Meeting with deputations and the Administration
[Consultation Report and Proposals on the Method for Selecting the Chief
Executive by Universal Suffrage]
1.
The Subcommittee deliberated (index of proceedings attached at Annex).
2.
The Subcommittee received views from 111 deputations/individuals
attending the meeting, and noted that 13 written submissions had been received
from other organizations/individuals which/who did not attend the meeting.
3.
The Chairman reminded members that the next meeting would be held on
23 May 2015 at 9:00 am to continue to receive views from deputations on the
Administration's proposals on the method for selecting the Chief Executive by
universal suffrage.

The Under Secretary for Constitutional and
Mainland Affairs ("USCMA") thanked the
deputations for their views and comments. He
emphasized that for constitutional development to
move forward, it was necessary to seek common
ground, set aside the differences in view and
strive for consensus. The work of the Hong
Kong Special Administrative Region Government
was to formulate, in strict accordance with the
law, a package of proposals for selecting CE by
universal suffrage that was constitutionally and
legally in order, fair and reasonable, and at the
same time take heed of factors including political
reality and actual operation to strive for universal
suffrage through "one person, one vote" in 2017
as scheduled.

Mr CHAN Kam-lam considered that the specific
method for selecting CE by universal suffrage
should not be tailor-made for individuals or
individual political parties.

In response to deputations' concern about the
future refinement to the method for selecting CE,
USCMA said that after achieving universal
suffrage, should there be a need to amend the
method for selecting CE after 2017, Article 7 of
Annex I to BL and the "Five-step Process" of
constitutional development had already provided
a clear legal basis for initiating such further
amendments to the method for selecting CE.
He emphasized that the Proposals could respond
to the strong aspiration of the different sectors of
the society to implement universal suffrage for
the selection of the CE as scheduled, and to allow
Hong Kong’s constitutional development to move
forward.

merits in forming the nominating committee
("NC") by following the same framework of the
four sectors of the Election Committee in order to
strike a balance among the interests of all sectors
and ensure the preservation of the capitalist
system in Hong Kong.

discussion had to be based on the legal
framework constituted by BL and the Decision of
the Standing Committee of the National People's
Congress ("NPCSC") on 31 August 2014 ("2014
Decision of NPCSC").

Government should respond to Hong Kong
people's demand for genuine universal suffrage.
Mr Jeffrey LAM considered that debating over
whether the Proposals would allow Hong Kong
people to have genuine or fake universal suffrage
was meaningless. He agreed that the method for
selecting CE by universal suffrage should strictly
comply with the Basic Law and the relevant
Decisions of NPCSC. He believed that after CE
was selected by universal suffrage through "one
person, one vote" in 2017, the electoral method
could be refined in future.
In response to concern of some deputations,
USCMA
explained
the
constitutional
responsibility of NPCSC under the "Five-step
Process" of constitutional development.

"first-past-the-post' voting system might not
ensure that the CE-elect would have sufficient
legitimacy in the community as the candidate
who obtained the highest number of votes might,
in fact, have obtained only a small number of
valid votes. She said that she would vote
against the Proposals which were formulated
under the restrictive framework of the 2014
Decision of NPCSC.

on all Members to support the Proposals, so as to
meet the aspiration of the community for electing
the next CE through "one person, one vote" in
2017, thereby taking an important step forward in
the constitutional development of Hong Kong.
