An Act to enable the Council of the Borough of Paddington to close certain portions of Marshall-street, a public street in the said Borough, and a certain right-of-way leading therefrom; and to vest the feesimple of part of the land comprised in the closed portion of the said street and said right-of-way in the Marshall's Paddington Brewery (Limited), a Company duly registered under the "Companies Act"; and to vest in the said Borough for the improvement of Oxford-street certain pieces and parcels of land owned by the said Marshall's Paddington Brewery (Limited), fronting Oxford-street; and for other purposes in furtherance of or conse quent on the aforesaid objects. [23rd May, 1894.] W H E R E A S it is e x p e d i e n t t h a t certain portions of Oxfordstreet, in t h e B o r o u g h of P a d d i n g t o n , should be i m p r o v e d a n d widened : A n d w h e r e a s t h e l a n d r e q u i r e d for t h a t p u r p o s e is vested in t h e M a r s h a l l ' s P a d d i n g t o n B r e w e r y ( L i m i t e d ) : A n d w h e r e a s t h e said M a r s h a l l ' s P a d d i n g t o n B r e w e r y (Limited) is willing to dedicate t h e said l a n d for t h e said purpose in consideration of a c e r t a i n street k n o w n as M a r s h a l l - s t r e e t in t h e said B o r o u g h being closed a n d portion of t h e land thereof b e i n g vested in t h e said M a r s h a l l ' s P a d d i n g t o n B r e w e r y ( L i m i t e d ) : A n d whereas it is e x p e d i e n t to close t h e said M a r s h a l l - s t r e e t for t h e purpose aforesaid : Be it therefore e n a c t e d by t h e Q u e e n ' s M o s t E x c e l l e n t Majesty, by a n d w i t h t h e advice a n d c o n s e n t of t h e L e g i s l a t i v e Council a n d Legislative Assembly of N e w S o u t h W a l e s in P a r l i a m e n t assembled, a n d b y t h e a u t h o r i t y of t h e same, as follows :—• 1. This A c t m a y b e cited as t h e " O x f o r d - s t r e e t I m p r o v e m e n t A c t . " 2. F r o m a n d after t h e passing of t h i s A c t it shall be lawful for t h e M u n i c i p a l Council of t h e B o r o u g h of P a d d i n g t o n , for t h e purposes of t h i s A c t , to close a n d stop u p c e r t a i n portions of a road or street in t h e said B o r o u g h k n o w n as M a r s h a l l - s t r e e t , m o r e p a r t i c u l a r l y described in t h e F i r s t Schedule hereto, a n d t h e r e u p o n all t h e r i g h t s , easements, a n d privileges of a n y person or persons t h e r e i n or t h e r e o v e r shall cease and determine. 3. T h e directors of t h e M a r s h a l l ' s P a d d i n g t o n Brewery ( L i m i t e d ) are h e r e b y e m p o w e r e d to dedicate all t h a t piece or parcel of l a n d described in t h e Second Schedule hereto to t h e B o r o u g h of P a d d i n g t o n , for t h e purpose of t h e w i d e n i n g a n d i m p r o v e m e n t of O x f o r d - s t r e e t ; a n d t h e r e u p o n t h e fee-simple of t h e said land shall vest in the M u n i c i p a l Council of t h e said B o r o u g h for t h e p u r p o s e aforesaid, and t h e said l a n d shall, subject to t h e conditions hereinafter m e n t i o n e d , be formed i n t o a n d k e p t as a public street or road by t h e M u n i c i p a l Council of t h e said B o r o u g h . c 4. 4. U p o n t h e dedication of t h e said land by t h e M a r s h a l l ' s P a d d i n g t o n B r e w e r y ( L i m i t e d ) , all t h a t piece or parcel of l a n d described in t h e F i r s t Schedule hereto shall vest in t h e said M a r s h a l l ' s P a d d i n g t o n B r e w e r y ( L i m i t e d ) , for a n estate i n fee-simple free from all r i g h t s , e a s e m e n t s , a n d privileges of a n y person or persons t h e r e i n or thereover. 5. T h e said M a r s h a l l ' s P a d d i n g t o n B r e w e r y (Limited) shall, w i t h i n t w o years from t h e passing of this A c t , remove or cause to be r e m o v e d from t h e parcels of l a n d described in t h e said Second Schedule all b u i l d i n g s a n d m a t e r i a l s erected or placed on t h e said land, a n d in default of t h e i r so doing t h e M u n i c i p a l Council of t h e said B o r o u g h m a y e n t e r u p o n t h e said land a n d m a y r e m o v e or cause to be r e m o v e d all such b u i l d i n g s a n d materials a t t h e cost a n d e x p e n s e of t h e said M a r s h a l l ' s P a d d i n g t o n B r e w e r y ( L i m i t e d ) , a n d m a y recover t h e said cost a n d expense from t h e said M a r s h a l l ' s P a d d i n g t o n B r e w e r y ( L i m i t e d ) in a n y C o u r t of c o m p e t e n t jurisdiction as m o n e y paid by t h e M u n i c i p a l Council of t h e said B o r o u g h at t h e request of t h e said Marshall's Paddington Brewery (Limited). 6. If a n y action, suit, or other legal proceedings be i n s t i t u t e d or b r o u g h t b y a n y person or persons a g a i n s t t h e said M a r s h a l l ' s P a d d i n g t o n B r e w e r y (Limited) or its assigns, in respect of the parcel of land described in t h e F i r s t Schedule hereto, or of a n y right, ease m e n t , or privilege in respect thereof, it shall be lawful for t h e said M a r s h a l l ' s P a d d i n g t o n B r e w e r y ( L i m i t e d ) or its assigns to plead t h e general issue a n d give t h i s A c t in evidence t h e r e u n d e r . The T H E SECOND SCHEDULE K E F E R B E D TO. All that piece or parcel of land situated in the parish of Alexandria, county of Cumberland, Colony of New South Wales, be the hereinafter mentioned dimensions a little more or less, containing by admeasurement three hundred and twelve square feet, and being part of the land comprising block L of the subdivision of the Sydney Common : Commencing at the intersection of the present building line on the south-west side of Oxford-street with the east building line of Dowling-street; and bounded thence on the north-east by said building line of Oxford-street, being the north-east boundary line of said block L bearing south sixty-nine degrees forty-six minutes thirty seconds east ninety feet eight inches to the easternmost corner of said block L ; thence on the southeast by part of the south-east boundary line of said block L bearing south fifty-four degrees thirty-five minutes thirty seconds ..west eight feet four inches to the new building line in Oxford-street; and thence on the south-west by that building line bearing north fifty-five degrees forty-one minutes thirty seconds west eighty-six feet two and three-quarter inches, to the point of commencement. And also all that piece or parcel of land situated in the parish of Alexandria, county of Cumberland, Colony of New South Wales, be the hereinafter mentioned dimensions a little more or less, containing by admeasurement one thousand three hundred and forty-five square feet, and being part of the land granted to Maria Zouch, by Crown grant dated thirtieth April, one thousand eight hundred and forty: Commencing at the intersection of the present building line on the south-west side of Oxfordstreet with the south-east building line of Marshall-street ; and bounded thence on the north-east by said building line of Oxford-street bearing south sixty-nine degrees fortysix minutes thirty seconds east thirty-two feet five and a half inches and south fortyseven degrees thirty-seven minutes forty seconds east one hundred and forty feet seven inches to the northernmost corner of land now the property of H. E. Castle ; thence on the south-west by the new building line of Oxford-street bearing north forty-three degrees thirty-six minutes thirty seconds west one hundred and thirty-eight feet six inches and north fifty-five degrees forty-one minutes thirty seconds west thirty-seven feet one and a half inch to Marshall-street aforesaid; and thence on the north-west by the south-east building lino of said Marshall-street bearing north fifty-four degrees thirty-five minutes thirty seconds east twelve feet five and three-quarter inches, to the point of commencement.
