Case No. E-14 - and – OFFICE EMPLOYEES INTERNATIONAL UNION LOCAL 123 , AFL Decision No. 9 CERTIFICATE OF REPRESENTATIVE A petition having been filed with the Connecticut State Board of Labor Relations on July 17, 1945 by Office Employees International Union, #123 AFL, alleging that a question or controversy existed concerning the representation of employees of R. G. Miller & Sons, Inc. 151 Earle Street, Hartford, Connecticut, and the Board having duly investigated such question or controversy, and due notice of such investigation and of the filing of said petition having been given to all parties, AND, a public hearing with respect to such question or controversy having been held before the Board on August 30, 1945, pursuant to notice duly served upon all parties hereto, AND the Board by virtue of and pursuant to the power vested in it by Section 6 of the Connecticut state Labor Relations Act, having found that a question or controversy had arisen concerning the representation of employees of R. G. Miller & Sons, Inc. within the meaning of Section 6, subsection 2 of the Connecticut State Labor Relations Act, and having decided that in order to insure to the said employees the full benefit of their right to self-organization, to collective bargaining, and otherwise to effectuate the policies of the Connecticut State Labor Relations Act, the unit appropriate for the purposes of collective bargaining should be all office employees, but (excluding executive employees and those employees in a supervisory capacity with power to hire and discharge or to recommend the hiring or dismissal of employees) in the R. G. Miller & Sons, Inc., and the Board having duly directed an election by secret ballot be conducted by the Board and its Agent among the said employees to determine whether or not they desire to be represented by Local No. 123, Office Employees International Union, A. F. of L., AND, said election having been conducted on October 26 1945 under the supervision of the Board and its Agent, and a report of the results of said secret ballot having been prepared by the Board and served upon all parties on October 26, 1945, and no objection having been filed thereto, and it having been found that ten (10) employees were eligible to vote, that ten ballots (10) were deposited in the ballot box of which seven (7) were case for Local #123 Office Employees International Union, A. F. of L. and three (3) were cast against said Union, and it having been found after due investigation, that a majority of the persons voting in an election have designated and selected Local #123, Office Employees International Union, A. F. of L., and that Local 123, Office Employees International Union, A. F. of L., has been designated and selected by a majority of the said employees within said appropriate unit as their representative for the purposes of collective bargaining, NOW THEREFORE, by virtue of and pursuant to the power vested in the Connecticut State Board of Labor Relations by Section 6 of the Connecticut State Labor Relations Act, it is hereby CERTIFIED, that Office Employees International Union Local #123, AFL, has been designated and selected as representative for the purposes of collective bargaining by the majority of the employees classified as all office employees, but (exclusive of executive employees and those employees in a supervisory capacity, with power to hire and discharge or to recommend the hiring or dismissal of employees) employed by R. G. Miller & Sons, Inc. and that, pursuant to the provisions of Section 6 of the Connecticut State Labor Relations Act, said Office Employees International Union, Local #123, AFL, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment and other conditions of employment. /s/ A.G.
