Localfacilitiesandconditions (a) Diplomaticrepresentationinthehostcity; (b) Presenceofotherinternationalorganizations,includinginter‐governmental,non‐ governmentalandprivatefinancialinstitutionsactiveinthefieldofclimatechangeand development; (c) Availabilityofinternationalmeetingfacilitiesandtheconditionsfortheiruse(freeof charge,rent,etc.); (d) State‐of‐the‐arttele‐andvideo‐communicationfacilities(tele‐andvideo‐conference, web‐basedinteractiveplatforms,etc.) (e) Internationaltransportfacilities; (f) Localtransportfacilities; (g) Healthfacilities; (h) Hotelfacilities. (i) Suitableconditionsforemploymentofspouses,includingworkpermitsandother matters; (j) Availabilityofadequatehousing,schoolsandsocialnetworksforinternationalstaff; (k) AvailabilityoflocaltrainedpersonneltoservicetheworkoftheFund,takinginto accountlanguagerequirementsandotherrelevantskills; (l) ArrangementsfortheprocessingofvisasforBoardmembersandalternatemembers, staff,experts,representativesofStatesandotherofficialsperformingfunctionsforthe FundorinvitedtoattendFundmeetings,inaccordancewithinternationalpractice. 3.5. Selectionprocess BasedontheguidancefromtheCOP,throughdecision3/CP.17andtheGoverning Instrument,thefollowingstepsfortheselectionprocesscouldbeconsidered: 9. (a) Atitsfirstmeeting,theBoardwillreceiveandconsiderexpressionsofinterestandagree ontheprocessforselectingthehostcountryoftheFund; GCF/B.01‐12/09 Page4 (b) TheBoardwillapprovethemandateandresponsibilitiesoftheHostCountryEvaluation CommitteeandestablishtheCommitteemadeupofBoardmemberstoconductthe evaluationofexpressionsofinterest; (c) TheCommittee,withthesupportoftheInterimSecretariat,willworkin‐betweenand duringtheBoardmeetingsandpresentitsanalysisandconclusionstotheBoardfor takingthedecisiononthehostcountry; (d) TheBoardwilltakeadecisiononthehostcountrybeforeCOP18(inDoha,Qatarfrom 26Nov‐7Dec2012).ThisdecisionwillbepresentedtotheCOPforendorsementatits eighteenthsession;and (e) TheCOPwillendorsethedecisiononthehostcountryatitseighteenthsession. 4.1 HostCountryEvaluationCommittee TheHostCountryEvaluationCommitteewillconsistofsixoreightmembers,withthree orfourmemberseachfromdevelopinganddevelopedcountries,nominatedbytheBoardfrom amongitsmembership,excludingtherepresentativesofthosecountriesthathaveexpressed theirinterestinhostingtheFund. 10. 4.2 MandateandresponsibilitiesoftheHostCountryEvaluation Committee 11. ThemainresponsibilitiesoftheHostCountryEvaluationCommitteecouldbe: (a) Toconductanopenandtransparentprocesstoassesstheproposalsreceived,basedon theevaluationcriteriaandfollowingthemodalitiesforconductingtheevaluation; (b) Toprepareanevaluationreportwithinformationonhowtheevaluationcriteriahave beenappliedandpresenttheirconclusions,possiblyrecommendingashortlistranking ofatleastthreeproponents. Inordertoensureanopenandtransparentprocess,theCommitteemembers,inline withthebestpractices,willberequiredto: 12. (a) Beguidedintheirevaluationonlybythecriteriaforconductingtheevaluationas definedbytheCOPandtheBoard,assessthequalityoftheproposals/expressionsof interestontheirownmerit,andapplytechnicalexpertiseandprofessionaljudgment; (b) Treatallproponentsandproposalsequally,rejectanyattemptofinfluencebya proponentorathirdparty; (c) Keepallinformationobtainedintheevaluationprocessstrictlyconfidentialinordernot togiveundueadvantagetoanyproponent; (d) Discloseanyaffiliationwith,oranykindofinterestin,anyoftheproponentsand withdrawfromtheevaluationprocessincaseofaconflictofinterest; (e) Inlinewithbestpracticesininternationalpublicprocurementprocesses,executeand signadeclarationofimpartialityandconfidentiality(seeannexII)tothiseffect. 4.3 Modalitiesforconductingtheevaluation Takingintoaccountthebestpractices,thefollowingmodalitiesareproposedforthe deliberationsoftheHostCountryEvaluationCommittee: 13. GCF/B.01‐12/09 Page5 (a) TheCommitteewilldiscussthegeneralprinciplesonhowtoanalyzetheproposals, includingamethodologytoassessandweigheachcriterion; (b) Memberswillindividuallyconductevaluationandscoringforeachproposalbyusingthe methodologyagreedbytheCommittee; (c) TheCommitteewillpreparetheassessmentbasedontheconsolidatedscoring,discuss andadjustasnecessaryandpreparerecommendations,includingpossiblyashortlist rankingofatleastthreeproponents; (d) Ifalleffortsatreachingconsensushaveindeedbeenexhaustedandconsensuscannotbe reached,dissentingopinionscanbeincludedintheevaluationreport. Duringtheevaluationprocess,theHostCountryEvaluationCommitteecouldalso requestfurtherinformation,publiccommentsandconductlegalandotheranalyses.The EvaluationCommitteemayemploythefollowingtoolstoensureatransparentprocess: 14. (a) Conductsitevisitstohostcityincandidatecountries; (b) Publicpresentationandconsultationthroughweb‐basedtools; (c) Useofexpertsforanyanalysis,asdeemednecessary. 4.4 ConsiderationoftheoutcomeoftheevaluationreportbytheBoard TheHostCountryEvaluationCommitteewillbeinvitedtopresentitsreporttothe BoardandrespondtoBoardmembers’questionsasnecessary. 15. TheBoardwilltakethedecisionontheselectionofthehostcountryfortheFund.Inline withtherulesofprocedure,theBoardwillaimattakingthedecisionbyconsensus.Ifallefforts atreachingconsensushavebeenexhaustedandnoagreementhasbeenreached,theBoardmay applyappropriatedecision‐makingprocedure2toconcludethehostcountryselectionprocess. 16. ThedecisionoftheBoardonselectionofthehostcountryoftheFundwillbesenttothe COPforendorsementatitseighteenthsession. 17. 2 InordertoarriveataconsensusonthehostcountryoftheFund,aninformalconfidentialsurveycouldbe undertakeninseveralstages,duringwhichBoardmemberscouldexpresstheirpreferencesamongthepotential hostcountries,ontheunderstandingthat,aftereachroundofthesurvey,thecandidacybythecountryreceiving leastsupportwouldbewithdrawn.TheCo‐Chairscouldconductthesurveyonaconfidentialbasis. JuridicalpersonalityandlegalcapacityoftheFund Germany Mexico Namibia Poland Republicof Korea TorecognizethelegalcapacityoftheGreenClimateFund.TheFundwillhave fulljuridicalpersonalityinGermany.Itwillhavethecapacityinteraliato contract,acquireanddisposeofmovableandimmovableproperty,andto institutelegalproceedings. Inordertoensurethefullrecognitionofthejuridicalpersonalityandlegal capacityoftheFund,MexicowillconcludeaHostCountryAgreementwiththe Fund.SuchAgreementwillbesubmittedtotheMexicanSenateforratification andonceintoforce,itwillbecomesupremelawofthelandandallauthorities‐ atthefederal,stateandlocallevel‐willbeboundtorecognizeandexecuteits provisions. TheFundwillhavefullcapacitytocontract,acquireordisposeofmovableor immovablepropertyandtoinstitutelegalproceedings.Acquisitionof immovablepropertywillbeinaccordancewiththeprovisionsoftheMexican Constitution. MexicowillexpeditetheconclusionoftheHostCountryAgreementandwilldo itsutmosttofacilitateitsearlyentryintoforce. Namibia’sConstitutionguaranteesgrantingofjuridicalpersonalitytodifferent unisonorgans.CurrentlyNamibiahoststheUnitedNationsBodies’offices,and theSouthernAfricanCustomUnion(SACU),whichisoneoftheoldestcustom unionsintheworld.Theseorganizationshavefulllegalpersonalitywhich allowsthemtoexecutetheirdutiesindependently.Thesamewillbeconferred totheGCFSecretariat. ThemattersregardingjuridicalpersonalityandlegalcapacityoftheFundareto beregulatedinhost‐agreementconcludedbytheGovernmentofPolandandthe GreenClimateFundinthecasewhenWarsawisnominatedasahost‐cityofthe Fund. ToprovidethelegalframeworkthatwillenabletheGCFtohavejuridical personalityandlegalcapacityandenjoyprivilegesandimmunities,including taxexemptionsandspecialconsiderationinthevisaissuanceprocedures, relatedtothedischargeandfulfillmentofitsfunctions. BasedondecisionstakeninDecember2011bytheConferenceoftheParties (COP)totheUnitedNationsFrameworkConventiononClimateChange (UNFCCC),anddependingonmodalitiesandotherinstitutionalarrangements stillpending,Switzerlandcurrentlyassumesthatthesameprivilegesand immunitiesgrantedtointernationalorganizationsdomiciledinSwitzerland wouldalsoapplytotheSecretariatoncetheGreenClimateFundhasbeen definitivelyestablished. ThemattersregardingjuridicalpersonalityandlegalcapacityoftheFundare toberegulatedinhost‐agreementconcludedbytheGovernmentofPolandand theGreenClimateFundinthecasewhenWarsawisnominatedasahost‐cityof theFund.. UndertheHeadquartersAgreement,theGCFwouldenjoyprivilegesand immunitiessimilartothoseconferreduponotherinternationalorganizations consistentwiththefollowinginternationalconventions: o ViennaConventiononDiplomaticRelations; o ConventiononthePrivilegesandImmunitiesoftheUnitedNations;and o ConventiononthePrivilegesandImmunitiesoftheSpecialized AgenciesoftheUnitedNations. PrivilegesandImmunitiestotheFund o TheGCF’spremises,archivesanddocumentswouldbeinviolable. o TheKoreangovernmentwouldtakeallreasonablemeasurestoensure thesecurityandprotectionofthepremises.Communicationsand publicationswouldbeimmunefromcensorshipandanyotherformof interference. o TheGCFwouldenjoyimmunityfromlegalprocesswithregardtoits assets,exceptwheretheGCFhasexpresslywaivedsuchimmunity,in individualcases. o TheGCF,itsdeposits,incomeandotherassetswouldbeexemptfromall directtaxationandvalueaddedtax. o TheGCFwouldalsobeexemptfromdutiesonimportandexportof articlesforofficialuseandobligatoryinsurancepaymentsthatare imposedondomesticproprietors. PrivilegesandImmunitiestoFundOfficials o TheExecutiveDirector,membersoftheBoardwithdiplomaticstatus andstaffwithdiplomaticstatuswouldreceivetheprivilegesand immunitiesthattheKoreangovernmentgrantstodiplomatsof comparablerank,undertheViennaConventiononDiplomatic Relations. o Exemptionfromtaxationwouldbegrantedinregardtotheirsalaries andemolumentspaidbytheGCF,allcompulsorycontributionstoany obligatoryinsurancepaymentthatarerequiredfromanational’ssalary, andvalueaddedtaxthatisincludedinthepriceoffood,hotel accommodations,liquor,petrol,electricityandvehiclespurchasedfor personaluse. o Intheirofficialactions,theywouldenjoyimmunityfromlegalprocess andwouldnotbesubjecttoimmigrationrestrictionsandnational serviceobligations.InimportingpersonaleffectstoKorea,theywould possesstherighttoimportfreeofduty. o Otherstaffwouldreceiveprivilegesandimmunitiescomparableto thoseaccordedtheExecutiveDirectoronlywiththeexceptionsof privilegesandimmunitiesthataregrantedtodiplomatsofcomparable rankundertheViennaConventionandtherighttoimporttheir personaleffectsfreeofduty.However,theywouldhavetherightto importtheirpersonaleffectsfreeofdutyatthetimeoffirsttakingup GCF/B.01‐12/09 Page11 o Switzerland theirpostsinKorea. Expertsand/ortechnicaladvisorsperformingworkfortheGCFwould receivetheprivilegesandimmunitiesthataregrantedtootherstafffor thedurationoftheircontract. Additionalprivilegesandimmunities: o ParticipantsinvitedbytheGCFtotheirmeetingswouldenjoy exemptionfromimmigrationrestrictionsandalienregistrationsinthe exerciseoftheirfunctions. o Immunityfromlegalprocesswouldbegiventoanywordspokenor writtenandallactsintheircapacityasparticipants. o VisasandentrypermitsforKorea,whererequired,wouldbeissued promptlytoallpersonsreferredtotheBoard,ExecutiveDirectorand staff,aswellastheirspousesanddependants;expertsandtechnical advisorsonmissionfortheGCF;andperson(s)invitedbytheGCFon officialbusiness. o TheGCFstaffmembers’spousescanobtainemploymentintheir respectiveprofessionalfields,iftheymeetcertainrequirement. TheaforementionedprivilegesandimmunitiestobeconferredupontheGCF anditsstaffwillbeconcludedinconsultationwiththeGCF. PrivilegesandimmunitiesfortheGCFstaffwhoareKoreannationalsmaydiffer fromthoseofnon‐Koreannationals TheSecretariatwouldenjoyprivileges,immunitiesandfacilities, including: o Inviolabilityofthepremises,archives,property,funds,andassets. o Immunityfromjurisdictionandexecution. o Facilitiesinrespecttocommunications. o TheSecretariat,itsassets,income,andotherpropertywouldbeexempt fromdirectincometax,withinthesameframeworkasinternational organizationsinSwitzerland. o Exemptionfromindirecttaxes,withinthesameframeworkas internationalorganizationsinSwitzerland. o Exemptionfromcustomsdutiesforitsofficialactivities,withinthe sameframeworkasinternationalorganizationsinSwitzerland. PrivilegesandImmunitiestoFundOfficials Secretariatstaffwithdiplomaticstatuswouldenjoythesameprivileges, immunities,andfacilities,includingtaxexemption,asthosegrantedto representativesofpermanentmissionstotheUNwithdiplomaticstatus(inline withtheViennaConventionondiplomaticrelations). OtherSecretariatstaffwouldenjoyprivileges,immunities,andfacilities, including: o Immunityfromjurisdictionandexecutionforactsperformedbythem intheexerciseoftheirfunctions. o Inviolabilityoftheirpapers,datamedia,andofficialdocuments. o Exemptionfromdirecttaxesonsalaries,emoluments,andallowances GCF/B.01‐12/09 Page12 paidtothembytheSecretariat (thisexemptionalsoappliestoSwiss nationalsaslongastheSecretariatoperatesaninternaltaxationplan). Financialarrangements,administrativeandlogisticalsupporttotheFund Germany Anewbuildingasanecologicalmodelproject TheGreenClimateFundwillbelocatedona13,000m2federally‐ownedsitein anewbuildingwithhigharchitecturalappeal.Thebuildingwillcomplywith thelatestenergyandbuildingecologystandards,meetingthehighestdemands intermsofsustainability(Germangoldcertificate),ecologyandenergy efficiency(netzeroenergy). Besidesfunctionalofficeswithstate‐of‐the‐artofficetechnology,planning includesanaccessandlogisticsareawithsecuritycontrolsandavisitor receptionzone,anauditorium,aconferenceroom,acanteen/cafeteriaandan undergroundcarpark. Thecostsofconstructionandmaintenanceofthepremiseswillbebornebythe FederalGovernment,inlinewiththehigh‐standardagreementsGermanyhas providedforalltheinternationalorganisationsbasedinBonn. Germanywillinvestapprox.75.5millionEurosforthepropertyandthe constructionofthenewbuilding. Transitionalsolution UntilthenewbuildingisreadytohousetheGreenClimateFund,theFederal Governmentwillprovideattractive,renovatedandfullyequippedinterim offices,sothatGreenClimateFundofficialscanstarttheirworkwithoutdelay: therewillbespaceforsome100individualsfrommid2013andanadditional 100frommid‐2014. ByCOP19in2013atthelatest,theGreenClimateFundwillbeginoperationsin aseparatebuilding.Germanywillbeartherentalcostsforaccommodatingthe GreenClimateFundduringthistransitionalperiodandwillsubsequently financethecostsofrelocationtothenewbuilding. PermanentsupportfortheGreenClimateFund TheFederalGovernmentwill,asof2014,invest4millioneurosannuallyto covertheGreenClimateFund’sadministrativecostsinBonn.2millioneuros willbeprovidedin2013.TheFederalGovernmentwillthusensurestable workingconditionsfortheFund. Assumptionofrelocationcosts AllofficialsoftheGreenClimateFundandtheirfamilieswillbereimbursedfor thecostsofnecessaryrelocationtoBonninaccordancewithregulations applicabletoGermanfederalemployees.Forthispurpose,upto800,000Euros ayearwillbemadeavailablefrom2013to2015. Languagecourses OfficialsoftheGreenClimateFundwillalsohavetheopportunitytoattendfree GermanlanguagecoursestofacilitatefullintegrationintotheCityofBonn.The costoflanguagecourseswillalso,ifnecessary,becoveredforstaffnewlyhired inBonn.Upto60,000eurosayearwillbeavailablefrom2013. Developingcountries’travelcostfund Tofacilitatetheparticipationofrepresentativesfromdevelopingcountriesin meetingsandconferences,theGreenClimateFundwillbenefitfromatravel costfund.TheFederalGovernmentwillcontribute1millioneurosayearfrom 2014and500,000Eurosin2013. Outstandingeventinfrastructure InordertooffertheGreenClimateFundmaximumopportunitiesfordialogue, theFederalGovernmentwillprovide1millionEURin2013and2millionEURa yearbeginningin2014forconferencesinGermanyorganizedbytheFund. InordertoreduceexpensesandsupporttheoperationoftheGreenClimate Fund,Mexicowillprovideanappropriatebuildingofatleast1500square meters,freeofrent,foraslongastheFundneedsit. TosupportitsestablishmentinMexico,thegovernmentwillprovide500,000 USdollarstocoveradministrativeexpensesoftheSecretariat.Further contributionsanditsregularitywillbediscussedinthecontextofthe conclusionoftheHostCountryAgreement. TheGovernmentoftheRepublicofNamibiawillguaranteerent‐freeoffices, furnishingandfittingsaccordingtotheSecretariatspecificationsandprovide latestavailabletelecommunicationsandinformationtechnology. WarsawCityHallisoffering5000m²ofprofessionalofficespacelocatedon3 floorsofthePalaceofCultureandSciencefortheuseoftheGreenClimate Found,andensuresregularaccesstoad‐ditionalconferencehallsinother locations.ThemodernITinfrastructureintheofficespaceallowstoconnect anynumberoftelephonelines,Komer‐tel(ISDNbasedbusinessnetwork),SDI, Internet,andtousethehostingservicesonthewww.pkin.plserver.Officearea isavailabletotheGCFstarting1stJanuary2013. TheI‐Tower,wheretheGCFofficewillbehoused,isaneco‐friendlybuilding tailoredforinternationalorganizations.DesignedtomeetUNsecurity requirements.NewSongdoCitywillfullycooperatewiththeGCFtoensurethat allfacilitiesconformtoUNsecurityrequirements. TheGCFwillreceivespaciousofficesofupto21,500m2(43m2perperson, total500persons)intheI‐Towerrent‐freeforthedurationofitsoperations, andmajormaintenanceandrepairstothefacilitieswillalsobeprovidedfreeof charge(equivalenttoUSD6millionperannum).TheGCFwouldberesponsible onlyfornormalmaintenanceandutilities.Upto8,500m2ofadditionalspace canbeprovided,ifnecessary,inconsultationwiththelocalgovernment. Inaddition,uptoUSD1.4millionwillbeprovidedinitiallyforofficeequipment purchases. DedicatedofficesforLDCsandSIDSwillbeprovideduponrequest.Roomsfor culturalandreligiousactivitiesfortheGCFstaffwillbeprovidedintheI‐Tower. Anauditoriumthatseats434personsandtwoconferenceroomsthatseat104 and124personseachareavailable,freeofcharge. Within10minutesfromtheoffice,theGCFwillbeabletouseConvensiA,a world‐classconferencecentrefor20daysperannumfortheentiredurationof itsoperations,freeofcharge(equivalenttoUSD0.5millionperannum).The conferencevenueisequippedwithvarioussupportfacilitiesincluding simultaneousinterpretationsystems. TosupporttheGCF,upto20localgovernmentstaffwillbeavailabletoprovide on‐siteciviladministrativeservices,ifnecessary. TheGCFstaffandtheirfamilieswillbeprovidedwithacomprehensive WelcomePackagetofacilitatetheirrelocationandsettlingintolifeinKorea. Thepackageincludesvariousdiscountsforpublictransportation,andcultural andsportsfacilities(equivalenttoUSD0.3millionperannum). EducationalprogrammesandseminarstolearnKoreanlanguage,customsand domesticlaws,andadministrativesupportforpurchasinghealthinsurance policiesandacquiringadriver’slicensewillbeprovidedthroughthepackage. Switzerland GCF/B.01‐12/09 Page15 Therewillalsobeadedicatedhotlineforimmediateassistance,anddesignated real‐estateagenciestohelptheGCFstaffrentorpurchasehouses.Reserved seatsandscholarshipopportunitiesatinternationalschoolswillbeprovidedto thechildrenoftheGCFstaff. Inadditiontotheofficesiteandrelatedsupportbythelocalgovernment,the GCFwillreceivefinancialsupportforitsexpeditedestablishmentand operationalization.Korea,asanexpressionofitsfirmwilltocontributetothe GCF,willprovidefinancialsupportofUSD2millionin2012forstart‐up,and subsequenttohostingtheFund,anadditionalUSD1millionperannumuntil 2019. Throughnewandadditionalfinancialresources,Korea,asthehostcountry,will utiliseatotalofUSD40millionfortheperiodof2014‐2017tosupportcapacity buildingofdevelopingcountriesinaddressingthechallengesofclimatechange. Detailsontheoperationofthisfinancialsupportwillbedecidedinconsultation withtheGCF. TheSwissgovernmentandtheauthoritiesoftheCantonofGenevawillprovide theSecretariatwithfundingamountingto14.5millionSwissfrancs[12.09 millionEuros]toestablishandoperatetheGreenClimateFund,andthiswithin thestatutoryprovisionsfortheauthorisationandappropriationoffunds. Thesupportincludes: o freeofficespacefortheSecretariatintheWorldMeteorological Organisation(WMO)building. o start‐upfundingamountingto300,000Swissfrancs[250,000Euros] willbeprovidedforacquiringofficeequipment, o afinancialcontributiontotheoperatingcostsoftheSecretariat amountingto3millionSwissfrancsannually[2.5millionEuros], o afinancialcontributiontosupportthecapacitydevelopmentactivities ofdevelopingcountriesrelatingtotheGreenClimateFund’swork amountingto1millionSwissfrancsperyear[833,333Euros], o afinancialcontributiontowardsthetravelandaccommodationcostsof delegatesfromdevelopingcountrieswhoattendmeetingsoftheGreen ClimateFundCouncilamountingto120,000Swissfrancsayear [100,000Euros]. o ThisarrangementappliesforthefirstthreeyearsoftheSecretariat’s operationandwillbereviewedthereafter,accordingtotheSecretariat’s futureneeds.
