BY ADDING A NEW CHAPTER REQUIRING CERTAIN COMMERCIAL
PASSENGER AIRLINES
OPERATING WITHIN THE MUNICIPALITY
OF AN CH ORA GET 0 KEEP THE PUB U C INFORMED
OF THEIR BEREAVEMENT
POLICY AND PROVIDING A PENALTY FOR FAILURE TO COMPLY
WITH THE REQUIREMENTS.
WHEREAS, unlike many locales in the lower 48 states,the vast majority of the citizens of Anchorage have
immediate fan1ily members living outside the State of Alaska; and
WHEREAS, when medical emergencies,life and death situations, or bereavementsoccur, our citizens find
it necessaryto make emergencyairline reservationsin order to be with their immediate family members;and
WHEREAS,commercialpassenger
airlinesgenerallydo not publishtheir bereavement
policiesso that the
generalpublic hasreadyaccessto them; and
WHEREAS, many citizens have found themselvespaying full fares, or thousandsof dollars, for emergency
fares despitethe fact that many commercial passengerairlines have corporate bereavementpolicies in place
that would afford special fares in such situations; and
WHEREAS,the citizensof Anchoragewould be well servedin knowing the bereavementpolicies of the
airlinesthat they needto do businesswith during emergencyor bereavementsituations;and
WHEREAS the airlines, as well, have a right to protect themselvesfrom fraud or abuseby making clear their
requirements for proof that an emergency or bereavement situation actually exists; now therefore,
THE ANCHORAGE ASSEMBLY ORDAINS:
Section 1. AnchorageMunicipal CodeChapter11,Transportation.is herebyamendedto readasfollows:

AIRLINE BEREAVEMENT POLICY NonCE
Airline BereavementPolicv Notice.
A All commercial passengerairlines operating within the Municipality of Anchorage and providing
year-round, interstate airline services, shall publish their Bereavement/EmergencyPolicies as
follows:
The policy shall be publishedon the first Sundayin Januaryand July of eachyear in the
Outdooror Travel Sectionof the local newspaperwith the greatestcirculation.
2. The publication shall have a title stating the airline's name and the words

B. All commercial passengerairlines operating within the Municipality of Anchorage and providing
year-round, interstate service shall have posted at all times their BereavementlEmergencyPolicy
on their corporate internet website. This posting shall be available from the home page and shall,
at a minimum, meet the following requirements:

C. Violation of this section may be punishable through the imposition of a civil fine of $5,000, in
addition to the penalties and remediesavailable under section 1.45.010of this Code. Anyperson
aggrieved by a violation or threatened violation of this chapter may bring a civil action under
Section 1.45.010B. to enjoin that violation and to obtain the relief described in that section.
Section 2. This ordinance shall become effective May 1, 2002.
