Having just spoken to Tom, and from the email that Any dug out from Ralph Pelly we have worked out the issue with Condition 18
discharge: We had been asked to submit the drainage calculations only and therefore Tom was not looking at the drainage plan
that had been shown only to Andy Reading. We had thought that this drawing was already available.
Therefore to clarify:
No further information is expected other that drawing D01. This was the cause of confusion.
I attach:
D01 Rev D - drawing that EA have seen and approved.
D01 Rev F - latest scheme which takes into account the tree roots for the foul drain and soak away. (this has already been
submitted to the LPA via Mark Cassidy in relation to the tree AMS (Condition 20)
Please can you register these drawings formally.

In our response to Ralphs enquiry we advised of what our position would be if the information Ralph provided was to be submitted to the LPA as a formal discharge of condition application (see letter for details).

I have opened the documents provided in your e‐mail comprising a letter from Integral dated 23rd August 2012 , a letter from the EA to R Pelly dated 1st September 2012 and a copy of the Drainage Engineers Objection comment dated 3rd December.
I have also reviewed the website submissions – this includes a letter from Integral dated 25th October 2012, the letter from the Environment Agency to R Pelly dated 1st September 2012 and background papers calculation sheet, construction and logistics and construction programme all scanned 1st November. When the EA were consulted on the 9th November they would therefore have seen the information submitted to the planning department and their formal planning response comments would reflect that submission.
Notwithstanding that the EA were independently consulted by your team the comments provided to the LPA would have been based upon the submissions made to the LPA. I have no way of knowing if they reflect the information that was discussed earlier with R Pelly although it would appear quite clear that the LPA have a different letter from Integral than the one you provided to the EA as they have different dates? I also note that in the EA’s letter to R Pelly with reference to one of the conditions they state a requirement for further information in any event – so it doesn’t appear to me that the EA have confirmed either to me or your team that all the conditions are satisfied from their perspective?
It is to be noted that we consult the EA formally as part of the planning process and that is the relevant process that you need to address. They will have taken account of your full submission when we consulted and they have provided a clear response. It seems to me therefore that the position is clear – the EA consultation response is on the website and it raises issues that remain to be addressed. If you think there is anything missing from my summary of the situation that puts that position in doubt then please identify precisely what I am missing?
I acknowledge that a further submission was made on the 3rd December and the EA were consulted on that yesterday. However as also advised yesterday they are an external consultee and their comments may not be available for 21 days as that is the consultation period. If on that basis you have any supplementary information that you thought you had submitted other than that I have listed ( and which in any event you can see for yourself if you visit the website) then please provide it ASAP as further information will require a further consultation.

I apologise for the lengthy e‐mail but in the circumstances it is important that the position is made very clear so that the issue can be hopefully addressed swiftly.

There is confusion over what is needed for this as it is thought that all information has been sent and that the EA are satisfied with
the level of information. Please refer to the email below and attachments from Integral whom are dealing with this condition

proceed.

We believe that the planning department already have sufficient information to discharge condition 18. Please see the attached correspondence.
My colleague Ralph Pelly has provided a statement indicating the sustainable drainage principles adopted with regard to hydrological and hydrogeological context of the development in his letter to the EA dated 23rd August. In 4
his response to this letter (13th September) Andy Reading of the EA has stated that the EA has no objection to this condition being discharged and they would not require further input if the same information were to be submitted to the planning department in response to the formal condition. Both letters have already been submitted to the planning department.
Please indicate what further information is required with regard to the discharge of condition 18.
