Reproduction Fees for Publications, Exhibitions & Other Public Use
If you are publishing a book or making a film, video or television broadcast, developing web-based
resources or an Internet site, or using photographs in a talk, we may have the photographs you
need. We reserve the right to charge reproduction fees for any public use of the collections in
addition to the cost of the images and any Copyright fees the Copyright owner may wish to charge.
In addition to payment, a copy of the publication should be supplied to East Lothian Council’s
Library Service.
Reproduction fees may be waived for educational or academic use, and at the discretion of the
Principal Museums Officer or Records Manager.
Unless otherwise indicated, all reproduced images should be acknowledged as follows:“Courtesy of East Lothian Council Museums Service”
“Courtesy of East Lothian Council Archives & Records Management Service”
“Courtesy of East Lothian Council Library Service”
This fee will apply for ‘commercial re-use.’ This will not be covered by Creative Commons and
the exact licence will be determined by negotiation with ELC.
A new lower rate of £10.20 per image is introduced for ‘small scale’ publications. This will be
covered by the Creative Commons Re-use principles.
The context to be determined, as with the waiving (which we will also retain), at the discretion of
the Principal Museums Officer or Records Manager.
Creative Commons
Some of the images supplied by East Lothian Council’s Museums, Archives and Local History
Services from the collections, including those supplied for a specific commercial purpose, may be
re-used for non-commercial purposes under a Creative Commons Attribution-NonCommercialShareAlike 2.5 License. For details of the License Terms, see
http://creativecommons.org/licences/by-nc-sa/2.5/scotland/.

Terms & Conditions for image reproduction
The following standard conditions apply to the granting of authority to reproduce images. Other conditions,
applicable to individual cases, may be appended. No application for authority to reproduce images will be
considered without a signature on the relevant form, confirming acceptance of these conditions.
1.
The supply of photographs held by East Lothian Council’s Museums, Archives and Local History
Services does not in any way imply the granting of authority to reproduce copies, in any form, for any
purpose except as allowed under the terms of the Creative Commons Attribution-NonCommercialShareAlike 2.5 Scotland License (see http://creativecommons.org/licenses/by-nc-sa/2.5/scotland/).
Authority for reproduction for any other type of publication, broadcast or exhibition must be obtained by
completing an application form.
2.
The Museums, Archives and Local History Services reserve the right to deny authority to reproduce any
image at their discretion.
3.
Charges made for reproduction will take into account factors such as the purpose of the Licence, the
distribution of the publication and the type of organisation seeking the Licence. The current scale of
charges is detailed here but may be varied at any time, without prior notice. If requested, a formal
quotation, binding for a period of one month, will be given.
4.
Payment of an agreed fee will give the purchaser the non-exclusive licence to reproduce the image, in the
agreed manner only, for a single print run (or production, as appropriate). Reproduction rights for
television are for a single showing of the programme. A larger or repeated print run/production or
broadcast may be subject to repeat fees.
5.
The authority to reproduce given by payment of these fees extends only to the initial applicant. The
authority does not imply any right to the purchaser to authorise subsequent reproduction by a third party
other than under the terms of the Creative Commons Attribution-NonCommercial-ShareAlike 2.5
Scotland License.
6.
Payment may be made by cheque, on receipt of invoice, in pounds sterling, made payable to “East
Lothian Council.” Authority to reproduce the image is dependent upon receipt of full payment.
7.
In addition to the reproduction fee, a copy of the publication is also required.
8.
Copyright will be retained by East Lothian Council or other Copyright holder as indicated in the
acknowledgments.
9.
Unauthorised reproduction will infringe Copyright and may render the infringer liable to civil penalties.
Where works of art are still within Copyright, it is the responsibility of the applicant to obtain permission
to reproduce the work from the holder of the Copyright.
10.
You must ensure that any caption relating to the image used is correct and reflects the description
mentioned in the form. An acknowledgement of the source of the image should be made on every
occasion of publication in the form, detailed above unless otherwise stated. The acknowledgement shall
be made in such a way that it can be identified with the individual image to which it applies.

EAST LOTHIAN COUNCIL ARCHAEOLOGY SERVICE
HER ACCESS & CHARGING POLICY
This policy statement sets out the framework and guidelines for access to information held by East Lothian
Council Archaeology Service and to information contained in the East Lothian and Midlothian Historic
Environment Record (HER). It sets out the circumstances where charges will be made for the provision of HER
data, and the level of charges. Charges relate to the time taken to collate and prepare the HER information into
a suitable digital format, and in some cases for also providing curatorial advice.
Background
The HER contains records of all known archaeological and historic sites within East Lothian and Midlothian.
This includes buried archaeological remains, monuments, historic buildings, landscapes and artefacts, as well as
records of recent archaeological fieldwork projects. The HER is comprised of a database with over 17,000
records, linked to GIS mapping. This is supplemented with a wide range of reference material, including
fieldwork reports, photographs, plans, aerial photographs, and historic maps. The database is updated regularly
with new finds and discoveries.
The HER is a key resource used by the Archaeology Service as the basis for historic environment conservation
and management advice, such as for planning proposals and environmental schemes. The HER is also used by
members of the public, consultants, history societies, students, and academics. It is a resource that is available
for anyone who is interested in finding out about the archaeology and heritage of East Lothian and Midlothian.
The HER and the Archaeology Service seek to promote an open regime regarding access to information, and
make HER information freely available to the public through our website. The Archaeology Service makes
every effort to meet its obligations under the following legislation: the Freedom of Information (Scotland) Act
2002, the Environmental Information (Scotland) Regulations 2004, the INSPIRE (Scotland) Regulations 2009,
and the access provisions of the Data Protection Act 1998.
Access to HER information
The HER is available online through the John Gray Centre website: http://www.johngraycentre.org/ . It can be
searched either through the map or by the advanced search. This facility allows you to search the HER at the
same time as Archives, Local History, and Museums records for East Lothian.
The HER can also be accessed through PastMap, which provides online access to map-based information about
Scotland’s historic environment. See: http://pastmap.org.uk/
We do not currently have the facilities for members of the public to visit the HER in person, but enquiries by
telephone or email are welcome.
Copies of archived reports of archaeological fieldwork, which have been submitted to the HER, can be made
available to the public on request, subject to the charges set out below. Users of such supplied reports are
reminded that the reports remain the copyright of the author(s) and supply of a copy of a report by the HER does
not entitle the user to infringe this copyright.
Charging policy
At the discretion of the Archaeology Service, archaeological information and/or curatorial archaeological advice
will be supplied free of charge to students, genuine researchers, and members of the public within reasonable
limits. There may be a charge for complex, unusual or onerous enquiries. There may also be a charge for
unusual materials, postage and packing for supply of information and photocopies may be charged at the rate
below.
The Archaeology Service will impose a charge for the time expended to meet all commercial requests for
information and/or curatorial advice. This is intended to reflect the cost of staff time in providing information,
advice, assistance, and reports and to recover any reasonable costs for the supply of data (photocopies,
photographs, reports etc.).
The data is supplied in a suitable digital format, usually in the form of a spreadsheet or database with related
shapefiles for GIS mapping.
Page 32
At the discretion of the Archaeology Service, charges may be made for curatorial advice that lies outwith the
formal planning procedures. This may include extensive pre-application advice or advice for non-planning
developments (i.e. forestry, agri-environmental, permitted development etc).
The charge for staff time in providing information, curatorial advice, or any other assistance, in respect of
commercial requests and enquiries will be £100 (+VAT) per hour, or part of hour. Please see below for other
charges.
Estimates of likely costs for enquiries will be supplied in advance of a query being undertaken.
Charges

application or non-planning developments)

Guidelines for access to HER information
HER information is only valid, for a given area, for a maximum period of 6 months. After this period the HER
information becomes invalid. Enquirers should be aware that HER enhancement projects are continually adding
to the number of already known and recorded archaeological sites.
To comply with Ordnance Survey licence requirements, an end-user licence agreement will be required, signed
by both parties.
Although every reasonable effort is made to verify information contained in the HER database, the database is
compiled from a variety of often unchecked sources and the information it contains should not be seen as
definitive. Therefore, East Lothian Council Archaeology Service does not accept responsibility for the accuracy
of any HER information supplied by it and the user of the HER information accepts that, save as regards any
matter for which it is not possible in law to exclude or limit liability, East Lothian Council Archaeology Service
accepts no liability whether for direct, indirect, consequential or incidental damages or losses arising from the
use of HER information.
The whole of the copyright and all other intellectual property rights throughout the world for the whole term of
such copyright in the HER information is held by the East Lothian Council Archaeology Service. Dissemination
to a third party of the HER Information without the written consent of the Archaeology Service shall be deemed
as a breach of that copyright. HER information supplied to an enquirer shall not be retained after the specific use
for which it was requested has finished. Where specific consent under the copyright provisions governing the
HER has been obtained for dissemination of HER information to third parties through publications, reports or
theses, due acknowledgement of the use of HER information will be given.
Users of HER data will be expected to inform the HER of new sites or of information that comes to light as a
result of their research. Copies of, or access to, the completed research should be made available to the HER
within 6 months of completion.

CHARGING POLICY - CATEGORIES OF ORGANISATION
The appropriate rate of charge to be applied for hall lets, etc., is determined by the type of organisation hiring the
premises. It is not possible to provide an exhaustive list of all organisations that may apply for lets of Council
halls, etc. The following definitions of categories, together with examples, are intended to provide guidance on
the appropriate rate of charge to apply to different organisations.
CATEGORY 1: VOLUNTARY & CHARITABLE ORGANISATIONS
This rate of charge should be applied to charities and to voluntary organisations where the primary purpose of the
organisation is to provide a service to the community. It should also be applied to organisations working in support
of pensioners and young people to support groups for people with special needs.
Examples of voluntary and charitable organisations include:








Registered Charities
Groups for the Mentally or Physically Handicapped
OAP Organisations
Children's Playgroups/Youth Clubs/Young People's Organisations
Support Groups, (e.g. Alcoholics Anonymous, Single Parents Groups)
Religious Groups/Church Organisations
Festival/Gala Day Organisations
Community Councils
Parent/Teacher Associations
This rate of charge should also be applied to any musical or drama group performing free of charge to charitable
organisations.
CATEGORY 2: NON-PROFIT MAKING ORGANISATIONS
This rate of charge should be applied to organisations that operate on a non-profit making basis and where their
activities are of a general recreational nature, as distinct from a charitable cause or a specific social need or
community service. Organisations in this category will normally comprise individuals who give their time on a
voluntary basis and where the proceeds of any events are put back into the club/organisation's funds.
Examples of non-profit making organisations include: Amateur Sporting Organisations
 Other Amateur Recreational Organisations, (e.g. Floral Art Clubs, Bowling Clubs, Dance Clubs, Amateur
Dramatic Organisations, etc.)
 Round Table/Rotary Club/Inner Wheel/Ladies' Circle/Musselburgh Honest Lasses
 Association/Women's Guilds/Loyal Orange Lodge/Eastern Star, etc.
 Company Staff Organisations and Events, (e.g. Brunton Staff)
 Private Individuals, (e.g. Weddings)
Page 37
CATEGORY 3: COMMERCIAL ORGANISATIONS
This rate of charge should be applied to commercial organisations, i.e. where the organisation operates on a profitmaking basis. It should also be applied to central and local government bodies and other public and statutory
agencies. Examples of commercial organisations include:








Any Limited Company or PLC
Local Authorities
Health Boards
Professional Sporting Groups
Discos - Commercial Operators
Traders
Dance Schools
Co-operative Societies
Slimming Clubs
The charge should also be applied to individuals who intend to use the facility for personal profit, e.g.
aerobics/fitness instructors who charge participants to take part in the class.
NOTE : The appropriate charge to be levied in any given circumstances should be based on the category of the
organisation, NOT on the specific nature of the let. The only exception to this is where a commercial or
non-profit making organisation is running an event from which the proceeds are going to a charity. In
such instances, the organisation will require to provide proof (i.e. a letter from the charity), to
demonstrate that this is the case and will be charged at 50% of the standard rate.
