1. This A c t m a y b e cited as t h e " Necropolis ( A d d i t i o n a l A r e a s )
A c t of 1 8 9 3 , " a n d shall be read w i t h t h e A c t s thirty-first V i c t o r i a
n u m b e r f o u r t e e n a n d f o r t y - s e v e n t h Victoria n u m b e r e l e v e n ; a n d t h e
t h r e e A c t s m a y be collectively cited as t h e " Necropolis A c t s 1 8 6 7 1893."
2. I t shall b e l a w f u l for t h e Governor, w i t h t h e advice of t h e
E x e c u t i v e Council, to appoint, b y p r o c l a m a t i o n in t h e Gazette, n o t
less t h a n five persons of t h e L u t h e r a n d e n o m i n a t i o n , a n d n o t less t h a n
five p e r s o n s of t h e P r i m i t i v e M e t h o d i s t d e n o m i n a t i o n t o b e t r u s t e e s of
a b u r y i n g g r o u n d for persons of t h o s e d e n o m i n a t i o n s respectively as
h e r e i n a f t e r provided.
3. T h e p o r t i o n s of land described i n Schedules A , B , C, D, E , E ,
G, a n d I I h e r e t o shall vest i n t h e t r u s t e e s of t h e C h u r c h of E n g l a n d ,
R o m a n Catholic, P r e s b y t e r i a n , Wesleyan, I n d e p e n d e n t , a n d J e w i s h
C e m e t e r i e s a p p o i n t e d u n d e r t h e " N e c r o p o l i s A c t of 1 8 6 7 , " a n d t h e
t r u s t e e s of t h e L u t h e r a n a n d P r i m i t i v e M e t h o d i s t d e n o m i n a t i o n s ,
a p p o i n t e d u n d e r t h i s A c t , respectively, a n d t h e i r successors, to b e

n o t less t h a n five in n u m b e r , of each of s u c h o t h e r d e n o m i n a t i o n s for
t h e portions so set a p a r t , r e s p e c t i v e l y ; a n d on t h e application of t h e
t r u s t e e s of a n y p o r t i o n of land, w h e t h e r a p p o i n t e d u n d e r this A c t or
t h e " N e c r o p o l i s A c t of 1 8 6 7 , " to adjust t h e b o u n d a r i e s thereof, a n d
for t h a t purpose to vest a n y p a r t of a n y portion i n a n y s u c h t r u s t e e s ,
w h e t h e r a l r e a d y vested in a n y o t h e r b o d y of t r u s t e e s or n o t ; a n d t h e
separate portions so set a p a r t as aforesaid shall vest in t h e t r u s t e e s of
t h e d e n o m i n a t i o n s for w h i c h t h e y are set a p a r t a n d t h e i r successors,
a n d in t h e t r u s t e e s of t h e g e n e r a l c e m e t e r y of t h e Necropolis, a n d t h e i r
successors, respectively.
1. T h e provisions of t h e A c t thirty-first Victoria n u m b e r
f o u r t e e n a n d of t h e A c t f o r t y - s e v e n t h Victoria n u m b e r eleven shall
apply to t h e p o r t i o n s of l a n d described i n t h e Schedules h e r e t o , a n d
to t h e portions of l a n d set a p a r t u n d e r t h e powers conferred by
t h i s A c t ; a n d each b o d y of t r u s t e e s a p p o i n t e d , or to be a p p o i n t e d ,
shall, w i t h respect to s u c h p o r t i o n as is or shall be vested in t h e m ,
possess all t h e powers, a n d be s u b j e c t to all t h e obligations conferred
a n d imposed b y t h e said A c t s ; a n d t h e provisions of t h e said A c t s
shall he applicable to a n d in r e s p e c t of t h e said p o r t i o n s of land as
fully a n d effectually as if t h e said portions h a d b e e n respectively set
a p a r t a n d vested in t h e said t r u s t e e s by t h e said A c t s .
5. T h e p o r t i o n of t h e five h u n d r e d a n d s e v e n t y - s e v e n acres or
t h e r e a b o u t , dedicated b y notification i n t h e Gazette
of D e c e m b e r
second, one t h o u s a n d e i g h t h u n d r e d a n d eighty-seven, as a n additional
a r e a for c e m e t e r y purposes, w h i c h is n o t specifically vested in t h e
t r u s t e e s of a n y d e n o m i n a t i o n , shall be a n additional area to a n d shall,
for t h e p u r p o s e of t h e " Necropolis A c t s , 1 8 0 7 - 9 3 , " be deemed p a r t of
t h e l a n d set a p a r t u n d e r t h e " N e c r o p o l i s A c t of 1807 " as a g e n e r a l
c e m e t e r y a t R o o k w o o d : P r o v i d e d t h a t t h e Governor, w i t h t h e advice
aforesaid, m a y o u t of s u c h portion as aforesaid set a p a r t , b y p r o c l a m a ­
tion in t h e Gazette, a n y portion as a b u r i a l g r o u n d or additional b u r i a l

(5. E a c h body of t r u s t e e s shall h a v e power, s u b j e c t t o t h e
a p p r o v a l of t h e Governor a n d t h e E x e c u t i v e Council, to set a p a r t a n d
d e d i c a t e as a road, or for t h e p u r p o s e of d r a i n a g e , c i t h e r p e r m a n e n t l y
or t e m p o r a r i l y , a n d s u b j e c t to s u c h conditions a n d restrictions as m a y
bo convenient, a n y portion of t h e l a n d vested i n t h e m as aforesaid.
