose shall be and shall have the powers and duties of, a Constructing Authority within the meaning of the Public Works Act, 1900. 3 . The plan of the said work is the plan marked " Galong to Burrowa Bailway," signed by the Minister for Public Works, and countersigned by the Chief Engineer for Bailway and Tramway Construction, and deposited in the public office of the said Minister. 4. 4 . The cost of carrying out the said work, estimated at eightyone thousand six hundred and seventy-five pounds, shall he defrayed from such loan votes as are now, or may hereafter be, applicable to that purpose, and shall not under any circumstances exceed the estimated cost by more than ten per centum. 5 . The said line of railway may be constructed on or along or by the side of any public road or highway. 6 . Notwithstanding the provisions of section eighty-four of the Public Works Act, 1900, the Constructing Authority shall not be required or compelled, nor shall it be the duty of the said authority to make or maintain any fence along the said line of railway for the accommodation of any person or for any purpose whatsoever ; but the said authority may in his discretion make and maintain such fence in connection with the said line of railway as he may think fit. 7 . The Constructing Authority and any person authorised by him may use the said line, or any part thereof, before it is transferred to the Chief Commissioner for Railways and Tramways, and for that purpose may run thereon any carriages or waggons propelled or drawn by any motive power. SCHEDULE. T H E proposed railway commences a t t h e north-western end of Galong S a t i o n on t h e G r e a t S o u t h e r n R a i l w a y , a t 215 miles 72 chains 83 links from Sydney, and in proceeding in a generally n o r t h e r n direction to about 220 miles, crosses t h e m a i l road to H a r d e n , and follows its eastern side for a b o u t a mile, and crosses Limestone Creck. F r o m 220 miles it t i k e s a north-easterly b e a r i n g for a b o u t 2 miles, and crosses Wellsinker's Creek. Thence the line proceeds slightly west of n o r t h to 225 miles, crosses F o u r a n d F i v e Mile Creeks, a n d traverses t h e head of F l a t Rock Creek on its left side. I t then t a k e s a generally north-easterly course, on t h e south-eastern side of t h e main H a r d e n - B u r r o w a road, crosses it a t about 227 miles, follows t h e n o r t h - w e s t e r n side of t h a t road for a b o u t 1 / miles, crosses Corcoran's Creek, and descends its r i g h t b a n k for a b o u t a mile, crosses B u r r o w a R i v e r near its confluence w i t h t h a t creek, a p p r o x i m a t e l y 3 / miles beyond which it reaches the s o u t h e r n b o u n d a r y of t h e t o w n of B u r r o w a , curves nearly d u e n o r t h , a n d t e r m i n a t e s in t h a t t o w n s h i p near R y a n ' s Creek a t 233 miles 56 chains 83 links from Sydney, being a total distance of 17 miles 64 chains, a n d subject to such deviations a n d modifications as m a y be considered desirable by t h e C o n s t r u c t i n g Authority. 1 2 1 2 Act
