Purpose of report

At its meeting on 26 September 2006, the North and Leith Local Development
Committee (LDC) received a deputation from the residents of New Cutt Rigg,
with a petition containing 59 signatures, expressing concerns over the provision
of a ball court and basketball hoops at the above location.

A decision was taken to report back to the next meeting of the North and Leith
LDC addressing:

The issues raised by the deputation regarding the use of the Soccer and
basketball courts.
The potential for relocating the Soccer and basketball courts within the
park and provide a breakdown of costs.
It was also agreed to arrange and report back on a visit by officers and elected
members to Victoria Park.

The attached plan (Appendix 1) shows the current position of the ball court and
basketball hoops. The facility was originally provided through a funding package
that included funds raised by the Newhaven Community Council, to meet a
latent need for teenage activity provision within the Newhaven and Trinity area.
Complete refurbishment of the ball court took place in February to March 2003
at a cost of f30,OOO. The works included total replacement of the synthetic
grass sand filled playing surface (f 14,700)and the installation of a new all
metal fence (f 13,165)specifically chosen to reduce vibration noise from ball
rebound, and tarmacadam repairs (f2,135).The ball court has been in
operation for 20 years now and has proved very popular with young people.

Subsequent to the provision of the facility, the development of domestic
property at New Cutt Rigg took place. The new residents are now expressing
their concerns regarding the noise generated through the use of the court,
together with problems experienced through youths gathering and being
involved in anti-social behaviour such as vandalism, stone throwing, trespass
and the use of bad language.

It was noted at the LDC meeting of 26 September 2006 that there was a conflict
arising between the social amenity and free physical activity offered by the ball
court and the social stress created by the associated anti-social behaviour.

An invitation was sent to all elected members on the North and Leith LDC to
attend a site meeting on 22 November 2006. At this meeting the following
recommendations were made:
That ‘noise tests’ should be undertaken by staff from Services for
Communities Regulatory Services, to record the noise generated by the
court while in use.
That the Community Police and Youth Action Teams liaise with Park
Ranger and Mobile CCTV staff within Services for Communities, to
increase patrols in the Victoria Park area and monitor anti-social
behaviour.

That Park Rangers staff undertake a park user survey to ascertain the
views of regular park users regarding provision and standards within
Victoria Park.
That approaches are made to Children and Families, North Edinburgh
Liaison Officers, to gauge the level of use of the ball court and provision
for teenagers in the Newhaven and Trinity area.
That firm costings are obtained for re-siting the existing ball court and
reinstating the existing area.

Appendix 2 provides a breakdown of the specified works required to remove the
ball court and basketball court from its current position to the only suitable new
location within the park. These works have not yet been subject to tender, but
current estimates, based on similar works, suggest this will be in the region of
f 150,000-f200,000 depending on the availability of specialist contractors and
materials.

There is currently no budget provision to implement the re-location of the
facility.
Recommendations

The North and Leith LDC is asked to accept the recommendations in item 6 of
the report resulting from the site meeting.

The North and Leith LDC is asked to note the specifications and draft costs for
the re-location of the play area, together with the fact that there is currently no
budget provision to implement the re-location.

The North and Leith LDC request the Director of Services for Communities to
report back to a future meeting of the LDC on the results of the implementation
of the action points outlined in item 6 of the report, together with a detailed
report relating to complaints between May 2006 and May 2007.

LINE MARKINGS
Supply Line markings, which are to be permanently inlaid in yellow for 5 a side
football arcs and centre spot.
SANDFILL
Supply and brush sand into carpet pile until fully saturated.
Sand fill to be a minimum of 25kg/m2
Sand to be specially graded rounded or sub rounded dry silica sand. Angular sand is
not accept able.
Sand grade in the range 0.71 - 0.25mm, particle shape to pass the Rittenhouse Scale
in the range 0.83 - 0.97
Re visit after completion and once settlement has taken place to brush a further
quantity of sand into the pile.
