Newman Smith High School Discipline Management Plan Level 1 Procedures: 1. Intervention shall occur by the staff member who is supervising the student or who observes the misbehavior. 2. Repeated violations shall result in a more severe response. Four Level 1 violations will result in a Level 2 Offense, except where noted. Consequences: Disciplinary actions shall include, but not be limited to: warning/reprimand, conference with student, withdrawal of privilege, classroom isolation, teacher-assigned detention, work detail, confiscation of items, and/or parental contact. Level 1 Offenses include, but are not limited to: • Cheating/plagiarism/copying the work of another: Cheating/plagiarism/copying may result in a grade penalty and disciplinary action to be determined by the teacher. All incidents of this nature need to be documented on a Code of Conduct referral and given to NSHS administration. Second offenses will result in a Level 2 consequence. • Eating and/or drinking in an unauthorized area: Only unflavored water is allowed in classrooms.. • Failure to bring books/supplies to class and/or do assigned work • Horseplay and/or running in the halls, cafeteria, or classrooms • Littering • Loitering, either in an unauthorized area, or on campus after school hours • Misuse of pass • Use, display or evidence of possession of a paging or cellular device in the school building between the hours of 7:30 am and 4:15 pm will result in confiscation of the device. These items may be retrieved for a $15 fee. • Public displays of affection are limited to holding hands • Sleeping in class • Violation of published classroom rules and/or procedures established by the teacher • Unauthorized use/possession of an iPods, MP3, radio, recorder, etc: At the discretion of the teacher, radios, MP3, recorders, iPods, etc. may be used for educational purposes within the classrooms. Students shall, however, keep these items in their book bags until they are in the classroom in which the use is authorized. • Violation of CFBISD Dress and Grooming Policy. Level 2 Procedures: 1. Refer violations to an administrator 2. Disciplinary action will be based on previous actions and/or the seriousness of the offense. Repeated violations shall result in a more severe response. Consequences: Disciplinary actions shall include, but not be limited to: afternoon detention, DMC placement, suspension, work detail, withdrawal of privilege, and/or legal action. Level 2 Offenses include, but are not limited to: • Bus disturbance Additional information is provided in the School Transportation handbook. • Continuation of Level 1 offense • Insubordination or disturbance in class, hall, cafeteria, or elsewhere on school grounds • Dress code violations • Engaging in threatening behavior and/or encouraging, promoting, or inciting violence • • • • • • • • • • • • • • • • • • • Excessive tardies Extortion/coercion: Defined as threatening others. Failure to properly display ID ID’s must be worn in a visible manner on the person and above the waist at all times: 1st - 3rd occurrence - warning 4th occurrence or more– DMC These levels start over each nine weeks grading period Forgery and/or falsification of a school document: Some cases of forgery/falsification may be serious enough to become a Level 3 offense. Administrative discretion will be used in determining these cases. Gambling or any form of wagering Gang-related drawings, signs, verbal comments and/or gestures (first offense) Hazing Insubordination/Failure to comply with at reasonable request/Failure to serve admin. consequences Leaving school/class without permission: Leaving class without permission is considered insubordination/truancy. Misbehavior at a school-sponsored activity Possessing, smoking, or using tobacco products on campus or at any supervised school activity: Tobacco products, including lighters, matches, and flints will also be confiscated. Possessing any laser-pointer, knife, club, or chain deemed inappropriate by school personnel: Any laser-pointer, knife, club, chain, or other item will also be confiscated. Profanity, vulgar comments, vulgar gestures and/or drawings Harassment (verbal abuse, racial slurs, and/or derogatory statements): Defined as intentionally, knowingly, or recklessly making physical contact, comments, gestures, or conduct relating to an individual’s race, color, sex, national origin, disability, or sexual orientation. Verbal or physical conduct or communication of a sexual nature will not be tolerated. Truancy/Skipping: Defined as an unverified absence from one or more class periods. (Note: State law requires that, in order to receive credit for class, a student must attend that class 90% of the available class time. When there is a verified and legitimate excuse for any absence that may cause a student to be below the 90% attendance requirement, that absence may be made up in an after-school or Saturday session in order for the student to recover credit.) Violation of clinic procedure: For further information, please see the District Student Handbook. Unauthorized use of vehicle, speeding, or parking lot violation Additional information is included in Parking Lot Violations and Consequences handout Vandalism/Criminal Mischief: Defined as damaging or defacing another person’s or school’s property. Non-felony theft Level 3 Procedures 1. Refer violations immediately to an administrator 2. Additional information regarding the offenses that result in placement at the District Alternative Education Program (DAEP), procedures, due process, conferences, and appeal process can be found in the Code of Student Conduct. A student MAY be placed in an AEP if the student commits any of the following offenses on school property or while attending a school-sponsored or school-related activity, on or off school property. 1. Involved in any offense or policy violation listed as General Misconduct 2. Involved in any persistent and/or serious misbehavior. (See glossary for definitions) 3. Selling, giving, delivering, manufacturing, or using any substance deemed inappropriate by administration. 6. Possessing or using any legal knife including a pocketknife. * 7. Possessing, distributing, or accessing pornographic or lewd materials in any media format. A student WILL be placed in an AEP if that student engages in any of the following regardless of where the conduct occurs: 1. Engaging in conduct that occurs off school property and not at a school-sponsored or school-related event, and that results in the Superintendent or designee having reasonable belief that the student has engaged in conduct defined as a felony offense other than those defined as a Title 5 felony; and the continued presence of the student in the regular classroom threatens the safety of other students, teachers or would be detrimental to the educational process. 2. Conduct involving a public school and containing the elements of the offense of false alarm/report or terroristic threat. 3. Retaliation against any district employee, volunteer, or professional providing services to the district. 4. Being required to register as a sex offender with or without court supervision. A student SHALL be placed in an AEP if the student commits any of the following offenses on school property or while attending a school-related or school sponsored activity, on or off school property. 1. Reckless and/or dangerous behavior 2. Serious and/or persistent misbehavior 3. Weapon possession (includes “look-alike” weapons) 4. Formal removal from class by a teacher A student SHALL be placed in an AEP if the student commits any of the following offenses on or within 300 feet of school property or while attending a school-related or school sponsored activity, on or off school property. 1. Engages in conduct containing the elements of Assault [Texas Penal Code §22.01 (a) (1) (2) (3)] • Intentionally, knowingly, or recklessly causes bodily injury to another. • Intentionally or knowingly threatens another with imminent bodily injury. • Intentionally or knowingly causes physical contact with another when the person knows or should reasonably believe that the other will regard the contact as offensive or provocative. (Note: Aggravated assault or assault against a school employee, volunteer, or professional providing services to the District is expellable). 2. Fighting (mutual combatants) Fighting will NOT be tolerated at Newman Smith High School and will result in legal action, three-day suspension, and AEP assignment. 3. Engages in conduct punishable as a felony. 4. Possessing (any amount), using, selling, giving, delivering, conspiring OR attempting to possess, use, sell, give, deliver, conspire or be under the influence of (legal intoxication not required) any of the following substances on school premises or off school property at a school-sponsored activity, function, or event: (Note: felony offenses are expellable). • Any controlled substance or dangerous drug as defined by law including, but not limited to: marijuana, controlled substances, dangerous drugs, any narcotic drug, hallucinogen, stimulant, depressant, amphetamine, or barbiturate. Includes “look-alike” drugs. • Alcohol or any alcoholic beverage. • Engages in conduct that contains the elements of an offense relating to an abusable volatile chemical. • Any other intoxicants, mood changing, mind altering, or behavior altering drugs. • Possessing or selling seeds or pieces of marijuana in less than a useable amount. 5. Engaging in conduct that contains the elements of the offense of public lewdness or indecent exposure (includes mooning, flashing, etc.) 6. Selling, giving, delivering, possessing, manufacturing, or using any form of drug paraphernalia. 7. Possessing or selling any “look-alike” weapons including but not limited to: starter guns, air guns, BB/pellet guns, or ammunition. 8. Involvement in gang activity and/or public school fraternity, sorority, or secret society. 9. Failing to report potentially serious, dangerous and/or threatening activity to school or police authorities. Level 4 Procedures 1. Refer violations immediately to an administrator 2. Additional information regarding the offenses that result in expulsion from the district, procedures, due process, hearings, and appeal process can be found in the Code of Student Conduct A student MAY be expelled if that student engages in any of the following within 300 feet of school property or while attending a school-sponsored or school-related activity on or off school property. 1. Selling, giving, delivering to another person, possessing, using, or being under the influence (legal intoxication not required) of any amount of marijuana or controlled substance, a dangerous drug or alcoholic beverage. 2. Deadly Conduct. 3. Engages in conduct that contains the elements of an offense relating to an abusable volatile chemical. 4. Serious or persistent misbehavior while assigned to DAEP. A student MAY be expelled if that student engages in any of the following regardless of where the conduct occurs: 1. A student who engages in expellable conduct on school property or a school-sponsored/school-related event of another school district in the State of Texas. 2. Engaging in conduct that under the Texas Penal Code constitutes a false alarm or report OR terroristic threat involving a public school. 3. A student engages in obstruction or retaliation against a school employee (Penal Code 36.06) or a volunteer as a result of the person’s employment or association with the District. 4. Criminal Mischief if punishable as a felony. A student WILL be expelled if that student engages in any of the following within 300 feet of school property as measured from any point on the school’s real property boundary line or while attending a schoolsponsored or school-related activity on or off school property. 1. Committing a serious act or offense while under the influence of alcohol or drugs, if the behavior is not punishable as a felony. 2. Aggravated assault or assault (including retaliation) against a school employee, volunteer, or professional providing services to the District 3. Using, exhibiting, or possessing a firearm, illegal knife, a club, or prohibited weapon as defined by state and/or federal law. 4. Committing arson or offenses that contain the elements of arson. 5. Committing indecency with a child, aggravated kidnapping, manslaughter, criminally negligent homicide, aggravated robbery, or injury to a child. 6. Murder, capital murder, or criminal attempt to commit murder or capital murder. A student shall be expelled who participates in conduct that contains the elements of aggravated assault, sexual assault, aggravated sexual assault, murder, capital murder, criminal attempt to commit murder or capital murder, aggravated robbery, or organized criminal activity against another student, without regard to where the conduct occurs. A student WILL be expelled if that student commits any of the following offenses on school property or while attending a school-sponsored or school-related activity on or off school property: 1.Drug and alcohol offenses if punishable as a felony. 2. Use, exhibition, possession of: a firearm, an illegal knife, a club, or a prohibited weapon 3. Any firearm muffler or firearm silencer. 4. Any destructive device, such as an explosive, incendiary or poison gas bomb or grenade. 5. Behavior containing the elements of the following under the Texas Penal Code: • Aggravated assault • Sexual assault • Aggravated sexual assault • Arson • Murder/Capital murder/Criminal attempt to commit murder or capital murder • Manslaughter • Criminal negligent homicide • Indecency with a child • Aggravated kidnapping • Aggravated robbery
