Gibson County Board of Education Monitoring: Review: Annually, in April Descriptor Term: Transfers Within the District/NonResident Students Descriptor Code: 6.206 Rescinds: 6.206 Issued Date: 09/08/16 Issued: 05/10/16 1 Transfer students will meet the same enrollment requirements as new students. 2 3 4 5 6 During the month of June each year, a parent/guardian may request that his/her child attend a school within the system other than the one to which the child is zoned.** The director of schools or his/her designee shall review such requests and, if adequate space is available, grant such transfers unless a transfer would be adverse to the best interests of the child or the school system. If granted, the student must provide his/her own transportation to and from the school.1 7 8 9 10 11 Except within the first ten (10) days of a school year where a parent/guardian may appeal the assignment of a student to the Board,2 after a student has enrolled in one (1) school within the system, he/she shall not be permitted to transfer to another unless there is a change in residence of the student’s parents or guardian outside the area in which the student enrolled. Any exception to this policy must be brought before the director of schools for evaluation and decision. 12 13 14 15 16 17 18 19 Students whose families transfer their residence to another school area must obtain permission from the Director of Schools to remain at their current school. Students who present evidence that they will move during the school year and who desire to enroll in a different school in the new area may do so only with prior written approval of the Director of Schools for a change of school area. The Director may grant other exceptions to this policy at his discretion for valid and sufficient reasons. Families who fail to seek written permission to either remain at their original school area or move to a new area where their parents reside risk removal from Gibson County Special School District, as well as the payment of restitution to the District for any financial loss. 20 21 22 Students who attend Medina Middle or move into the Medina/Gibson zone will attend South Gibson County High School. All other students who attend Dyer, Kenton, Rutherford, Spring Hill, and Yorkville Schools or move into their zone must attend Gibson County High School. 23 24 25 Principals shall allow credit for work transferred from other schools only when substantiated by official transcripts or successful completion of comprehensive written examinations approved, administered and graded by the principal or his/her designated representative.3 26 27 28 29 30 31 32 33 34 35 1. Resident students are defined as students who reside with their parents or legal guardians within the boundaries of the Gibson County Special School District, as defined by 1981 Private Acts Chapter 62, as amended. All other students are considered non-residents. 2. All residents of the Gibson County Special School District, as defined by 1981 Private Acts Chapter 62, as amended, may attend school within the Gibson County School District. 3. Children of employees of the Gibson County Special School District will be allowed to attend school in the Gibson County Special School District. b. Students residing on a road or street, that divides two (2) school districts, and as of September 1, 2004, are being serviced by bus routes of one (1) or more school districts, may choose to attend the closest school to their residence, whether or not at that residence within the boundaries of the school district in which that school is located. c. In cases involving "equal shared parenting" between parents, the child shall be permitted to attend school in the Gibson County Special School District if the child resides at least four nights out of seven in that school district and one of the child's parents resides in the same school zone. d. Any non-resident student that attended the Gibson County Special School District through grade12, provided that their attendance does not have an adverse effect on the Desegregation Plan of the student's resident school district; and provided that the student's resident school district has no objection to the student attending the Gibson County Special School District. e. Non-resident students may be accepted in a specific school on a space available basis in accordance to EIA class size standards less 10% of total capacity for that grade level, this may be waived by the Director of Schools on a case by case basis. When accepted at a specific school, enrollment will be for that school year only. Brothers and sisters will be given first priority for enrollment. Other non-resident applicants will be placed on a waiting list. f. If a student is zoned by Kenton Special School district (hereinafter KSSD) to attend Kenton Elementary, for so long as the Gibson County Special School District contracts with KSSD to operate Kenton Elementary, the student may attend Gibson County High School. g. Transfers will be permitted on a non-discriminatory basis except where the cumulative effect will reduce desegregation in either district. 33 Proof of Residence 34 35 36 37 Students who desire a transfer from another school district must present proof of residency and/or proof of the aforementioned conditions within twenty (20) days prior to the first day of school, if possible.
