Reason for urgency:
1.
Item discussed at a previous meeting and failure to bring it forward was an
oversight.
2.
Need to ensure that Parishes are not prevented from speaking effectively on
upcoming applications
3.
Need to ensure that the experience of the outgoing committee with the trial
rules is captured in view of the all-out elections approaching

Amendments to the Procedure for the Determination of Planning Applications –
Public Participation
Item numbering refers to the Council constitution numbering:

After the first sentence insert “Similarly, Parish Councils may nominate one
Parish Councillor to comment on any application within their Parish or which
has a significant impact on the residents of their Parish.”
In the next sentence, remove the word “Ward” so that Councillor refers to
ward or parish councillors.
Effect: 1 Parish rep of each significantly affected parishes will have a
protected right to speak, and will have a right to speak in favour of as well as
against an application. Potentially increases the number of speakers by 1 for
an item within a parish or 2 for items on the borders of parishes.

Ward Councillors may comment on any application either within their Ward, or
which has a significant impact on the residents of their Ward. If a Ward Councillor is
objecting to a planning application he/she must advise the Assistant Director
(Democratic Services), in order that the applicant can be offered a right of reply. Any
request to speak must be submitted in accordance with paragraph (g) of this Annex.
New clause:
d.

which has a significant impact on the residents of their Ward. Similarly, Parish
Councils may nominate one Parish Councillor to comment on any application within
their Parish or which has a significant impact on the residents of their Parish. If a
Councillor is objecting to a planning application he/she must advise the Assistant
Director (Democratic Services), in order that the applicant can be offered a right of
reply. Any request to speak must be submitted in accordance with paragraph (g) of
this Annex.
2. To formally add the following two clauses to the information in the agenda. The
first may need to be added formally to the constitution because of the Data
Protection implications. The second may perhaps not.

Amendment 2: add new clauses:

Persons wishing to speak shall be asked to supply contact details and to give
permission for those details to be passed to other persons wishing to, but unable, to
speak, on the same side, to facilitate ensuring that all the concerns are represented
to the Committee. There is no obligation on speakers to represent other persons’
concerns, and all persons wishing to make representations are advised to submit
written representations as well by the deadline, so that the points raised can be
investigated.

Written representations: All persons wishing to make representations are
reminded that planning decisions are legal decisions, not Council policy decisions,
and are therefore covered by the rules of evidence, and not those of democratic
representation. Only evidence that has been submitted via the official process may
be taken into account in making planning decisions. Written submissions submitted
within the consultation period will be published on the website and be available to
members of the Committee. Later written submissions should be sent to the address
published on the agenda, by the deadline published on the agenda, and will be
circulated to all members of the committee. No direct dialogue with members of the
committee is permitted either beforehand or at the meeting unless officers are
present.
