out an e x c h a n g e of certain land a b u t t i n g on
such lane for other land at t h e i n t e r s e c t i o n
of G e o r g e - s t r e e t w i t h Martin-place, to be
dedicated as a public t h o r o u g h f a r e ; and for

H E R E A S it is e n a c t e d b y t h e G e n e r a l Post Office ( A p p r o a c h e s
I m p r o v e m e n t ) A c t , 1889, t h a t c e r t a i n lands i n t h e city of
S y d n e y t h e r e i n described shall be vested i n t h e M i n i s t e r for P u b l i c
W o r k s a n d his successors as a corporation sole on behalf of H e r l a t e
M a j e s t y for a n a b s o l u t e estate in fee-simple in possession, a n d t h a t
such l a n d s m a y after t h e formation of a p u b l i c street be sold by
p u b l i c a u c t i o n : A n d w h e r e a s it is e n a c t e d by t h e G e n e r a l P o s t
Office ( A p p r o a c h e s I m p r o v e m e n t ) A c t A m e n d m e n t A c t , 1892, t h a t
c e r t a i n p o r t i o n s of l a n d described in t h e F i r s t S c h e d u l e t h e r e t o are

M a r t i n - l a n e aforesaid : A n d whereas t h e b o u n d a r y line of M a r t i n - l a n e
at a n d a b o u t t h e p o i n t w h e r e t h e e n t r a n c e to t h e said s u b w a y opens
o u t u p o n t h e s a m e is i r r e g u l a r a n d i n c o n v e n i e n t for b u i l d i n g purposes
a n d o u g h t t o be rectified : A n d whereas t h e said b a n k is willing to
s u r r e n d e r for u s e as a p u b l i c t h o r o u g h f a r e a portion of t h e l a n d sold
to it as aforesaid a n d s i t u a t e a t t h e i n t e r s e c t i o n of George-street w i t h
M a r t i n - p l a c e in e x c h a n g e for a portion of l a n d p a r t l y i n c l u d e d in a n d
p a r t l y a b u t t i n g on M a r t i n - l a n e a t a n d a b o u t t h e e n t r a n c e to t h e said
s u b w a y , a n d it is e x p e d i e n t t h a t t h e proposed e x c h a n g e should be

1. This Act
m a y be cited as t h e " G e n e r a l P o s t Office
(Approaches Improvement) Act F u r t h e r A m e n d m e n t Act, 1901."

3. So m u c h of t h e P r i n c i p a l A c t a n d t h e A m e n d m e n t A c t as is
i n c o n s i s t e n t w i t h this A c t is h e r e b y repealed.
4. T h e c o n s t r u c t i o n of t h e said s u b w a y is h e r e b y a u t h o r i s e d
and validated.
5. (1) T h e F i r s t S c h e d u l e to t h e A m e n d m e n t A c t is h e r e b y
a m e n d e d b y s u b s t i t u t i n g t h e description of t h e a m e n d e d b o u n d a r i e s of
M a r t i n - l a n e set forth in S c h e d u l e A to t h i s A c t in lieu of t h e descrip­
t i o n of t h e b o u n d a r i e s of M a r t i n - l a n e set forth in t h e F i r s t Schedule
to t h e said A m e n d m e n t A c t .
(2) T h i s section shall t a k e effect a n d be c o n s t r u e d as if it
h a d b e e n e n a c t e d i m m e d i a t e l y after t h e p a s s i n g of t h e A m e n d m e n t
Act.
6. A l l t h a t p o r t i o n of l a n d described i n t h e S c h e d u l e B to t h i s
A c t shall b e a n d is h e r e b y v e s t e d in t h e B a n k of A u s t r a l a s i a a n d its
successors for a n e s t a t e in fee-simple in t h e s a m e m a n n e r a n d to t h e
s a m e e x t e n t as if it h a d been i n c l u d e d in t h e m e m o r a n d u m of transfer
to t h e said b a n k u n d e r t h e P e a l P r o p e r t y A c t a n d h a d passed t h e r e ­
u n d e r , b u t r e s e r v i n g u n t o H i s M a j e s t y t h e K i n g t h e exclusive use a n d
e n j o y m e n t of t h e s u b w a y c o n s t r u c t e d t h r o u g h t h e said l a n d e x t e n d i n g
t o M a r t i n - l a n e from t h e face of t h e n o w e x i s t i n g r e t a i n i n g wall on t h e
n o r t h side of M a r t i n - p l a c e in a direction a t r i g h t a n g l e s to a n d across
t h e p a v e m e n t a n d across p o r t i o n of t h e l a n d sold to t h e b a n k a n d
u n d e r n e a t h t h e s a m e , t o g e t h e r w i t h t h e r i g h t t o H i s M a j e s t y to do all
t h i n g s necessary in c o n n e c t i o n w i t h t h e r e p a i r a n d m a i n t e n a n c e of.
such subway.
7. F r o m a n d after t h e c o m m e n c e m e n t of t h i s A c t all t h a t
p o r t i o n of l a n d described in S c h e d u l e C to t h i s A c t shall b e a n d is
h e r e b y dedicated to public u s e as a p u b l i c t h o r o u g h f a r e to f o r m p a r t
of G e o r g e - s t r e e t a n d M a r t i n - p l a c e , a n d shall, u p o n t h e p u b l i c a t i o n in
t h e G a z e t t e of a p r o c l a m a t i o n b y t h e Governor, b e c o m e vested in t h e
M u n i c i p a l Council of t h e City of Sydney in t h e s a m e m a n n e r a n d
subject to t h e s a m e conditions a n d obligations as in t h e case of o t h e r
p u b l i c h i g h w a y s of t h e said c i t y .

8. I t shall h e lawful for t h e R e g i s t r a r - G e n e r a l to a m e n d t h e
deposited p l a n w h i c h has been lodged b y t h e M i n i s t e r in r e s p e c t of t h e
subdivision of C r o w n l a n d in M a r t i n - p l a c e a n d M a r t i n - l a n e for t h e
p u r p o s e of rectifying t h e b o u n d a r i e s shown t h e r e o n in accordance
w i t h t h i s A c t ; also to call i n a n d cancel a n y certificates of title issued
i n favour of t h e said B a n k of A u s t r a l a s i a in respect of t h e lands sold
a n d t r a n s f e r r e d to t h e b a n k as aforesaid, a n d to issue to t h e said b a n k
one or m o r e certificates of title in lieu thereof a m e n d e d in accordance;
