I n t ro d u c t i o n
The Food Safety Authority of Ireland Act 1988, facilitated the establishment of the Food Safety
Authority of Ireland (FSAI) to perform the functions assigned to it by this Act. The principle
function of the Authority shall be to take all reasonable steps to ensure that:
(a) food production in the State (whether or not distributed or marketed in the State), and
(b)food distributed or marketed in the State,
meets the highest standards of food safety and hygiene reasonably available. It shall, in
particular, take all reasonable steps to ensure that such food complies:
1) with any relevant food legislation in respect of food safety and hygiene standards, or
2) in the absence of any such legislation, with the provisions of generally recognised standards or
codes of good practice aimed at ensuring the achievement of high standards of food hygiene
and food safety.
The FSAI believes that Guidance Notes have a major role to play in helping both the regulators
and the food industry achieve a higher degree of compliance with Regulations and with good
practice generally.A good, well prepared, Guidance Note must, if it is to achieve these objectives,
provide regulators and industry alike with clear guidance on the application of the relevant law.
While a Guidance Note is not, of course, a substitute for the Regulations, the FSAI believes that
adherence to it should make compliance easier by providing the basis for a high degree of
consistency in application of those Regulations. In other words, the FSAI believes that a good
Guidance Note will enhance respect for and compliance with the law and that all parties,
especially consumers, will benefit.
We hope this series of Guidance Notes will meet the aims we have set out here and that they
will contribute to the development of the high standards we aim to achieve in the food inspection
service.
This document should be used as a guide when classifying food samples, submitted for
microbiological and/or chemical analysis to the official food control laboratories by authorised
officers. Classification of food samples into discrete categories will facilitate the health boards and
laboratories in the completion of their returns to the Food Safety Authority of Ireland, under the
terms of the service contracts1. In turn, this will enable the completion of official statistical returns
to the European Commission.The segregation of food into discrete categories and will also allow
for a more in-depth analysis of these returns. Such information may prove valuable in the design
of sampling programmes and trend spotting, with the overall intention of providing optimal data
for the protection of the consumer.

Purpose
To standardise the recording of the particulars of a foodstuff submitted for testing by an
authorised officer to the official laboratories.The standardised information will enable the correct
completion of official statistical returns and clearer identification of food safety issues.The coding
system is important to enable electronic capture of information in a database form at a
national level.

Samples are classified by EU category as defined by the European Communities2. In this
classification system, each of the 21 categories are coded using an EU category code (01-21). EU
categories and their associated codes are listed in Table 1.
Many products are easy to classify, however this is not always the case. Ambiguities may arise in
certain instances. This is particularly the case with multi-component products containing food
components from a number of different categories e.g. soft drinks containing yoghurt, products
containing eggs and cereal, products containing meat and eggs, products containing fish and
eggs, etc.
To clarify these issues a set of criteria has been developed to describe each EU category (see
‘Category Criteria’) and most products may be categorised using these criteria.The decision tree
shown in Figure 1 should be applied if difficulty arises when classifying food samples.
NOTE: There are multi-component products that are not classified using the decision tree. For
this reason it is important to read the criteria for each category as detailed in ‘Category Criteria’,
where all exceptions are noted.
For assistance, example products are also listed in Appendix 1.

EU Category Code 1 - Dairy Products
This category should be used for food samples that comply with the following definition:
"Milk products namely products exclusively derived from milk, it being accepted that
substances necessary for their manufacture may be added provided that these substances
are not used to replace in part or in whole any milk constituent, and composite milk
products, namely products of which no part replaces or is intended to replace any milk
constituent and of which milk or a milk product is an essential part, either in terms of
quantity or characterisation of the product".3
Cheese, dairy fats, ice cream, milk and yoghurt should be categorised as Dairy Products.
Important Note:
Products which contain only a minimal amount of milk or milk product would not be
regarded as a milk product e.g. milk chocolate and drinks containing yoghurt. However, if
the milk or milk product determines the character of the final product and it could not be
made without the milk ingredient, then the product is regarded as a milk product e.g.
cheeses and pre-prepared drinks made up with milk.

EU Category Code 2 - Eggs and Egg Products
This category should be used for food samples that comply with the following definitions:

Eggs:
"eggs in shells as laid by a hen, duck, goose, turkey, guinea fowl or quail".

Egg products:
"the content of eggs, as whole egg or only the yolk or only egg albumen or a mixture of
yolk and albumen in liquid, frozen or dried form, single or in combination with other foods
or drinks to a minimum content of 50% egg product".4
Important note:
If a product contains less than 50% egg product, as can be reasonably determined, then it
should not be categorised as an egg product.
Clarification:
The following inclusions and exclusions are applicable:

Prepared dishes such as omelettes

Eggs in mayonnaise, commonly referred to as "egg mayonnaise”

EU Category 3 - Meat and Meat Products, Game and Poultry
This category should be used for food samples that comply with the following definitions:
Meat:
"all parts of domestic bovine animals, swine, sheep, goats and solipeds which are suitable for
human consumption".5
"meat, including meat vacuum-wrapped or wrapped in a controlled atmosphere which has
not undergone any treatment other than cold treatment to ensure preservation".6
Poultry meat:
"all parts fit for human consumption of the following species: domestic fowl, turkeys, guineafowl, ducks and geese".7
"meat which is vacuum-wrapped or wrapped in a controlled atmosphere, which has not
undergone any preserving process other than chilling or freezing".8
Game:
"all parts of domestic rabbit which are fit for human consumption".9
"land mammals, or birds, which are not considered as domestic" and not referred to in the
definitions of meat and poultry above "but which are farmed as domestic animals".10
“wild land mammals which are hunted (including wild mammals living within an enclosed
area under conditions of freedom similar to those enjoyed by wild game) and wild birds
which are not covered by the definitions of meat, poultry meat, rabbit meat and farmed
game above.”11

Meat Products:
"products prepared from or with meat which has undergone treatment such that the cut
surface shows that the product no longer has the characteristics of fresh meat".12
"meat to which foodstuffs, seasonings or additives have been added or which has undergone a
treatment insufficient to modify the internal structure of the meat and thus to cause the
characteristics of the fresh meat to disappear".13
"meat which has been minced into fragments or passed through a spiral-screw mincer".14
For the purposes of this document "meat products" may contain meat from mammals, poultry
meat or game meat as defined previously.

The following inclusions and exclusions are applicable:
Inclusions
• All products containing meat (except products appearing in Category 6 (Soups, Broths and
Sauces)) and Category 17 (Prepared Dishes) which have not been classified as "Egg and Egg
Products”. Examples include meat pies, pizza containing meat, cooked meats and cured meat
products, sausages, burgers (without a bun), breaded chicken, flash fried meat/meat products
that are not fully cooked
• Gelatin.

• Soups and sauces are classified as Category 6
• Sandwiches (including cooked burgers with buns) classified in Category 17 irrespective of

This category should be used for food samples that comply with the following definitions:
Fishery:
"all seawater or freshwater animals or parts thereof, including their roe, excluding aquatic
mammals, frogs and aquatic animals covered by other community Acts".15
"any fishery product which has undergone an operation affecting anatomical wholeness, such
as gutting, heading, slicing, filleting, chopping, etc".16
"any fishery product which has undergone a chemical or physical process such as heating,
smoking, salting, dehydration or marinating, etc., of chilled or frozen products, whether or not
associated with other foodstuffs, or a combination of these various processes". 17
Clarification:
The following inclusions and exclusions are applicable:
Inclusions
• All products containing fish (except products appearing in Category 6 and Category 17), which
have not been classified as "Egg and Egg Products" and which have not been classified as "Meat
and Meat Products, Game and Poultry". Examples include fish pies, pizza containing fish, cooked
fish, battered fish and fish fingers. Soups and sauces are not included in this category.They are
classified in Category 6 (Soups, Broths and Sauces).
