can be heard that day on the application of Mid City Transit Corp. 518 State Rt. 17M Middletown NY 10940 for

Tom Depuy representing Mid City. Basically we are proposing is that this was their employee
parking area and we are going to put a fence around the area move the employee parking across the street . We
are going to fence this area in and install a new catch basin where all the drainage comes together. We will
regrade that area and resurface it. Basically we are going to run the fence line up the property line on the
corner, kitty corner as a requirement of the zoning, we will be heading down here and selectively removing trees.
We were out in the field with Mr. McGoey and marked each tree. The minimal tree removal thru the area and
there is a slight expansion here, we put some gravel here and the maximum area in that area is 10’ in width. We
are also proposing some tree cleaning. It is illustrated here but we will be more selective depending on if there is
any openings in the chain link fence installation.

Thank you. We have been working on this since they began to move the parking across the

Hello- I live on the corner of Breslin and Beakes. My main concern is noise. What they could do
is put a solid fence, maintenance free & vinyl. Something that would deflect some of the noise. It goes on all day
long and sometimes from 11, 12 or 2 in the morning. It’s been 3 in the morning several times. Buses come in
and I sleep with earplugs and it wakes me up. That is one concern. Between Breslin St. and the bus company.
The other concern is will there be no parking signs put back up. I can’t tell you how many times I have gone to
cut my lawn and I can’t because someone is parked on it. they were taken down 2-3 years ago when they redid
the storm drains and were never put back up.

Is that on Beakes?

Yes, on Beakes. Also because they had a shortage in parking they were parking in between that
lot that’s between Mid City and Breslin. I wanted to ask about the pines that are being put up. If I am facing that
fence are they in front or behind the fence?

In front of the fence.

I saw 9 of them on the site plan? I know this is probably a different meeting that probably took
place but I am curious as to the 139 car parking lot. Will there be fencing around that also?
G. Lake
We will come back to that.

I looked over the site plan details for landscaping across the street. I’m sure it will be taken care
of but I did not see anything at ground level or street level along the road as far as fixing up that area or putting
grass or whatever.

Ok. I will talk quickly about the parking lot and then will turn the rest over to the engineers. The
parking lot across the street as you already notice is being worked on now. We spent a lot of time trying to make
sure that would be pleasant to the eye for the neighborhood. We felt that was an important part as people came
up North St./17M. We put extra demands on them. I think for a parking area you will find it to be one of the
most attractive ones when you see the lights, the landscaping etc. it won’t look like a mall parking lot. I don’ t
have anything here tonight for that because I did not expect to talk about it. Again, I think anybody in that area
should be very pleased with the final project. the gentleman that does own that land has many projects in Town
and they are all good jobs so my confidence is quite high. To answer your question, he is adding landscaping in
the back. I don’t think he is doing white vinyl to make it more quiet, maybe a few more pine trees?

White pine and some other evergreens, 6-8’.

We normally don’t debate, we take your information but I want to give you what is going to be
done. Tom – can you answer some of the questions he had.
T. Depuy
We are proposing 6 to 8 foot high evergreens and some white pines and Norway spruces. We
are proposing the fence to be black vinyl with black posts to blend into the background. It’s chain link with no
slats – just the pine trees.
G. Lake
as far as the no parking signs along Beakes, we will send something to the DPW. That is their
department. Marylynn has made a note and will inform them tomorrow. Anybody else want to speak?

What are we looking at for the height of the fence? Is it 6’ and 3’?

We had indicated at the previous meeting that we are going to be 6’ but at the
one corner is in a residential and we are showing it as 3’. We are going to the ZBA to ask for a variance to
increase that to 6’.
D. Dulgarian
so tonight you are looking for approval for the 6’ and the 3’? Hopefully you will be
granted 6’ variance before you actually put it up?

Yes, correct.

I think it’s an improvement over what is there now. I understand the growth needed
for the company and have no issues. The neighbor bought up a good issue with the screening. For my
knowledge, these buses run at 2 a.m.?
T. Depuy
They return at that time – they are out on trips.
Dan/Mid City
Basically with the addition of the parking lot we already have a part that is planned to
avoid putting the buses in reverse and using back up beepers. We will try to have 2 rows that are for the late
buses to come in and out of. We do have handful of buses that have late night sports trips and such. They can
just pull in and park, we can put our trip buses for weekends and at night in certain sections to avoid the back up
noise.

Yes, we will have a designated late night drop off area.

Again, I like the project. Dick, I will put the rear screening in your hands. I would like to
see it be as effective as possible. I know in the past we have done a mound and then the landscaping to gain
some privacy and quiet. Whatever you decide.
J. Keegan
I agree that it is an improvement. I agree with the no parking signs around Beakes.
Other than that I have no issues.

I think Mr. Tilden bought up a good point about the noise in the area. We did mention
the landscaping trying to reduce it. I think it is something that could be revisited. I know on the plan it says
selected trees. In other words, they are going to plant the trees and protect the area and give you as much noise
break as possible. As long as it is on the plan we can revisit it and say it’s not enough, it’s not working. .. I
understand your concern. The trees will grow out but not immediately.
A.Guattery
I agree, it’s a good example of a business trying to be a good neighbor. Mid City buses
are in and out all the time and it can get noisy. Perhaps the pines could be staggered along Breslin and get a few
more in as we get up to Beakes. You have 4 that you are showing along the residential lot, maybe Tom could stick
3 in between them staggered to get them to grow out quicker.
T. Depuy
We could propose an add’l 3-4 trees in that area.
A Guattery
I think Mid City is showing that they want to be a good neighbor. When all is said and
done we can keep everyone in the neighborhood happy. I have nothing else.
T. Hamilton
I agree with the staggering of the pines. The parking, the main reason the lot is across
the street is that the employees can park in the new lot and should not be on the streets any more. That is what
the new lot is for – to stop that from happening.
R. McGoey
You have some planting along Beakes?
T. Depuy
Yes, I had put a note on there - we have some proposals from some landscapers and we will
meet the 249 rule and detail that.
G. Lake
Ok – you need to add a few trees and if any of them die they need to be replaced. We have
been talking about placing something on plans for replacement of landscaping. I would like to see something on
that. Any problems with Dick’s comments? I think we need to talk about the sidewalk connecting along 17M.
I see on this plan it is down here. Do you have a safe way to get the people onto your property?
T. Depuy
We had a meeting. On the adjacent property where they are doing the parking they are going to
have a sidewalk along Beakes with a crosswalk across at the intersection. It’s not happening on our side, its on
the other side.
G. Lake
I realize that – I’m just reviewing the whole scheme. We want to make sure we meet the safety
for everybody. I have nothing else.
T. Hamilton
On that landscaping note it should state that the ones that do not survive thru the
winter will be replaced at the next growing season.

that day on the application of 12th Rock Ministries for Subdivision approval, Site plan and special permit use
approval of a 91,700 indoor recreational sports facility with a food service area located on Pocatello Rd. O.C. Rt.
11 on Tax lot 69-1-64.2 and 64.3 under Section 249-20 of the zoning law of the Town of Wallkill. All parties of
interest shall be heard at said time and place. I rec’d his mailings.

Jay Samuelson, Engineering Properties. What we have here is 2 parcels that total about 93
acres. One is 86 and the 2nd lot is 5. We are going to be doing a SD and adding about 8.5 acres to the 5 acre lot.
The indoor recreation will consist of 4 hardwood basketball and volleyball courts, one turf field and an indoor
running track. There will be associated locker room facilities, offices and a small food service area. Access will be
obtained from Pocatello Rd. (County Rt. 11) directly opposite the firehouse entrance on the other side. It’s Mt.
Hope Rd. Originally the traffic was designed to gain access off Eggerton Ave. Our initial application was heard
by the School District and the Fire District and thru conversations we reoriented the project to have a main access
off of Mt. Hope Rd. with emergency access only out to Eggerton Rd. there will be a gate at Eggerton Rd. which
will have a Knox box for the Fire Dept. the only time it will be used is to allow traffic to exit on weekends during
large events. The other thing was the parking. At this point we are proposing to pave 301 spaces along the front
and side of the building. In the rear we are proposing to land bank 325 parking spaces. In land banking we will
construct that area as if we were going to pave it. We will not put the final asphalt on it, we will put topsoil and
seed. At some point in time if the need arises they can strip the topsoil etc. we can support parking for overflow
for the few large events that they may have. There is an existing berm along the school property that we will be
maintaining and landscaping. This is the area, 13.5 acres – there is an existing berm here next to the school
which we will be landscaping and maintaining. One of the existing barns which is in good shape is going to be
maintained and used for storage by the applicant. There will be no public access to that building.

Actually my concern was addressed. I’m with the School District, President of the Board right
now. You guys should know we met with the applicant and engineer just voiced our concern which was the main
access coming off Pocatello. We had a similar concern as the Fire Dept. It sounds like they have met that concern
so we are satisfied.

Dicks comments –any problems?
J. Samuelson
We met with Dick in a workshop. We have gone over a few of the items. Most of the items on
his comment letter have been addressed in this submission. I just rec’d SWWP comments today that I will
address. The rest of them I have no issues with.
G. Lake How about the OC DPW?
J. Samuelson
I sent the plans and copies of the traffic report 4/21/16. I have not heard from them yet. We
had met with them informally before we came to the PB and showed them the project. they did not come up
with any major concerns at that time. Just told us to submit plans and a traffic report for that area.
G. Lake
I thought you mentioned at WS that you might need a turning lane? Maybe I’m thinking of the
wrong project or different applicant.
J. Samuelson
Not on this project.
G. Lake
Is there anything else in Dick’s comments? Unfortunately without anything in writing from the
County we can’t act. We will ask you to waive the 62 day time frame (OK) and then when you get the info from
the County and it gets back to us we can see if we agree with it. there might be something that we see that might
change everything.
R. McGoey
is OC Health Dept going to review the plans?
J. Samuelson
That is the problem I have. I would like to get the Health Dept. to review the water main
ext. but I can’t without a neg dec. or preliminary.
G. Barone
Because this is not a Type 1 we can neg dec it with the understanding that they will have
to address OC DPW comments or concerns.
J. Samuelson
We are committed to answering any commentsconcerns they have.
G. Barone
Then we can give them preliminary so they can start working with the Dept of Health. I
don’t see a legal barrier to that.

As long as the understanding is there that between preliminary and final that if there is a drastic
change the preliminary goes away. I don’t want to be caught in something I can’t get out of.
J. Samuelson
Yes, and I agree.
D. Dulgarian
I am for the banked parking. Although the entrance, intersection won’t be used often it
probably can be intense at times, especially in the winter months when it’s dark out. I would be interested in
seeing the County comments on it. I do have concerns on that. On the Eggerton side is it all paved?
J. Samuelson
No we are going to end the paving at the end of the building and then it will be gravel
out to Eggerton from there. A gravel emergency access road out to Eggerton.
D. Dulgarian
Yes, but you will use that at big events and weekends?
J. Samuelson
right, if they have them during the winter they will have to clear the snow off the entire
field areas. If they do, it will all have to be cleared for parking and emergency access as well.

Hello, Gregg with 12th Rock Ministries and no we are not running it as a ministry. It is a
completely separate business operation so it’s not tax free.

I agree with Dougs comments and most likely they will have events all year round and
they will need to keep that cleared all year round. I think it’s a good project.
B. Capozella
I’ve given my opinion before – I love the project and am all for anything for the kids. My only
concern has been since the beginning of the project – the exit coming out of there. I think at this point I’ve said
enough about it and would love to see what the County has to say about it. Once we get their report back maybe
Sells can look at it. I know we have the traffic study here that talks about the number of trips and so forth based
on the Goshen Facility. Right now it looks great; obviously you don’t tell it could be a number of trips that would
reduce it to a C. I like to have the facts in front of me instead of scattered over the pages. Maybe have Sells look
at this and make his comments and go from there.

I agree, the project in itself is very good but we need to see traffic numbers. It’s important and I
know the County will make the rules on whether or not a light go in. It’s all about safety for everyone. We
certainly understand the schools position. We need to make sure we protect everyone. On that note I really
agree 100% on banking for the parking. I have a problem with the gravel emergency access road. It does not just
snow it rains here and will turn into a mud pit. It won’t do us any good if we set it up and cover it with topsoil and
grass. I would like to see that better defined.
J. Samuelson
The emergency access road will be 20’ wide and will be no topsoil or grass that will be just the
item. This includes the bus parking in the back – that will all be gravel all the time.

on that emergency lane where you are stating the gravel you have to make sure the lane is left
open for the emergency crash gate. It has to be stipulated where they are going to park to leave the access lane
open.

Ok. You have no problem with Dick’s comments (no). We are going to move forward and ask
the board to give you preliminary but I really want it understood that if the County comes back those
modifications must be done between preliminary and final.

I need a permit from them to get my driveway so i will do what they ask for.

in Wallkill. We are on the other side of Town for over 20 years and are looking to expand the operations to this
side of Town. We have met with the Board numerous times and believe we have addressed the items.
G. Lake They have been to the Town Board and the Town Board added this use to the zoning as an allowable
use. That is why they are not going to the ZBA. Motion to open this PH at 8:12pm. Motion to close this PH at

What you did in Goshen is in the Town of Goshen, not Wallkill. We believe you don’t need the Public Hearing.
We understand that Goshen maintains that for you. (all of it). If Goshen is going to continue it’s up to them but if
they don’t someone has to maintain it. Just for the safety factor and the future get together with Mr. Barone and
straighten that out.

Caldor Indoor Self Storage Site Plan/Special Use Permit – 360 Rt. 211e (50-2-36) # 09-05
G. Lake This is an allowable use by the Town Board. The reason is retail is changing and this might be a way to
take some of the larger spaces.

Dave Higgins, Lanc & Tully Eng. WE were here in June and at that point in time the Town Board
had not yet adopted the Local Law to allow the self-storage use. We have updated the plan since that time. I
made a change in the plan. I will hand out some papers to show you exactly what we have done. Basically we
were proposing the entrance to the office space in the front portion of the building and we had access to the
storage areas with an overhead door and a keypad control on the side of the building behind the pizza place.
Since then the owner have reviewed it and wanted to reconfigure some of the area they want to utilize. We have
eliminated the office space previously shown in the front and we are still using the side behind the pizza place.
Access of 14’ overhead sliding door for the storage area. The building is 2 stories. We also want to have the main
entrance to the office space and add’l storage from the rear of the building. It would be to the left of the scuba
shop. One of the comments at the last meeting was to try to improve the view from Carpenter Ave. We would
like to make that our entry for the office space. We would clean up the façade in the back and also the side
where they need the second entrance. We still have relocation and cleanup of the dumpsters. The crew was in

calcs. The s.f. is now at 33,520 total associated with the self-storage. The zoning notes have been updated to
reflect the size of the structure and percentage of the building. We are making exterior improvements to the
façade and sign.

As far as the dumpsters we are trying everything that is in our control to fix it. They are
promising to close the doors. We are dependent on kids that are taking out garbage.

I understand what a headache it is. I owned a small retail so I’m familiar with it. It’s the only
thing that is bad out there. If your garbage guy is not willing to close them then get another one. The one that
works for the Town closes the gates. I would think this is a good account and they would be concerned if you
were going to take your business elsewhere.
D. Dulgarian
I have no problem with the use. I do feel strongly that the back entrance is a highly
traveled road and even the entrance should have a reader board or more appealing, maybe some landscaping.
The far corner of the lot still has concrete barriers – that should be filled in with grass or made to look like
something, it’s messy. You have done a tremendous job but you need to concentrate on the rear of the building .
It’s highly travelled and the entrance is easy to miss. That entrance should be spruced up with landscaping and
signage.
