Act No. 68, 1901.
An Act to give certain officers and persons the
powers and duties of the Registrar-General ;
to prescribe the oath to be taken by deputy
registrars-general; to provide that statutory
declarations and the oath of a sworn valuator
maybe made and taken before certain officers;
and to validate certain acts, acknowledg­
ments, instruments, documents, writings,
declarations, and oaths. [27th December, 1901.]

a n d b y t h e a u t h o r i t y of t h e same, as follows :—
1. This A c t m a y b e cited as t h e " Real P r o p e r t y a n d Convey­
ancing (Amendment) Act, 1001."

2. I n t h i s A c t —
" D e p u t y r e g i s t r a r - g e n e r a l " m e a n s a person a p p o i n t e d d e p u t y
r e g i s t r a r - g e n e r a l u n d e r t h e R e a l P r o p e r t y A c t or t h e P e a l
P r o p e r t y A c t , 1900.
" D e p u t y r e g i s t r a r " m e a n s a person a p p o i n t e d d e p u t y r e g i s t r a r
u n d e r t h e A c t t w e n t i e t h Victoria n u m b e r t w e n t y - s e v e n , or
t h e R e g i s t r a t i o n of Deeds A c t , 1807.
" J u s t i c e " m e a n s j u s t i c e of t h e peace.
3. (1) A n y d e p u t y r e g i s t r a r - g e n e r a l a p p o i n t e d before or after
t h e c o m m e n c e m e n t of t h i s A c t , a n d a n y person t o be a p p o i n t e d by t h e
G o v e r n o r in t h a t behalf b y notification in t h e G a z e t t e , m a y exercise
a n y power conferred a n d p e r f o r m a n y d u t y imposed on t h e R e g i s t r a r G e n e r a l by or u n d e r a n y s t a t u t e , or by v i r t u e of a n y office vested in
t h e R e g i s t r a r - G e n e r a l by or u n d e r a n y s t a t u t e .
(2) W h e r e before t h e c o m m e n c e m e n t of this A c t , and a c t i n g
or p u r p o r t i n g to act for or on behalf of or with t h e s a n c t i o n of t h e
R e g i s t r a r - G e n e r a l a n d for t h e p u r p o s e of exercising a n y power con­
ferred or performing a n y d u t y imposed on t h e R e g i s t r a r - G e n e r a l b y
or u n d e r a n y s t a t u t e , a d e p u t y r e g i s t r a r - g e n e r a l or a d e p u t y r e g i s t r a r
has done a n y acts or t h i n g s , s u c h acts or t h i n g s shall be deemed t o
h a v e b e e n a n d to be as valid as if done by t h e R e g i s t r a r - G e n e r a l .
4. E v e r y d e p u t y r e g i s t r a r - g e n e r a l a p p o i n t e d after t h e com­
m e n c e m e n t of this A c t shall, before e n t e r i n g u p o n t h e duties of his
office, t a k e t h e following o a t h before a J u d g e of t h e S u p r e m e C o u r t : —
" I do solemnly swear t h a t 1 will faithfully a n d to t h e best of m y
ability e x e c u t e a n d p e r f o r m t h e office a n d duties of d e p u t y
r e g i s t r a r - g e n e r a l for t h e State of N e w S o u t h W a l e s . So
h e l p m e God."
5. W h e r e before or after t h e c o m m e n c e m e n t of this A c t , a n d
a c t i n g or p u r p o r t i n g to a c t u n d e r t h e a u t h o r i t y of a n y s t a t u t e , —
(a) a n y person h a s m a d e a n y a c k n o w l e d g m e n t ; or
(b) t h e R e g i s t r a r - G e n e r a l or a n y d e p u t y r e g i s t r a r - g e n e r a l or
d e p u t y registrar h a s issued, signed, or m a d e a n y i n s t r u m e n t ,
d o c u m e n t , or writing,
s u c h a c k n o w l e d g m e n t , i n s t r u m e n t , d o c u m e n t , or w r i t i n g shall n o t be
deemed to h a v e b e e n or to lie invalid b y reason only of a n y infor­
m a l i t y in t h e m a n n e r or t i m e of affixing, impressing, or p r i n t i n g a n y
seal on s u c h a c k n o w l e d g m e n t , i n s t r u m e n t , d o c u m e n t , or w r i t i n g , or of
the omission to affix, i m p r e s s , or p r i n t a n y seal as aforesaid.
6. (1) A s t a t u t o r y declaration m a y be m a d e before t h e R e g i s t r a r G e n e r a l or before a n y d e p u t y r e g i s t r a r - g e n e r a l , d e p u t y registrar, or
commissioner for affidavits, a n d w h e n so m a d e shall h a v e t h e s a m e
effect as if m a d e before a j u s t i c e .
(2) W h e r e before t h e c o m m e n c e m e n t of t h i s A c t a n y person
h a s m a d e before t h e R e g i s t r a r - G e n e r a l or a n y d e p u t y r e g i s t r a r - g e n e r a l ,
deputy
d e p u t y registrar, or commissioner for affidavits, a n y s t a t u t o r y declara­
tion, or declaration in t h e form of a s t a t u t o r y declaration, such
declaration shall be deemed to h a v e had and shall h a v e t h e same
effect as if m a d e before a j u s t i c e .
7. "Where a sworn v a l u a t o r u n d e r t h e I l e a l P r o p e r t y A c t , 1900,
is resident a t some place outside; t h e c o u n t y of C u m b e r l a n d h e m a y
t a k e t h e oath r e q u i r e d b y section n i n e of t h e said A c t before a n y
j u s t i c e or commissioner for affidavits.
W h e r e before t h e c o m m e n c e m e n t of t h i s A c t a n y sworn v a l u a t o r
u n d e r t h e R e a l P r o p e r t y A c t or t h e P e a l P r o p e r t y A c t , 1900, resident
as aforesaid, h a s t a k e n t h e oath r e q u i r e d by such justice or commissioner
for affidavits, such oath so t a k e n shall be deemed to h a v e been, a n d
shall be, as valid a n d of t h e same effect as if t a k e n before t h e R e g i s t r a r General.
8. N o t h i n g in this A c t shall affect a n y proceedings p e n d i n g a t
the c o m m e n c e m e n t of this A c t .
