COMPETITIONRULESANDREGULATIONS
These Competition Rules and Regulations are specific to and govern the 2017 South Carolina
Bar YLD Instagram Scholarship Competition: YOUR BIG IDEA (“the Competition”). By applying to
participate in the Competition, you agree that you have read and will abide by these Rules and
Regulations and the decision of the Competition Sponsor, the South Carolina Bar Young Lawyers
Division.ParticipationintheCompetitionconstitutesfullandunconditionalagreementandacceptance
oftheseRulesandRegulations.
I.
TheCompetitionSponsor.
The Competition Sponsor is the South Carolina Bar Young Lawyers Division iCivics Committee
(“theYLD”).
II.
TheCompetitionDates.
TheCompetitionbeginsonWednesday,March1,2017andrunsthroughWednesday,April19,
2017at5:00p.m.EST.EntriesmustbereceivedbytheYLDwithinthistimeperiodtobeeligibletobe
win.
III.
ParticipantEligibility.
TheCompetitionisopentoparticipantswhoatthetimeoftheirentry:
•
areSouthCarolinaresidents.
•
arehighschoolseniorsattendingahighschoollocatedintheStateofSouthCarolina.
•
are enrolled or plan to be enrolled to attend any post-secondary institution for the
2017-2018schoolyear.

Any participants who have not reached the age of eighteen at the time of their entry must
obtain signed permission from a parent or legal guardian in order to submit an entry into the
Competition.ThisisincludedontheApplicationForm.
The YLD shall have the right at any time to require proof of identity and/or eligibility to
participateintheCompetition.Failuretoprovidesuchproofmayresultindisqualification.Allpersonal
andotherinformationrequestedbyandsuppliedtotheYLDforthepurposeoftheCompetitionmustbe
truthful,complete,accurateandinnowaymisleading.
TheYLDmayatanytimeinitssolediscretiondisqualifyanyparticipantwho:
•
doesnotmeettheCompetitioneligibilitycriteria,
•
failstocomplywiththeseRulesandRegulations,
•
attemptstodisrupttheCompetition,
•
orattemptstocircumventanyoftheseRulesandRegulations.
IV.
HowtoApply
Nopurchaseorentryfeesarerequiredtoenterortobeawardedascholarshipaspartofthe
Competition.
ParticipantswhomeettheconditionsasoutlinedinSectionIII.ParticipantEligibilityareeligible
to enter the Competition during the Competition period by downloading an Application Form and
following the instructions provided. You are solely responsible for ensuring that all information you
submitisaccurate.
ParticipantsmusthaveanInstagramaccounttoentertheCompetition.Youmaysignupfora
freeInstagramaccountat:www.instagram.com.

You may be contacted by the YLD to supply additional documentation, including proof of
enrollmentatapost-secondaryinstitutionandarecentphotographofyourself.Theproofofenrollment
willbeviewedbytheYLDbutwillbekeptconfidential.

Only one entry per person will be accepted. Entries made with multiple addresses, under
multipleidentities,orthroughtheuseofanydeviceorartificetoentermultipletimesareautomatically
void.Anyparticipantwhoattemptstosubmitmorethanoneentrymaybedisqualified.
Submissionmaterialsshallnotbereturnedtotheparticipantsandwillbecomepropertyofthe
SouthCarolinaBar.
V.
SubmissionEligibility.
Yourvideoentrymust:
•
Meet all guidelines, criteria and technical requirements imposed by Instagram with
respecttovideospostedonInstagram;
•
NotcontainURLsorlogoslaidovervideofootage;
•
Not contain any copyrighted works, including music, pictures, posters, etc., unlessyou
are the owner of such rights or have permission of the rightful owner to submit the
materialinaccordancewiththeserules;
•
Not contain any content that violates the law or the rights of a third party, including
privacy,personality,and/orintellectualpropertyrights;and
•
Beintendedforapublicaudienceandnotcontain,depictorrefertoanycrude,vulgar,
obscene, sexually explicit, disparaging, discriminatory, offensive, illegal, or otherwise
unsuitable language, activity or other content (all as determined by The Competition
Sponsorinitssolediscretion).

Youwillneedto:

MakesureyourInstagramaccountisNOTsetto“Private.”
•
Hashtagyourvideoentrywith“SCBarYLD”and“YourBigIdea”
•
CopyandpasteyourInstagramvideo’sURLintotheApplicationForm.
BysubmittingavideoentrytotheYLD,yourepresentandwarrantthatyou:
•
Aretheoriginalcreatorofthevideo;
•
Agree that the YLD will not infringe or violate any third party’s intellectual property, privacy,
personalityorotherrightswhentheYLDcopies,displays,edits,modifies,transmitsorotherwise
usesyourvideoentryinconnectionwiththeCompetitionoranyadvertising;
•
AgreethatthevideomeetsalloftheeligibilityrequirementssetoutintheseCompetitionRules
andRegulations;
•
Agree that the video, all images and ideas submitted with the Application Form are being
submittedonanon-confidentialbasisandmaybeedited,postedorpublishedinanymannerby
the South Carolina Bar or the South Carolina Bar Young Lawyers Division without any
compensationtoyou;
•
AgreethatthevideoandallimagescontainedthereinaresubmittedtotheYLDforitsuseand
thevideo,imagesandallideasshallbecomethepropertyoftheYLDuponsubmission,including
but not limited to publishing it in electronic form on the South Carolina Bar website or other
SouthCarolinaBarsocialmediapageswithoutfurthercompensation;
•
Understandthatthesubmissionofthevideoentryandanyimagesandcontentmayimpactthe
participant’slegalrightstoprotecttheimages,contentandideascontainedtherein;and
•
Agree that the South Carolina Bar and the YLD also have the right to use your name,
photograph,biographicalinformationandschoolnameincreditalongwithyourvideoentry.
•
Confirm all trademarks and copyrighted material have been properly acknowledged on the
ApplicationForm.
VI.
SubjectandParticipantReleases.
Ifyourvideoentryshowsanyindividualinsuchawaythattheindividualcanberecognized,you
must obtain written consent from that individual to permit the YLD to copy, display, transmit or
otherwiseusethevideo,andyoumustprovidetheYLDwiththeoriginalcopyofthatconsentuponthe
YLD’srequest.

Videosthataresubmittedwithinadequatedocumentation,asdeterminedsolelybytheYLD,will
notbeeligibleforthecontest.
VII.
Other.
TheYLDmaydisqualifyanyentryifitdetermines,initssolediscretion,thatthesubmissiondoes
notcomplywiththeseeligibilityrequirementsorotherwisewiththeseRulesandRegulations.
VIII.
ScholarshiptobeAwardedatCloseofCompetition.
Onescholarshipintheamountof$2,000.00willbeawarded.
Therecipientofthe2017SouthCarolinaBarYLDInstagramScholarshipCompetition:YOURBIG
IDEA will be announced, at the discretion of the YLD, by methods of the YLD’s choosing, on or before
June2,2017.
Inordertobeeligibletobeawardedthescholarship,therecipientmayberequiredto:
•
SignaDeclarationofCompliancewithRulesandRegulations.
•
Producevalididentification.
If the above requirements are not met, the recipient could be disqualified at the discretion of
theYLD,andanotherrecipientmaybeselectedinhisorherplace.
IX.
JudgingProcess.
All application forms, video entries, and other documentation will be evaluated by a group of
judges comprised of members of the South Carolina Bar and based on the evaluation of the criteria
listedbelow.Alldecisionsmadebythejudgesarefinal.
TheCompetitionjudgeswillincludereviewofeachvideoentrytoevaluate:
•
Originalthought.
•
Substantiveanswertooneofthequestionsprovided.
•
Creativepresentation.
X.
Disclaimers,LiabilityandIndemnification
ByparticipatingintheCompetition,youreleaseandagreetoindemnifyandholdharmless
the YLD and the South Carolina Bar and their employees, directors, officers, affiliates, agents,

judgesandadvertisingandpromotionalagenciesfromanyandalldamages,injuries,claims,causes
ofactions,orlossesofanykindresultingfromyourparticipationintheCompetitionorreceiptor
useofanyscholarshiporprize.ByparticipatingintheCompetition,youfurtheragreetoindemnify
and hold harmless the YLD and the South Carolina Bar and their employees, directors, officers,
members, affiliates, agents, judges and advertising and promotional agencies from any and all
damages, injuries, claims, causes of actions or losses of any kind (including actual legal fees and
expenses) arising from or related to: (a) your failure to comply with any of these Rules and
Regulations;(b)anymisrepresentationyoumakeundertheseRulesandRegulationsorotherwise
totheCompetitionSponsor;or(c)yourparticipationintheCompetition.
NeithertheSouthCarolinaBarnortheYLDshallhaveanyliabilityforanylossordamageof
anyvideosoressaysenteredintheCompetitionorforanyotherlossordamageresultingdirectly
orindirectlyfromyourparticipationintheCompetition.
NeithertheSouthCarolinaBarnortheYLDareresponsiblefor:(1)incorrectorinaccurate
transcriptionofentryinformationorlate,lost,incomplete,misdirectedentries,orentriesreceived
throughimpermissibleorillegitimatechannels;(2)technicalfailuresofanykind,includingwithout
limitationthemalfunctioningofanytelephone,computer,network,hardwareorsoftware;(3)the
unavailabilityorinaccessibilityofanyservice;(4)unauthorizedhumaninterventioninanypartof
the entry process or the Competition; (5) electronic or human error which may occur in the
administration of the Competition or the processing of entries; or (6) any injury or damage to
personsorproperty,includingwithoutlimitationyourcomputer,whichmaybecaused,directlyor
indirectly,inwholeorinpart,fromyourparticipationintheCompetitionorfromdownloadingany
material.
Neither the South Carolina Bar nor the YLD will be liable to you for any indirect, special,
consequential, or punitive damages in connection with the Competition or these Rules and
Regulations.

XI.
Termination.
If for any reason the YLD cannot run the Competition as planned, (including as a result of
bugs,tampering,unauthorizedintervention,fraud,technicalfailures,infectionbycomputervirusor
any other cause that corrupts, impairs oraffects the administration, security, fairness, integrity, or
properconductoftheCompetition)theYLDreservestherighttocancel,modify,extendorsuspend
theCompetition.Inthatevent,theYLDmaydeterminethewinnerfromamongtheeligibleentries
receiveduptothetimeofthe impairment,orcanceltheCompetition.TheYLDmayalsodisqualify
any individual who tampers with or in any way corrupts the entry or voting process, or who
attemptstounderminethelegitimateoperationoftheCompetitionbycheating,hacking,deception,
orotherunfairpractices,orbyattemptingtoannoy,abuse,threatenorharassanyotherentrantsor
representativesoftheYLDortheSouthCarolinaBar.TheYLDreservestherighttomodifyorcancel
theCompetitionatanytimeincluding,withoutlimitation,intheeventoftechnicalcorruption,virus,
bugs, non---authorized human intervention or any other technical problems, which may arise from
time---to---timebeyondthecontroloftheYLD,destroyingtheintegrityoftheCompetition.Noliability
or responsibility is assumed by either the South Carolina Bar or the YLD, resulting from user
attempts to participate in the Competition or if required, download any information necessary to
participateintheCompetition.
XII.
Law.
TheseRulesandRegulationsconstitutethecompleterulesandregulationsassociatedwith
the Competition. The Competition is subject to applicable federal, state and municipal laws and
regulations.TheseRulesandRegulationsaresubjecttochangewithoutnoticeinordertocomply
withanyapplicablefederal,provincialandmunicipallawsorthepolicyofanyother entityhaving
jurisdictionovertheYLD.TheinterpretationandenforceabilityoftheRulesandRegulationsorthe
rights and obligations as between the applicant and the YLD in connection with the Competition
shallbegovernedbyandconstruedinaccordancewiththelaws ofthestateofSouthCarolina.All

disputes, claims and causes of action arising out of or connected with the Competition or these
RulesandRegulationswillberesolvedexclusivelybytheappropriatecourt.
XIII.
LanguageDiscrepancy.
IntheeventofanydiscrepancyorinconsistencybetweentheRulesandRegulationsofthe
CompetitionandanyotherstatementscontainedinCompetitionrelatedmaterials,theRulesand
Regulationsshallprevail,governandcontrol.
