Dear Licensee:
The Iowa Alcoholic Beverages Division is formally denying the application for renewal of
License/Permit No. LC0038472. The denial is based on the fact that the limited liability
company, Nicks Rome Tap LLC, has been administratively deleted by the Iowa Secretary of
State’s Office.
Limited liability companies making application for a liquor license, wine permit or beer permit
are required by Iowa law to be licensed to do business in the State. Iowa Code § 123.3(34).
Despite local authority approval, a review by this Division revealed that the limited liability
company, Nicks Rome Tap LLC, is no longer registered and in good standing with the Iowa
Secretary of State’s Office. To renew your license the limited liability company must be
reinstated.
Reinstatement
To reinstate the limited liability company, contact the Iowa Secretary of State’s Office at
515.281.5204. DO NOT DELAY! Obtaining reinstatement of the limited liability company
may be a lengthy process and may require payment of back taxes. The limited liability
company must be reinstated by August 30, 2014, in order for your license to be renewed.
Once the limited liability company is reinstated, contact Annie Adamovicz in the Division’s
regulatory section at 515.281.7426 to let her know. When the information is verified, your
license may be renewed as originally requested.
Appeal
You may appeal the denial of your license by filing a notice of appeal with Annie Adamovicz,
Iowa Alcoholic Beverages Division, 1918 SE Hulsizer Road, Ankeny, Iowa 50021, or facsimile
number 515.281.7375. Your notice of appeal must be filed with the Division by August 30,
2014.
If you file an appeal, an administrative hearing will be scheduled. In order to obtain renewal of
your license through the hearing process, you will need to demonstrate that the limited liability
company meets all the licensing requirements, including the good standing requirements set
forth in Iowa Code § 123.3(34).
In the meantime, the application is considered “timely filed.” The timely filing status allows
you to continue to sell alcoholic beverages during the 60-day period ending on August 30,
2014. As a condition to the timely filing status, the Division has deposited your license fees.
If the limited liability company is not reinstated or an appeal is not filed, all selling and serving
of alcoholic beverages must cease on August 31, 2014. You may apply for a refund of any
unused quarters of your license fee.
