CCSB DOCKET 2016-2 SECTION I SUBJECT 2 Analysis Research Project 1231 This proposal is based on information developed through Research Project 1231, which was initiated in June of 2014 in light of evidence of potential interpretation disputes and to investigate the transportation characteristics of wrapping paper, including wrapping paper sets. During the course of Research Project 1231, questionnaires were mailed to 190 potential manufacturers or shippers of the involved commodities, along with three trade associations believed to represent those companies. Mailings were sent in July of 2014, and for nonrespondents, a second, follow-up questionnaire was sent in October of 2014, inviting them to participate in the research. Additional questionnaires were sent as the CCSB was made aware of other potential industry contacts. From those mailings, 13 companies responded that they do not manufacture or ship the involved articles, and five companies provided some information. No responses were received from the associations contacted. History of Provisions The provisions for wrapping paper, including wrapping paper sets, reflect action on numerous proposals spanning several dockets over several decades. Since the time of their establishment/adoption, there have been amendments to the involved provisions, including class adjustments, packaging changes and the addition of clarifying or restrictive Notes. About Wrapping Paper, including Wrapping Paper Sets The involved research encompasses an array of wrapping paper utilized in a variety of applications. However, the commodities embraced within this research project can be divided into three distinct categories: decorative wrapping paper or paper-backed foil, wrapping paper, NOI, and gift wrap sets. Gift Wrap Sets Subject 2, Page 5 of 8 CCSB DOCKET 2016-2 SECTION I SUBJECT 2 Transportation Characteristics Density—Overall, the information of record includes 15,280 density observations submitted by shippers and carriers, observed firsthand on CCSB dock surveys and obtained from the CCSB’s Density Study1. The data can be further analyzed into the three distinct categories as previously mentioned. The table below relates that information, where known, to the proposed provisions, and subprovisions, where applicable. Larger rolls, primarily those holding 50 feet or more per roll, may be tendered unitized to lift truck skids or pallets. Handling and stowability should be comparable to that of other like-packaged freight. There have been no reports of unusual or significant handling or stowability problems. Liability—The involved commodities are not unusually susceptible to theft, hazardous in nature, unusually liable to damage, nor do they appear likely to damage other freight. Some of these commodities, particularly holiday wrap, are time-perishable, although no problems have been reported in this regard. Responding shippers and carriers reported minimal to no claims for the involved articles. The value per pound for wrapping paper, including wrapping paper sets ranges from $0.35 to $26.67, with an average of $2.72 per pound. The Density Study is part of an ongoing effort by the CCSB to collect information on actual shipments; it is not tied to any particular research project, nor does it target any particular product category. Carriers that choose to participate in the study periodically submit shipment data captured through their respective freight auditing programs. The data is identified by NMFC item, and only verifiable data points, which include the weight and the dimensions and/or cube of the shipping unit involved, are used. 2 While the density information relating to decorative gift wrap is wide in range, nearly 70% of the figures are clustered between 6 and 12 pcf, with over 53% between 8 and 10 pcf. 3 While the density information relating to wrapping paper, NOI, is wide in range, slightly over 80% and 92% of the figures are 12 pcf or greater, for proposed subs 1 and 2, respectively. 4 The density information related to gift wrap sets is broadly distributed throughout the range. CCSB DOCKET 2016-2 SECTION I SUBJECT 2 Relationship to CCSB Policies and Guidelines CCSB policy calls for the amendment of classifications for commodities that are a source, or potential source, of interpretation disputes so as to eliminate or avoid those disputes. The items named in the Present Classification Provisions herein apply on various types of wrapping paper, including wrapping paper sets, which may result in interpretation questions. As such, to address the potential interpretation issues, and in the interest of clarification and simplification, it would be within CCSB policy to combine these related items, as shown in the Proposed Classification Provisions. CCSB policies also call for establishing or amending classification provisions to reflect a commodity’s known transportation characteristics. Information of record for decorative gift wrap shows a range in density from 1.00 to 40.61 pcf, with an average density of 9.68 pcf, and no unusual or significant handling, stowability or liability characteristics. As explained in footnote 2 on page 6, the preponderance of density figures are concentrated within a narrow range around the overall average. Under CCSB guidelines, an average density of 9.68 pcf is generally associated with class 100, which calls for a minimum average density of 9 pcf. This proposal would assign class 100 to item 151780.5 Information of record for wrapping paper, NOI, shows an overall range in density from 1.38 to 96.18 pcf, and no unusual or significant handling, stowability or liability characteristics. It has been found that wrapping paper in rolls less than 50 feet per roll exhibits generally lower densities than wrapping paper in rolls 50 feet or more per roll, or other than in rolls, with average densities of 18.19 pcf and 23.00 pcf, respectively. As explained in footnote 3 on page 6, a strong clustering of density figures are concentrated within a narrow range around the averages. This proposal would assign classes 70 and 65, which under CCSB guidelines call for minimum average densities of 15 pcf and 22.5 pcf, respectively, in item 151800.5 Information of record for gift wrap sets shows a range in density from 1.23 to 48.11 pcf, with an average density of 11.07 pcf, and no unusual or significant handling, stowability or liability characteristics. As explained in footnote 4 on page 6, the densities are broadly distributed throughout the range, with the composition of these sets varying from set to set. Under CCSB policy, commodities exhibiting a wide range in density not accurately reflected by a single overall average density may be assigned density-based classes; especially when there are no unusual or significant handling, stowability or liability characteristics. Accordingly, this proposal would cancel items 153850, 154500, 154560 and 174030, with reference to item 153900. Concurrently, item 153900, which provides classes based on the CCSB’s standard 11- 5 Precedent for this approach can be found in Docket 2014-2, Subject 7 (May 2014), involving wood shakes or shingles. No significant handling, stowability or liability concerns were reported and, as such, density was determined to be the primary transportation characteristic. Wood shakes or shingles exhibited a wide range of densities—3.20 to 58.26 pcf—with a significant concentration of density observations—over 73%—clustered around the overall average density of 21.98 pcf. Based on the information of record, and in keeping with CCSB guidelines, that proposal was approved as docketed, assigning class 70, and the provisions first appeared in Supplement 2 to NMF 100-AN, effective August 9, 2014. ©2016 National Motor Freight Traffic Association, Inc. Subject 2, Page 7 of 8 CCSB DOCKET 2016-2 SECTION I SUBJECT 2 subprovision density scale6, would be amended to specifically name gift wrap sets in the viz. listing. 7 Further, in the interest of clarification, two new Notes would be established. The first new Note would be referenced by item 151780 to direct the NMFC user to item 151800, sub 2 for provisions applicable to decorative or gift wrapping paper or paper-backed foil in rolls 50 feet or more per roll, or other than in rolls. The second new Note would be referenced by item 153900 to clarify that the provisions for gift wrap sets apply on gift wrapping paper or paperbacked foil and one or more of the following in the same retail package: boxes, gift cards, seals, tags, ribbon, ribbon bows or rosettes. Lastly, Notes, items 151791, 151792, 151801, 151802, 151803, 151804, 154502 and 154562 would be canceled with no further application. Based on the information of record, this proposal, as docketed, is consistent with CCSB policy and precedent. 6 The CCSB’s standard 11-subprovision density scale includes reference to Item (Rule) 170, the inadvertence clause, and Item (Rule) 171, the “bumping” privilege. 7 Precedent for this approach can be found in Docket 2016-1, Subject 11 (January 2016) involving “Cookies or Crackers.” In that instance, the CCSB approved the cancelation of separate items for cookies or crackers that ranged in density from 0.26 to 73.23 pcf, with reference to the full-scale densitybased provisions of item 72040, with other bakery goods.
