(N “Opiioid antiddote” meeans naloxxone hyddrochloridde, or any other similarlly acting drug appproved byy the Unitted Statess Food annd Drug Adminiistration ffor the treeatment oof an opiooid overdoose. “Opiioid overrdose” meeans an aacute conndition including, but not limited to, extreme physical illness, decreaased levvel of conscioousness, respiratory depreession, cooma, or death reesulting from thhe consum mption or use of ann opioid ddrug or annother subbstance with w which an opioid ddrug was combineed, and tthat a layyperson would rreasonablly believee to requirre medicaal assistannce. “Schhool-sponnsored fuunction” means any actiivity, eveent, or program m occurring on oor off schhool grouunds, whhether duuring or outsidee of regullar school hours, tthat is orrganized or supported by the schoool. 2. (New secttion) a. Each boaard of eduucation, bboard of ttrustees ministratorr of a nonnpublic of a chharter schhool, and chief schhool adm school shall deevelop a policy, in accoordance with guiidelines Educationn pursuannt to sectiion 3 of establisshed by thhe Departtment of E this actt, for the emergenccy adminiistration oof an opiooid antidoote to a studentt or staff member who is experienccing an oopioid ovverdose. The pollicy shall: (1) rrequire eeach schoool that includes any of tthe gradees nine throughh 12, and permit aany other school, to obtain a standinng order for opioid antiidotes puursuant tto sectioon 4 of the “Ovverdose Preventtion Act,,” P.L.20013, c.466 (C.24:6J-4), andd to mainntain a supply of opioidd antidotees under tthe standding orderr in a seccure but unlockeed and eaasily accesssible loccation; and (2) ppermit thhe schooll nurse, oor a trainned employee designated pursuannt to subsection cc. of this section, to adminnister an opioid antidotee to any student oor staff m member w whom the nurse or trained employyee in goood faith beelieves iss experienncing an oopioid oveerdose. b. (1) Opioidd antidotees shall bee maintaiined by a school pursuant to paraagraph (1)) of subssection a.. of this section inn quantitties and types ddeemed addequate bby the boaard of eduucation, bboard of ttrustees of a chharter schhool, or cchief schhool admiinistrator of a nonnpublic school, in consuultation w with the D Departmeent of Edducation aand the ment of H Human Seervices. Departm (2) T The opioiid antidottes shall bbe accesssible in thhe schooll during regular school hours annd duringg school-ssponsoredd functioons that take plaace in thee school oor on schoool grounnds adjaceent to thee school building. A booard of eeducationn, board of trusteees of a charter may, in school, or chief school administraator of a nnonpublicc school m 2 its disccretion, m make oppioid antiidotes acccessible during schoolsponsorred functiions that take place off schoool grounnds. c. (1) The scchool nurrse shall hhave the pprimary responsibiility for the emergency aadministrration of an opioid antidotte in accoordance with a ppolicy developed uunder thiss section. The boaard of eduucation, board oof trusteees of a chharter schhool, or chhief schoool adminnistrator of a noonpublic school shhall desiggnate addditional em mployeess of the school district, ccharter school, or nnonpublicc school w who volunnteer to adminisster an oopioid anttidote in the evennt that a student oor staff membeer experieences an opioid overdose when thhe nurse is not physicaally preseent at thee scene. The dessignated employeees shall only bee authorizzed to adm minister oopioid anttidotes affter receivving the trainingg requiredd under suubsectionn b. of secction 3 of this act. (2) In the evvent thatt a licenssed athleetic traineer voluntteers to adminisster an oopioid anntidote ppursuant tto this aact, it shhall not constituute a vioolation off the “A Athletic T Training L Licensuree Act,” P.L.19884, c.203 (C.45:9-337.35 et sseq.). d. A policy developed pursuannt to this section sshall requuire the transpoortation off an overrdose victtim to a hhospital eemergenccy room by emeergency services personneel after tthe adminnistrationn of an opioid antidote,, even iff the perrson’s syymptoms appear tto have resolveed. Thee Departtment off Educatiion, in (New ssection) a. 3. with the Departm ment of Human Servicees and consulttation w approprriate medical expperts, shhall estabblish guidelines ffor the developpment off a policyy by a sschool disstrict, chharter schhool, or nonpubblic schoool for tthe emerrgency aadministraation of opioid antidotees. Eachh board oof educatiion, boardd of trusttees of a charter school, and chieef school administtrator of a nonpubblic schoool shall ment the gguideliness in develloping a ppolicy purrsuant to section implem 2 of thiis act. b. T The guideelines shaall includde a requiirement tthat each school nurse, and eachh employeee designnated purssuant to subsectioon c. of section 2 of thiss act, receeive trainning on sttandardizzed protoccols for ministratioon of an oopioid anttidote to a student or staff m member the adm who exxperiencess an opioiid overdoose. The training sshall include the overdosse prevention infformationn describbed in suubsectionn a. of section 5 of tthe “Oveerdose P Preventionn Act,” P.L.20133, c.46 (C.24:66J-5). Thhe guidelines shall specify an approopriate enntity or entitiess to provvide the ttraining, and a scchool nurrse shall not be solely responsibble to traain the employeess designaated pursuant to subsecttion c. of section 2 of this acct. (New section) N funds appropriaated or otherwisse made availabble pursuuant to P.L.19991, c.226 (C.18A:440-23 et seq.) mayy be usedd to compply with the requuirementss of sectioon 2 of thhis act in nnonpublicc schools. "Em mergency medical responsee entity" means aan organization, companny, goveernmentall entity, communnity-baseed prograam, or healthcare systeem that pprovides pre-hosppital emeergency m medical services and asssistance too opioid oor heroin addicts oor abusers in the event oof an overrdose. "Em mergency medical respondeer" meanss a persoon, other than a health care pracctitioner, who is eemployedd on a paaid or voolunteer basis inn the areaa of emerrgency response, including,, but not limited to, an emergenncy meddical techhnician acting inn that pperson's "Heallth care practitiooner" means a professional cappacity. prescribber, pharrmacist, or otherr individdual whoose profeessional practicee is regulated purrsuant to Title 45 of the R Revised S Statutes, and whho, in accoordance w with the ppractitioner's scopee of profeessional practicee, prescribbes or disspenses ann opioid aantidote. "Medical asssistance" means pprofessionnal mediccal servicces that are proovided to a person experienncing a drrug overddose by a health care ppractitioner, actinng withiin the practitionner's scoope of professional praactice, inccluding pprofessionnal mediccal servicces that are moobilized tthrough ttelephonee contact with thee 911 tellephone emergeency serviice. "Opiioid antiddote" means naloxxone hyddrochloridde, or anyy other similarlly acting drug appproved byy the Unitted Statess Food annd Drug Adminiistration ffor the treeatment oof an opiooid overdoose. "Patient" meaans a persson who is at risk of an opioid overrdose or a persoon who iis not at risk of an opioiid overdoose who, in the person's individdual capaacity, obttains an opioid aantidote from a 4 health ccare pracctitioner, professioonal, or professionnal entity for the purposee of adm ministerinng that aantidote tto anotheer personn in an emergeency, in accordannce with subsectiion c. oof sectionn 4 of P.L.20113, c.46 (C.24:6J-44). "Patieent" incluudes a proofessionall who is acting in that professioonal's inddividual capacity, but dooes not includee a professsional whho is actinng in a professionaal capacityy. "Preescriber" m means a health caare practiitioner auuthorized by law to presccribe meddications who, acting withiin the praactitioner's scope of profe fessional ppractice, pprescribees an opiooid antidoote. "Presscriber" includees, but is not limitted to, a physiciann, physiccian assistant, or advanced practicce nurse. "Proofessionall" meanss a persson, other than a healtth care practitioner, whho is empployed onn a paid bbasis or iis engageed on a ment or ttherapy, volunteeer basis iin the areeas of subbstance abbuse treatm criminaal justice,, or a relaated areaa, and whho, acting in that pperson's professional or vvolunteer capacity, obtains an opioidd antidotee from a health care prractitioneer for thhe purpooses of dispensing or adminisstering thhat antidote to otheer parties in the coourse of bbusiness or voluunteer acttivities. "Professiional" inccludes, buut is not limited to, a steerile syrinnge accesss program m employyee, or a llaw enforrcement officiall. "Proofessionall entity"" meanss an oorganizattion, company, governm mental eentity, coommunityy-based pprogram, sterile syringe access program,, or any oother orgaanized grroup that employs two or more pprofessionnals whoo engagee, duringg the reggular couurse of businesss or voluunteer activities, inn direct innteractionns with oppioid or heroin addicts oor abuserrs or othher persons suscepptible to opioid overdosse, or wiith other persons who are in a possition to pprovide direct m medical aassistancee to opioiid or herooin addiccts or abuusers in the event of an ooverdose. means a patient, pprofessionnal, professional entity, "Reccipient" m emergeency meddical respponder, [or] emerrgency m medical reesponse entity , school, sschool district, or school nuurse who is prescrribed or dispenssed an oopioid anntidote inn accordaance witth sectionn 4 of P.L.20113, c.46 (C.24:6J-44). (cf: P.L L.2015, cc.10, s.1) Section 4 of P.L.20013, c.46 (C.24:6J-4) is am mended to read as 8. S followss: 4. aa. (1) A prescribber or otther heallth care practitioner, as approprriate, mayy prescribbe or disppense an oopioid anttidote: (a) directly oor through a standding orderr, to any recipient who is deemedd by thhe healthh care practitionner to be capaable of adminisstering thhe opioidd antidotte to an overdosse victim m in an emergeency; (b) through a standing order, to any prrofessionaal or emeergency medicaal respondder who iis not actting in a pprofessional or voolunteer capacityy for a professiional entity, or an emerrgency m medical responsse entity, but who is deemedd by the hhealth carre practitiioner to 5 be capaable of addministeriing opioidd antidotees to overrdose victtims, as part off the proffessional's regularr course of busineess or voolunteer activitiees; (c) through a standinng order, to any professioonal who is not acting in a professional or volunnteer cappacity forr a profeessional med by thhe healthh care prractitionerr to be entity, but whoo is deem capablee of diispensingg opioidd antidottes to recipientts, for adminisstration thhereby, aas part off the proffessional's regular course of businness or voolunteer aactivities;; (d) through a standinng order, to any professionnal entity or any emergeency mediical respoonse entitty, whichh is deemed by thee health care prractitioneer to empploy proffessionalss or emeergency m medical respondders, as apppropriatte, who arre capable of admiinisteringg opioid antidotees to overrdose victtims as paart of the entity's rregular coourse of businesss or voluunteer actiivities; (e) through a standingg order, tto any proofessional entity w which is deemedd by the hhealth carre practitiioner to eemploy prrofessionaals who are cappable off dispenssing opiooid antiddotes to recipiennts, for adminisstration tthereby, as part oof the enntity's regular couurse of businesss or voluunteer actiivities ; (f) through a standing order, to a scchool, schhool disttrict, or school nurse puursuant to the provvisions off section 2 of P.L. , c. (C. ) (pending before tthe Legisslature as this bill).. (2) ((a) For tthe purpooses of thhis subsection, whhenever tthe law expresssly authorrizes or requires a certainn type off professional or professional enttity to obbtain a standing orrder for opioid anntidotes pursuannt to thiss sectionn, such pprofessionnal, or thhe professsionals employyed or enggaged byy such proofessionaal entity, as the caase may be, shaall be pressumed byy the presscribing oor dispennsing heallth care practitioner to bbe capablee of admiinisteringg or dispensing thee opioid antidotee, consisttent with tthe expreess statutoory requirrement. (b) For the purposess of thiss subsecttion, whenever thhe law expresssly requires a certaain type oof emergency mediical respoonder or emergeency meddical response entiity to obttain a staanding orrder for opioid antidotess pursuannt to this section, such emeergency m medical medical rresponderrs emplooyed or respondder, or tthe emerrgency m engaged by succh emergeency meddical respponse enttity, as thhe case med by thee prescribbing or dispensingg health may bee, shall bee presum care praactitionerr to be caapable of administeering the opioid anntidote, consisteent with tthe expresss statutoory requireement. (c) For thee purposees of thiis subsecction, whhenever tthe law expresssly authorrizes or reequires a school orr school ddistrict too obtain a standding orderr for opioid antiddotes purssuant to tthis sectiion, the school nurses em mployed or engageed by thee school oor school district shall bbe presum med by tthe prescribing orr dispenssing health care practitioner to be capabble of addministeriing the opioid anntidote, consisteent with tthe expresss statutoory requireement. (3) ((a) Whennever a pprescriberr or otherr health ccare pracctitioner prescribbes or ddispenses an opioid antidoote to a professioonal or 6 professional enntity purssuant to a standding ordeer issuedd under paragraaph (1) oof this suubsection, the stannding ordder shall specify whether the proffessional or professsional enntity is auuthorized tthereby to direcctly administer thhe opioid antidote to overddose victtims; to dispensse the opiioid antidote to reccipients, ffor their aadministraation to third paarties; or to both aadministerr and disppense the opioid anntidote. If a stannding ordder does nnot includde a specification in this reegard, it shall bee deemedd to authoorize the pprofessionnal or proofessionaal entity only too administer the oppioid antidote witth immunnity, as prrovided by subsection cc. of thiss section,, and it shall nott be deem med to authorize the prrofessionaal or proofessionall entity too engagee in the further dispensing of tthe antiddote to recipientts, unless such w, as provvided by ssubparagrraph (b) authoritty has beeen granteed by law of this pparagraphh. (b) Notwithsstanding the provvisions of this paaragraph to the contraryy, if the llaw expreessly authhorizes or requires a certain type of professional, prrofessionaal entity,, emergeency meddical respponder, mergencyy medical responsee entity , sschool, scchool disttrict, or [or] em school nurse to administeer or disppense opiioid antiddotes purssuant to a standding ordder issuedd hereunnder, thee standinng order issued pursuannt to thiss sectionn shall bee deemedd to grannt the auuthority specifieed by thhe law, even if such autthority iss not exxpressly indicateed on the face of thhe standinng order. (4) Any preescriber or otherr health care prractitioneer who prescribbes or diispenses an opioid antidotte in goood faith, and in accordaance withh the proovisions oof this suubsection,, shall noot, as a result oof the prractitioneer's acts or omisssions, be subject to any criminaal or civiil liabilityy, or anyy professsional dissciplinaryy action under T Title 45 oof the Revvised Stattutes for pprescribinng or disppensing an opiooid antidoote in acccordance with P.L.2013, c.446 (C.24::6J-1 et seq.). b. (11) Any prrofessionaal or proffessional eentity thaat has obttained a standinng order, pursuantt to subsection a. of this section, for the dispenssing of oppioid antiidotes, m may dispennse an oppioid antiidote to any reccipient w who is deeemed byy the proffessional or profeessional entity tto be caapable off adminisstering thhe opioidd antidotee to an overdosse victim in an em mergency. (2) Any professional or profeessional entity thhat dispennses an opioid antidote iin accorddance withh paragraaph (1) off this subssection, in good faith, and purrsuant to a standding ordeer issuedd under subsecttion a. off this secction, shaall not, ass a resultt of any acts or omissioons, be ssubject to any crriminal oor civil liability or any professional discciplinary action foor dispenssing an oppioid antiidote in C.24:6J-1 et seq.). accordaance withh P.L.20133, c.46 (C c. (11) Any em mergencyy medicall respondeer or emeergency m medical responsse entity that hass obtaineed a stannding ordder, pursuuant to subsecttion a. oof this section, ffor the aadministraation of opioid antidotees, may aadministerr an opioiid antidotte to overrdose victtims. 7 (2) Any emeergency m medical rresponderr or emeergency m medical responsse entity tthat admiinisters ann opioid aantidote, in good ffaith, in accordaance withh paragrapph (1) of this subssection, annd pursuaant to a standinng order issued under subseection a. of this seection, shhall not, as a ressult of anny acts or omissioons, be suubject to any crim minal or civil liiability, oor any ddisciplinaary actionn, for addministeriing the opioid antidote in accorrdance w with P.L.22013, c.446 (C.24:6J-1 et seq.) d. (11) Any pperson whho is thee recipiennt of an opioid anntidote, which hhas been prescribeed or disppensed forr adminisstration puurposes pursuannt to subssection a. or b. of tthis sectioon, and w who has reeceived overdosse prevenntion infoormation ppursuant to sectionn 5 of P.L L.2013, c.46 (C C.24:6J-5), may aadministeer the oppioid antidote to another person in an eemergencyy, withouut fee, iif the anntidote reecipient believees, in goood faith, that the other peerson is experienccing an opioid ooverdose. (2) Any persson who administeers an oppioid antiddote purssuant to paragraaph (1) off this subsection shhall not, aas a resullt of the pperson's acts or omissionns, be suubject to any crim minal or ccivil liabiility for adminisstering thhe opioid antidote in accorddance withh P.L.20113, c.46 (C.24:66J-1 et seqq.). e. In additioon to the immunitty that is providedd by this section for authorized persons who arre engagged in tthe presccribing, mmunity dispenssing, or aadministeering of aan opioidd antidotee, the im provideed by secttion 7 or section 8 of P.L.2013, c.466 (C.2C:35-30 or C.2C:35-31) shaall apply to a perrson who acts in aaccordancce with this secction, proovided thhat the reequiremennts of those sectiions, as applicaable, havee been meet. f. A Any schoool, school district, school nuurse, schoool emplooyee, or any othher officerr or agentt of a boaard of eduucation, charter schhool, or nonpubblic schoool who addministerss, or perm mits the addministraation of, an opiooid antidoote in goood faith iin accorddance withh the proovisions of sectiion 2 of P P.L. , c. (C. ) (pending beforee the Legislature as thiss bill), aand purssuant to a standiing ordeer issuedd under subsecttion a. off this secction, shaall not, ass a resultt of any acts or omissioons, be ssubject too any crriminal oor civil lliability, or any discipliinary acttion, forr adminiistering, or for permittinng the adminisstration oof, the opioid antiddote in acccordancee with P.L L.2013, c.46 (C C.24:6J-1 et seq.). (cf: P.L L.2015, cc.10, s.2) 9. This act shhall take effect onn the first day of thhe fourthh month ment of next foollowing the date of enacttment, exxcept thee Departm Educatiion may take anny anticiipatory aadministrrative acttion in advance as shalll be necesssary for tthe implementationn of this aact. 8 STATE EMENT Thiss bill wouuld requiree a boardd of educaation, boaard of trusstees of a chartter schoool, and chief schoool administrator of a nonnpublic school to develoop a poliicy, pursuuant to D Departmeent of Edducation ministratiion of ann opioid aantidote guidelinnes, for tthe emerggency adm to a student oor staff m member who is experienncing an opioid overdosse. The ppolicy will: (1) reqquire a scchool thatt includess any of the graddes nine tthrough 112, and peermit anyy other schhool, to oobtain a standinng order for opioiid antidootes and tto maintaain a suppply of opioid antidotess in a secure and eeasily acccessible llocation; and (2) permit the schoool nursee or trainned employees too administer an opioid antidote to any sttudent or staff member whom the nnurse or trained employeee in goood faith bbelieves iss experieencing ann opioid overdosse. The opioid aantidotes must be accessiblle in the school during regular sschool hours and dduring schhool-sponnsored fuunctions that takke place iin the schhool or oon schooll groundss adjacentt to the school building. A board of education,, board oof trusteees of a charter school, oor chief sschool addministrattor of a nnonpublic school may, inn its disscretion, make oppioid antidotes acccessible during school--sponsoreed functions that taake place off schoool grounds. Under the ppolicy, thhe schoool nurse will havve the pprimary responssibility ffor the emergenccy adminnistrationn of an opioid antidotee. The bboard of educatioon, board of trusteees of a charter school, or chieff school administtrator of a nonpubblic schoool will mployees who vollunteer too administer an designaate additiional em opioid antidote in the event thhat a sttudent orr staff m member when thee nurse iss not phyysically experieences an opioid overdose w presentt at the scene. The bill direects the D Departmeent of Edducation, in consuultation medical with thhe Departtment of Human Services and apprropriate m experts, to estabblish guiddelines foor school districts, charter sschools, and noonpublic schools in devveloping their poolicies ffor the adminisstration oof opioid antidotess. The guuidelines will requuire that each scchool nurrse, and eeach empployee designated by the board of educatiion, boardd of trusstees of a charter school, or chief school adminisstrator oof a noonpublic school pursuant to thee bill’s provisioons, receeive training on standarddized prootocols ffor the adminisstration oof an opioid antiddote to a student oor staff m member who exxperiencess an opiooid overdoose. The training will incluude the overdosse prevention infformationn describbed in suubsectionn a. of section 5 of tthe “Oveerdose P Preventionn Act,” P.L.20133, c.46 (C.24:66J-5). The bill provvides imm munity froom liabiliity for scchool nurses and other employeess or agennts of a booard of eeducation, charter school, or nonnpublic scchool, annd prescrribers off opioid antidotess for a school, for goodd faith accts or om missions cconsistent with thhe bill’s provisioons.
