GEEL SITE SPECIFIC PROVISIONS This Document is the translation of the “Specifieke Bepalingen voor de Locatie te Geel” of which the Supplier can ask a copy. In case of an inconsistency between this Document and the “Specifieke Bepalingen voor de Locatie te Geel”, the latter prevails. 1 2 CONTRACTOR’S/SUPPLIER’S EMPLOYEES 1.1 The Contractor/Supplier shall provide BP, prior to the start of the execution of the Agreement, with a list of names and addresses of the Contractor’s/Supplier’s employees involved in the execution of the Agreement, its Sub-Contractors’ employees and any other third party involved. 1.2 The Contractor/Supplier warrants that all its employees, its Sub-Contractors’ employees and any other third party engaged in the execution of the Agreement, comply with all immigration laws and, where required, they are in the possession of a valid work permit for the duration of the Agreement. 1.3 The Contractor/Supplier shall ensure that nominated key personnel are available throughout the period of the Agreement. No re-assignment shall take place without the prior written consent of BP. 1.4 The entrance hours at BP’s Site are weekdays from Monday to Friday from 08.15 to 16.45 hours, unless permitted otherwise. 1.5 For Work which needs to be carried out on the Site at times other than specified in subclause 1.4 above, the Contractor/Supplier needs to seek written permission from BP at least 24 hours in advance. 1.6 If working overtime is required, the number of employees concerned who are working on BP’s project, with a list of their names and the duration of the overtime, must be submitted to BP’s security department before 15.00 hours on the day that overtime work is planned. Overtime lists may only include employees who have passed through BP’s access procedure. GOOD HOUSEKEEPING 2.1 BP considers it essential for the Contractor/Supplier to act as a “good house-keeper” on the Site during the period of the Work, both in the work areas as well as in and around the temporary accommodation. 2.2 The Contractor/Supplier shall remove all non-industrial waste from the Work area. The Work area must be kept clean and tidy at all times; emergency exits and other entrances and exits must be kept free at all times; safety and fire extinguishing equipment must be accessible at all times; and excess or discarded material must be removed daily. Simply cleaning up the Work area at the end of the work period will not be considered sufficient. 2.3 Any contamination by and/or spillage and/or leakage of oil or chemicals must be cleaned up immediately by the Contractor/Supplier. Whilst removing such contamination, spillage or leakage, adequate safety measures must be taken by the Contractor/Supplier. Geel Site Specific Provisions Revisiondate: December 2015 Documentum: 411453 Revision: 1 Attention: before use, check the revision number of this copy with that of the network 2.4 The Contractor/Supplier shall take adequate measures, to prevent fire and to protect people, installations, materials, devices and equipment. 2.5 The exhausts of diesel-driven equipment shall be fitted with spark eliminators of a type approved by BP. Diesel engines and compressors shall be of a silent design and shall have fire extinguishing equipment, approved by BP, close by them. 2.6 BP has at all times the right to inspect all material and equipment supplied by the Contractor/Supplier for the purpose of carrying out the Work, and is similarly entitled to make personal searches of the Contractor’s/Supplier’s personnel and that of its Subcontractors on entering or leaving BP’s site (this e.g. for security and theft prevention). GEEL SPECIFIC CLAUSES FROM CURRENT GENERAL CONDITIONS 3. Registering and recording of presence 3.1 Except where there is prior written approval, signed by an authorised representative of BP, the Work of the Contractor, his employees and/or those of his Sub-Contractors must be carried out during the normal working hours currently applicable in BP. The normal working hours are from Monday to Friday, from 7.45 a.m. to 4.14 p.m. For consideration of safety reasons, no work may be carried out on Sundays and public holidays nor on the fixed holidays applicable in the maintenance department. The Contractor shall find out in good time the fixed holiday arrangements of the BP maintenance department. The Contractor guarantees that the restrictions of working hours enforced by law are respected. 3.2 For consideration of safety reasons, BP needs to be able to verify at all times who is present on the Site. For this reason, presence recording of all the employees of the Contractor and/or Sub-Contractors, building site managers, supervisors and visitors is required both when they enter and when they leave the enclosed areas; this presence recording is for security reasons and irrespective of the actual nature of the agreement (hourly-based work or work by contract). Everyone must personally do a time registration. The application of this rule may be checked by BP at any moment. 3.3 4. In compliance with Belgian law a random inspection may be performed – for theft prevention - at the exit of the Site. Everyone must voluntarily cooperate. Obstruction will result in a possible removal from the Site and future entrance will be blocked. Deliveries to the Building Site - Dispatch Notes 4.1 All deliveries of materials and equipment for the Contractor must be accompanied by dispatch notes with a clear mention of the name of the Contractor. 4.2 If this stipulation is not complied with, BP shall reject the shipment and return it at the cost of the sender. 4.3 Under no circumstance may BP take delivery of goods on behalf of the Contractor. Deliveries on BP premises can only be executed after approval from and according to BP staff instructions. 4.4 The deliveries for the Contractor must be made during work-days from 7.45am to 15.30pm to the stores of the Contractor. Geel Site Specific Provisions Revisiondate: December 2015 Documentum: 411453 Revision: 1 Attention: before use, check the revision number of this copy with that of the network 4.5 All deliveries with trucks with a maximum allowable mass of more than 3.5 tons will use the east entrance “STRAAT 6”. People will use “STRAAT 5” main entrance. 5. Organisation of the Building Site, Dismissal & Security 5.1 Building Site management. On the BP Site the Contractor itself shall organise and direct the Work. The Contractor may, however, delegate the management and supervision of the work to a deputy of his own company who is qualified to take his place when absent and to whom all desired orders or instructions about the work can be given (someone who can communicate with BP and with workers). Nevertheless, the Contractor remains the sole person responsible for the correct execution of his contract Work. If the contract Work has been entrusted to an association of contractors or a company, the latter must appoint a delegate from the starting date of the Work. 5.2 Arrangement of the Site 5.2.1 The Contractor undertakes to place his Site equipment in a central location: "Contractor Area" or in another location designated by the BP representative. Any inconvenience that may be caused by this is to be fully borne by the Contractor. The Site equipment shall comprise offices, workshops, stores, canteen and toilet facilities. The Contractor shall also provide all the necessary equipment, vehicles, transport and handling equipment, gear, scaffolding, tarpaulins, hoisting equipment and miscellaneous tools required for the execution of the Work. The Contractor is also responsible for providing and/or interconnection of utilities: electricity power supply, water and compressed air, unless otherwise stipulated in the special specifications or the technical specification. 5.2.2 The Contractor shall also bear the costs of the maintenance and upkeep of the rooms (stores, canteen, toilet facilities, workshops and offices) as well as for the equipment, which BP has given permission to use. 5.2.3 When the Contractor provides a temporary building yard, the Contractor must restore the territory where the yard was implanted, in its original condition after termination of the Works and this at the Contractor’s expense. 6. Guidelines for the acceptable use of IT and information 6.1 The information and computer resources provided by the BP Group to employees for use are essential company assets of BP. As with all company assets, employees should be familiar with the standards governing their use. The purpose of these guidelines is to define what constitutes acceptable use of the BP Group information and information technology facilities. Compliance with these guidelines is expected of all contractors, consultants, or anyone else who has information and computer resources provided to them for the BP Group commercial purposes. 6.2 Acceptable use of BP Group information and information technology facilities extends the normal business; legal and ethical practices afforded other assets to computers, the information stored within, and the activities relating to computer use and protection. 6.3 BP information and information technology facilities may be used for BP business purposes only. Limited, occasional or incidental personal, non-business use is acceptable only where such personal use is conducted with a sense of responsibility, and the privilege must not be abused. BP may request the Contractor to take disciplinary action, up to and including termination, where information technology assets are not used in an acceptable manner. (Keep in mind that all IT traffic by all users is traceable) Your conduct must at all times protect BP’s integrity and reputation and prevent BP’s liability. All information owned, saved or distributed must be subject to BP’s acceptable use and information guidelines. Internet traffic can be subject to 3 categories : i. Business use ii. Abuse iii. Unethical behaviour In case of abusive or unethical behaviour, BP may request the Contractor to take disciplinary actions. Examples: Business use: Industrial reports, industrial information or technical issues. Abuse: : Downloading large amounts of non-business information; playing of electronic games; looking at film/video clips, sending enormous e-mails, etc. Unethical behaviour : Use of offensive materials such as pornographic or adult-oriented web sites, or materials advocating hatred, bigotry, or violence towards any person or group on the basis of their religion, race, ethnicity, sexual orientation or other immutable characteristics will not be tolerated. • You may not participate in or incite illegal activities. Intellectual copyright must be respected. • Do not trust any data coming via internet before verifying the source and authenticity. • Communicating over the internet is not safe unless messages are encrypted.
