MEMBERSHIP TERMS & CONDITIONS
Monroe Car Wash & Detail Center, LLC
Overview
You (”Member”) permit Monroe Car Wash & Detail Center, LLC (the ”Company”) to enroll you in the Freedom Unlimited Wash Plan (the
"Program") and to be charged as per this (”Agreement”) according to the prevailing Rate Schedule the Monthly Rate. After the Monthly Rate
has been fully paid, Program entitles Member and each of their individually enrolled car (the “Registered Car”) to Program Benefits from the
first day of any month until the last day of the same month regardless of the initial subscription date.
Your Subscription fee will be automatically billed to your credit/debit card on the first day of each month until this Agreement is terminated
either by you or by the Company. You hereby authorize this credit/debit card charge without any recourse to the Company. This program
cannot be combined with any other programs or discounts including: VIP Club membership benefits, corporate or fleet account discounts,
and/or coupons. There are no refunds, credits or adjustments for days or times that the car wash is temporarily closed due to inclement
weather or maintenance. The Company reserves the right to modify or cancel this Program or any membership at any time.
Subscription can be cancelled at any time by providing 10 days written notice before the end of the current month pursuant to the
Agreement Amendment or Cancellation Form; however, no refunds or credits will be given for partial periods.
A. Eligibility/One Car Per Membership
I understand and acknowledge that only personal cars are eligible for this program. Subscription is not valid for cars that cannot fit on the
conveyor or are unable to ride through the tunnel, i.e., rear or top bicycle, boat and ski racks are prohibited. Only the Registered Car listed
on the Subscription Application (the “Application”) is eligible for the Program and must have its license plate registered on the Registered
Car. Only Registered Cars with a properly registered license plate may enter the wash line for Program Benefits; otherwise cash or
credit/debit card must be used to pay for that wash. Any non-or improperly Registered Car must pay for their wash once in the wash lane.
Modifications to this Agreement for any Registered Car must be made before entering the wash lane. No exceptions. Membership is only
transferable upon purchase of a new car or upon providing official notice to the Company not more than once every 90 days. Any change in
Registered Car or license plate must be reported to Monroe Car Wash & Detail Center immediately. Any attempt to change license plate
from a Registered Car will prevent it from operating, invalidate your subscription, and prevent you from enjoying Program Benefits. No
refund, rebate or credit will be provided.
B. Approval
By enrolling in the Freedom Unlimited Daily Wash program, I agree that the credit/debit or debit card provided in this Agreement can be
charged the Monthly Rate for the Program indicated in my Application on or about the first day of each month by the Company or its agents.
I also agree that I waive any and all rights to withhold or delay payment of the related credit/debit or debit card charges, whether as
described in my agreement with credit card issuer or otherwise.
C. Payment
Monthly subscription fee payments will continue to be collected each month, on the first day of the month the contract was entered into
regardless of the membership usage of the affiliated car wash until this Agreement is cancelled in writing by completing the Agreement
Agreement Amendment or Cancellation Form pursuant to the Discontinuation Procedure, I agree that for each subsequent month the
Company may charge my credit/debit card on or about the first day of each month the Monthly Rate, as it may be adjusted from time to time,
for the wash package selected in my Application. Regardless of such termination, any outstanding balance of such membership
subscription fee will remain due and payable in accordance with this Agreement. If you fail to pay your monthly subscription fees payable
within 30 days after the date such payment is due, your membership privileges may be cancelled and you will have to re-apply for
membership under new Terms & Conditions. Furthermore, I acknowledge that I am responsible for all accrued and unpaid charges in
accordance with Discontinuation Policies and Procedures.
D. Recurring Charge Authorization
By enrolling in this Program, Member agrees to be charged the Monthly Rate indefinitely until this Agreement is terminated and cancelled
pursuant to Agreement Amendment or Cancellation Form Policies and Procedures. Monthly charges permitted under this Agreement will be
made on the 1st day of each month.
E. Denied, Canceled, Expired Charge Cards & Late Fees
If a credit/debit card is denied for any month, Company shall continue to attempt to charge that credit/debit card the Monthly Rate plus any
and all accrued and unpaid amounts as per the Recurring Charge Authorization. A denied, canceled, or expired credit card, does not
constitute discontinuation and Member shall continue to be liable and responsible for payment of the Monthly Rate until such time that the
Member has submitted a completed Agreement Amendment or Cancellation Form pursuant to the Discontinuation Policy defined herein
regardless of lack of use. All charges that could not be processed (including bounced submissions or denied charges) shall incur a late fee
of $10 for every day past the 1st day of each month that the Member has a balance (original and all interim accrued charges) overdue.
In the event that my credit/debit card expires or its use is otherwise limited by the issuer and the Company is unable to charge the credit
card in accordance with these payment terms, I will promptly either renew the credit/debit card or provide the Company with an alternate
credit card and provide the Company with all new applicable information; and if I do not, I agree the Company may deactivate my license
plate and that such deactivation does not relieve or reduce my obligations under Section E. or Section F. of this Agreement.
F. Program Benefits
Company reserves the right to change the name, contents, and value of individual services at any time after posting such information on the
Company website which is www.MonroeCarWash.com.
G. Contact
I understand the Company does not accept any requests to discontinue or alter Program Subscription via electronic means, i.e., online,
telephone or through email. Any and all changes to this Agreement must be performed in accordance with the proper and timely submission
of a fully completed Agreement Amendment or Cancellation Form pursuant to the Discontinuation Policies and Procedures.
H. Changing Cars
Membership is transferable upon purchase of a new car or upon providing official notice to the Company not more than once every 90 days.
When replacing one Registered Car and replacing it with another, Member will not be charged as long as there is only one Registered Car.
To avoid paying for two cars, please complete and submit an Agreement Amendment or Cancellation Form with the cashier to change your
Membership subscription by cancelling the old Registered Car and enrolling the new Registered Car. Agreement Amendment or
Cancellation Form must be completed before bringing the unregistered car into the wash lane.
I. Amendment or Termination Policy/Changing Wash Plans
I understand that I can amend or terminate this Agreement at any time subject to the Amendment or Termination Policy and following the
Discontinuation Procedure and that discontinuation does not entitle Member to a full or partial refund or store credit for any reason. Member
must render full payment for unpaid services or indebtedness prior to discontinuation. Company is permitted to charge Member’s credit/debit
card(s) for unpaid services or indebtedness if not done so prior to or at time of discontinuation. Frequency of usage of Program Benefits, or
lack of usage, does not constitute grounds for automatic discontinuation or a refund at any time regardless of death, disability, car accident,
or loss of employment.
J. Discontinuation Procedure
By participating in this Program, I understand that to discontinue this Agreement, I am required to:
1) Obtain an Agreement Amendment or Cancellation Form from the Company’s Cashier or Manager at 178 Main Street, Monroe,
Connecticut 06468 during normal operating hours when the car wash is open. Company cannot email or fax Agreement
Amendment or Cancellation Forms nor can we accept emailed or faxed copies of Agreement Amendment or Cancellation Forms.
2) Member must render full payment for unpaid services or indebtedness prior to acceptance of any Agreement Amendment or
Cancellation Form.
3) Complete Agreement Amendment or Cancellation Form and return to the Company via:
a) Certified US Mail, or
b) In person.

4) Agreement Amendment or Cancellation Form must be received within 10 days prior to the 1 day of the month that Member wants
to discontinue Program.
5) Retain copy of signed (by Company staff) Agreement Amendment or Cancellation Form and Discontinuation Receipt for your
records.
K. Introductory Programs
Company may reduce or waive the monthly charge for a specified period of time for new, previously unsubscribed, Members upon initial
Membership. This offer is not available to those who have discontinued their Program within the most recent 90 days from signing this
Agreement. Company does not have any introductory or Trial Programs that automatically cease recurring billing after the introductory
period.
L. Contract Changes
This Agreement, including Rate Schedule and Program Benefits, may be changed without notice. The most recent Terms and Conditions
are available on the Company’s website www.MonroeCarWash.com. By entering into this Agreement, Member agrees to be bound to and by
the rules and regulations of most recently published Agreement.
M. Additional Benefits
This Agreement does not bind the Company to offer any advertised benefits other than those explicitly listed in this Agreement. Additional
promotions and benefits are decided at the Company's sole discretion.
N. Hours / Closing Policy
Company’s hours may vary from time to time. Company may close at any time on any day for any reason. Company is scheduled to be
closed on: New Year’s Day, Easter Sunday, Independence Day/July 4th, Thanksgiving Day, and Christmas Day. Closing early, closing
entirely for a day or period of days does not constitute a failure to provide Program Benefits as described in this Agreement and no Member
shall be given a whole or partial refund for any reason due to Company being closed.
I understand and acknowledge that the Company cannot be held responsible in cases where the car wash is closed for whatever reason
which may include but are not limited to weather, holidays, or equipment maintenance or renovation. There are no refunds, credits or
adjustments for days or for times that the car wash is temporarily closed due to inclement weather or maintenance.
BY SIGNING THE ENROLLMENT FORM YOU ACKNOWLEDGE RECEIPT OF A FULL COMPLETED COPY OF THIS AGREEMENT
EXECUTED BY YOU AND MONROE CAR WASH & DETAIL CENTER, LLC AND A COPY OF THE TERMS & CONDITIONS. I HAVE
READ THIS AGREEMENT. I UNDERSTAND THIS AGREEMENT AND I WILL ABIDE BY THE TERMS & CONDITIONS IT CONTAINS.
