RESOLUTION 01-9343
A RESOLUTION DETERMINING PETITION 01-RIS11 FOR A RESIDENTIAL IMPACT STATEMENT
FOR DRIVE-THROUGH BANK LANES AT 405 8TH STREET SOUTH, MORE PARTICULARLY
DESCRIBED HEREIN; AND PROVIDING AN FFFECTIVE DATE.
WHEREAS, St. Charles Limited Partnership has requested a Residential Impact
Statement for two existing drive-through bank lanes and one new
drive-through ATM lane in accordance with Section 110-135(a)(7) of
the Code of Ordinances; and
WHEREAS, the Planning Advisory Board, following an advertised public hearing,
considered the public input, the recommendation of the staff, and
recommended by a vote of 5 to 0 that Residential Impact Statement
01-RIS11 be approved, finding that the criteria had been met; and
WHEREAS, after considering the recommendation of the Planning Advisory Board
and giving the petitioner an opportunity to speak, the City Council
finds that the criteria for granting the petition have been met and
that the petition should therefore be granted; and
WHEREAS,
the applicant has requested a waiver from the limitation on
operation of hours to permit 24-hour operation of the ATM;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NAPLES, FLORIDA:
Section 1. That Residential Impact Statement Petition 01-RIS11 is hereby
granted for drive-through bank lanes at 405 8th Street South, more
particularly described as:
The westerly 13.33 feet of Lot 12; all of lots 13 through 18,
inclusive, Block 16, Tier 9, Replat of Naples Seaboard and Gulf
Railway Company, per Plat Book 1, Page 59, Public Records of Collier
County, Florida, together with that certain vacated 15 foot wide,
north-south alley in the north half of said Block 16, Tier 9,
abutting lots 15 through 18, inclusive on the west side and Lot 14
on the east side of the said alley.
Section 2. The request for a permanent waiver from Section 110-139(a) of the
Code of Ordinances to permit 24-hour operation of the ATM is
approved.
Section 3. That this resolution shall take effect immediately upon adoption.
PASSED IN OPEN AND REGULAR SESSION OF THE CITY COUNCIL OF THE CITY OF NAPLES,
FLORIDA, THIS 3RD DAY OF OCTOBER, 2001.
