If you elect the Payment Plan, and paying by credit card you must provide your credit card information to us, and we will charge your payments to your credit card on the applicable Due Dates. Acceptance: By signing this Enrollment Form, the parties acknowledge that they have read this Enrollment Form, the Participant Waiver and Release, and the attached Enrollment Agreement, and the parties agree to be bound by the terms set forth in this form, the Participant Waiver and Release, and in the Enrollment Agreement, as of the latest date appearing below. Complete Agreement. This Enrollment Agreement, the Participant Waiver and Release, and the Enrollment Form together form a legally binding contract between you, the Student, and Intentional Yoga Teacher Training LLC. 2. Pre-­‐Enrollment Refund Policy. You may cancel this contract within three business days of your execution of the Enrollment Form, in which case all Tuition and fees paid by you shall be refunded, except for the $25.00 Application Fee. If you are rejected by us before enrollment, then all Tuition and fees paid by you shall be refunded, except that we may retain the $25.00 of the application Fee. All notices of cancellation must be made in writing, and all amounts due to you as a refund shall be mailed within 30 days of such notice to you at the address stated in the Enrollment Form. If more than three business days have elapsed since your execution of the Enrollment Form, then the amount of your refund shall be determined in accordance with the Post-­‐Enrollment Refund Policy set forth in Section 3 below. Unless you receive notice from us that you have been rejected from enrollment prior to the commencement of our training program, then you are deemed enrolled in the training program. 3. Post-­‐Enrollment Refund Policy. Upon your enrollment in the training program, you may notify us that you wish to discontinue the training program (“Drop Out”). If you Drop Out, you will only be refunded a percentage of your Tuition, and we shall retain all other fees. If you Drop Out within three days after the commencement of the training program, then you shall receive a refund equal to fifty percent of your Tuition. If you Drop Out in day 4 after the commencement of the training program, then you shall receive a refund equal to twenty five percent of your Tuition. If you Drop Out five or more days after the commencement of our training program, then you will not receive any refund. 4. Acknowledgement. By executing this Agreement, you acknowledge that we do not guarantee job placement to you upon completion of the training program. {BH319284.DOCX} Intentional Yoga Enrollment Agreement, 3/18/14 Page 5 of 5 5. Rescheduling. We reserve the right to reschedule the training program commencement date in our sole discretion. 6. Condition. Your timely payment of all monies due shall be a condition of continuing enrollment and graduation. 7. Notices. All notices required or contemplated by this Agreement shall be in writing and shall be either personally served at or mailed to the Student at the address stated in the Enrollment form, or to us at Intentional Yoga Teacher Training 6800 South Westnedge Suite 11 Portage Michigan 49002. For purposes hereof, an item shall be considered mailed if the sender can establish that it was sent by means including, but not limited to, the following: (i) by United States Postal Service, postage prepaid; (ii) by air courier service (Federal Express or the like); or (iii) by telefax or other means of electronic communication, provided the sender obtains written confirmation or proof of such communication (such as a telefax transmission report, written acknowledgment from the recipient, or other reliable proof of delivery). 8. Payment of Legal Fees in the Event of Litigation. In the event of any litigation between the parties concerning the subject of this Agreement, the prevailing party shall be entitled to payment or reimbursement for its reasonable attorneys' fees. For this purpose, reasonable attorneys' fees shall be deemed to include court costs, including those for appellate proceedings, and fees for attorneys, paralegals, legal assistants, accountants, and similar persons. 9. Amendment. This Agreement shall not be changed orally, but only by an agreement in writing, signed by the party against whom enforcement of any waiver, change, modification, extension or discharge is sought. Any waiver or amendment enforceable against us must be signed by either Kathleen P. Moskalik or Timothy J. Moskalik. 10. Governing Law. This Agreement shall be governed by and interpreted under the laws of the State of Michigan, irrespective of where this Agreement is made or to be performed, and irrespective of any applicable principles of conflict of laws. {BH319284.DOCX} Intentional Yoga Enrollment Agreement, 3/18/14 Page 6 of 5
