Napoleon Township Zoning Board of Appeals Wednesday June 10, 2015 PRESENT: James Penn, Chairman; Janet Day, Secretary; and Larry Kujawa, Alternate; Steve Doerr, Planning Commission Liaison, and Al Roden ABSENT: Tim Horsch, Township Board The meeting was called to order by Chairman J. Penn, on Wednesday June 10, 2015, at 6:03p.m. in the Township Hall meeting room at 6755 Brooklyn Road, Napoleon, MI A motion was made by J. Day, supported by L. Kujawa, to approve the minutes of Wednesday, May 13, 2015. The motion carried. Case#15-06-0007 – A public hearing was held on the request Paul and Patricia Albrecht of 8021 South Portage Road to allow a 20X26 ft. deck to be add to the front of the home that is closer to the water, has a west side , total side yard and a percentage of lot coverage greater than is allowed by the Ordinance. J. Penn, Chairman, asked if the Board had any questions. Roden asked if the deck height was greater than 12 inches. P. Albrecht stated that the deck height will be 18 inches. There was discussion concerning the percentage of lot coverage since the lot was very small and possible issues with water runoff. It was noted that the property was served by municipal sewer and because the addition was a deck storm water would be able to run into the ground under the deck. Motion by A. Roden and supported by J. Penn to grant the variances of 13.5% increase in lot coverage from the allowed 30%, 10.83 feet from the required 50 feet front yard setback from water, 1.7 feet from the required 10 feet minimum west side yard setback and 6.3 feet from the total side yard requirement of 25 feet and for this request only based on Article 13-Section 13.3.3 – C- Subsection 3. The motion carried unanimously. Motion by J. Penn and supported by L. Kujawa to adjourn the meeting. The motion carried.
