The following are changes, clarifications and responses to questions from Bidders:
1. Question: What is the Engineer's Estimate for the project?
Response: A rough estimate of work to be provided under this project (not include the
equipment to be provided by the Owner) is $1,000,000.
2. Question: Is the Owner public or private?
Response: The Owner is a private entity.
3. Question: Were Contractors invited to bid this project or can any contractor bid the
project? If invited, can the list of invited Contractor's be provided?
Response: Yes, any Contractor may bid this project. However, we have only sent
notices to specific Contractors. The Contractors that received a notification of this
project are as follows:
Bryan Construction Company
Dudley Construction Ltd.
JTR Constructors, Inc.
R+B Group, Inc.
CSA Construction, Inc.
LEM Construction Co.
N&S Construction Co., L.P.
T&C Construction, Ltd.
4. Question: Is a bid bond required?
Response: A bid bond is not required.
5. Question: Is retainage 5% or 10%?
Response: Retainage for this project is 10%. Article 21 of Section 00100 should read
as follows: “From each partial payment made to the CONTRACTOR, an amount equal
to ten (10) percent will be retained until 30-days after the completion of all Work to the
satisfaction of the Owner and Engineer.”
6. Question: Can bid date be change to provide additional time?
Response: The bid date has been changed to 4:00 p.m., Friday, June 24, 2016.

7. Question: Contract time is 180 days. Can this be increased and is there a deadline
that has to be met?
Response: The Contract Time may be increased to the extent the wastewater
treatment plant has to be operational by the end of February 2017.
8. Question: Has the process equipment been orders or will it be ordered by the Owner
once the construction contract is executed? If the latter, we may not get the equipment
for 6 months.
Response: The equipment to be provided by the Owner has not been ordered at this
time. The equipment will be ordered upon review of the bids. We understand that the
equipment may not arrive on site until late fall; however, a large portion of the project
can be under way and near completion. Most of the equipment will only require the
connection of a few pipes and power (i.e. the equipment is not needed for a majority of
the construction work.)
9. Question: The bid form is lengthy. Could the bid form be shortened to a lump sum? Is
the breakdown needed on the bid day?
Response: The project is a lump sum bid. Item 5.01 of the Bid Proposal (Section
00300) is the lump sum base bid for which the project will be awarded. Item 5.02 Base
Bid Unit Price Breakdown is where we would like to see how project costs are
distributed throughout the project. It would be greatly appreciated if Item 5.02 could be
completed before the bid due date, but is not a requirement. However, the successful
bidders will be required to complete Item 5.02 prior to execution of the
agreement/contract.
10. Question: Since the Owner is providing most of the process equipment, could the
actual manufacturer's scope be made available so we are award of their inclusions and
exclusion?
Response: The manufacturer's scope for this project is attached as Attachment “A”.
11. Question: Can any of the indemnification clauses be modified?
Response: The Owner requests that the indemnification clauses remain unchanged.
However, if modification to the indemnification clauses are requested, the bidder shall
provide said modifications to J. Dale Browne, Jr., P.E. at [email protected] in
pdf and Word formats entitled “Requested Indemnification Clause Modifications” and
shall be received by 10:00 a.m., Monday, June 20th. The pdf attachment shall
specifically state which indemnification clause is to be modified (i.e. reference Contact
Document section, item number, etc.) and proposed rewording of the indemnification
clause. All efforts will be made to responded back to the respective bidder by 5:00 p.m.,
Thursday, June 23rd as to the acceptance, rejection, or additional modifications are
approved.
