--------------------------------------- INTRO: 2/14/2011 Adopted: 212812011 TOWNSHIP OF FAIRFIELD ORDINANCE #2011-05 AN ORDINANCE AMENDING CHAPTER 4 GENERAL LICENSING OF THE CODE OF THE TOWNSHIP OF FAIRFIELD REGARDING SECTION 4-11 BINGO, RAFFLES AND GAMES OF CHANCE WHEREAS, the Governing Body of the Township of Fairfield finds it necessary to amend Chapter 4 Section 4-11 regarding Off-Premises and On-Premises fees and to add a new sections to Chapter 4 Section 4-11 regarding Instant Raftle Games, Calendar Raftle, Casino Night, Off-Premises Merchandise Draw Raffle, and On-Premises Merchandise Draw Raftle which is submitted to the Planning Board or the Board of Adjustment; and WHEREAS, the Governing Body of the Township of Fairfield also finds it necessary to increase the License Fees for Raffles and Bingo and to charge licensing fees for Instant Raffle Games, Calendar Raftle, Casino Night, Off-Premises Merchandise Draw Raftle, and On-Premises Merchandise Draw Raftle. NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWNSHIP OF FAIRFIELD, COUNTY OF ESSEX, STATE OF NEW JERSEY AS FOLLOWS: 1. Chapter 4 General Licensing. Shall be and is hereby amended as follows: Changes to 4-11.1 d. 1, 2, (3 remains unchanged) and add 4., 5., 6., and 7. The section License Fees for Bingo the fee will change also. 4-11.1 License. d. License Fees for RafJIes. 1. Off-Premises SO-SO Rame. TeR ($10.00) Twenty (520.00) dollars for each one thousand ($1,000.00) dollars of the value of prizes awarded in each rame with respect to which tickets or rights to participate may be sold in advance of the occasion or the drawing or allotment of prizes, commonly called an "off-premises" raftle. 2. On-Premises SO/50 Draw Rame. All registered organizations holding raftles wherein all tickets or rights to participate are sold only to persons present at the place of the drawing, the winner(s) determined and the prize(s) awarded to a person or persons present at the drawing, must pay a licensing fee ofteR ($10.00) twenty (520.00) dollars for any such raftle or cash prizes (50.50) in excess of four hundred ($400.00) dollars or merchandise prizes where the total combined retail value of prizes awarded is in excess of four hundred ($400.00) dollars. -- - - - - 3. Carnivals. Twenty ($20.00) ($10.00) dollars for each carnival wheel or game conducted on any day or series of six (6) consecutive days at one (I) location. 4. Instant Raffle Game. Licensing fees payable by law to the Control Commission for this type of license is $20.00 for each day on which instant rame tickets are sold or offered for sale, or $750.00 for one-year license to sell, or to offer for sale, instant raffle tickets during that year. 5. Casino Night. One Hundred (5100.00) dollars for each day of operation. 6. Off-Premises Merchandise Draw Rame. Twenty (520.00) dollars for each 51,000 or part thereof of the total retail value of the prize(s) to be awarded. 7. On-Premises Merchandise Draw Rame. Twenty ($20.00) dollars for each day on which a drawing(s) is to be conducted under the license only if anticipated value of the merchandise prize(s) is in excess of $400.00. Otherwise, there is no license fee. License Fees/or Bingo. License fees for bingo shall be tea ($10.00) twenty ($20.00) dollars for each occasion upon which any game or games are to be conducted under such license. 2. All ordinances and parts of ordinances inconsistent herewith are hereby repealed. 3. If any section, paragraph, subdivision, clause of provision of this ordinance shall be adjudged invalid, such adjudication shall apply only to that section, paragraph, subdivision, clause or provision so adjudged, and the remainder of this ordinance shall be deemed to be valid and effective. 4. This Ordinance shall take effect immediately upon passage and publication in accordance with law.
