SAINT CHARLES CHURCH, RYDE,
CEMETERY ACT.
Act No. G, 1936.
An Act to provide for the removal of human
remains and certain slabs and tombstones
from a portion of the Roman Catholic
Cemetery attached to the Church of Saint
Charles, Ryde; for the reinterment of such
remains and the re-erection of such slabs
and tombstones in another part of such
cemetery; to authorise the erection of a
church upon the land from which such
remains, slabs and tombstones have been
removed; and for purposes connected therewith. [Assented to, 9th April, 1936.]

E it enacted by the King's Most Excellent Majesty,
by and with the advice and consent of the Legislative Council and Legislative Assembly of New South
Wales in Parliament assembled, and by the authority of
the same, as follows :—
1 . This Act may be cited as the "Saint Charles
Church, Ryde, Cemetery Act, 1936."

2. (1) T h e R e v e r e n d E d w a r d Gell, t h e R o m a n
Catholic P a r i s h P r i e s t of the P a r i s h of Ryde, m a y cause
the r e m a i n s of a n y p e r s o n b u r i e d in the land described
in the F i r s t P a r t of the Schedule to this A c t (so f a r a s
such r e m a i n s can b y reasonable diligence be discovered
a n d identified) t o g e t h e r w i t h a n y slab or tombstone i n
relation t h e r e t o , t o be collected with due care, a n d m a y
cause such r e m a i n s to be r e v e r e n t l y r e i n t e r r e d in a n d
such slab or tombstone re-erected on t h a t p o r t i o n of the
l a n d described in t h e Second P a r t of the said Schedule
which does n o t f o r m p a r t of the land described in t h e
F i r s t P a r t of the said Schedule.
(2) T h e said R e v e r e n d E d w a r d Gell shall d e f r a y
the cost of t h e removal, r e i n t e r m e n t a n d re-erection, b u t
shall not be liable to p a y a n y e x h u m a t i o n fees in r e s p e c t
thereof.
(3) No compensation shall be p a y a b l e b y t h e said
R e v e r e n d E d w a r d Gell to a n y p e r s o n in respect of t h e
p e r f o r m a n c e of a n y act a u t h o r i s e d by this Act.
3. I t shall be lawful to erect u p o n t h e land described
in t h e F i r s t P a r t of the said Schedule, including the p a r t
of the land from which such r e m a i n s h a v e been r e m o v e d
p u r s u a n t to this Act, a church, n o t w i t h s t a n d i n g any t r u s t
affecting such p a r t .

FIRST PART.

Commencing
a t a p o i n t on t h e b o u n d a r y fence between S a i n t Charles H y d e C h u r c h
a n d School l a n d s s i t u a t e d 35 feet south-easterly f r o m t h e a l i g n m e n t
of C h a r l e s s t r e e t ( s u c h fence b e i n g 96 feet f r o m a n d parallel t o
V i c t o r i a r o a d ) a n d b o u n d e d o n t h e n o r t h - e a s t by t h e aforesaid fenced
l i n e b e a r i n g south-easterly 100 feet t h e n c e on t h e s o u t h - e a s t by a l i n o
b e a r i n g south-westerly 185 feet, t h e n c e o n t h e south-west b y a l i n e
parallel to aforesaid fence b e a r i n g n o r t h - w e s t e r l y 100 feet t h e n c e b y
a line b e a r i n g n o r t h - e a s t e r l y 185 feet t o t h e p o i n t of c o m m e n c e m e n t .

on
on the south-eastern side of Charles-street 96 feet and bearing southwesterly from its intersection with the south-western side of Victoriaroad thence bounded on the north-east by a line bearing south-easterly
218 feet 6 inches to the boundary between the Church and Presbytery
lands thence on the south-east by that boundary bearing southwesterly 283 feet to a Reserve for Graves as shown on plan at Department of Lands, Sydney, and numbered Ms. 2035 Sy. thence on the
eouth-west by part of the northern boundary of that reservation bearing north-westerly 217 feet 33 inches to the south-eastern side of
Charles-street aforesaid thence bounded on the north-west by that
fiide of that strset bearing north-easterly 269 feet 8J inches to the
point of commencement.
