INTRODUCTION
Patientsinjuredbyprescriptiondrugssometimesclaimthattheirpharmacistshadadutytowarnthemabout
potentialsideeffectsandotherdangersassociatedwithprescriptiondrugs.Thismemorandumprovidescitations
tocourtdecisionsfromacrossthecountrythataddresstheissueofwhetherandwhenpharmacistshaveadutyto
warn.
Mostcourtshaveruledthatpharmacistsdonothaveageneraldutytowarnpatientsabouttheirprescribed
drugs.Instead,thegeneralruleisthatdrugmanufacturershaveadutytoprovidegeneralwarningstophysicians,
andthenphysicianshaveadutytowarntheirpatientsaboutthedrugstheyprescribe.Mostcourtsimposethis
dutytowarnonphysicians,ratherthanpharmacists,becausephysiciansdecidewhichdrugstoprescribe.
Physiciansknowwhichwarningsareappropriateforaparticularpatientbecausetheyhaveaccesstothepatient’s
completemedicalhistory.This“learnedintermediarydoctrine”isthetraditionalrationaleforrejectingclaims
thatpharmacistshaveadutytowarn.
Afewstatecourtshaverejectedthelearnedintermediarydoctrine,andhaveinsteaddecidedthatpharmacistsdo
haveageneraldutytowarnpatients.Althoughmostcourtsthathaveconsideredtheissuerejectthenotionthat
statecounselinglawscreateadutytowarn,aminorityofcourtshavepointedtocounselinglawsasevidencethat
pharmacistshaveadutytowarn.
Othercourtshaveheldthatpharmacistshaveadutytowarnonlyincertaincircumstances.Forexample,some
courtshaveruledthatpharmacistshaveadutytowarnaboutknowncontraindications,orclearerrorsontheface
ofaprescription(e.g.,excessivedosages).Othercourtsrejectthenotionofageneraldutytowarn,butholdthat
apharmacycanvoluntarilyassumeadutytowarn.Forexample,apharmacythatadvertisesitsdrugutilization
reviewandcomputerwarningsystemsmayhaveassumedadutytowarnaboutdangeroussideeffects.
