Subject to the Terms and Conditions listed on the reverse and as per the following: I have completed this application accurately and truthfully. By signing this application, I agree to be bound by the committments I have made in the application and to have them form conditions on any permit that is issued. Further, I agree to absolve the City of Winnipeg, the Chief of the Fire Paramedic Service and any Designated Employee from any and all damages or civil litigation caused by or attributable to the storage of fireworks/pyrotechnic special effects by the owner, occupier or person in charge of the premises. This Permit is subject to a Fee as set out in the By-law. Upon receipt of payment, this Permit is valid unless suspended or revoked. Further Conditions: This Permit is non-transferable and is valid for the storage of >1000 kilograms gross weight of Low Hazard Fireworks-Class 7.2.1.; or any amount of High Hazard Fireworks-Class 7.2.2.; or any amount of Pryotechnic Special Effects-Class 7.2.5. at the above noted business address. The Chief of the Fire Paramedic Service or any Designated Employee may revoke or suspend a Dangerous Quantity Fireworks Storage Permit upon giving such notice and opportunity to appeal the revocation or suspension where the Chief or Designated Employee believes the applicant has contravened any conditions of the Permit, the provisions of the By-law, or any provisions of the Manitoba Fire Code or where conditions make the permitted activity unsafe. TERMS AND CONDITIONS The person to whom a Dangerous Quantity Fireworks Storage Permit has been issued shall implement and comply with the following conditions by: - retaining the Permit at the business address where the Low Hazard Fireworks-Class 7.2.1. or High Hazard Fireworks-Class 7.2.2. or Pyrotechnic Special Effects-Class 7.2.5. are being stored and producing such Permit for examination upon request; - allowing any Fire Paramedic Service employees to enter and inspect the premises for compliance with all applicable sections of the By-law; - ensuring a sprinkler system is in the building in conformance with the requirements for buildings classified as High Hazard Industrial in the Manitoba Fire Code, unless an exemption is granted by the Fire Paramedic Service; - providing portable fire extinguishers in conformance with NFPA 10, minimum size 4A (2 - 2A's = 1 4A); - not allowing any employee under the age of eighteen years to store any fireworks; - not allowing any employee under the age of eighteen years to handle any fireworks unless under the supervision of a Fireworks Supervisor; - strictly limiting the sale of any fireworks to person(s) eighteen years of age or older and prohibiting the sale of fireworks to persons under eighteen years of age; - providing for sale, only those fireworks that are included on the most recent list of authorized fireworks effects as maintained on a list by the Chief Inspector of Explosives for the Government of Canada pursuant to Section 24 of The Explosives Regulations, C.R.C. c.599; - not selling or offering for sale any fireworks to any person unless that person is in possession of a valid Fireworks Display Permit ("sparklers" or "caps" for toy guns DO NOT require a Fireworks Display Permit and are therefore exempt) or a valid Small Quantity Fireworks Distribution Permit; - displaying fireworks in lots that do not exceed 25 kilograms (55 lbs) gross weight, in a display case, package or other suitable receptacle that is NOT ACCESSIBLE to the general public; - ensuring any person who stores and handles fireworks does so in a manner that minimizes the risk that they will be set off accidentally, such as by storing fireworks in close proximity to combustible materials or a location where the fireworks will be exposed to the rays of the sun or excess heat; - ensuring any fireworks that are NOT displayed in an approved manner and ARE accessible to the general public are "mock samples" only, which contain no explosive compound and are clearly labelled as such; - providing all manufacturers instructions on the safe use of the fireworks with each sale; and - supplying printed information in a form acceptable to the Chief advising the purchaser or recipient of the fireworks that no fireworks may be ignited, fired or set off within the City of Winnipeg without a valid Fireworks Display Permit issued by a Fire Paramedic Service employee.
