The highest bidder to be the purchaser but if any dispute arises as to the last or best bidder, the lot in dispute shall be
put up again and resold, if the Auctioneer cannot decide who the last or best bidder was.
No person will be allowed to retract his or her bid after being taken and the Vendor reserves the right to bid either by
the Auctioneer or the Vendor’s agent for any lot offered.
The Auctioneer may refuse to accept any bid or withdraw any lot from the sale.
The Auctioneer may hold a bid and refer such bid to a Vendor before acceptance.
All purchasers shall on the fall of the hammer, pay the Auctioneers a deposit of 10% of the purchase price in cash or
approved personal cheque. The balance is to be paid by the close of the Auction by way of cash or approved
personal cheque and any goods purchased at this Auction must be paid for in full before removal of the goods from
these premises. Purchase price bid does not include GST.
In case of non-payment of such a deposit, the lot or lots may at the option of the Auctioneer be put up again and
resold and the defaulter’s bid at the option of the Auctioneer shall not be taken again during the sale.
All lots, having been made available for inspection, must be taken as they are and neither the Vendors nor the
Auctioneers will be liable for any misdescriptions of the lots. The said lots are to be taken with all faults (if any) and
no guarantees of any nature whatsoever as to the lots sold are given by the Vendors or Auctioneers.
No lots purchased may be removed until after the Auction.
All lots shall be at the buyers risk on the fall of the hammer and neither the Vendors nor the Auctioneers shall be
accountable for any deficiency, damage or loss which may arise thereafter.
Delivery, storage and handling charges to be paid by the purchasers where and when applicable and all deposits are
non-refundable.
All lots must be removed by the purchasers not later than 7 days after the Auction or as directed by the Auctioneer.
No parties will be allowed to remove their lots, or any portion thereof, until the purchase shall have been completed
and the full purchase price paid to the Auctioneers.
Storage charges may apply on lots which have been paid for and which remain uncollected by the third working day
following the sale.
The auctioneers shall not be responsible for any damage to property or injury to persons incurred during the removal
of lots purchased.
All vehicles are sold as unregistered unless otherwise stated by the Auctioneer.
No detailed inspection has been undertaken of any lot, and so absolutely no warranty or guarantee concerning
known or unknown faults is given or implied. Machines with mechanical appraisals are still sold subject to Clause 7
of the Standard Terms and Conditions of Sale, which refers to equipment being sold with all faults (if any).
Upon any purchase failing to comply with any of the above conditions any money deposited in part payment shall be
absolutely forfeited and all lots uncleared may be resold by Public Auction contract and the deficiency (if any) on
such resale, together with all costs and charges consequent upon such resale, shall be made good by the defaulter
at this sale.
No servant or agent of the Auctioneer is authorised to waiver, add to or vary these conditions without the written
authority of the Company Secretary or Manager of Southwell Land & Water.
Delivery of lots is not to be taken without a representative of the Vendor or the Auctioneer being present at the time.
The Purchaser shall ensure that delivery is taken of all lots available at the time of delivery.
Should any deficiency arise between the quantities of goods described at the time of sale and that available at the
time of delivery, the purchaser shall take, and the Auctioneers shall be required to effect delivery of only the quantity
actually so available. No compensation whatsoever shall be paid in respect of any such deficiency.
All persons entering these premises do so at their own risk. The Vendor and the Auctioneer shall not be under any
liability whatsoever for any injury, death or damage howsoever caused (including injury, death or damage caused or
contributed to by the negligence of the Vendor or Auctioneer, or their servants or Agents) suffer by any person
entering on to these premises. The purchaser shall effect insurance which:
(a)at all times covers liability to the public for an unlimited amount in respect of personal injury, death or damage
arising out of the taking of delivery, removal or dismantling of any lots, by or on behalf of the purchaser; and
(b)if necessary, provides cover for the full amount required by law against any liability whatsoever whether arising by
virtue of any statute related to workers compensation or employers liability or at common law to any person
employed by the purchaser in connection with the taking of delivery, removal or dismantling of any lot.
Whilst every care has been taken on the compilation of the Catalogue, the Auctioneer and/or the Vendor accept NO
RESPONSIBILITY for any misdescription and give no warranties as to the correctness of any descriptions
whatsoever.
The purchaser acknowledges that the Auctioneer is acting as the Authorised Agent for the Vendor and any rights of
action he may have in respect of the said lots purchased by him lie against the Vendor not the Auctioneer. In the
event that he wishes to take proceedings in respect of the said lots and the Vendor has not been named by the
Auctioneer in its dealing with him to date, he agrees to request the name of the Vendor and, provided the Auctioneer
provides the relevant details, to proceed against the Vendor not the Auctioneer.
A bidder is taken to be the principal unless, before bidding, the bidder has given to the auctioneer a copy of a written
authority to bid for or on behalf of another person.
It is an offence under the Property, Stock and Business Agent’s Act (NSW) 2002, Section 78 (3) and Regulations
2003 Clause 20 (1) for a person to do any of the following as a result of collusive practice, or to induce or to attempt
to induce another person by a collusive practice to do any of the following: (a) to abstain from bidding, or (b) to bid to
a limited extent only, or (c) to do any other act or thing that might prevent free and open competition.
