It is the policy of the ECSO to allow the tenant/occupant 72 (business) hours to leave the premises, after which the deputy will place the petitioner in possession of the residence. The petitioner is required to have made previous arrangements should a locksmith and/or mover be required. (Refer to current state statutes regarding landlord responsibilities for storage of personal property.) Provide the following to the Sheriff’s Office: • Original court-issued Writ • Cash or check ($75/person to be served) • Bond or proof of bonded mover (if required) • Your contact information PLEASE NOTE: Writs are orders from the Court to the Sheriff, and – once delivered to the ECSO - can only be stopped by an order to quash by the Court! Executions seize money and/or property to satisfy a judgment plus costs. The ECSO has 60 days to serve and attempt to satisfy a judgment on a Writ of Execution. If expired, a Writ may be renewed. Writs for seizure of property MUST be accompanied by a bond of indemnity for 2X the value of the property to be seized. EAP’s require a demand for cash first, followed by seizure of personal property and, finally, real property as allowed. In addition to the $75 service fee, a pre-paid, non-refundable deposit is required for executions involving seizure of property. The ECSO shall determine an amount due based on the anticipated costs of the specific seizure. Costs include (but are not limited to) towing, storage, officer time, appraisals, posting and sale costs. Additional costs will be billed or claimed from sale proceeds. Writ of Replevin Replevins return specific property to an owner/creditor. Writs for seizure of property MUST: • Be accompanied by a bond of indemnity for 2X the value of the property, and • Include specific detail of the item(s) to be recovered (ie: serial number/model/VIN). The ECSO will not seize property pursuant to execution without proof of ownership. If the writ does not specifically identify the property, a supplemental court hearing may be required to determine ownership. At any time prior to sale, if the debtor claims an exemption under WI Stat 815.18(6a) the seizure and/or sale will be halted and any property seized will be returned to the debtor.
