Explanatory Memorandum to Tynwald Members

Title of measure
Civil Aviation (Dangerous Goods) (Application) Order 2017 (SD 2017/0130).

Changes in policy
None.

Effects of the measure
The Order applies the Air Navigation (Dangerous Goods) (Amendment) Order 2017
(SI 2017/28) to the Island with modifications. This has the effect of requiring that
dangerous goods carried by air to or from the Island or by aircraft registered on the
Island which may be located anywhere in the world comply with the latest
international requirements.
The Island’s legislation for the carriage of dangerous goods by air consists of the
UK’s Air Navigation (Dangerous Goods) Regulations 2002 (SI 2002/2786) as modified
and applied to the Island. Periodically, the international requirements for carriage of
dangerous goods are updated by the International Civil Aviation Organisation (ICAO)
and the UK amends its orginal set of Regulations to require adherence to the latest
edition of “Technical Instructions for the Safe Transport of Dangerous Goods by Air”.
The Order has the effect of applying the UK’s latest amendment Regulations to the
Island which will implement the requirement of compliance with the 2017-2018
Edition of the Technical Instructions.
The Order will revoke the Civil Aviation (Dangerous Goods) (Application) Order 2014
(SD 2014/0001) which had the effect of requiring compliance with a previous edition
of the Technical Instructions.

Reasons for the measure
As the operator of a responsible international Aircraft Registry, the Isle of Man is
committed to implementing the latest international aviation safety requirements into
national legislation.
The legislation is necessary to ensure dangerous goods are carried in accordance
with ICAO’s latest edition of “Technical Instructions for the Safe Transport of
Dangerous Goods by Air”.

The Order will not create any resource implications.
6.
Tynwald procedure
The Civil Aviation (Dangerous Goods) (Application) Order 2017 is made under section
11 of the Airports and Civil Aviation Act 1987. Section 11(4) of the Act requires
Tynwald approval for the Order to come into operation.
