Sm,-With reference to my Circular Despatch of
the 2nd August, 1876, I have the honor to transmit
to you, for publication in the Colony under your
Government, a copy of an Order of the Queen in
Council (13th August, 1877), for giving efl'ect to a
Declaration conclnded between the Government of

Her Majesty and the Government of His Majesty
the King of the Belgians on the 23rd July last,
extending the provisions of the Extradition Treltty
of the 20th May, 1876, to certain additional crimes.
'1'he Declaration will come into operation on the
27th of this month.

PRESENT:
The Queen's ]}'[ost Excellent Majesty in Council.
'l:}[THEREAS by an Act of Parliament made and
passed in the Session of Parliament holden in
the thirty-third and thirty-fourth years of the reign
of Her Present Majesty, intituled "An Act for
amending the law relating to the Extradition of
Criminals," and also by an Act of Parliament made
and passed in the Session of Parliament holden in the
thirty-sixth and thirty-seventh years of the reign of
Her present Majesty, intituled "An Act to amend
the Extradition Act, 1870," it was amongst other
things enacted, that where an arrangement has been
made with any foreign State with respect to the
surrender to sllch State of any fugitive criminals,
Her Majesty may, by Order in Council, direct that
the said Acts shall apply in the case of such foreign
State; and that Her JYIajesty may, by the same or
any subsequent Order, limit the operation of the
Order, and reshict the same to fugitive criminals
who are in or suspected of being in the part of Her
lYIajesty's dominions specified in the Order, and
render U,e operation thereof subject to such conditions, exceptions, and qualifications as maybe
deemed expedient:
And whereas a Treaty was concluded on the 20th
clay of TlIay, one thousand eight hunched and seventysix, between Her Majesty and the King of the
Belgians, for the Mutual Extradition of Fugitive
Criminals, to which Treaty the above-mentioned
Acts of Parliament were applied by an Order in
COllncil of the twenty-first day of July, one thousand
eight hundred and seventy-six:

twenty-third day of July, one thousn,nd eight hundred and seventy-seven, between the Government
of Her lIfajesty n,ud the Government of His Majesty

crimes, which decln,mtion is in the terms following:The Government of Her Mn,jesty the Queen of the
United Kingdom of Great Britain n,nd Ireland, n,nd
the Government of His l\bjesty the King of
the Belgians, having judged it expedient, with the
view to the more complete prevention of crime
within their respective territories, thn,t persons
charged with or convicted of certain crimes in
addition to those enumerated in Article I of the
Trcn,ty between Great Britn,in n,nd Belgium for the
mutual surrender of fugitive criminals of the 20th of
May, 187G, shall, und81'- the provisions of that 'l'reaty,
be reciprocally delivered up, hn,ve n,greed n,s
follows:Persons charged n,s principn,ls or n,ccessol'ies with
or convicted of the umlermentioned crimes committed in the territories of the one Party n,nd who
shall be found within the territories of the other
Pn,rty, shall be reciprocn,lly delivered np to each
other under the circumst8~nces and conditions stated
in the 'l'ren,ty between Great Britain and Belgium
for the mntun,l surrender of fugitive criminals, of
the 20th lI'by, 187G:L Administering drugs or using instruments with
intent to procure the miscarrin,ge of women.
2. Bign,my.
3. Abandoning children, exposing or unlawfully
detn,ining them.
4. Any malicious Act done with intent to endn,nger
persons in a rn,il wn,y train.
5. Receiving any chattel, money, vahmble security,
or other property, knowing the same to have been
embezzled, stolen, or feloniously obtained.
The provisions of the prescnt Decbmtion shall
come into force ten days after its publicn,tion, in conformity with the forms prescribed by the In,ws of the
High Contmcting Parties.
In witness whereof, the Undersigned have signed
the present Declaration, and have n,ffixed thereto the
sen,ls of their arms.

thousand eight hunched and seventy-seven, the sn,id
Acts slmll apply in the cn,se of the said Declamtion
with the G()vernment of His ]\bjesty the King of
the Belgin,ns n,s fully to all intents and purposes as
in the case of the srud recited Tren,ty.

The Government do not himl themselves to
accept the lowest or any tender, and will reqnire
the guarantee of two responsible persons for
the dne performance of the Contract.
