misdemeanor: (1) Engages in brawling or fighting; or (2) Disturbs an assembly or meeting, not unlawful in
its character; or (3) Engages in offensive, obscene, abusive, boisterous, or noisy conduct or in offensive,
obscene, or abusive language tending reasonably to arouse alarm, anger, or resentment in others. A
person does not violate this section if the person's disorderly conduct was caused by an epileptic seizure.

STATEMENT OF PROBABLE CAUSE

Your Complainant is a Minnesota Peace Officer with the Roseville Police Department and makes this Complaint
based on the reports and observations of Officer G. Dattilo (#196). On March 4, 2017, Roseville Police Officers
were dispatched to Cub Foods, 1201 Larpenteur Avenue, Roseville, Ramsey County, regarding an assault. Officers arrived and observed a male, identified as: N.P.M., DOB 04/21/1996, sitting on the floor in the store. N.P.M. had been sprayed in the face with mace. Officers learned that N.P.M. has autism and was in the bakery
eating a cookie that he believed was free to customers. A second customer, later identified as: Timothy Guy
Knutsen, DOB 10/27/1963, was upset that N.P.M. was taking cookies and did not believe they were free to
customers. Knutsen approached the service desk to report N.P.M.’s behavior, but the service desk employee advised there
was nothing she could do. N.P.M. checked out at the cash register and returned to the bakery. Knutsen followed
and confronted N.P.M. over eating the store’s cookies. When N.P.M. turned towards Knutsen, Knutsen
discharged the “Freeze Plus P” chemical spray in N.P.M.’s face causing bodily harm. N.P.M. started yelling and
Knutson left the store. Knutsen later contacted Police regarding the incident and advised he did not know that N.P.M. had autism and
believed N.P.M. was on drugs. Knutsen admitted spraying N.P.M. in the face, but stated it was not a lot of
spray. Knusten admitted N.P.M. did not do anything threatening towards him and only turned around abruptly
after Knutsen said “Hey” to N.P.M. Knutsen admitted it was “stupid” but wanted to tell him (N.P.M.) to knock it
off and took out his spray as a precautionary. 2

From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, I, the Issuing Officer, have
determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant’s arrest
or other lawful steps be taken to obtain Defendant’s appearance in court, or Defendant’s detention, if already in custody,
pending further proceedings. Defendant is therefore charged with the above-stated offense(s).
