Contractor, his supervisors and his workmen will have to act upon as per the directives given to them by the factory representative (site-in-charge) from time to time in respect of work awarded to him. Contractor’s Supervisor should meet the site – in – charge at least twice in a day and apprise him with the progress of the work and take necessary guidance. Records/entries/instructions of such guidance will be made in a register to be maintained by the contractor/supervisor which will be countersigned by the site-in-charge or nodal officer nominated. 2. The contractor has to provide effective supervision during the period of contract. 3. The contractor will visit, survey and study the site and the quantum of work before submitting his quotation. 4. The contractor has to prepare and submit the planning schedule, programme chart, deployment details, list of tools and equipment in consultation with the officer-in-charge of the respective area for which the contract is concluded, before commencement of the contract. 5. The work related to all types of monitoring, supervision, administration and execution of the contract lies with contractor. For any faults, damage, complaints, the contractor will be held responsible and shall be liable to penalty as decided by the management. 6. The contractor must ensure that the workers are deployed for only 06 days a week with 01 days off in a week. 7. The contractor shall maintain the following Registers : a) Muster Roll in Form-XIV b) Register of Wages Form-XVII c) Register of deduction for damages or loss in Form-XX d) Register of Fines in Form-XXI e) Register of Overtimes in Form-XXIII f) Wages slips in Form-XIX should be issued to contract workers one day prior to the date pf payment of wages. g) Register of persons employed in Form-XIII h) Employment Card to be issued to Contract Workers in Form- XIV i) Register of advances in Form-XXII 8. There will be periodical surprise checking of the services provide by the contractor for the subject job by the representative of General Manager. Workers will be paid wages as per prevailing rate of minimum wages of respective schedules. Workers should be paid their wages in presence of designated authority nominated by the factory. Such certificate should be forwarded with claim bill for release of payment. II. SECURITY & PVR FORMALITIES: 1. The contractor and his workmen shall follow factory’s security rules in force from time to time. General Manager reserves right to disallow any of the contractor’s workmen from being deployed in the Factory and estate area without assigning any reason. The contractor will submit PVR for all the workers engaged by him including 20% extra to cater for the absenteeism before the start of contract. 2. The Security/Authorized section will maintain register for the Contractor’s workmen and obtain their signature while coming “IN” and going “OUT” or as the case may be and user section will also maintain register in the same way. Certificate of attendance will have to be enclosed duly countersigned by I/C user section while submitting the bill for the payment and respective attendance registers to be produced whenever required by audit authorities. 3. If any employee of the contractor is found to have committed misconduct or misbehaviors, the factory at its sole discretion, may direct the contractor to remove such employee and the contractor shall remove such employee(s) without questioning the decision of the factory. 4. The personnel deployed by the contractor will not have any business connection/ dealings with any agency/agencies directly or indirectly associated with the Factory. The personnel deployed by the contractor shall not engage themselves in any undesirable activities whether within the factory or in the estate area. III. SAFETY TERMS: 1. Contractor has to make his own arrangement for consumables/tools/safety equipment and personal protective equipments/material handling equipments etc. required for use by his workmen to carry out the assigned task. Contractor will ensure that his workmen always adhere to safe working practices. 2. All the Contractor workmen will be provided with red/maroon colour jacket with the contractor’s name written on the back and ensure that they wear the same while entering factory/work place. 3. No housing accommodation to the personnel deployed by the contractor will be provided by the factory. IV.TERMINATION & PENALTY CLAUSE: 1. In case of unsatisfactory performance/services, the contact will be liable to be terminated at any time giving 30 days notice and forfeiting the Performance Security. 2. General Manager reserves the right to suspend the contract at any time without assigning any reasons. 3. The average attendance of contract labourer during the month should be atleast 80% otherwise the penality of Rs 5000/- shall be imposed on the contractor in that particular month. V.ARBITRATION: In case of any dispute between the factory and the contractor, it will exclusively be referred to a Sole Arbitrator to be appointed by the DGOF/OFB. The decision of such sole arbitrator shall be final and binding on both the parties to the dispute. VI. LEGAL CLAUSE: 1. Workmen below the age of 18 years and above 60 years should not be employed by the contractors. The working hours be generally restricted to 8.00 hrs a day excluding lunch break of 1 hour. Page:2/5 2. The employees of the contractor should not have any right/claim whatsoever for seeking employment in the factory. 3. The contractor & workmen engaged by the contractor should not have any adverse police record and should have good character. Clear PVRs should be submitted by the contractor to the factory management before engaging any of their workmen. The contractor will be responsible for good conduct and behavior of himself and his men deployed in the factory. 4. The factory management will not be held responsible for any accident or injury to the men of the contractor and for converge of any risk involved or liability arising out of any accident etc. which will have to be born by the Contractor. The contractor will be responsible for any accident including loss of life or Injury suffered by any of his workmen during discharge of the duty and also responsible for payment of compensation to their employees as per labour laws. If need arises Factory management will recover such amount form the contractor to effect payment to the affected contractors employee. 5. The contractor will have to abide by labour laws including Payment of Wages Act, Minimum Wages Act, and Contract Labour Regulation Act. , Workmen’s Compensation Act.(wherever applicable), Factories Act and other legislations and notifications of Government of Madhya Pradesh made applicable form time to time. The provisions of these labour laws shall be made applicable to the Contractor’s workmen as the case may be during the period of contract. 6. The contractor, his supervisor and workmen will ensure that no damage is caused to any of the government property of the factory. In the event of any damages caused, the cost of damages would be compensated by contractor or would be deducted form the bill/security deposit of the contractor based on market value. 7. Contractor has to submit a copy of license granted to him under Contract Labour Regulation and abolition Act. 1970 (and the Rules made there under by the authorities) within a period of 30 days of the award of the contract. 8. Apart from above important notes/ directives, the contractor shall also abide by other Terms and conditions as stipulated in the relevant contract depending upon the circumstances, as the case may be. 9. The contractor shall not appoint any sub-contractor for the work assigned to him. If any subletting is noticed, the contract will be short closed forfeiting PSD (Performance Security Deposit). 10. The contractor will have to take out the following insurance policies to cover all the risk and keep them valid till the successful completion of the contract: (i) Workmen’s Compensation (if applicable) (ii) Risk/Liability of the 3rd party 11. All the rates quoted by the firm should be in prescribed format attached with the tender. Quotation not in prescribed format is liable to be treated as invalid. 12. Quantity Increase (Option) Clause: The factory reserves the right to increase quantity of the order at the prevailing rates, terms and conditions during the validity of the contract. However, the option will not exceed 50% of the original ordered qty. VII. PAYMENT TERMS:- Payment shall be made on submission of :a) 100% payment of labour charges will be made on the basis of following documents: i. Job Completion Certificate issued by User section representative. ii. Attendance Sheet (Signed by JWM/paying authority of user section) iii. Wage disbursement certificate in presence of paying authority of respective section. Page:3/5 b) 100% payment toward government contribution of EPF and ESIC will be reimbursed on actual basis on submission of EPF and ESIC Challan. Contractor is required to submit EPF and ESIC return and other relevant documents periodically. c) 100% payment for the consumables and equipment charges will be made on prorata basis every month on submission of usage/completion certificate issued by the user section. d) 100% Service Tax will be reimbursed on submission of service tax challan along with relevant documents e) Form 6A should be submitted within one month of end of contract period. The contractor should satisfy the signing of withdrawal forms and Form 3A of employees to the management within one month of end of contract. These two points would have to be satisfied before claiming last bill and performance security deposit. VIII. GENERAL NOTE ON TENDER ENQUIRY: 1. The contractor shall quote minimum service charges (i.e profit) of amount 5.6% of labour and material/equipment charges as fixed lump sum amount. The service charges shall be fixed during the currency of contract 2. Prices shall be quoted by the contractor both in figures and words. 3. Earnest Money Deposit (EMD): Tenderers shall submit the Earnest Money Deposit ( if asked) in the form of a crossed Demand Draft, fixed Deposits Receipts, Banker’s Cheque, Bank Guarantee (BG) from any scheduled Commercial Bank in favour of General Manager of the factory, otherwise their offer may be ignored. The firm’s already registered at the factory/Sister Ordnance Factories contract need not pay EMD. 4. Offer should have a minimum validity of 90 days from the date of opening of the Tender. 5. The Tenderer should offer rate confirming to the specification indicated in the Tender. However, if he is offering deviation such deviations should be indicated clearly to evaluate the offer. In no case the request for change in specification after placement of supply order will be agreed to. 6. Unsolicited letter/canvassing /post tender correction: - Canvassing by Tenderers in any form, including unsolicited letters on tenders submitted or post tender corrections shall render their tenders liable for summarily rejection. 7. Contractor must start the work within 07 days after acceptance of Tender/Issuance Supply Order or as incorporated in Supply Order. 8. Risk Purchase: If the firm fails to complete the work delivery period, factory reserves the right to complete the same at firm’s risk and cost. 9. Jurisdiction of Court: The Civil Court of Jabalpur shall only have jurisdiction to all Civil Suit / legal proceeding arising out of in any way touching or concerning to the case. 10. Penalty For Use Of Undue Influence : The contractor has to undertake that he has not given, offered or promised to give directly or indirectly any gift, consideration reward, commission, fees, brokerage to any person in service of the Factory or otherwise in procuring the contract or for bearing to do or for having done or for borne to do any action in relation to the obtaining or execution of the contract or any other contract with the Government for showing or for bearing to show favour or disfavour to any person in relation to the contract or any other contract with Government. Any breach of the aforesaid undertaking by the contractor Page:4/5 or any one employed by him or acting on his behalf , as defined in the Indian Penal Code, 1980 or the Prevention of Corruption Act, 1974 or any other Act enacted for the prevention of corruption shall entitle the Factory to cancel the contract and all or any other contracts with Contractor and recover from the Contractor the amount of any loss arising from such cancellation also shall render the Contractor to such liability, penalty as the Factory may deem proper, including but not limited to termination of contract, imposition of penal damages, forfeiture of the Security Deposit and refund of the amounts paid by the Factory. 11. A decision of the Factory or his nominee to the effect that a breach of the undertaking has been committed shall be final and binding on the Contractor. Giving or offering of any gift, bribe or inducement or any attempt to any such act on the behalf of contractor towards any officer/Employee of the factory or to any other person in a position to influence the decision of the Factory directly or indirectly or any attempt to influence any Officer/Employee of the factory for showing any favour in relation to this or any other contract, shall render the contractor to such liability, penalty as the factory may deem proper, including but not limited to termination of contract, imposition of penal damages, forfeiture of the Security Deposit and refund of the amounts paid to the Factory. 12. The contractor shall get open the bank account of all the contract labourers engaged for the work. The payment to the contract labourers shall be made to their bank account. 13. The contractor’s performance in respect of similar nature of work undertaken by them at the factory or in any of the units of the O.F. Board Organization or Central Government/ State Government/PSUs should be entirely satisfactory otherwise his offer will not be considered. 14. In case two or more quotations are equally placed in terms of cost and other conditions, the contract will be awarded to the contractor with higher vendor rating, in the absence of which, the same will be equally divided. The order shall be placed on the firms in alphabetical order of the name of the firm in case of division of contract on more than one firms. 15. PSD – The successful tenderer will have to pay performance security deposit of 10% of the contract value in the form bank guarantee/DD/FDR. Whole job contract for Safe Guard and cleaning of cycle/scooter stands and car parking area situated at 16 locations near main gate, west gate and Vidyanagar gate as per following details:Near West gate, Bldg. No. 409 to 417 = 09 Nos. Near Vidyanagar gate Bldg.no.388 to 389 = 02 Nos. Near Main gate , Bldg No.T/60/1 to T/60/4 = 04 Nos. Car parking in front of main gate = 01 Nos. ----------------------Total = 16 Nos. 2. The contractor will be responsible for safeguard the cycle/scooter/other automobile, of GCF employees or visitors, kept in the stands mentioned above, during the factory working hours, on all days of factory working from 0700 hrs to1900 hrs. The contractor will also be responsible to safeguard one of the above cycle/scooter shed in front of main gate, during night shift, from 1900 hrs to 0700 hrs. 3. The contractor will be responsible for any theft of cycle/scooter/other automobiles or accessories or fuel from vehicles, of GCF employees or visitors, parked in the stand/parking area during the period of contract. 4. The contractor will be liable to pay compensation, as decided by GM/GCF or his authorised representative, for any theft of Scooter/Cycle/other Automobiles or accessories or fuel, to the vehicles parked in the stands/parking area during the period of contract, and also for any damages caused to the vehicles from any miscreant elements. 5. If contractor fails to pay the said compensation, the same will be recovered from the contractor’s bills. 6. The contractor will be required to provide 5 unskilled labourers and one supervisor for the subject work. 7. The contractor should ensure proper cleanliness on daily basis and removal of wild growth as and when required, (especially twice during rainy season), of the sheds, parking area and surrounding areas. 8. Vehicle of factory employees, trade apprentices, and allied Establishment employees and visitors of the factory shall be allowed to park in the stands. 9. The period of contract will be for 312 working days, which can be extended for further 106 working days, if required. 10. The willing contractors may visit the locations of scooter/cycle sheds make themselves aware of quantum of work before submitting their offers. 11. The contract will be governed by PV clause to the extent the minimum wages notified by the Central Govt. from time to time, during the currency of the contract . B. General Terms and Conditions: 1. While carrying out the work, contractor will be responsible for abiding all security and safety regulations by his workmen. In case of any loss caused to the factory due to the violation of above regulations by his workmen, or any omission / commission on the part of his workmen, the contractor has to make good the loss, as may be determined by GM/GCF who will have the right to recover for all such losses from the contractor’s bill. Contractor’s bills will be accepted only on production of all related documents viz ESIC, EPF, job completion certificate, wage payment certificate and attendance of labourers duly signed by WIC, JWM/Y&E and DO of Y&E. The contractor should employ only adult workers above 18 years and below 60 years. The contractor will submit clear PVRs of all workmen to be employed by him against the instant contract. The contractor shall submit the list of labourers and the supervisor who he intends to employ and get approval of the factory management. Full addresses and passport size photos of the labourers and the supervisors shall be submitted by the contractor to the factory management before the commencement of contract. The contractor’s men will wear half sleeve maroon jacket, with firm’s name marked on the front and backside of the jacket. If the contractor fails to complete the work or any portion thereof, as agreed upon, or fails to comply with any direction given to him GM/GCF shall deduct the proportionate amount, from the contractor, or terminate the contract and forfeit the security deposit.
