Overarching Section 75 Agreement – Collaborative working
TITLE
agreement relating to the establishment and management of
jointly commissioned services pursuant to section 75 of the
National Health Service Act 2006

Barnet has worked on integrated health and social care
services for some time: defining a local vision for
integration; agreeing a Concordat for Integration with
Barnet commissioning and provider partners; and setting up
an integrated care programme, reporting to the Health and
Wellbeing Board (HWBB).
Section 75 allows Local Authorities and National Health
Service (NHS) bodies to enter into partnership
arrangements in relation to certain functions, where these
arrangements are likely to lead to an improvement in the
way in which those functions are exercised.

Overarching Section 75
Barnet Council and NHS Barnet CCG entered into a
Collaborative Working Agreement dated 16 August 2013 for
integrated health and social care, relating to the
establishment and management of jointly commissioned
services. This is an overarching agreement for joint
working.
Speech and Language Therapy
Barnet Council and NHS Barnet CCG entered into a
Section 75 agreement inApril 2014
Occupational Therapy
Barnet Council and NHS Barnet CCG entered into a
Section 75 agreement in April 2013
Looked after Children
Barnet Council and NHS Barnet CCG entered into a
Section 75 agreement in April 2013
Under the approved Scheme of Delegation for Education
and Skills/Family Services, as found on the council’s
website, the Commissioning Director, Children and Young
People has the power to ‘Enter any S75 agreement with
Health Partners and monitor arrangements and agreement
and management of S75 agreement. This report authorises
the Council to enter into Deeds of Variation, in line with the
Council’s Contract Procedure Rules, covering:
This DPR seeks approval to:

Extend the overarching Collaborative Working
Agreement to continue indefinitely and extend the
S75 agreements for the following services:
Speech and Language Therapy

Extending the end date to March 2019 with the
estimated annual pooled fund of £2,053,635. The
London Borough of Barnet contribution is £403,635
and Clinical Commissioning Group contribution is
£1,650,000.
Occupational Therapy

Extending the end date to March 2019 and the
estimated annual pooled fund of £401,000. The
London Borough of Barnet contribution is £60,000
and Clinical Commissioning Group contribution is
£341,000.
Looked after Children

Extending with the end date to March 2019 and the
estimated annual pooled fund of £131,941. The
London Borough of Barnet contribution is £40,838
and Clinical Commissioning Group contribution is
£91,103.
The London Borough of Barnet contributions are funded
within the existing relevant budgets.
Section 75 agreements are overseen by the Council and
CCG’s Joint Commissioning Executive Group.

Summary Delegated Powers Report (DPR) – Guidance Notes
How do I complete a Summary DPR?



Give the decision an appropriate title. This is how the decision will be referred to
when published.
Decision taker. The name of the authorised person within the service area who, under
the Scheme of Delegation set out in the Constitution, is taking the decision.
Summary of decision. Include all information relevant to the decision. The headings
below are for guidance only; it is not necessary to include information under all of
these headings, only those support the decision being taken:- Relevant previous decision(s);
- Corporate priorities and policy considerations;
- Risk management issues;
- Equalities and diversities issues;
- Use of resources implications;
- Legal issues;
- Constitutional powers / delegated power being exercised;
- Background information; and
- Background documents



Audit trail of decision. The self-assurance process is designed to enable those
empowered to take decisions to do so without unnecessary bureaucracy. However,
this does not negate the need for accurate and appropriate record keeping within
your service area. A central record of the decision (including any advice received)
should be retained in your service area for future inspection (e.g. for audit/FOI
requests).
Decision Taker’s Statement. Statement to confirm the decision taker has fulfilled their
duty to provide relevant and accurate information and has included senior
management team sign off. In producing this self-assurance statement it is the
