As feared the annexation of Texas caused problems. The north wanted to end the expansion of slavery to do this Representative David Wilmot proposed the Wilmot Proviso which would not allow slavery in the new territories. 3

The bill passed in the in the House of Representatives because the north had a higher population. The bill however failed in the South as since there was the same number of free and slave states with the addition of Iowa the south had the advantage because the Vice President breaks ties in the Senate.

There were many proposed solutions such as extending 36 30' to the Pacific and allowing popular sovereignty to decide. Popular sovereignty is where which ever idea is voted on by the people that live there wins.

Slavery played a major role in the 1848 election. Polk did not run for reelection. The Democrats nominated Lewis Cass a senator from Michigan. The Whigs nominated Zachary Taylor, war hero of the Mexican war.

Neither side wanted to alienate voters with the slavery issue so both simply refused to address the issue. The refusal to acknowledge slavery led to the creation of the Free Soil Party led by Martin Van Buren the former President.

In the Election Van Buren did not win but he did take enough votes away from Cass to ensure that Taylor carried enough votes win win states he otherwise wouldn't have and allowed Taylor to win the election.

Shortly after the election gold was discovered causing enough people to live in California to apply for statehood. The problem with California is that the people there did not want Slavery but that would upset the balance of free states. 9

The Great Compromiser, Henry, Clay came up with another solution, The Compromise of 1850. The Compromise of 1850 had five parts trying to preserve the union of the North and South.

It being desirable, for the peace, concord, and harmony of the Union of these States, to settle and adjust amicably all existing questions of controversy between them arising out of the institution of slavery upon a fair, equitable and just basis: therefore, 1. Resolved, That California, with suitable boundaries, ought, upon her application to be admitted as one of the States of this Union, without the imposition by Congress of any restriction in respect to the exclusion or introduction of slavery within those boundaries. 2. Resolved, That as slavery does not exist by law, and is not likely to be introduced into any of the territory acquired by the United States from the republic of Mexico, it is inexpedient for Congress to provide by law either for its introduction into, or exclusion from, any part of the said territory; and that appropriate territorial governments ought to be established by Congress in all of the said territory, not assigned as the boundaries of the proposed State of California, without the adoption of any restriction or condition on the subject of slavery. 3. Resolved, That the western boundary of the State of Texas ought to be fixed on the Rio del Norte, commencing one marine league from its mouth, and running up that river to the southern line of New Mexico; thence with that line eastwardly, and so continuing in the same direction to the line as established between the United States and Spain, excluding any portion of New Mexico, whether lying on the east or west of that river. 4. Resolved, That it be proposed to the State of Texas, that the United States will provide for the payment of all that portion of the legitimate and bona fide public debt of that State contracted prior to its annexation to the United States, and for which the duties on foreign imports were pledged by the said State to its creditors, not exceeding the sum of dollars, in consideration of the said duties so pledged having been no longer applicable to that object after the said annexation, but having thenceforward become payable to the United States; and upon the condition, also, that the said State of Texas shall, by some solemn and authentic act of her legislature or of a convention, relinquish to the United States any claim which it has to any part of New Mexico. 5. Resolved, That it is inexpedient to abolish slavery in the District of Columbia whilst that institution continues to exist in the State of Maryland, without the consent of that State, without the consent of the people of the District, and without just compensation to the owners of slaves within the District. 6. But, resolved, That it is expedient to prohibit, within the District, the slave trade in slaves brought into it from States or places beyond the limits of the District, either to be sold therein as merchandise, or to be transported to other markets without the District of Columbia. 7. Resolved, That more effectual provision ought to be made by law, according to the requirement of the constitution, for the restitution and delivery of persons bound to service or labor in any State, who may escape into any other State or Territory in the Union. And, 8. Resolved, That Congress has no power to promote or obstruct the trade in slaves between the slaveholding States; but that the admission or exclusion of slaves brought from one into another of them, depends exclusively upon their own particular laws. 12

There were three views on the Compromise of 1850. The North felt they did not need to compromise, the South wanted to be allowed a peaceful withdraw from the union, and people from both sides wish to compromise.

The Compromise took effect only after Taylor who opposed the plan died suddenly allowing Vice President Millard Filmore who supported the Plan to sign it into law.

The Fugitive Slave Act created by the Compromise of 1850 made it illegal to aid fugitive slaves and allowed them to be arrested even in states slavery was illegal in. Commisioners who decided if blacks were slaves or not were to be paid $5 if not a slave $10 if found a slave the result was 332 to 11 cases in 10 years were slaves and thousands of blacks fled to Canada.

Because of the Compromise and the Fugitive Slave Act the Abolitionist movement grew. An Abolitionist is someone who doesn't want to contain slavery they want to end it. 17

The Abolitionist movement was inspired by stories of Frederick Douglas and Sojourner Truth both former slaves. With the New Fugitive Slave Act the Undergound Railroad or the path slaves took from different secret homes to escape slavery now had to get them to Canada.
