INDUSTRIAL ARBITRATION (AMENDMENT) ACT,
Act No. 42, 1953.
An Act to make certain provisions relating to
membership of industrial unions of employees
and long service leave of employees; for these
and other purposes to amend the Industrial
Arbitration Act, 1940-1952 ; and for purposes
connected therewith.

E it enacted b y t h e Queen's Most Excellent Majesty,
b y a n d with t h e advice a n d consent of t h e Legis­
lative Council a n d Legislative Assembly of New South
Wales in P a r l i a m e n t assembled, a n d b y t h e a u t h o r i t y of
t h e same, as follows :—
1. (1) T h i s A c t m a y be cited a s the " I n d u s t r i a l
A r b i t r a t i o n ( A m e n d m e n t ) Act, 1 9 5 3 . "
(2) T h e I n d u s t r i a l A r b i t r a t i o n Act, 1940, as
a m e n d e d b y subsequent A c t s , is in this A c t r e f e r r e d to
a s the P r i n c i p a l Act.
(3) T h e P r i n c i p a l Act, as a m e n d e d b y t h i s Act,
may be cited as the I n d u s t r i a l A r b i t r a t i o n Act, 19401953.
2 . T h e P r i n c i p a l Act is a m e n d e d —
(a) by o m i t t i n g from p a r a g r a p h (a) of subsection
one of section t w e n t y the w o r d s " t h i r t y - f i v e
p o u n d s " a n d b y i n s e r t i n g in lieu thereof the
words " f o r t y p o u n d s " ;
(b) by omitting from the same p a r a g r a p h the w o r d s
" o n e t h o u s a n d seven h u n d r e d a n d fifty p o u n d s "
a n d by i n s e r t i n g in lieu thereof the w o r d s " t w o
thousand p o u n d s " ;
(c) b y o m i t t i n g from the same p a r a g r a p h the w o r d s
" P r o v i d e d f u r t h e r t h a t no a w a r d shall be m a d e
for the p a y m e n t of w a g e s or r e m u n e r a t i o n of
persons
p e r s o n s occnpying m a n a g e r i a l positions unless
such p e r s o n s a r e exclusively employed by t h e
Commissioner for R a i l w a y s , the Commissioner
for R o a d T r a n s p o r t a n d T r a m w a y s , t h e
Metropolitan Meat Industry

of a n y city, shire, or m u n i c i p a l council, or a r e
employees employed u n d e r the Police Regula­
tion Act, 1899, or a n y s t a t u t e p a s s e d in sub­
stitution for or a m e n d m e n t of the s a m e " ;
( d ) b y i n s e r t i n g in the s a m e subsection after t h e
words " P r o v i d e d that an award affecting" the
w o r d s "officers of e i t h e r H o u s e of P a r l i a m e n t
or
persons
employed
in e i t h e r
of
the
D e p a r t m e n t s of the L e g i s l a t u r e u n d e r t h e

(e) b y o m i t t i n g from the same subsection the w o r d s
" s u c h e m p l o y e e s " a n d by i n s e r t i n g in lieu
thereof the w o r d s " s u c h officers a n d e m p l o y e e s " .
3 . T h e P r i n c i p a l A c t is f u r t h e r a m e n d e d —
(a) b y o m i t t i n g p a r a g r a p h ( a ) of subsection one
of section 88c a n d b y i n s e r t i n g in lieu thereof
t h e following p a r a g r a p h : —
" ( a ) (i) in the case of employees who h a v e
w h e t h e r before or after the com­
mencement
of
the
Industrial
Arbitration
(Amendment)
Act,
1953, completed a t least t w e n t y
y e a r s ' service with a n e m p l o y e r
be—
( a ) in respect of t w e n t y y e a r s '
service so completed, t h r e e
months, and
(b)
(b) in respect of each t e n y e a r s '
service completed after such
t w e n t y y e a r s , six a n d onehalf weeks, a n d
(c) on the t e r m i n a t i o n of t h e
employee's
services,
in
r e s p e c t of t h e n u m b e r of
years'
service
completed
since he l a s t became entitled
to an a m o u n t of long service
leave,
a
proportionate
a m o u n t on t h e basis of six
a n d one-half weeks for t e n
y e a r s ' service; and
(ii) in the case of employees who h a v e
w h e t h e r before or a f t e r the com­
mencement
of
the
Industrial
Arbitration
(Amendment)
Act,
1953, completed a t least ten y e a r s '
service but less t h a n t w e n t y y e a r s '
service with a n employer a n d
whose services with such employer
a r e t e r m i n a t e d by the employer for
a n y cause o t h e r t h a n
serious
misconduct or b y the employee f o r
a n y r e a s o n or b y r e a s o n of t h e
d e a t h of the employee a f t e r such
commencement, be a p r o p o r t i o n a t e
a m o u n t on the b a s i s of t h r e e
m o n t h s for t w e n t y y e a r s ' service,
or";
(b) by i n s e r t i n g a t the end of the same subsection
the following proviso a n d n e w subsection:—
P r o v i d e d t h a t a n employee entitled to l o n g
service leave in p u r s u a n c e of t h e provisions of
s u b p a r a g r a p h (i) of p a r a g r a p h ( a ) of t h i s
subsection shall n o t be entitled to long service
leave in p u r s u a n c e of the provisions of the said
s u b p a r a g r a p h as enacted immediately before
t h e commencement of the I n d u s t r i a l A r b i t r a t i o n
( A m e n d m e n t ) Act, 1953, a n d a n y long service
leave
leave taken by a n employee before such
commencement in p u r s u a n c e of the p r o v i s i o n s
of s u b p a r a g r a p h (i) of p a r a g r a p h (a) of t h i s
subsection as enacted immediately before such
commencement shall be deducted from the long
service leave to which such employee is entitled
u n d e r s u b p a r a g r a p h (i) of p a r a g r a p h (a) of
t h i s subsection.
(1A) W h e r e a n employee dies a n d a n y long
service leave—
( a ) to which such employee w a s entitled
h a s not been taken, or
(b) accrues
upon
termination
of
the
services of such employee by r e a s o n of
his d e a t h ;
the employer shall t h e r e u p o n p a y to such
e m p l o y e e ' s p e r s o n a l r e p r e s e n t a t i v e the w a g e s
t h a t would h a v e been p a y a b l e to such employee
in r e s p e c t of such long service leave less a n y
a m o u n t a l r e a d y p a i d to the employee in r e s p e c t
of a n y such long service leave.
A n y a m o u n t p a y a b l e b y the employer u n d e r
t h i s subsection a n d n o t p a i d m a y , w i t h o u t
prejudice to a n y o t h e r mode of recovery thereof,
be recovered by the p e r s o n a l r e p r e s e n t a t i v e a s
u n p a i d wages due a n d p a y a b l e to him u n d e r
a n a w a r d or i n d u s t r i a l a g r e e m e n t b y the
employer concerned,
(c) by i n s e r t i n g next after subsection four of the
same section the following new subsection:—
(4A) A n y exemption g r a n t e d p u r s u a n t to
subsection four of t h i s section shall n o t a p p l y
to an employer in respect of a n y employee w h o ,
within a p e r i o d of t h r e e m o n t h s after the d a t e
of commencement of the I n d u s t r i a l A r b i t r a t i o n
( A m e n d m e n t ) Act, 1953, or the d a t e from
which such exemption t a k e s effect, or the d a t e
of commencement of his employment, as t h e case
m a y r e q u i r e , h a s b y notice in w r i t i n g to t h e
e m p l o y e r elected to be subject to the p r o v i s i o n s
of the a w a r d or i n d u s t r i a l a g r e e m e n t r e l a t i n g
to long service leave or sick leave, as t h e case m a y
be, in lieu of those p r o v i d e d for in such scheme.
Notwithstanding
N o t w i t h s t a n d i n g a n y provision of a n y such
scheme w h e r e a n employee h a s given notice i n
w r i t i n g as aforesaid, such employee shall be
entitled to such benefits u n d e r such scheme,
o t h e r t h a n long service leave or sick leave, a s he
would h a v e been entitled to receive h a d he
v o l u n t a r i l y left the service of the employer u p o n
the date u p o n which such notice w a s g i v e n : E x ­
cept as aforesaid u p o n such notice being given
the r i g h t s of the employee to a n y benefits u n d e r
such scheme a n d the obligations u n d e r such
scheme of the employer a n d a n y p e r s o n s c h a r g e d
w i t h the a d m i n i s t r a t i o n of such scheme in respect
of t h a t employee a n d a n y p e r s o n claiming u n d e r
the employee or in respect of his employment
shall cease a n d d e t e r m i n e .
( d ) b y i n s e r t i n g n e x t after subsection eight of the
same section the following new subsection:—
(8A) (a) T h e t e r m s of e v e r y a w a r d m a d e
p u r s u a n t to this section a n d in force a t t h e
commencement of the I n d u s t r i a l A r b i t r a t i o n
( A m e n d m e n t ) Act, 1953, shall be deemed to be
varied, as f r o m such commencement, to t h e
extent n e c e s s a r y to give effect to the p r o v i s i o n s
of subsection one of this section as a m e n d e d b y
t h e said Act.
(b) A s soon as practicable a f t e r such
commencement the r e g i s t r a r shall v a r y the
t e r m s of every a w a r d to which p a r a g r a p h (a)
of t h i s subsection applies to give effect to the
t e r m s of t h a t p a r a g r a p h .
The r e g i s t r a r m a y r e f e r a n y m a t t e r a r i s i n g
out of t h i s subsection to the commission for
direction.
4. T h e P r i n c i p a l A c t is f u r t h e r a m e n d e d b y i n s e r t i n g
i n subsection two of section ninety-six after t h e w o r d
" b u s i n e s s " the w o r d s " o r the p r e m i s e s in o r u p o n which
p e r s o n s a r e employed b y h i m in such i n d u s t r y . "

(1) T h e P r i n c i p a l A c t is f u r t h e r a m e n d e d —
(a) b y o m i t t i n g from subsection t h r e e of section
one h u n d r e d a n d twenty-seven the w o r d s " t e n
p o u n d s " a n d b y i n s e r t i n g in lieu thereof the
w o r d s "fifty p o u n d s " ;
(b) b y o m i t t i n g section 129A a n d by i n s e r t i n g in lieu
thereof the following section:—
129A. (1) T h e r e g i s t r a r m a y , on application
b e i n g m a d e b y a n y p e r s o n a n d on proof to his
satisfaction t h a t such p e r s o n is t h e s e c r e t a r y
or a duly accredited r e p r e s e n t a t i v e of a n
i n d u s t r i a l union of employees whose m e m b e r s
a r e e n g a g e d in a n i n d u s t r y in r e s p e c t of which
a n a w a r d or i n d u s t r i a l a g r e e m e n t is in force,
issue to t h a t p e r s o n in w r i t i n g a n e n t r y a n d
inspection p e r m i t .
(2) T h e p e r s o n to w h o m a n y such
e n t r y a n d inspection p e r m i t h a s been issued
m a y , if such p e r m i t is for t h e time being in
force—
( a ) e n t e r t h e p r e m i s e s of a n y employer
e n g a g e d in a n y such i n d u s t r y —
(i) d u r i n g a n y lunch h o u r or nonw o r k i n g time f o r t h e p u r p o s e
of i n t e r v i e w i n g employees on
legitimate u n i o n b u s i n e s s ;
(ii) d u r i n g w o r k i n g h o u r s for t h e
p u r p o s e of i n v e s t i g a t i n g a n y
suspected b r e a c h of t h i s A c t or
of a n y a w a r d or i n d u s t r i a l
a g r e e m e n t in force i n r e l a t i o n
to such i n d u s t r y ;
(b) for the p u r p o s e of i n v e s t i g a t i n g a n y
suspected b r e a c h of t h i s A c t o r of a n y
a w a r d or i n d u s t r i a l a g r e e m e n t in force
in r e l a t i o n to such i n d u s t r y , r e q u i r e
a n y employer e n g a g e d in such i n d u s t r y
to p r o d u c e for his inspection d u r i n g
the u s u a l office h o u r s a t t h e e m p l o y e r ' s
office
office or other convenient place a n y
time a n d p a y sheets k e p t by him in
r e g a r d to employees in such i n d u s t r y ,
a n d m a y make copies of the entries in
such time a n d p a y sheets r e l a t i n g to
a n y such suspected breach.
I n this subsection " p r e m i s e s " includes a n y
building, mine, mine working, ship, vessel, or
place of a n y kind wherein or in respect of which
a n y i n d u s t r y is c a r r i e d on or a n y work is being
o r h a s been done or commenced.
(3) A n e n t r y a n d inspection p e r m i t —
(a) shall remain in force until it expires
in accordance with p a r a g r a p h (b) of
this subsection or is revoked in pur­
suance of the provisions of this
section;
(b) shall expire when the p e r s o n to whom
it w a s issued ceases to be the s e c r e t a r y
or a duly accredited r e p r e s e n t a t i v e of
the i n d u s t r i a l union and notification of
such cessation h a s been given to the
registrar;
(c) may be revoked by the r e g i s t r a r if ho
is satisfied t h a t the p e r s o n to whom it
w a s issued h a s wilfully h a m p e r e d or
hindered
employees
during
their
w o r k i n g time or h a s otherwise acted in
an i m p r o p e r m a n n e r in the exercise or
purported
exercise of a n y
power
conferred on him by this section.
A n y decision of the r e g i s t r a r revok­
ing a n y e n t r y a n d inspection p e r m i t
shall be subject to a p p e a l to the
commission as prescribed.
(4) N o t h i n g in this section
shall
a u t h o r i s e a s e c r e t a r y or duly
accredited
r e p r e s e n t a t i v e of a n i n d u s t r i a l union of
employees to e n t e r a p r i v a t e dwelling house, or
t h e l a n d u s e d in connection therewith, unless
some m a n u f a c t u r e or t r a d e in which labour is
employed is c a r r i e d on therein.

(5)
(5) A n y
person
who
hinders
or
o b s t r u c t s the h o l d e r of a n e n t r y a n d inspection
p e r m i t for t h e time being in force in the exer­
cise of a n y p o w e r conferred on him by t h i s
section shall be liable to a p e n a l t y n o t exceeding
fifty p o u n d s .
(6) A p e r s o n to w h o m a n e n t r y a n d
inspection p e r m i t h a s been issued p u r s u a n t to
t h i s section shall u p o n the e x p i r y or revocation
of such p e r m i t r e t u r n such p e r m i t to t h e
r e g i s t r a r for cancellation. A n y p e r s o n f a i l i n g
to comply w i t h the p r o v i s i o n s of t h i s subsection
shall be liable to a p e n a l t y n o t exceeding fifty
pounds.
(2) T h e t e r m s of e v e r y a w a r d or i n d u s t r i a l
a g r e e m e n t which is in force a t the commencement of
t h i s A c t a n d in which p r o v i s i o n s h a v e been i n s e r t e d
p u r s u a n t to subsection one of section 129A of t h e
P r i n c i p a l A c t shall a s from such commencement be
deemed to be v a r i e d by omitting such provisions t h e r e ­
from. A s soon a s practicable after such commencement
the r e g i s t r a r shall v a r y the t e r m s of every such a w a r d
or i n d u s t r i a l a g r e e m e n t to give effect to the p r o v i s i o n s
of this subsection.
6. T h e P r i n c i p a l A c t is f u r t h e r a m e n d e d by i n s e r t i n g
n e x t a f t e r section 129A the following new section:—
129B. (1) A n employer engaged in
any
i n d u s t r y or calling to which a n a w a r d or i n d u s ­
t r i a l a g r e e m e n t r e l a t e s or applies shall give
absolute p r e f e r e n c e of e m p l o y m e n t t o m e m b e r s
of t h e i n d u s t r i a l union or u n i o n s e n g a g e d in
such i n d u s t r y or calling.
(2) W h e r e a n a d u l t p e r s o n is, a t t h e
d a t e of commencement of t h e I n d u s t r i a l A r b i ­
t r a t i o n ( A m e n d m e n t ) Act, 1953, employed b y
an employer in a n y i n d u s t r y or calling to which
an a w a r d or i n d u s t r i a l a g r e e m e n t r e l a t e s or
a p p l i e s , or a f t e r such commencement e n t e r s
into
into employment w i t h a n employer in a n y such
i n d u s t r y or calling, or is employed by a n
employer in a n i n d u s t r y or calling to which
no a w a r d or i n d u s t r i a l a g r e e m e n t relates or
applies a n d a n a w a r d o r i n d u s t r i a l agree­
m e n t is m a d e in respect of such i n d u s t r y
o r calling, such a d u l t p e r s o n shall n o t con­
tinue in such employment a f t e r the e x p i r a ­
tion of a p e r i o d of twenty-eight d a y s from the
date of commencement of the
Industrial
A r b i t r a t i o n ( A m e n d m e n t ) Act, 1953, or such
e n t r y into employment or the d a t e on which
the a w a r d or i n d u s t r i a l a g r e e m e n t so m a d e
becomes o p e r a t i v e , a s the case m a y r e q u i r e ,
unless—
(a) he is a financial member of an indus­
t r i a l union of employees whoso mem­
bers a r e engaged in such i n d u s t r y or
calling; or
(b) he h a s applied to be a d m i t t e d as a
member of such i n d u s t r i a l union.
(3) A n employer bound by an a w a r d or
industrial agreement
shall n o t
knowingly
continue in employment in a n y position or
employment subject to the a w a r d or i n d u s t r i a l
a g r e e m e n t a n y a d u l t p e r s o n who c o n t r a v e n e s
or fails to observe the provisions of subsection
two of this section.
(4) E v e r y p e r s o n who is obliged to
become a m e m b e r of a n i n d u s t r i a l union of
employees in accordance w i t h the foregoing
p r o v i s i o n s of this section shall be entitled to
become a m e m b e r of such union on application
m a d e in accordance with its rules a n d in so f a r
a s the rules of a n y such union a r e inconsistent
w i t h the p r o v i s i o n s of this subsection they shall
be null a n d void.
(5) (a) No m e m b e r of a n i n d u s t r i a l
union shall be expelled from such union except
in accordance w i t h the provisions of this
subsection.
(b)
(b) Twenty-eight d a y s ' notice of
the p r o p o s e d expulsion shall be given to such
member.
(c) Within the said p e r i o d of
twenty-eight d a y s such member m a y a p p l y to
the commission for a n o r d e r r e s t r a i n i n g t h e
union from continuing with the expulsion a n d
p e n d i n g the decision of the commission no
f u r t h e r steps shall be taken by the union in
connection with the expulsion.
(d) U p o n a n y such application the
commission shall, as soon as practicable,
proceed to enquire into the r e a s o n s for the
expulsion.
(e) (i) If the commission is satis­
fied t h a t the circumstances a r e such as to justify
the expulsion it m a y g r a n t leave to the union
to proceed accordingly.
(ii) If the commission is not so
satisfied it m a y make an o r d e r r e s t r a i n i n g the
union from t a k i n g a n y f u r t h e r steps in connec­
tion w i t h t h e expulsion.
(G) F o r the p u r p o s e of this section—
(a) " a d u l t p e r s o n " m e a n s a p e r s o n of
eighteen y e a r s of age or u p w a r d s a n d
every o t h e r p e r s o n who is for the time
being in receipt of not less t h a n the
m i n i m u m r a t e of wages p r o v i d e d for
adult employees by the a w a r d or
i n d u s t r i a l a g r e e m e n t which r e l a t e s or
applies to the i n d u s t r y or calling in
which he is e n g a g e d ;
(b) " i n d u s t r i a l a g r e e m e n t " includes a n y
a g r e e m e n t affecting r a t e s of p a y or
conditions of e m p l o y m e n t m a d e u n d e r
a n y A c t o t h e r t h a n this A c t ;
(c) a p e r s o n shall n o t be deemed to h a v e
a p p l i e d for m e m b e r s h i p of a n indus­
t r i a l u n i o n unless he h a s applied for
such m e m b e r s h i p in the m a n n e r p r e ­
scribed by the r u l e s of t h e u n i o n a n d
tendered
t e n d e r e d a n y fee or
subscription
r e q u i r e d by such rides to be p a i d or
t e n d e r e d by p e r s o n s a p p l y i n g for such
membership.
(7) N o t w i t h s t a n d i n g
anything
con­
tained in this A c t or the rules of a n i n d u s t r i a l
union a n employee shall not be compelled t o
p a y in advance m o r e t h a n one-fourth of the
a m o u n t p r e s c r i b e d by such rules a s the a n n u a l
fee or subscription p a y a b l e for m e m b e r s h i p of
such union.
(8) A n y p e r s o n who commits a breach
of a n y of the provisions of subsection one, two
o r t h r e e of this section shall be liable to a
p e n a l t y not exceeding one h u n d r e d p o u n d s .
P r o c e e d i n g s for the recovery of such p e n a l t y
m a y be taken by the s e c r e t a r y of a n i n d u s t r i a l
union concerned in the i n d u s t r y or calling in
which the person alleged to have committed the
breach is engaged.
(9) (a) I n the event of a t r a d e union
which is r e g i s t e r e d as a n i n d u s t r i a l union—
(i) refusing or failing to admit to mem­
b e r s h i p of such union a n y p e r s o n
entitled to be a d m i t t e d t h e r e t o in p u r ­
suance of the provisions of subsection
four of this section within a p e r i o d of
one m o n t h a f t e r application b y such
p e r s o n for m e m b e r s h i p , or
(ii) expelling a n y p e r s o n from m e m b e r ­
ship of such union otherwise t h a n in
accordance with the provisions of
subsection five of this section,
the commission m a y o r d e r such t r a d e union t o
p a y a p e n a l t y n o t exceeding one h u n d r e d
pounds.
(b) The p r o v i s i o n s of sections one
h u n d r e d a n d twelve, one h u n d r e d a n d t h i r t e e n
a n d one h u n d r e d a n d fourteen of this A c t shall
a p p l y , m u t a t i s m u t a n d i s , to a n d in respect of
the
the j u r i s d i c t i o n a n d p o w e r s conferred upon t h e
commission b y this section a n d a n y penalties
imposed by the commission u n d e r this section.
(10) T h e foregoing provisions of t h i s
section shall not a p p l y to or in respect of—
(a) t h e e m p l o y m e n t in a n y i n d u s t r y or
calling of a p e r s o n who h a s been issued
by t h e r e g i s t r a r p u r s u a n t to subsection
eleven of this section with a certificate
of exemption from m e m b e r s h i p of a n
i n d u s t r i a l union of employees covering
t h a t i n d u s t r y o r calling, if such certifi­
cate or a n y r e n e w a l thereof is for t h e
time being in f o r c e ; or
(b) the e m p l o y m e n t of a n y p e r s o n to whom
a certificate of exemption from union
m e m b e r s h i p has been issued p u r s u a n t
to p a r a g r a p h (b) of subsection two of
section t w e n t y of this A c t if the p e r i o d
specified in such certificate or a n y
r e n e w a l thereof h a s n o t e x p i r e d ; or
(c) the employment d u r i n g a p e r i o d of
vacation of a b o n a fide s t u d e n t of a
school, college or u n i v e r s i t y ; or
(d) the e m p l o y m e n t of p e r s o n s occupying
m a n a g e r i a l p o s i t i o n s ; or
(e) the employment of a n y p e r s o n who h a s
applied for a certificate of exemption
p u r s u a n t to subsection eleven of this
section a n d whose application h a s n o t
been finally d e t e r m i n e d .
(11) ( a ) F o r the p u r p o s e s of this sub­
section " c o n s c i e n t i o u s b e l i e f " includes a n y
conscientious belief w h e t h e r the g r o u n d s thereof
a r e or a r e n o t of a religious c h a r a c t e r a n d
w h e t h e r the belief is or is not p a r t of the
doctrine of a n y religion.
(b) A n y p e r s o n w h o —
(i) objects on the g r o u n d s of conscientious
belief to being a m e m b e r of a n indus­
t r i a l union of e m p l o y e e s ; a n d
(ii)
( i i ) applies in the m a n n e r p r e s c r i b e d t o
the r e g i s t r a r for a certificate of
exemption from m e m b e r s h i p of a n y
such u n i o n ; a n d
(iii) satisfies the r e g i s t r a r t h a t his objec­
tions on the g r o u n d s of conscientious
belief a r e g e n u i n e ; a n d
(iv) p a y s to the r e g i s t r a r an a m o u n t equiva­
lent to the subscription p r e s c r i b e d b y
the rules of the i n d u s t r i a l union for
m e m b e r s h i p of such u n i o n ;
s h a l l be issued by the r e g i s t r a r with a certificate
of exemption from m e m b e r s h i p of the i n d u s t r i a l
union.
(c) A n y such certificate
shall
r e m a i n in force for the p e r i o d specified t h e r e i n
a n d m a y be renewed from time to time b y the
r e g i s t r a r u p o n p a y m e n t of such a m o u n t , n o t
exceeding the a m o u n t r e f e r r e d to in sub­
p a r a g r a p h (iv) of p a r a g r a p h (b) of this
subsection, a s the r e g i s t r a r m a y r e q u i r e .
(d) A n y a m o u n t received by the
r e g i s t r a r p u r s u a n t to this subsection shall be
p a i d by him to the credit of the Consolidated
Revenue Fund.
(e) A n y p e r s o n whose applica­
tion for a certificate of exemption from mem­
b e r s h i p of a n i n d u s t r i a l union, or for a n y
r e n e w a l thereof, u n d e r this subsection is
refused, m a y within twenty-one d a y s of the
decision of the r e g i s t r a r refusing the applica­
tion a p p e a l in the m a n n e r p r e s c r i b e d to t h e
commission from such decision. T h e commis­
sion m a y on such a p p e a l m a k e such o r d e r a s it
t h i n k s fit.
(12) N o t h i n g in this section shall limit
o r in a n y w a y affect—
( a ) the p o w e r s , a u t h o r i t i e s , duties o r
functions conferred or imposed upon
the commission or a committee by a n y
other
other provisions of this Act except to the
extent to which the exercise or performance of any such power, authority, duty
or function would be contrary to or
inconsistent with the provisions of subsections one, two or three of this section.
(b) the rights or obligations conferred or
imposed on an employer or employee
by any other provisions of this Act or
by an award or industrial agreement;
(c) any law relating to preference in
employment to persons who have served
as members of the naval, military or
jiir forces of the Commonwealth.
