Glennon Center - Council Chambers 15077 Molokai Drive, Tega Cay Monday, August 18, 2014 Councilmembers Present: Mayor George Sheppard, Mayor Pro Tempore Jennifer Stalford, Dottie Hersey, Chris Landvik-Larsen and Ron Kirby. A quorum was present. Councilmembers Absent: N/A Staff Present: Charlie Funderburk, City Manager; Katie Poulsen, Assistant City Manager; Bob McCleave, City Attorney; Tim Gillette, Operations Director; Tom Goebel, Development Services; Ryan Powell, Utilities Director; Leslie Richardson, Municipal Clerk The Press was duly notified of the meeting. Mayor George Sheppard called the meeting to order at 6:30 p.m., noted it was a regular City Council meeting held on Monday, August 18, 2014. He announced all members of Council were present. He stated the Press was duly notified of the meeting and then led the Pledge of Allegiance and a Moment of Silence. MOTION Mayor Sheppard motioned to amend the agenda to address Item 3 then Item 2. Councilmember Kirby seconded the motion. VOTE: AYES unanimous ITEM 1 PUBLIC HEARING A. Presentation of Budgets for Fiscal Year 2014-2015 for General Fund, Tega Cay Utility Department (TCUD), Tega Cay Utility Department II (TCUD-II), Beach and Swim Center, Storm Water, Community Events and Hospitality Tax City Manager Funderburk presented the budgets for Fiscal Year 2014 – 2015 for General Fund reporting no millage rate increases for next year, completion of the Comprehensive Plan, increased funding for street & park maintenance and general aesthetics, plans for the continuation of wild fire cameras project, upgrades to the Police Department, and hiring additional employees. Mayor Sheppard opened the floor for public comments. There were none. Mayor Sheppard opened the floor for Council comments. Mayor Pro Tempore Stalford stated concerns from residents requesting to reduce the millage rate. City Manager Funderburk reported the millage rate is addressed based by what is allotted by State Law and by percentage of population increase. Therefore Tega Cay will remain at 89 and will not face an increase. City Manager Funderburk presented the budget for Tega Cay Utility Department (TCUD) to include a ten percent (10%) Sanitary Sewer Cleanout, $100K to Fund Balance Reserve, doubling meter replacement and rates remaining the same as FY13-14. Mayor Sheppard opened the floor for public comments. No public comments. No Council comments. City Manager Funderburk updated Council on progress since acquisition of the former TCWS system and noted the financial outlook is on target as projected. He announced the budget includes a twenty percent (20%) sanitary sewer cleanout required by DHEC addressing issues from previous owner, $725K to Fund Balance Reserve, and meter replacement to transition to radio meters. Mayor Sheppard opened the floor for public comments. No comments. Mayor Sheppard requested an explanation of the SRF (State Revolving Fund). Tega Cay Regular City Council Meeting August 18, 2014 Page | 2 City Manager Funderburk reported that the City will apply for funds once construction permits are approved by DHEC for mandatory repairs. The application is tentatively set for October with payments starting 2015-2016. Mayor Sheppard opened the floor for public comments. 1) George Chakmakian, 1100 Palmyra Drive, asked if there would be an offsetting reduction in personnel. City Manager Funderburk reported that reads are contracted at approximately $0.53 per meter with future savings to go back into operation maintenance. 2) Mary Ann Fugita, 3101 Point Clear, raised a concern with timeframe to change the meters. City Manager Funderburk announced this would start by the end of this year, and could take up to 3 -5 years for full completion. Rates being based on consumption will be addressed down the line as rates are reviewed every year. No further public comments. City Manager Funderburk reported the amount of beach and swim center memberships sold this year and expenditures. He reported the FY14-15 budget includes no rate increases, continuing repairs, construction of new storage area, and replacing pool furniture. Mayor Sheppard opened the floor for public comments. No comments. City Manager Funderburk reported on general utility expenditures for Stormwater. He reported the FY14-15 budget to include no rate increases, and approximately $92K toward Capital projects. Mayor Sheppard opened the floor for public comments. No comments. City Manager Funderburk presented the FY14-15 community events budget which includes purchasing a new Christmas tree. Mayor Sheppard opened the floor for public comments. No comments. Mayor Sheppard opened the floor for Council comments. Councilmember Hersey and Councilmember Kirby requested to consider planting a tree in the community to be decorated during the holidays. City Manager Funderburk presented the FY14-15 hospitality budget. Mayor Sheppard opened the floor for public comments. No comments. Mayor Sheppard opened the floor for Council comments. No comments. ITEM 3 SPECIAL PRESENTATIONS A. Recognition of Tega Cay Sports Team Champions Mayor Sheppard recognized Jacob Sarna, players, parents and representatives of the Tega Cay All Star Teams for their outstanding achievement in sports. The team received a standing ovation from the audience. B. Proclamation for Childhood Cancer Awareness Month Mayor Sheppard presented the proclamation to Ms. Dana Boutwell, former Ms. Strawberry Queen. Ms. Boutwell thanked the Council for their support last year. She raised $41,000 for Cookies for Kids Cancer Awareness in September during her reign as Ms. Strawberry Queen. C. TCUD-II City Manager Funderburk updated Council on progress since acquisition of the former TCWS system. He thanked Ryan Powell, Utilities Director, and the TCUD team for their hard work. FY14-15 Tega Cay Golf Course Budget Mr. Dave Taylor, Pinnacle Golf Management, Mr. Josh Brown, Director of Golf, and Mr. Chuck Smith, Superintendent presented the budget and projections for the coming year with priorities focused on improving the tee box area and all amenities on the golf course. Mr. Taylor reported the course is expected to finish this year at 32,663 rounds, resulting in $1,179, 234 in revenue ($36.10 per round). He reviewed budget revenue and expenditure highlights. Discussion ensued on the projected profit for the coming year. Mr. Taylor ended with information on communications and marketing strategies. Mayor Sheppard commended Mr. Smith and Mr. Brown for their professionalism and hard work. Councilmembers Hersey, Kirby and Landvik-Larsen thanked them for their continued efforts and hard work in and around the golf course. E. Golf Cart Rules & Regulations Lt. James Patterson, Tega Cay Police Department, presented the golf cart rules and regulations for safety. He stated the following State Laws: Carts must be registered with the SCDMV. Drivers must have a valid driver’s license and be at least 16 years of age. Drivers must be able to show proof of Insurance and stickers must be visible on the shield. No operation of golf carts if the speed limit is 35 MPH or more and is more than 4 miles from your home. No night time riding of golf carts. Must adhere to all State and Local traffic laws. No motorized vehicles in the Memorial Gardens. Be mindful that pedestrians have the right of passage, slow down when passing passengers especially on walking trails. 1) George Chakmakian, 1100 Palmyra Drive, asked if there were laws pertaining to children restraint for the back of the golf carts. Lt. Patterson clarified that there are no laws in place for children restraint. Mr. Josh Brownell of the Tega Cay Golf Course noted that no personal golf carts are allowed on the golf courses, as it is private property. Safety regulations and overall courtesy to golf course members also prevents private carts from being used on the course. Councilmember Hersey inquired if the rules were State Laws and if the law could be changed. Mayor Pro Tempore Stalford asked what to do if you see a child driving a golf cart. Lt. Patterson reported to please contact the Police Department if you witness a child operating a golf cart. Councilmember Kirby asked how often the police golf cart is in operation. Lt. Patterson reported the golf cart is in operation daily. City Manager Funderburk reported that the City of Tega Cay is not allowed to put any laws in place that are less restrictive to the State Laws regarding the operation of golf carts. ITEM 2 PUBLIC COMMENTS Mayor Sheppard opened the floor for comments and noted there would not be a vote on Ordinance 70 at this meeting. The following came forward: 1) Tom Holmes, 2049 Manila Bay Lane, spoke against using common parking and driveways for boats and requested that the police find ways to better utilize the common areas that will not obstruct homes. 2) Jim Van Blarcom, 4017 Windward Drive, requested that the police officers are given permission to enforce positive change within our community. 3) Tom Eisele, 3028 Point Clear, spoke against trucks and boats being parked in common drive ways and shared concerns about deteriorating pumps around the city. City Manager Funderburk clarified that the old well houses in the cul-de-sacs will be torn down Mr. Eisele commended Ryan Powell and the TCUD team on their outstanding work. He inquired about the status Hubert Graham Way. Mayor Sheppard clarified that plans are in the works to construct a road extending from the Stonecrest/Walmart area to Deer Creek, near the old farmhouse, scheduled to begin early 2015. Tega Cay Regular City Council Meeting August 18, 2014 Page | 4 4) A resident shared concerns with parking in the street in traditional Tega Cay. 5) David Steib, Manila Bay Drive, inquired if there were concerns with falling property values due to limited parking because of boats and narrow parkways. 6) Daryl Fisher, Suwarrow Circle, stated concerns with residents that are not keeping up with regular maintenance of their yards, parking too many cars on the streets and the effect these have on property value. 7) Mary Ann Fugita, 3101 Point Clear, asked who owns the parking pads. City Attorney McCleave explained the background on the property dates back to the 1970’s when earlier developers had plans to have parking pads. However, during bankruptcy parking pads were not addressed. 8) Dee Hudson, Point Clear Drive, reported a concern regarding parking pads and what can be displayed on a parking pads. City Manager Funderburk reported, at this time, nothing is in place to address jurisdiction of the parking pads or what can be displayed on the parking pads. 9) Tom Holmes, 2049 Manila Bay Lane, requested more discussion and resolution regarding Ordinance 70. 10) Jerry Romaris, 4024 Windward Drive, stated concerns of safety and raised concerns with parking pads. Mayor Sheppard asked if there were any more public comments. There being none, public comments closed. ITEM 4 NEW BUSINESS A. Resolution in Support of the Presentation of the POW/MIA Flag Mayor Sheppard presented the resolution in support of the presentation of the POW/MIA Flag to be presented year round with the National Flag at the City’s Veterans Memorial. The City of Tega Cay recognized the 3rd Friday of each September as National POW/MIA Recognition Day. Mayor Sheppard invited Chuck Gross to accept the resolution. MOTION Councilmember Landvik-Larsen motioned to approve the resolution in support of the presentation of POW/MIA Flag. Councilmember Kirby seconded the motion. VOTE: AYES unanimous Mayor Sheppard recognized Dick Petersen, First Commander of the Tega Cay Veteran’s Association, present at the meeting. B. Introduction and 1st Reading of an Ordinance for Fiscal Year 2014-2015 General Fund Budget MOTION Councilmember Hersey motioned to approve the introduction and 1st reading of an ordinance for fiscal year 2014-2015 General Fund budget in the amount of $7,128,816. Councilmember Landvik-Larsen seconded the motion. VOTE: AYES unanimous C. Introduction and 1st Reading of an Ordinance for Fiscal Year 2014-2015 Tega Cay Utility Department (TCUD) Budget MOTION Mayor Pro Tempore Stalford motioned to approve the introduction and 1st reading of an ordinance for fiscal year 2014-2015 TCUD Budget in the amount of $1,373,769. Introduction and 1st Reading of an Ordinance for Fiscal Year 2014-2015 Tega Cay Utility Department II (TCUD-II) Budget MOTION Councilmember Landvik-Larsen motioned to approve the introduction and 1st reading of an ordinance for fiscal year 2014-2015 TCUD Budget II in the amount of $2,028,134. Councilmember Kirby seconded the motion. VOTE: AYES unanimous E. Introduction and 1st Reading of an Ordinance for Fiscal Year 2014-2015 Beach and Swim Center Budget MOTION Councilmember Kirby motioned to approve the introduction and 1st reading of an ordinance for fiscal year 2014-2015 Beach and Swim Center Budget in the amount of $218,876. Councilmember Landvik-Larsen seconded the motion. VOTE: AYES unanimous F. Introduction and 1st Reading of an Ordinance for Fiscal Year 2014-2015 Storm Water Budget MOTION Councilmember Hersey motioned to approve the introduction and 1st reading of an ordinance for fiscal year 2014-2015 Storm Water Budge in the amount of $397,242. Councilmember Kirby seconded the motion. VOTE: AYES unanimous G. Introduction and 1st Reading of an Ordinance for Fiscal Year 2014-2015 Community Events Budget and Hospitality Tax Budget MOTION Councilmember Mayor Pro Tempore Stalford motioned to approve the introduction and 1st reading of an ordinance for fiscal year 2014-2015 Community Events Budget in the amount of $81,900 and Hospitality Tax Revenue in the amount of $130,000. Councilmember Landvik-Larsen seconded the motion. VOTE: AYES unanimous H. Introduction and 1st Reading of Ordinance 465 Amended Mayor Funderburk stated the outlining conditions of Ordinance 465 for MI Homes now referred to as Garden Homes. The following amendment changes the date of Ordinance 465 Amended. MOTION Councilmember Hersey motioned to approve the introduction and 1st reading of an ordinance 465 Amended. Councilmember Kirby seconded the motion. VOTE: AYES unanimous I. Amendment to City Manager’s Contract City Attorney McCleave reviewed the various amendments to City Manager’s Funderburk’s contract. MOTION Mayor Sheppard motioned to approve the Amendment to the City Manager’s Contract to extend date to October 1, 2019, base salary increased to $110K as of October 1, 2014, not eligible for living increase until October 1, 2015. Councilmember Landvik-Larsen seconded the motion. VOTE: AYES unanimous Mayor Sheppard and Councilmembers commended City Manager Funderburk on his outstanding work as City Manager, and shared they are looking forward to years to come. Tega Cay Regular City Council Meeting August 18, 2014 Page | 6 ITEM 5 CITY MANAGER’S REPORT City Manager Funderburk reported on the following: 1) Introduced Leslie Richardson as the new Municipal Clerk who will take over the municipal clerk duties as Katie transitions into the duties as Assistant City Manager. He welcomed Leslie and stated he is excited to have her. 2) Major Nelson and Lt. Patterson attend a training at Texas State University in San Marcos, TX from August 4 – August 8. This was a federally funded active shooting training which demonstrates how to respond to active shooters. They will be able to share the knowledge and train our officers to respond accordingly. 3) Mr. Petersen requested an Ordinance to protect the Eastern Box Turtle. He requested turtle crossing signs for appropriate street navigation. ITEM 6 COUNCIL COMMENTS Councilmembers Hersey and Kirby had no comments. Councilmember Landvik-Larsen thanked Lt. James Patterson for attending the council meeting and for keeping the community abreast of protection. He welcomed Leslie Richardson and wished her good luck in her new position. Mayor Pro Tempore Stalford reported that the Flipping Tabs Team is collecting aluminum tabs as a recycling project this year. All monies will go to the Levine Children’s Fund, specifically to pediatric research, for cancer. She noted collection bins at Tega Cay Elementary School, the Fire Department and City Hall. Mayor Sheppard reported the 2014 Kayak Polo Tournament will be held at the Beach & Swim Center in the Lake for Labor Day Weekend. He noted he is looking forward to viewing this new sport which should be quite exciting. Mayor Sheppard urged drivers to get out earlier during the school year and to have patience for pedestrians, especially the children. ITEM 7 PUBLIC COMMENTS 1) Tom Eisele, 3028 Point Clear, asked if there are plans to repave Tega Cay Drive. City Manager Funderburk reported that plans are underway to work with SCDOT on repaving Tega Cay Drive. 2) Michael Kasak, 7623 Black Hawk Lane, offered his services and distributed a portfolio as an Architect by trade to assist on the Comprehensive Plan. ITEM 8 EXECUTIVE SESSION MOTION Councilmember Hersey motioned to move to Executive Session to receive legal advice, discussions incident to contractual matters and discussions regarding personnel matters. Councilmember Kirby seconded the motion. VOTE: AYES unanimous. Councilmembers entered Executive Session at 8:23 pm and exited at 10:10pm Mayor Sheppard noted while in Executive Session, only those items on the agenda were discussed and no votes were taken other than to return to open session Tega Cay Regular City Council Meeting August 18, 2014 Page | 7 ITEM 9 ADJOURNMENT MOTION There being no further business, Mayor Pro Tempore Stalford motioned to adjourn the meeting.
