What is a Planning
Proposal?
The preparation of a Planning Proposal is the first step in
preparing a local environmental plan (“an LEP”) or an
amendment to an LEP. The LEP process includes the
submission of a Planning Proposal to the Department of
Planning and Environment for the Director-General of
Planning’s approval before community consultation is
undertaken. The Planning Proposal then forms part of the
documentation for the community consultation.
A Planning Proposal is a document that explains the intended
effect of a proposed LEP or amendment to an LEP and sets out
the justification for making that plan.
What is it an LEP?
An LEP provides the statutory framework (legislation)
supporting all planning, development and development
restrictions for land, and aims to conserve local heritage and
protect sensitive land.
The LEP is made up of a written instrument and maps.
Why was this
Planning Proposal
prepared?
The Planning Proposal seeks to amend Hurstville Local
Environmental Plan (“HLEP”) 2012 in relation to the subject
sites to:

Rezone Nos. 108 and 112 Forest Road, Hurstville from
B2 – Local Centre Zone to B4 – Mixed Use Zone;
Rezone Nos. 1 and 3 Wright Street, Hurstville from R3 –
Medium Density Residential Zone to B4 – Mixed Use
Zone;
Increase the height of buildings for Nos. 108 and 112
Forest Road and 1 and 3 Wright Street, Hurstville to
34.5m;
Increase the height of buildings for No. 124 Forest Road,
Hurstville to 46.5m;

Increase the maximum floor space ratio for Nos. 108 and
112 Forest Road and Nos. 1 and 3 Wright Street,
Hurstville to 4:1;
Remove the application of lot sizes for Nos. 1 and 3
Wright Street, Hurstville; and
Amend Clause 4.4A to include a provision relating to the
subject site stating that development consent must not be
granted for development unless the non-residential floor
space is at least 0.5:1.

this Planning Proposal?
The Planning Proposal applies to land within the local
government area (LGA) of Georges River Council at 108,
112 and 124 Forest Road and 1 and 3 Wright Street
Hurstville.
What is the purpose
of this Community
Consultation?
This community consultation is to inform you of the proposed
amendments to HLEP 2012 and to invite you to comment on
the Planning Proposal.
Under Section 56(2) (c) and 57 of the Environmental
Planning and Assessment Act 1979, Council is required to
undertake community consultation in accordance with the
Gateway Determination issued on 24 February 2017 and is
included in the consultation material.

Review of submissions
Report to the Independent Hearing and Assessment Panel
(IHAP) and Council on submissions and any proposed
changes to the Planning Proposal
Amendment to HLEP 2012 is considered by Council and
may either support or not support the Planning Proposal. If
approved by Council, the legal drafting of the LEP is
undertaken by Parliamentary Counsel.
The amendment to the LEP is made by the Council as
delegate for the Minister for Planning.
