In Supersession of all previous orders on the subject, the H.P. Tourism
Development Corporation Limited, Staff “Recruitment & Promotion Rules (Class I, II, III
& IV), 1975” are hereby revised and substituted with the H.P. Tourism Development
Corporation Limited, Staff “Recruitment & Promotion (Revised) Rules, 1985 as per
enclosed Annexure -‘A’ and Annexure ‘1‘with introduction of separate disciplines in the
services of the Corporation as Follows;

There would be five main disciplines, namely, Administration, Accounts,
Catering, Transport and Information/Publicity with four sub-disciplines within the
catering discipline, namely, Food& Beverages, House Keeping, Front office and
Kitchen.
In the catering discipline the seniority, will be separate up to the level of General
Manager (Hotels) with separate seniority in each of the four sub- disciplines up to
the level of Tourism Development Officer on Corp[oration-wise basis. For the
purpose of filling up the posts of General Manager (Hotels) Tourism
Development Officers in the four sub-disciplines would be eligible on the basis of
their combined seniority.
Seniority in the Accounts discipline will be separate up to the level of Finance
Manager on Corporation –wise basis.
Seniority in the Transport discipline in the operational and workshop wings will
be separate on Corporation-wise basis as also up to the level of Area
Manager/Asstt. General Manager (Transport).
Seniority in the Information/ Publicity discipline will be separate up to the level
of Area Manager on Corporation-wise basis.
Seniority in the Administration discipline including all miscellaneous posts will
be separate in each category on Corporation-wise basis.
For filling up the posts of Dy. G.M. (Hotels)/Area Managers/Asstt. General
Managers would be eligible on the basis of joint seniority.
The introduction of the above mentioned disciplines/sub-disciplines and the
Himachal Pradesh Tourism Development Corporation Limited, Staff “Recruitment &
Promotion (Revised) Rules, 1985” shall come into force with immediate effect.

RECRUITMENT& PROMOTION RULES (REVISED), 1985
SECTION: I GENERAL
These rules shall be called the HP. Tourism Development Corporation Limited
Staff Recruitment & Promotion (REVISED) Rules 1985.
RULE-1: For the purpose of these rules, wherever applicable, the classification of
posts/ services will be as under:1) Class 1 posts- the maximum of the pay scale of which is not less than Rs 1850/
2) Class 11 posts –the maximum of the pay scale of which is less than Rs 1580/3) Class 111 posts- the maximum of the pay scale of which is not less than Rs 600/4) Class 1V posts- the maximum of the pay scale of which is than RS 600/RULE-2: All appointments to posts will be made by the Managing Director.
RULE-3: No person shall be appointed to any post under the Corporation unless
he is:1) A citizen of India, or
2) A subject of Nepal/ Bhutan, or
3) A Tibetan refugee who came over to India before 1st January, 1962 with the
intention of permanently settling in India, or
4) A person of Indian origin, who has migrated from Pakistan with the intention of
permanently settling in Indi
Provided that the persons belonging to categories (11), (111) and (1V) shall be a
person in whose favour a certificate of eligibility has been given by the competent
authority, i.e. by the Government of India, and if he belongs to category (1V) the
certificate of eligibility will be issued for a period of one year after which such a
candidate will be retained in service subject to his having acquired Indian Citizenship.
RULE-4: The age of a person at the time of his first appointment to the service of
the Corporation must not be less than 18 years and it shall also exceed 17 years. The
maximum age limit up to 45 years may be relaxed by the appointing authority in
exceptional cases keeping in view the qualifications and experience of the candidate and
his suitability for the post to be held by him.
RULE-5: A candidate must produce the following documents before he is
allowed to join the service of the Company on his first appointment:1) A certificate of good moral character from the Principle Academic
Officer of his University, college or school or the Head of the
Educational or Technical Institution Last attended by him;
2) Certificate of good moral from a responsible person not being his
relative, who is well acquainted with him in private life and

unconnected with his University, College, School or other
Educational or Technical Institution;
A medical certificate of fitness from the Medical Officer of a
Government Hospital/Officer of the Company;
A declaration to the effect that he has not more than one living wife;
In case of female employee a declaration to the effect that she has not
married a person having already a living wife;
A statement of immovable/ movable property and at intervals
thereafter, as may be demanded by the management.
RULE-6: All persons whether recruited directly or promoted to higher posts shall
remain on probation for a period of two years which can be extended up to three years for
reasons to be recorded on writing. If the work and conduct of an employee is not
satisfactory during his probation period or extended probation, he shall be discharged
from the service, if he was appointed by direct recruitment or reverted to the post from
the service from where he was promoted, as the case may be. On satisfactory completion
of probation period, the appointing authority may confirm such employee on the
recommendations of DPC, the person shall be deemed confirmed unless he is informed to
this effect in writing.
Approved officiating service shall be reckoned as period spent on probation. The
period of adhoc promotion shall also count for probation. Service spent on deputation to a
corresponding or higher post will also count towards the period of probation.
If any person after having reverted to his formed post, is subsequently re
appointed to a post from which he reverted, his previous service in the higher post may
be reckoned as period spent on probation, if the appointing authority so specified in the
order of reappointment.
RULE-7: No employee shall be confirmed unless a satisfactory report from the
concerned authorities is received with regard to verification of his character and
antecedent. Where an adverse report in this regard is received, the employee shall be
discharged from service on the basis of such an adverse report.
RULE-8: Reservation for members of Scheduled Casts and Scheduled Tribes
communities, backward classes, Ex-servicemen, Handicaps etc, Will be made according
to instructions issued by the Government of Himachal Pradesh from time to time, both in
direct recruitment and promotions.
RULE-9: Persons to be appointed in the service of the Corporation Should
preferably have knowledge of customs, manners and dialects of Himachal Pradesh.
RULE-10:The job specifications (academic qualifications, Technical/professional
qualifications, experience, age etc, for various posts, mode of filling up etc, shall be as
specified in Annexure ‘1’to these rules. These job specifications can be changed/
amended by the Board of Directors of the Corporation from time to as may be deemed
expedient by the Board of Directors. The amended job specifications shall have the same
effect as if these were contained in these rules.
The job specifications as provided in Annexure-1 to these rules for various posts
may be relaxed in special circumstances by the Board of Directors.
Posts will be filled up either by promotion or by direct recruitment as specified in
Annexure -1 to these rules.
RULE-11: For the purpose of giving effect to reservation of posts to be filled up
by direct recruitment and by promotion, for the same and each category, a roster shall be
maintained and posts filled up accordingly.
SECTION-II DIRECT RECRUITMENT
RULE-12: 1) All vacancies will be notified to the Employment Exchanges in
terms of the Employment Exchanges(Compulsory Notification of Vacancies) Act,
1959.The post will also be advertised in at least two local newspapers(One English One
Hindi) circulating in the state, as the case may be.
Departmental candidates will also be eligible to apply against the posts advertised
in the prescribed notified to the Employment Exchanges and will be considered along
with outside candidates and a common merit list or order of preference will be drawn.
Vacancies/ posts can also be filled up by deputation of employees from
Government and from Public Sector Undertakings.
RULE-13: The Personnel Department at the Headquarters will be responsible for
notifying the vacancies to the Employment Exchanges and/ or advertising the vacancies
stating the specifications, as the case may be. Personnel Department will screen the
applications for all categories of posts. Reasons for rejecting any application during
screening stage will be briefly recorded on the application itself. In case the competent
authority considered a candidate suitable due to any other reason though he does not
possess the minimum laid down specifications, the reason, for such consideration should
be recorded on the application.
RULE-14: The selection of candidate will be made by a Selection Committee to
be constituted by the Managing Director. The Selection Committee shall be competent to
lay down its own procedure for subjecting the candidates to trade test and interviews to
judge their suitability. For recruitment to the posts of typists, steno etc, persons fulfilling
the job specifications shall be put to a practical test to be conducted by an official
authorized by the Managing Director and the candidates who qualify the test will be
interviewed by a duly constituted Selection Committee for final selection committee:RULE-15: The following guiding principles shall be observed in the formation of
panels by the Selection committee:1) It will be permissible for a Selection Committee to prepare a panel of
selected candidates on order of merit so long as all the candidates are,
in the judgment of the Committee, clearly fit for the advertised post and
fully confirm to advertised specifications. The number on panel should
be based on the expected vacancies likely to arise in near future (not
exceeding one year).
2) The Selection Committee will hold tests written, practical and/ or oral,
to determine the suitability of candidates interviewed by them and their
relative merits.
3) It will also be permissible foe a Selection Committee to prepare lists of
candidates considered fit for posts/grades lower than the advertised
posts/grade.
4) All panels will be valid normally for one year , but the validity period
can be extended by the Managing Director for a period not exceeding
six months at a time; the total extension not exceeding a period of one
year. The reasons for the grant of extension would be recorded in
writing by the authority concerned.
RULE-16: Offers of appointment shall be made strictly in accordance with the
order in which the candidates are placed on the panels at the time of selection by the
Selection Committee subject to availability of vacancies.
SECTION-III PROMOTION
RULE-17: Subject to Rules10 to15 all posts to be filled up by promotion shall be
filled by grade to grade promotion of personnel to the extent that qualified and
experienced hands are available in the appropriate category as per specifications as
contained in Annexure’1’ t5o these rules.
RULE-18: Broadly speaking, for all categories of posts, the basic principles for
promotion will be merit, efficiency, past performance, seniority being taken into
consideration, if other factors are equal.
RULE-19: Subject to job specifications laid down for a particular post, the
Managing Director shall have power to lay down suitable criteria to determine merit and
efficiency by means of written/ oral tests, performance appraisal, interview etc.
RULE-20: All eligible candidates will be assessed/ interviewed by a
Departmental Promotion Committee to be constituted by the Managing Director. The
Departmental Promotion Committee shall subject to Rule 14 prepare a panel of
employees found fit for promotion in the order of merit to be indicated therein.
RULE-21: Offers of appointment shall be made strictly in accordance with the
order in which the names of candidates are placed on panel in the order of merit drawn by
the Departmental Promotion Committee subject to availability of vacancies.
SECTION-IV SENIORITY
RULE-22: (I) For the purposes of the above rules, seniority as between personnel
selected as a result of the same interview/assessment shall be determined not in
accordance with their date of joining but in accordance with the order or preference (if
any) drawn-up by the selection committee. If there is no order of preference, date of
appointment in the grade will determine seniority, provided that where persons recruited
initially or persons promoted initially on temporary basis or on terms of probation and
subsequently confirmed in an order different from the order of merit drawn by the
Selection Committee/Assessment Committee or in an order different from their dates of
joining, as the case may be, seniority shall follow the date of confirmation and not the
original order of merit drawn by the Selection/Assessment Committee or the dates of
joining.
II) The Departmental Assessment Committee should record and the number of
candidates not exceeding the number of available vacancies to be filled in. Persons found
unfit for promotion to vacancies in the levels where promotion goes by seniority subject
to elimination of unfit should be considered in the next assessment along with others, the
intention being that a person superseded once should not be considered as having been
superseded for good. A person who had been superseded as such shall not, if he is
subsequently found suitable and promoted take seniority in the higher posts/ cadre over
the junior official who had superseded him. Promotion on officiating basis would be
made on the basis of seniority subject to rejection of unfit.
III) however, in cases where confirmation has been delayed or amounts of certain
circumstances and reasons wholly connected with and extraneous to his work, the
seniority would be determined either from the date of joining or from the order of merit
drawn by the Selection/ Assessment Committee, as the case may be.
SECTION-V PROCEDURE TO BE FOLLOWED IN MAKING
PROMOTIOS:
RULE-23: Service records and confidential character rolls of all employees shall
be properly maintained by the Personnel Department in accordance with standings
instructions.
RULE-24: Whenever there is any occasion to fill a vacancy by promotion the
competent authority must have before it and must fully take in to account confidential
character rolls of all personnel eligible for appointment to the vacancy.
RULE-25: All promotions will, as a rule, be considered by the appropriate
Department Promotion Committee which will submit its recommendations to the
competent authority. In case. However, where the prescribed governing principle is the
rule of seniority, subject to suitability and competent authority considers the senior most
man to be suitable for promotion, it will not be necessary to convene a meeting of the
Departmental Promotion Committee.
RULE-26: Departmental Promotion Committee will be free to devise their own
procedure for assessment of candidates. The Committee should, however, be largely
guided by the service record and confidential character rolls, Supervisors knowledge
about the employee’s capabilities, written reports of the immediate Superior officer,
employee’s intelligence, capacity to Learn, aptitude and his behavior with the Superiors,
colleagues and juniors, of all employees eligible for promotion from next Lower grade
according to prescribed Specifications.
RULE-27: Although the competent authority will, as a rule, pay due regard to the
recommendation of Departmental Promotion Committees, it must be distinctly
understood that the Committee’s are purely advisory bodies, the responsibility or
granting promotions or making appointments being solely that if the competent authority.
RULE-28: Selection and Departmental Promotion Committee’s shall be
constituted by the appointing authority in such a manner that they have on them at least
three officer out of which one shall be an officer from the Personnel Department.
RULE-29: (I) Each member of a committee will assess the candidate under
consideration independently according to a procedure to be mutually agreed upon by the
members and an order of preference will then be prepared on the basis of average
assessment made by all members. The Chairman will prepare the minutes of the
Committee which will be signed by all members including the representatives of the
Personnel Department.
(II) All orders of appointment (whether by promotion or by direct recruitment)
will be issued only by the Personnel Department with copies to the Accounts and others
Departments concerned.
(III) all records relating to recruitment/ assessment shall be deposited without
delay with the Personnel Department after the proceedings are drawn and signed by the
Selection Committee/ Assessment. It will be the responsibility of Personnel Department
to arrange for the verification of character and antecedents of selected candidates and for
their Medical examination.
SECTION-V1 APPEALS
RULE-30: Any employee who is the aggrieved by an order of promotion on the
ground that he has been superseded may appeal through his Departmental Head to the
Managing Director,. In case the appeal is wrongly addressed to a still higher authority,
the departmental Head will correct the order. The Departmental Head shall, if possible,
enter in a separate note the reasons why the decision was taken. The appeal should be
marked Confidential and routed through the Personnel Department. The Personnel
Department will enter their comments below the note of the Department Head. The
decision taken by the Managing Director will be communicated to the employees
concerned through the Personnel Department.
(1) If any employee is still not satisfied with the decision of the Managing
Dire4ctor, he shall have a right to appeal to the Board of Directors in
the manner prescribed above, whose decision shall be considered final.
SECTION-VII MISCELLANEOUS
RULE-31: The power to interpret these rules shall vest in the Managing Director
which shall be final
RULE-32: The power to amend these rules and make additions there to deletion
there from shall vest in the Board of Directors of the Company. The amendments/
additions/ alterations/so made by the Board of Directors shall have the same effect as of
