Reported: 01/10/2017. I (Officer J. Brewer) was dispatched to 1141 Millbrook Court in regards to a motor vehicle accident with unknown injuries. Dispatch advised a car had rammed another car into a building. While enroute, another caller from 1146 Millbrook Court stated a drunk person had wrecked their vehicle into his car and his apartment. Upon arrival, I observed a silver 2009 Toyota Corolla crashed, facing south, into 1146 Millbrook Court with heavy rear end damage. The Toyota Corolla was owned by VI #1, Shannan Sathers. EFD was already on scene and stated the Toyota Corolla had been rear ended by a Jeep Wrangler and pushed into the apartment building. I located a red 2011 Jeep Wrangler Sport parked, facing north, in front of 1139 Millbrook Court. There was glass on the rear bumper and tire marks on the pavement leading to the Toyota Corolla. WI #1, Olivia Sease, approached EFD and me and said the offender had dropped a bag on her front steps. I checked the bag and located a brown wallet with the offenders identification, Brandon Everly. The bag also contained an unopened bottle of Maker`s Mark Whisky (200mL) and an unopened bottle of Orval Trappist Ale (11.2oz). Sease stated she was inside her apartment (1139 Millbrook Court) when she heard the accident. She ran outside and observed Everly pulling his Jeep forward from the Corolla. She didn`t think he would stop so she started yelling at him. Everly stopped, got out of the Jeep and started to look around. Sease asked, "Do you know what you just did?" Everly responded, "uh, uh, uh" and started to walk up to her apartment. Sease told Everly to stop as he approached. Everly told her, "I`m going inside to get my registration." Sease replied, "no you don`t live here." Everly told Sease that he lived on Wimbledon and she explained to him that it was the next street over. At that point, Everly walked toward Wimbledon Court. Sease advised Everly left the bag on her front steps at some point during their conversation. She also advised he was not wearing shoes. Officer E. Kitzinger and I knocked on the front door of 1143 Wimbledon Court. After a few moments, Everly answered the door. He was not wearing shoes. Officer E. Kitzinger asked Everly, "where is your Jeep at?" Everly responded, "yeah, it`s over there." Officer E. Kitzinger asked, "over where?" Everly replied, "yeah, it`s over there. I backed it into somebody." At that point, I placed Everly into double-locked handcuffs. Once in handcuffs Everly started crying and voluntarily stated, "I`ve got an alcohol problem, please." I read Everly his Miranda Warning. He acknowledged he understood his rights and nodded his head "yes" that he wanted to continue to speak with me. However, Everly refused to answer questions I asked. I asked Everly if he had any insurance on the Jeep. He started to answer and then declined because he didn`t want to talk about it. Afterward, he requested his lawyer. Everly had a prior conviction for operating without proof of insurance per Docket #: 82D05-1203-CM-01561. When contact was made with Everly he smelled heavily of the odor of alcoholic beverage, his eyes were red/watery, his face was red and his speech was slow. He was placed into the rear seat of my patrol car (1612) and transported to the VCCC. Due to previously fleeing the scene of the accident I postponed Standard Field Sobriety Tests (SFST`s) until arrival at the VCCC. Everly`s vehicle was towed from the scene via Tri-State Towing. The apartment building at 1146 Millbrook Court received damage to the downspouts and there was a crack in the brick. Sather`s vehicle sustained heavy front end and rear end damage. No injuries were reported. An accident report was completed (See Accident #: 17-00638). The victim stated that she and her ex-husband, the suspect, have been attempting to reconcile and that he has been living at her residence for the past two months. Tonight, he arrived home about 2330 hrs and was intoxicated. The victim told him that she was tired of his drinking and wanted him to leave. He became irate. In the presence of their 8 year old daughter, he picked up the microwave oven from the counter and threw it down the stairs. He then swiped across the top of the refrigerator; knocking numerous items onto the floor including a ceramic piggy bank which shattered. After he went out the front door, she locked it. He broke the window out of the storm door attempting to get back in. As he reentered the residence, he kicked the window frame across the living room. The window impacted the wall and damaged the dry wall. The victim was visibly upset and in fear for her safety and that of her 8 year old daughter. The suspect was walking away from the residence as officer arrived. He admitted that he had been drinking and was going to stay at his grandmother’s house because he and his ex-wife had been arguing. Officer observed the damage to the residence. The victim just wanted the suspect to leave. The victim was provided a case number and telephone number to the record`s dept. She was advised to file for a protective order as well as eviction papers as soon as possible. The suspect got a ride from a friend and left for the night. Upon arrival I met with the reporter that stated the child had told him the house where she lived. The witness stated that he attempted to make contact with someone at that residence with negative results. He could see that there were additional children inside. The front door was ajar, but did not want to enter. I was able to make contact with resident and mother of the child that stated she had been asleep and the child must have exited the front door on her own. I explained to the mother(IO) that she needs to make arrangements for another person to sit with the children if she is not going to be available for them. I also recommended locks for the doors. The mother stated she has had prior cases with CPS and provided her case workers name (Heather Beamis). I have contacted and left a message for that case worker to contact me in reference this incident. The mother stated that she has four children and five large dogs. When he confronted her, the person she was with did not stop. The suspect did return into the store with loss prevention, and they recovered the items. The suspect went into the office because she thought they were just going to ban her, but when she found out the police were called, she fled. They believe she got into a vehicle with the other person who was with her. The Dorsey`s purchased the gift cards then could not reach the suspect via phone so they went the Henderson County Jail to give them to their grandson in person. The victim, Russell Paschall, was sitting in a chair in the living room. I observed him to have a cut under his left eye and it was bleeding. K9 Officer J. Matthews spoke with Paschall while I spoke with the offender, IO #1 and IO #2. While speaking with the offender I observed a rifle laying on the ground under a box. He advised it was an air soft rifle. I checked the rifle and confirmed it was not real. The offender admitted to punching Paschall and causing the injury. Amanda advised the incident started last night when Matt just lost control in front of their 3 children and began to assault her, a report was taken then. Reported: 01/11/2017. CONDIFF, M. V. Officer Condiff and myself were dispatched to Buffalo Wild Wings in reference to a hit and run. Upon arrival, I saw a Ford Mustang with several individuals standing around it. The Mustang was facing south in the row of spots directly in front of the store with damage to the driver side door. There was a silver colored paint left behind on the blue Mustang where the damage was. It was parked six spots down from the front row of spots to the store and in the most south end parking spot of the row (2 parking spots per row). I spoke with the victim, Jason Arvin, who advised his car had been hit and 2 females put information together to identify the suspect. I then spoke with the female that witnessed the incident. I identified her by her KY license as Courtney Embry. She explained that she saw a silver 4 door Grand Am or Grand Prix that was also facing south, pull out of its spot and pulled forward at an angle and struck the Mustang. She explained that it had a white plate and appeared as if the same type of plate as the victim vehicle (PC Passenger plate). The suspect then backed up, stepped out and assessed the damage on the Mustang. He then looked around as if to check if anyone saw and then got back in his vehicle and left, Embry explained. I asked what time this approximately happened and Embry stated around 00:15. I asked her where the suspect vehicle was and she pointed out the 4th spot from the front row spots in the north end spot in the row. She then explained she told the staff and while speaking with another female worker, they tied information together. After Embry explained what the suspect looked like, the bartender at Buffalo Wild Wings, Mackenzie Pruiett was able to identify the suspect.She said he currently works at Biaggi`s and currently comes in and she serves him. She pulled his credit card receipt from the night of the incident and then pulled him up on Facebook. Pruiett then showed Embry a photo of Nulton and Embry confirmed it was him that hit the vehicle and left.
